On 5/5/2008, Jon Goldberg sent us the following note:
I'm writing to you to inform you of a change in the Disco Biscuits Archive.org/LMA upload policy. Based on recent considerations, we have decided to do away with a restricted upload policy. We would like for anyone to be able to upload Disco Biscuits and Disco Biscuits Side Projects recording to the LMA. Plan C will still exist, however they will no longer control the content on archive.org. They can download shows and alter them if they wish and reupload them, however they will not be able to remove sources. Thank you for your assistance. Soundboard recordings of the Disco Biscuits (post 1/1/2000) are still not allowed to be posted on Archive.org.
On 10/29/2005 we received the following email explaining the change of guard for the "official approver" for the Disco Bicuits live music archive. Jordan Nadler (ghotiphan4398gmailcom) is the new archivist. Jon Goldberg is still the official contanct for the band.
I am stepping down as the contact person for the disco biscuits archive stuff. Jordan Nadler (ghotiphan4398gmailcom) has been a constant help to our group and an archive uploader for a while and can answer any approval/unapproval type questions. He can add or remove people from the approved uploader list. Jordan also knows all of our standards and can accept or decline uploads. Clearly the disco biscuits offical taping policy will still be enforced, but since i'm fairly busy with the official releases, i'm letting Jordan take over this responsibility.
On January 6, 2004, the Disco Biscuits gave permission through their archivist Jon Goldberg for shows to be hosted at the Archive. *Please Note that Uploads are Limited*: Jon will be choosing specific items to be hosted (to be uploaded by him and his designees). Do not upload other material at this time, thanks!

[Note all shows hosted are to be available in lossless format. Regarding archive.org's *separate* idea of possibly having *supplemental* mp3's to be made our lossless holdings, Jon opined:]
i would prefer to be the person to select the stuff that will be availible
as .mp3s....preferably the stuff that i post to the db.com website. every
few months i post a new soundboard on the db.com website as .mp3. this is
the way that we release sbds. i also released several of the sbds as shn as
well. but not all of them. my initial plan for the LMA is to put up all of
the shows that I have released via the db.com website, since we do not
publically archive our shows that have previously been released. i'd also
like to basically compile a best of list of biscuits shows and then work on
getting the best copy i have on the archive.
as i mentioned, i have a few (2-3) people that i plan on having help me
administer the biscuits content. so i will send you an updated
taping/trading policy and the few names/emails of my henchmen...

The Disco Biscuits (TDB) allow their fans to freely record and trade audience source recordings of their live performances, in a variety of formats. However, certain rules do apply. We hope that these rules will encourage fairness and the open exchange of TDB recordings, while respecting the integrity of the live concert experience that is "Bisco." The bottom line is that taping is a privilege granted by the band to their fans. By respecting these simple rules you can help guarantee that the band will always be able to allow their fans to tape and trade their shows.
Audience taping is permitted at almost all shows by The Disco Biscuits. (For purposes of the band's taping policy, performances by individual band members of The Disco Biscuits (Ex; Electron, Ah Moshi Moshi, Jon Gutwilig Solo Acoustic sets, etc.) will fall under the same guidelines that apply to full band performances.) When The Disco Biscuits are performing at a festival or other event featuring multiple bands, that particular event's policy may override The Biscuits' regular taping policy. Such occasions rarely arise, yet please keep in mind that, when they do, it will be your obligation to respect any rules established by the organizer of said event.

