3:06 am
and americans have a choice, leaders in our country have a choice. do we want the seal broken permanently and we want this to pass as public dialogue that young people listen to and think, well, that's just politics today. no, is not. it is in decent. it should not be something that becomes normal in our public life. this is, again, another sign of the trump effect. he's the one who started this kind of dialogue about mccain himself going back to the campaign, saying he was no war hero because he was captured. it's such disrespect and in decency at awe time when someone in public life such as a huge person in public life in john mccain is going through such terrible illness. the fact that the white house doesn't do the right thing shouldn't be surprising. >> no, it shouldn't. >> and the fact that congressional leaders don't take this opportunity to stand up and say, enough, enough is also
3:07 am
something they are going to have to be accountable for. >> this is systematic of a deeper or problem within the conservative moment. hating john mccain has been industry for folks on the far right for a long time. what's different is the president elevated it, as david said. flow comes from the top, and that flows through his administration. the fact that there is not the decency, gut is decent seu, to not kick an objective american hero, it is stunning, it is indicative of the at months fear. it is not not connected to its moral compass. the pow, a leader of their own party in the 2008 election, that that person is not respected but instead attacked for the sin of a little bit wipolitical indepe. that is important to understand. his sin is not playing to whoever is empowered at a particular time, the republican
3:08 am
party. >> that is such a great point. look, donald trump again sort of started this. sorted as public awe way when he went after john mccain and pows. what people sometimes fail to understand with all the snarkiness is there are families involved. cindy mccain, john mccain's wife, tweeted to the aide, kelly sadler, who made this remark, may i remind you that my husband has awe family, 7 children and 5 grandchildren. megyn kelly, who is on "the view," has to in public go through the crucible of watching her dad's disease. so we understand she will address all of this today. and kelly sadler i think called meghan mccain directly to apologize. >> say it was a bad joke. it was not animas driven, that
3:09 am
she doesn't hope as some kind of equation between what mccain is doing now. that doesn't matter. this isn't about is sadler. it is about her boss he said nothing about this. it's a layup in politics. you don't have to have grown up in the business or worked on campaigns to know that. when somebody in your charge says something disgusting about somebody in the fight of their life, you speak up. it's obvious. unless you're okay with it. play the sound of the president talking about john mccain. >> he he's not a war hero. >> he's a war hero. five and a half years. >> he's a war hero because he was captured. i like people who weren't captured, i hate to tell you. >> except for the one senator at 3:00 in the morning and went like that, we would have had health care too. we would have had health care too. >> the evening we were going to terminate obamacare, we got a bad vote. you know about that, right? that was not a nice thing. >> we had it except for the one vote. you remember that beautiful night.
3:10 am
it was defeated, but one vote changed. >> it's okay to be angry at your opponents. we see it all the time down there. but how you disagree matters. we all know that the reason donald trump isn't tweeting right now, didn't is say anything last night even though you know he's damn well aware of this is because he's okay with taking a shot like that at is john mccain. >> that's the bottom line. most of the sound you just played outside the remark of him not being a hero, that's all fair game. >> it just shows the tone. >> but my point is, it's actually helpful montage because it shows the two ends of this, right? something completely in decent that he said to savage john mccain and his reputation. john mccain said politics ain't bean bag. he is going to take on a member of his own party who cast a vote that sunk his version is of
3:11 am
health care in an attempt to repeal the obama era health care plan. that's the difference. this is where you're right. this is the president of the united states who yet again does not recognize that the office is bigger than him. that to have a white house staff is to represent a great institution of this country. and you don't allow it to be undermined by a young person who makes a real mistake and had the decency to call mccain. >> this is not a tough call. leadership, step up and condemn it for saving honor and courage in american politics that john mccain almost uniquely stands for. >> my favorite jab on the show is that? you hear that? that's the sound of mcconnell and ripe saying nothing in the face of something they should be saying something about. >> one last note on this. the snarkiness is contagious.
3:12 am
when you start going publicly after a war hero like john mccain, it catches fire. yesterday on fox business there was a form or lieutenant tom m mcnerny. yesterday i guess he crossed the line even for him. here's what he said about john mccain. >> the fact is that john mccain it worked on john. that's why they call him song bird john. >> that's absurd. he stayed in prison refusing to be let out when he had the opportunity to show solidarity with his fellow soldiers. >> it is both inaccurate. unfortunately, there's a lot of people with unfortunate views of the world who are on television who can make those kinds of
3:13 am
statements. nobody who knows anything about senator mccain, republican or democrat, would give that any attention. you know, there's lots of subset on fox news that doesn't really deserve comment. >> mccain is called the maverick. that man was thanked for what he said on that show. i know fox put out a statement saying he won't be on anymore. in the moment he was thanked for his comments. >> one less sign of i think the situation we're dealing with in this country. last fall, john mccain was more popular among independents and democrats than republicans. this is a lifelong regan republican. somebody the far left has never been fond of. that fact that he is more popular is both a sign of his broad respect in the political spectrum but also how the fringe has diminished the honor and respect he deserves over a lifetime of service. >> okay. next point. "new york times" reporting, david, that the head of homeland

