tv   CNN Tonight With Don Lemon  CNN  August 15, 2018 12:00am-1:00am PDT

12:00 am
this is "cnn tonight". i'm don lemon. the president's attorney, rudy giuliani, on the attack. in what appears to be an atempt to distract and deflect from ex-white house aid omarosa's allegations and in the process making a bigger mess. claiming in a interview that donald trump knew nothing in advanced and at the same time claiming if he did t wouldn't be a problem anyway and claiming that president trump never talked to james comey about michael flynn. so is all of this a smart strategy as giuliani represents
12:01 am
the president? he just might find himself sitting across from robert mueller. and attorney bradley moss. good evening to both of you. tonight rudy giuliani's asked about omarosa's claim that she's been interviewed by the special counsel. she also claimed he knew about the emails before wikileaks released them to the public. giuliani said this. >> if she has some piece of proof that demonstrates that the president was aware of what emails they had, what would that mean? >> i don't know -- >> if he knew, is it a problem? >> no. and he didn't know. i'm not even going to get into the hypothetical.
12:02 am
he did not, no. >> so he didn't know but if he did t wouldn't be a problem. >> these sorts of arguments are made in front of judges. you're trying get a case dismissed or a, the facts support this and b, if they don't, the law supports us. sometimes the judge will rule for you on the legal question. i don't know that it make as lot of sense in the court of public opinion. so i don't know that it makes sense. and that's what this -- let's make no mistake about it. what rudy giuliani is doing is planting seeds that are aren't true and don't make sense. >> absolutely. he is not in a court of law. when he is, things will change dramatically and he won't be at the forefront anymore. >> here's more from giuliani. >> i know she's lying.
12:03 am
>> you know she's lying? >> i know she's lieening because i was on the campaign more than she was. from june to november i was with him 24 hours a day. the first wikileaks exposure he was completely surprised. he asked me do you think there will be more? i told him i have no idea but i heard some reporter on cnn, fox, i don't know where that he builds it up, build tsz up. i said i think this guy may have more than that. >> so bradley, the president's attorney potentially -- is he a witness to a significant event here? >> he's making himself into a witness. this is certain laenot how i would handle but this is rudy giuliani. this is who he is. this is the spin he's doing. but he's making himself a
12:04 am
material witness to numerous parts of the campaign and been there whdonald trump was learni things. remember in july of 2016 donald trump was talking about russia, i hope you can find the emails and there's going to be a huge discovery. this happened all in the context of the trump tower meeting. does this prove he knew in advance? flow. the steps simply not helping his client. >> so jennifer, today, president trump continued his attack on attorney general jeff sessions saying if we had a real attorney general this witch hunt would never have been started. the fact is he hasn't fired jeff
12:05 am
sessions. so listen to rudy giuliani. >> so clinton went through two people. >> and donald trump put sessions in there who is supposedly his best friend -- not pete sessions. >> if jeff had a nanny problem, probably a lot better. the first two clinton peephole nanny problems. >> he to are recuse himself from the entire investigation. >> i don't know why he didn't come to the president about that. >> better if jeff session husband a nanny problem? >> ethics experts told him he had to recuse based on circumstances. the president is far from an ethics expert. he did what he should have done and the president has to live with that or not. he can fire him but -- >> you said, bradley, that
12:06 am
anything that omarosa should be taken with a huge or massive grain of salt. do you think someone like omarosa could be a keys witness given her place in the trump campaign? >> only she has some other audio recordings. in the situation room, which is a huge breach of protocol. and if she could corroborate what other people with far more credibility -- she was rated one of the top tv villains of all time. but if she can provide any supplemental evidence, if there is any. >> i'm going to put up this poll, 2/3 of americans think mueller should try to wrap up his work by the midterm.
12:07 am
69 -- 57% democrats and 69% independents agree. >> i think everyone wants it to wrap up for different reasons. democrats want to be done because they think the mueller report is going to be explosive and very damaging to the president. so they waeupbt to see that too. the problem is these things take time. they need to let mueller do his work. he hasn't even spoken to roger stone yet. so there's more work to do. >> don't you think both sides are setting themselves up for something that's not anticlimactic. we don't know if there's any collusion or anything. no one knows what he's doing. i think that might be a problem. >> we don't even know if we're
12:08 am
going to see the report. i think you're right but one of the problems with mueller's investigation is he can't really talk. so everyone spins things in their own heads. >> appreciate your time. thank you very much. i'm going to bring in a california democrat who is on the intelligence committee. so the president's lawyer, let's talk about rudy giuliani. he says former fbi director, james comey flat out lied when he said the president told him to layoff flynn, which comey has testified to in front of congress under penalty of perjury documented at the time with contemporaneous memos. who has more credibility? >> in america we believe the people who raise their right hand and go under oath and tell their version of events.
12:09 am
comey has done that, other witnesses has have well. he is still unwilling. so as the evidence stands i think america trusts james comey. who do you believe? bob mueller or the president? nearly two dozen indictments and a verdict in the manafort case is bob mueller. >> omarosa claimed president trump knew ahead of time that wikileaks would release the clinton hacked emails. but she isn't necessarily aworthy source. what are your thoughts on that? >> you can say that again about her credibility. she is certainly a situation. what she is alleging that donald trump knew before hand, that actually matches up with stphof evidence we heard in the
12:10 am
investigation, which is there was deep obsession to understand exactly where whether the 30,000 emails were out there or not. that's something we want to learn more about. i wouldn't bank any case on omarosa's words. >> he said it's true and claimed he was with trump when the emails were released. >> he's certainly conflicted, don. and i don't believe most of what he says. he keeps changing the version of the events because the original versions start to look more and more guilty. >> 2/3 of americans want muler to finish the investigation by midterm. if the president's lawyer then successful in creating a deadline, do you think? >> i hope not and i understand why americans believed that.
12:11 am
all of his actions have basically taken our country into a trump slump. health care costs are going up. wages are going down and because of just rampant krupgdz at the white house, people are ex exacperated and -- so you have to do it the right way. when you lie to investigators, when you tamper with witnesses as paul manafort did and ubskwrubgt justice, the investigation's going to take longer. can actually bring this to a conclusion. >> 70% say it trump should testify. >> it tells me most americans believe what donald trump said about hillary clinton. if you take the 5th aphebd mendment, you're doing what the mob does. so if he wants to prove he's above the mob, he should come
12:12 am
clean with thumarecon people. >> the white house is defending president trump calling omarosa a dog. you tweeted this today. "local man praoubs he's not racist by calling black woman who called him a racist a dog." >> we know what he's saying when me tosult my colleagues and if it's dog whistling is what he's doing. it's wrong and what is really surprising because senator jeff blake tweeted calling a woman a dog is wrong. no republicans spoke up. and i actually called on jeff flake. time come over and switch parties. you should think about who you want your colleagues to be.
12:13 am
>> what did he say? >> he hapbtz responded. he's been quite honorable but actions speak louder than tweets. we'd love to have him with us. >> thank you for your time. when we ecome back is there actually a secret tape of donald trump using the "n" word while he's on the apprentice? this is not a bed. it's a revolution in sleep. the new sleep number 360 smart bed, from $999... intelligently senses your movement and automatically adjusts on each side to keep you both comfortable. and snoring? how smart is that? smarter sleep. to help you lose your dad bod, train for that marathon, and wake up with the patience of a saint. and now, save up to $500 on select sleep number 360 smart beds. plus, no interest until january 2021. ends wednesday.