-- No photography, using digital or still cameras, is allowed at any TDB show.
-- No videotaping is ever allowed without expressed written consent of the band.
Please do not bring cameras of any kind to any TDB show, as the venue is instructed not to allow them in the building. Neither the band, nor the venue, will be allowed to hold or watch any such equipment. You will be asked to leave the camera outside. Anyone found videotaping a TDB performance will forfeit the ownership of the tape on demand and will be asked to leave the venue. In order to obtain permission to photograph or videotape The Disco Biscuits, please contact Matt O'Brien at mobATdiscobiscuitscom with a detailed written proposal at least 2 weeks prior to the show date in question.
Currently, there is no ticketed "Taper's section" at The Disco Biscuits' shows, so there are no specific "Taper's Tickets". Equipment location and microphone placement is governed first by the venue and second by The Biscuits' Tour Manager, Jon Dindas. The foremost restriction is that the band asks that tapers not obstruct the line of sight, which extends between the soundboard and the stage. This doesn't mean that "Front of Board" recording is not allowed; rather, it means that tapers must place their mics and decks in spaces that are not in the way of the Engineer or venue. If there is any uncertainty as to where equipment can be placed, please ask Jon Dindas or the venue prior to setting up.
The band wants to be as accommodating to tapers as possible. However, in order to make this happen, the band asks that you adhere to a simple set of rules designed to guarantee they enjoyment of the audience and the tapers alike.
Audio Taping Rules:
- Soundboard patches are not available at any performances by The Disco Biscuits.
- Tapers must bring, and are responsible, for all of their own equipment.
Please don't ask the venue or TDB crew to provide you with the gear that you forgot.
- The enjoyment of the audience in attendance at a concert always takes precedence over recording efforts.
This means that at no time should tapers ever require other patrons to be quiet or otherwise interfere with their enjoyment of the show. Be smart about where you set up your gear: when you tape, you tape at your own risk. Sometimes things have been known to get pretty crazy down on the dance floor, and you shouldn't expect those caught in the frenzy of the moment to tip toe around your rig.
Duplication
- Audience taping at The Disco Biscuits' concerts is authorized for non-commercial purposes only. Unauthorized sale, duplication and/or distribution is in violation of applicable laws and is strictly forbidden. All performances by The Disco Biscuits and recordings are the exclusive property of The Disco Biscuits. All rights reserved. The rights to record The Disco Biscuits' performances set forth in this policy constitute an express, revocable license. We reserve the right to withdraw our sanction of recording, tape trading, and/or non-commercial digital audio file transfers on a case specific basis or in general, as we deem necessary. No waiver of any copyright or trademark right is intended.
- All participants in audio recording exchange (regardless of format) acknowledge and respect the copyrights and exclusive ownership of the music and performances by the performers, writers and publishers. In plain English, this means that the music contained on any recording of a performance by The Disco Biscuits, be it a studio album or live recording, is the possession of The Disco Biscuits.
- All taping must be for personal use only, which may include trading (via analog or digital tape, CD, or digital file transfer). Recordings may be traded only for an equivalent amount of similar media (DATs, cassettes, or Compact Discs, pre-recorded or blank). Regardless of any expenses incurred in duplicating a recording, no money may ever be exchanged as part of a trade. However, stamped, self-addressed envelopes may be included with blank media, allowing for fans to engage in "blanks and postage" (b-n-p) arrangements.
- The mediums by which audio trading is publicized may not be commercialized. Therefore newsletters, web sites, clubs, or any other communication forum facilitating audio trading cannot accept advertising, offer links for compensation, exploit databases compiled from their traffic, or otherwise derive any commercial profit in any form. Stores or businesses may not offer to duplicate The Disco Biscuits media for customers or sell or otherwise provide media containing unreleased The Disco Biscuits music for any price. A statement of compliance with this policy must be clearly posted on all web sites engaged in trading activity.
If the band chooses to offer for sale (via physical media such as CD, or via digital download) a particular performance by The Disco Biscuits, this Official version will take precedence over amateur recordings being offered for download. In these instances, we require that digital audio repositories remove any recording of these particular performances from their collections within 7 days of the official release or 7 days of The Disco Biscuits announcing the intention to release, whichever is earlier. Notwithstanding the above, The Disco Biscuits reserve the right to require immediate removal of any unreleased Biscuits material. It is the responsibility of the site host to remain informed of the current list of The Disco Biscuits' officially released recordings and to maintain their site accordingly. In no case may any officially released The Disco Biscuits' recording (live or studio) be duplicated or otherwise traded or offered. Broadcast of unreleased The Disco Biscuits recordings via radio or online is permissible only if it conforms to all the guidelines applicable to other forms of duplication.
The Disco Biscuits are aware of how many of you have been turned on to "Bisco" via a tape, CD, or MP3 from the web. As a result, we feel greatly indebted to the legions of dedicated tapers and traders who have helped spread our music to the world. However, as our fan base continues to grow, we feel it is important to state these simple rules so as to protect not only our music, but also your right to record, and trade, it freely. Please do not hesitate to inform us of any individuals who are in violation of these policies or contact us with any questions.

I know i originally said 4-5 uploaders, but i decided to go with 10. I hope that's ok. I think these guys will really help initially get things going and will also make it really easy for us to get new stuff on there in the future. I've included their names, email addresses they use for the archive, and the screenname they use, if they already have one. could you shoot me an email when these guys are good to start uploading?
