>> western city of ahmedabad, and it was bound for london's gatwick airport. cnn's nada bashir is with us now from gatwick. now, what are you learning about the crash and the passengers? >> well, look, we are still getting more information as it comes in from authorities in india and of course, internationally. this is truly become a multinational investigation effort. but there are still mounting questions as to what led to this crash. and of course, real concern over the fate of the passengers and crew members on board and also those in the surrounding area that

were impacted by the crash. now, what we know at this stage is that among the 242 passengers and crew members on board, that flight, 169 were indian nationals, 53 were british nationals. there were seven portuguese nationals and one canadian national. and of course, we've been hearing throughout the day warnings from police officials and other authorities that there were fears that the majority of those on board that flight had been killed. now, this remarkable news that there is believed to be one survivor, there are still questions as to whether there may be any further survivors. we had heard earlier in the day from the air india chief suggesting that there had been some who had who were injured and then taken on to local hospitals for urgent care. but at this stage, no clarity just yet on the total number of casualties in the split between passengers and crew members and of course, those that have been impacted in the local area. what we do know according to reuters, citing local police officials,

is that at least 290 people have been killed. and as you mentioned, the tragic news, of course, that this crash directly impacted a hostel for a local medical college. there have been students gathered in the dining hall at the time of the crash, and that dozens have been taken to hospital suffering injuries. we've heard from the indian medical association and the medical.

>> on top of the building a little bit, so that would have been the only survivable place. but yeah, it's very surprising. >> well, it's even more surprising. my understanding is that he was in seat 11 a we looked at a diagram online of what the plane looks like. he was just ahead of the wing, right in front of what appears to be a bulkhead and an emergency exit. you were describing the back of the plane being perhaps the most survivable spot, but i guess it's even more astounding that someone was able to walk away from this. >> yeah, especially in that seat 11, you know. that's right. where the spar of the wing would go under and it would it would be a solid place for the aircraft to hit the ground. but as far as survivability above it, that incredibly surprising. >> yeah. given what we know about the crash so far, this mayday call, a signal being lost at roughly 625ft, and the crash

happening within a minute after takeoff. what does that overall picture suggest to you about what might have gone wrong? >> well, the fact that there was a mayday call that quickly after what? the rules around using the word mayday mean that you're you're imminently losing control of the aircraft. you cannot recover. and that's what the mayday, mayday means. so that happened. what the signal was lost at 630ft. i'm not sure. i don't have an answer for that, but i do have a concern about the configuration of the airplane. after the. it took off. and you can see it's pretty clear that the flaps are not down on the aircraft and that the landing gear is out. and that's just the exact opposite of what you would expect to see at that altitude. the landing gear should have been withdrawn and the flaps should have been down. still, to make that aircraft climb. and that's not what happened here. so that's the first thing i'd be looking at in the accident and in the records of the black box is to see what configuration the airplane was in and when.

>> yeah. and in the video, it seems to sort of sink. and obviously it appears that the pilot at some point felt that there was no way out and signaled for mayday, as you said, this is the first crash involving a boeing 787 dreamliner since it entered into service roughly 15 years ago.

>> to beat the national guard in the event of a rebellion or invasion of the united states. or if he can't enforce the law somehow. now, each of those three avenues is a little bit thin. i mean, you can't say that just because someone is waving a mexican flag at a protest that the united states has been invaded by mexico. so that's a little bit thin. and the notion of being unable to enforce the law is also a little bit tricky, because the fact that these protests started over, the fact that the federal government was quite successful at enforcing the law and then separate from all of that, you know, the state can also attack the fact that the law at issue here says any request to send up the national guard must come through the governor. now, it certainly didn't come through gavin newsom here. he's arguing it did not. the president says, well, we sent it to the governor's office. so again, lots of different avenues that the state

of california can have here to attack. what what's been done? >> talk to us about the legal guidelines for the behavior and the protocol for not only the national guard, but for these marines that are expected to be downtown tomorrow. >> this is a really big sticking point, boris. and to gavin newsom's point that you said in the tease they can these military can support or provide aid to immigration enforcement, but they can't walk down the street carrying out raids and so on. so what does that mean in the in the event that immigration officers are out carrying out a raid or something and they carry a bunch of marines with them who are armed, if if those marines opened fire, have they aided in the enforcement action or are they just providing protection? and that's a gray legal area that i think this lawsuit seeks to work out. >> defense secretary pete hegseth was on the hill earlier today, and he was asked repeatedly if he would abide by a court decision if it goes against president trump on his choice to deploy these marines and the guard there in l.a., he said, what i can say is we

should not have local judges determining foreign policy or national security policy for the country. >> now, if you notice from my tease when you introduced me, it said congressional relations a few times. i've prepped a lot of cabinet secretaries to prepare for testimony, and he knew exactly what he was saying. there. now there is one correct answer to that question, which is, of course, i would obey with the court's order. now, if the courts wrong, we will take this all the way up to the supreme court because we think we have a good legal case. but this whole hemming and hawing over, well, we don't believe that judges. i mean, come on, they're really winking and nodding to their base, their. >> what winds up happening depending on today's decision for other states moving forward, because the administration is making clear that this is kind of a test case for them. >> yeah, it's national law, you know. and so any decision here all around the country, other jurisdictions ought to keep an eye on now, certainly nothing is going to be different in texas or new york or pennsylvania, depending on what happens in california. that's why it's incumbent on the courts to come

talking about. this is something obviously, you say he experienced with a number of friends. what were you talking about? >> you know, it's so hard that transition coming back to civilian life and the support system is there, but we can be doing better. obviously, you know the numbers, some of the statistics are absolutely staggering. you know, in the 22 years in the global war on terror in iraq and afghanistan, we had 7800 troops killed in action. and that is not the watered down people that paid the ultimate price for our country and to fight for our freedom. however, in that same amount of time, we've lost over 120,000 veterans to suicide in this country.
