"risk & reward" starts right now. >> "new york times" editorial board has type of donald trump saying that he doesn't believe what he is saying on immigration. that all of his promises to secure the border are not real. and if he is president he doesn't intend to do what he says. that is according to "new york times." apparently had it on tape but it is off the record. "the new york times" says it will not release the tape unless donald gives him permission to do so. i call on dan ailed, ask "the new york times" to release the tape. and do so today before the super tuesday primaries. deirdre: breaking news. in potential serious blow to

donald trump campaign, gop contenders said alleged secret tapes should be released now. alleged contents, donald trump telling "new york times" what he really thinks about immigration. this is "risk & reward." i'm deirdre bolton. we're 24 hours away from super tuesday. the most important day in the primary season. candidates making their last-ditch efforts before the big day. senator cruz now here with more. >> it is either false and if donald didn't say that to the "new york times," then he deserves to have this cleared up and releasing tapes and clear it up. the alternative is that it is true. that not only did donald trump bond the "gang of eight" rubio amnesty effort, not only did he give $50,000 to the members of "gang of eight," that he actually now is telling "the new york times" editorial board, pay no attention to what i'm saying on immigration because i, donald trump, don't intend to do anything. deirdre: so according to buzzfeed, these tapes may call

negotiation session. katrina, what do you make of this bombshell? this could be very damaging to the campaign. >> well, i don't think so at all. this was back in january. all of sudden there is top secret allegations the day before the election. i don't think so. but i can point you to article written by byron york, written from the washington dam inner he asked donald trump solid positions where there might be room for negotiation. there is no secret here. deirdre: katrina, people don't know how media works as well as you do, i do, often editorial board meetings, candidates or business leaders come. they meet with numerous writers, numerous editors. is it possible that donald trump said something off-the-cuff in what he thought was a closed-door meeting? >> i'm sure it is possible that they had discussions off the record. it happens all the time. you know that. whether it is at editorial board meeting or even at an in-studio meeting. that is not what is at play
5:04 pm
here. what is at play are allegations being made the night before the election on mr. trump's core issue, particularly that it is going to be a good issue for texas. but why wait until the day before the election? so that is the key here. and i think most people know at this point in the game they're going to be throwing all kinds of allegations just to hurt mr. trump. deirdre: okay. to your point, before super tuesday, and especially where texas is such an important state, senator cruz's home state and one where donald trump is obviously competing very seriously. now speaking of that, the fur is flying at least if you look at weekend exchanges. top candidates for the republican presidential nomination, you had florida senator rubio mocking from the time runner donald trump before a heavily college-aged crowd. here is a sound bite. >> always calling me little marco. i will admit he is taller than me. he is like 6'2", why i don't understand why his hands are the
5:05 pm
size of someone's who's 5'2". have you seen his hands? they're like this. and you know what they say about men with small hands. >> little marco rubio, a total, total feather weight. he is not a lightweight. i think he is going to faint. now, we don't need a fainter to negotiate with china. he is not cool. he sweats too much. and i don't want him negotiating for us. >> he doesn't sweat. he doesn't sweat pause his pours are clogged from the spay tan that he uses. donald is not going to make america great. he will make america orange. deirdre: katrina, so, listen, both sides have to punch. both sides are punching but does this end up hurting both of them or not at all? >> well i don't think so. i think everybody understands this is contest, this is donald trump's race to lose. we all know that marco rubio hasn't won a single state. so he is trying to do everything
5:06 pm
he can, even trying to outdo much trump at being mr. trump. just coming off like amateur night at the the improv. deirdre: there is other allegations. one thing to joke about sweating and makeup, that he won't release tax returns because of ties to mafia. here is the comment on that. >> there have been multiple media reports about donald's business dealings with the mob, with the mafia. maybe his tax returns show that those business dealings are a lot more extensive. >> his dealings with the mafia? deirdre: okay. so he is obviously being questioned is senator cruz taking a question from abc's george stephanopoulos. but to what extent are you helping donald trump navigate these attacks, or do you think he has them covered? >> no, i think he has them covered quite well. there are no ties to the mob. that is just ridiculous. here we are the day before the election and you've got two
5:07 pm