security, kirjsten nielsen, was publicly berated at a cabinet meeting by president trump who was quite exercised because he felt she hadn't fixed the poorest border and was still allowing illegal immigrants into the country. no one knows what exactly it was that set him off. but publicly berated her to the point where there is some talk that she considered resigning. >> partly what is interesting, be is and it's not a surprising story that the president would go off on someone in a public setting like that. it is how often the stories leak. that's what is interesting to me. you have a west wing that is really so transparent in all the dysfunction. it just shows you it is a team that is largely not working well together. and we're talking this week about some potential success, real success and actual success

with the freeing of the hostages on the part of the president. national security and foreign policy is an area where the president and the presidency has a lot of unique control. when it comes to team building, teamwork that leads to moving the country domestically, it's a different matter. and some of these problems on his i think reveal why there hasn't been more accomplishment. >> that's a strong point. look, i'm not bothered by him going at it with his cabinet secretary. he has his policy priorities, his own style. there's no pride in politics. if you don't like it, get out. >> he controls the levers of power. he's blaming her that immigrants keep crossing in? he could have a policy. is she single handedly responsible? >> i think what was going on in the meeting is he was saying, hey, you have been given these directives to do these things and they're still not happening. that is is at least within the bonds of normal political

dynamic. >> first of all, there is the presidential philosophy, the buck stops here. and the tone comes from the top. we'll solve it together. who hasn't he insulted someone in public or personal terms. >> it's not awe style. that's not what they really believe because of what david gregory just told you. they leak in a way in awe way i have never seen, especially what was leaked about sadler. in the context of them knowing it was a joke that fell flat. that shows complete lack of faith by whoever leaked that story. they knew it was a kill shot on sadler. they knew how ugly this is about the administration. >> thank you both very much. >> ahead on "new day", we will be talking live with former defense secretary ash carter. this is a big get. you cannot ask for a better mind and more experience when it comes to talking about what we're dealing with with foreign policy right now. he's going to tell us what he

rudy guiliani, president trump's lawyer, said it is common to pay hush money. here's what he told sean hannity. >> michael would take care of stuff like this like i do for my clients. i don't burden them with every single thing that comes along. >> what he says now is they use nondisclosure payments, not that they make $130,000 payments. let's bring in chief analyst jeffrey tube in. do they do things without telling you and have people sign nondisclosures? >> the most charitable reading of rudy's remarks were that they sometimes is sign nondisclosures without the consent of the client. but it is perfect live absurd to
3:22 am
suggest that lawyers routinely settle cases without telling their clients what they're doing. and that is certainly what he said to sean hannity. >> i'd be surprised if rudy ever did anything like that to be honest. michael cohen, i think it is strongly evidenced by what his pattern of behavior was, is that he probably did lots of this kind of stuff that trump was aware of, semi aware of, or unaware of. that doesn't make it okay. rudy has himself in a little bit of a bind is in his position about how absurd it is that a president would have to comply with a subpoena. listen to what he said about this exact issue back in the pretrump days. >> if the president is asked to testify, is subpoenaed to testify before a grand jury and