candidates whose campaigns are literally tanking. polling today shows every single candidate combined can not beat donald trump's number. he is almost reached 50% nationally. of course they will say whatever they can to try to create as much doubt as possible. deirdre: what if donald trump loses in texas, how important is that to him? >> it is not extremely important for mr. trump to win texas but i can say he will do extremely well in texas, if not win texas. i think he is definitely will carry all the other states. deirdre: katrina, donald trump ducking a question about the endorsement of former kkk grand wizard david duke. here is the comment. >> i don't know anything about david duke, okay? i don't know anything about what you're even talking about with white supremacy or white supremacists. i don't know, did he endorse me or what is going on? i have to look at the group. i don't know what group you're talking about. you wouldn't want me to condemn a group i know nothing about. deirdre: senators rubio and cruz
5:08 pm
wasted no time in responding. here are your comments. >> we can not be a party that nominates someone who refuses to condemn white supremacists and ku klux klan. we can not be a party that does that. >> watching donald's interview when he repeatedly declined to denounce the kkk, declined to denounce david duke, i thought that was unfortunate. deirdre: this morning trump defended himself saying he couldn't hear the question posed by interviewer. >> i disavowed david duke and i disavowed him the day before in major news conference which is surprising because he was at the major news conference. cnn was at the major news conference and they heard me very easily disavow david duke. i sit down again. i have a lousy earpiece provided by them. and, frankly he talked about groups. he also talked about groups. and i have no problem with disavowing groups i would at least like to know who they are. deirdre: katrina, was this too little too late?
5:09 pm
there are a lot of people say that's the case? >> well, no, simply because part of the reporting that is being left out after mr. trump already unequivocally and immediately disavowed endorsement, there were reports that came out that the endorsement never occurred. so when jake tapper asked mr. trump about the anti-defamation league and another david duke, he wasn't sure. it was very confused. comes off during interview. he didn't know what he was talking about. wanted more information. we find out again last night, david duke himself came out said he did not endorse donald trump to begin with. deirdre: so you see this as just what has become typical mudslinging in a very heated -- >> absolutely. deirdre: very heated field. very important day. last question here about a tweet. mitt romney tweeting out disqualifying and disgusting response by real donald trump to the kkk coddling of repugnant bigotry not in the character of america. how does donald trump feel with
5:10 pm
mitt romney calling this out on twitter and also questioning as we alluded to earlier, the validity of the tax statements? >> well, i don't really think anybody is thinking about mitt romney or what he thinks. he pretty much handed the election to barack obama when he ran last time. so we're not really concerned about that. our main concern sick maaing sure the people of this country know they have a choice to vote for a man who is personally invested in the success or failure of this country. mr. trump's empire was built right here in the usa. this is going to his family when he is doing gone. whether or not this country makes it is on his hand. he wants to take control of that and make sure this country survives. deirdre: katrina, thank you very much for the time. glad to have you here. katrina pierson, trump spokesperson. speaking of donald trump, candidates make final push before super tuesday tomorrow. donald trump is going to hold a rally. he is at a state university in georgia. he may respond to cruz chris's
5:11 pm
challenge -- ted cruz's challenge. we'll bring you remarks live. marco rubio wants to remind voters what is at stake tomorrow. >> i really believe voters would see through this con job he is trying to do. obviously that hasn't happened. i believe a first-rate con artist is on the virge of taking over party of lincoln and reagan. we need to remind people what is at stake here. deirdre: tune into fox business. we're here all super tuesday. neil cavuto, lou dobbs. they will bring results as soon as they come in 6:00 p.m. eastern time. when we come back, senator cruz's campaign, reacts maybe satisfied with trump spokesperson comments. pushing for release of "new york times" alleged secret tape on trump's immigration comments. moments away from release of final batch emails hillary clinton's private server. we'll bring them to you as soon as they are released. >> have you always told the
5:12 pm
truth? >> i always tried to. always. always. >> some people are going to call that wiggle room you just gave yourself, always tried to. >> no. >> jimmy carter said i will never lie to you. >> you're asking me to say, have i ever, i don't believe i ever have. >> is that a question you would like another shot at answering? >> i will just say no. >> men are all wearing the same outfits, okay? every guy is wearing the exact same thing! you know if george clooney showed up with a lime green tux and a swan coming out of his [bleep], somebody would go, what are you wearing george? [laughter] when you think what does it look like? is it becoming a better professor by being a more adventurous student? is it one day giving your daughter the opportunity she deserves?

before the election on mr. trump's core issue, particularly that it is going to be a good issue for texas. but why wait until the day before the election? so that's the key here. and i think most people know at this point in the game they're going to be throwing all kinds of allegations just to hurt mr. trump. deirdre: that was donald trump's spokesperson. with me just moments ago responding to claims that senator cruz made that there is a "new york times" tape that indicates that donald trump's true views on immigration are different than what he has sometimes publicly stated. former georgia congressman and senator cruz supporter j congressman kingston, thank you for your time. what do you make of the last 24 hours before super tuesday? are candidates getting desperate or are we still talking about some of the issues that matter most to potential voters? >> i think this is relevant and i think it is part of the drama that leads into any election.
5:17 pm
you don't have all the information up front. although i would say it is well-known he did use illegal aliens to build the trump tower. "new york times" and among other outlets covered that thoroughly. many of the polish migrant workers never have gotten paid. if you will there are articles on mr. trump's true stance on migrant labor. i think it is relevant. the fact he still won't release this tax and flimsy excuse being audited. why are you being audited all the time? there is nothing in the audit that says you can't release your tax returns. i have had to do that as candidate. most candidates have to release taxes at some point. what is he hiding? deirdre: but there is a question of tone that we have seen show up in senator cruz's campaign where you just heard directly from donald trump's spokesperson that she says that the timing of this discussion, we also just want to underline this point, this is according to a news source, buzzfeed, which did not
5:18 pm
have a reporter in the room, does not have a transcript, and is only going off hearsay from somebody who was in the "new york times" building at that time. so katrina pierson, trump spokesperson told us, time something rather tricky, 24 hours before super tuesday. >> i think reality is super tuesday will go right past for all of us. mr. trump will win some states but mr. cruz is going to win a whole lot of delegates. he will be victorious in texas. he is going to do well here in georgia. and he is going to walk away from super tuesday with some votes. then they will go on to kansas and go on to michigan and all other states coming up in between now and ohio and florida on the 15th. so it is going to continue to be a knock down, drag out campaign, but that is why ted cruz has consistently attacked rubio and trump on their records as opposed to these ad homonym attacks which you are hearing -- they're silly.
5:19 pm
they're scary and they're inappropriate. language that we're hearing. deirdre: yeah, i agree with you, but some are more substantive. for example, here is alabama senator jeff sessions yesterday endorsing donald trump which many people thought really hurt senator cruz by far the most. here is sessions comments. >> i think at this time, in my opinion, my best judgment, at this time in american history, we need to make america great again! [cheers and applause] deirdre: congressman, that endorsement prior to this point in the campaign many people thought would go to senator cruz. what is going on? >> well, you know, senator sessions is popular in alabama. he is not known in georgia. i don't think he is known in mississippi or tennessee. i don't see how a conservative like mr. sessions can overlook the fact that mr. cruz has given
5:20 pm
thousands upon thousands of dollars to hillary clinton and to john kerry, mr. trump, excuse me, how he has given thousands of dollars to john kerry and hillary clinton and nancy pelosi. how mr. trump has supported planned parenthood and how he has been pro-choice. deirdre: you think senator sessions lost the plot for a minute? >> i think mr. sessions reads polls very well and most people have admitted long ago that alabama is going to go to trump. i think that -- deirdre: he wants to be on the right side? >> yes. i don't think there is anything really spectacular about it. i like senator sessions a lot but he is not a national figure. i don't see him crisscrossing the country and talking about trump. and he knows he can't sell trump as a conservative. what trump is, he has some disruption to him that is appealing. i want to burn washington down. i want to turn the city