3:24 am
representing him or her who has been as wrong as rudy guiliani has been, as imprecise as rudy guiliani has been. is lacking in command of the facts as he's been. and this is all playing out on an international stage on television. i'd be really worried about that. the other thing is of course this is just about politics. this is just a political brawl under the guise of legal representation. i love this description of this kind of legal under world that rudy guiliani says he's part of. you know, jeffrey and i know a lot of lawyers and some of the best in the country. guess what people, they don't operate this way because it's not how it is is done without the client's consent and paying hush money. it's garbage. >> but trump likes him being on offense. especially when you put the

attributes out there, loose, imprecise and often wrong on the facts. he's got the right client. >> you're hired! >> let's talk about what vice president pence said to nbc news and for the first time seemed to really issue his own verdict on the mueller investigation. so here's the vice president. >> it's been about a year since this investigation began. our administration has provided over a million documents. we fully cooperated in it. in the interest of the country, i think it's time to wrap it up. and i would very respectfully encourage special council and his team to bring their work to completion. >> can i just say one thing, i think there's absolutely nothing wrong with what mike pence said there. >> you think it's okay to wade into an ongoing investigation? >> in the way he expressed himself, every administration that gets investigated hopes
3:26 am
that an investigation gets wrapped up. i think just particularly when you compare what pence said to what trump has said over and over again, witch-hunt. nothing to be seen here, i just think we need to modulate our outrage. there is not improper about what mike pence said. >> the only thing where he gets out of the context of the normal is to think that a year is too long. as we know, no disrespect, you were in the business at one time. you like to drag them out, these investigations. i would be surprised if cohen's situation is over within a year. >> it is certainly true that a year is not a long time in -- >> benghazi was four years, and that was just political. >> that's right. but expressing frustration -- >> sure, qualifying. >> -- is part of the game too. >> by the way, that was mike pence. i'm sure in his mind is he was thinking what i'm going to say is this is a witch-hunt, fake news, and that's what came out.
3:27 am
that's him in fifth gear, basically. i'm with jeffrey on this. i think it's totally -- you know, i'm sure mueller is saying we should wrap this up as soon as too for the good of the country. >> right. >> does it have any bearing. >> it would get wrapped up a lot faster if the president submits to an interview with him. >> yeah. >> all right. now let's talk about what we keep learning about what michael cohen was up to and where he was getting money not leadup to becoming president and afterwards. at&t, as you know, is trying to buy time warner, apparently paid him not $200,000 but $600,000, jeffrey, for what? for his expertise? for slicking the deal with the president? hard to know. let's face it, he's not a telecommunications expert or a merger expert. >> what we -- this whole story about the money that has been paid to michael cohen from

3:29 am
>> sure. >> they are selling knowledge of the way the senate works, or in some cases, access to the administrationment a lot of lawyers get hired too because they have worked as prosecutors. they may know people in the justice department. or they have a reputation that lus them to be heard. so those can be good hires. what's outside the realm here is that here's his personal lawyer. >> right. >> who actually was on retainer to pay hush money to porn stars. and you have at&t wanting to make sure they are close to the president. i'm assuming that somehow he will be in the orbit to have is some influence. that's how desperate they are. >> it is a parameter of the russian probe. this is a group of men mostly, right? women, but mostly men, who are open for business. it is speculated. that's why they went to the meeting to get information about hillary clinton because they were open to the suggestion of let's do a deal about what we want. and this is the most obvious