upside-down. people are desperate to get washington turned around, they embrace it. who is the conservative doing, often the lone wolf, it is ted cruz. deirdre: not having that endorsement was a red flag to many. former georgia congressman, jack kingston there. >> thanks. deirdre: apple hearing to take place tomorrow on capitol hill. >> i think apple leadership risks having blood on their hands. i think tim cook will have a very hard time explaining why he stood in the way of justice. deirdre: a congressman will have tough questions to ask. we're minutes away from final batch of emails from hillary clinton's private server. we'll bring you the very latest. >> have you always told the truth? >> i always tried to, always. always. >> some people are going to call that wiggle room that you just gave yourself, always, always tried to. i mean jimmy carter said i will never lie to you. >> you know you're asking me to say, have you ever, i don't

>> i think apple leadership risks having blood on their hands and i think tim cook is going to hard time explaining why he stood in the way of justice on this issue. deirdre: apple and fbi will testify before the house judiciary committee tomorrow. it will be apple's first appearance before congress since the company received an order to break security measures on an iphone used by one of the san bernanadino killers. republican congresswoman, house judiciary committee member mimi walters is with me now. congresswoman, thank you for the time. bill gates is with the february by. almost all other tech leaders are with apple. which side are you on? should apple unlock this phone for the fbi? >> we need to recognize that this is a very difficult issue. in fact this is the debate goes at the heart of what the framers discussed when they were
5:26 pm
developing the fourth amendment. and now we have technology in modern society and technology moves so much quicker than government does, so much quicker that sometimes it is difficult to understand. so in tomorrow's hearing i hope to get both sides of the issue because i think congress is going to need to step in and solve this problem. deirdre: congresswoman, as you well know, i know you're from california, so silicon valley, you're up to 100% speed up what is going on there, apple has actually complied with the law 70 times since 2008. so there are a lot of people wondering why this time apple's ceo tim cook is lying down on the railroad tracks? >> because the issue here is that apple has data and technology that you as owner of that iphone own. nobody can get inside of that iphone and what the government's asking apple to do is create new software to get into the data.
5:27 pm
so in or the words undermined data and software they already have on the phone that is the crux of the issue. deirdre: okay. i want to go back since we're talking of the tech community, bill gates, legendary warren buffett making this comment. backs up what you said. if you were in early days of september 2001, you were receiving credible information something was going to happen. in this case security trumps privacy. as a lawmaker do you feel like there is opportunity for you and your colleagues to craft legislation that maybe accounts for this new, more modern and sometimes unfortunately more violent world? >> i think congress is going to have to take this issue and craft legislation to help guide companies. and what's going to happen, if we create a backdoor, into the software, it also opens up people's personal privacy for potential for government abuse and potential for criminals and terrorists to get our personal information.
5:28 pm
that is why this is such a difficult issue. because we're taking our liberty and our privacy versus national security. and i'm actually cosponsoring piece of legislation with chairman mack call, chairman of homeland security, chairman mccaul. he is creating legislation that will create a commission, experts in privacy, telecommunications in law enforcement and come to congress to help give us feedback to help guide us to solve this problem. deirdre: sounds like a fantastic idea. glad you're on the case. republican congressman mimi walters, congresswoman from california. part of it. someone thinks donald trump's campaign promises is unlawful, that u.s. forces could not allow them to follow orders. >> if we allowed that in government, american armed

commander-in-chief. deirdre: the final batch of hillary clinton's emails will be released by the state department. also our exclusive sourcing by fox news shows former clinton aide cheryl mills obtained top secret clearance. how is this possible? reporter: these letters to congress show clinton's former chief of staff cheryl mills captured top secret clearance despite sending classified information. officials say it's standard practice to suspend a clearance pending an investigation. but this practice is not being followed even as the clinton email system remains the subject
5:34 pm
of an f.b.i. investigation. >> the concern is there appears to be a counsel standard. had this happened to someone serving in the government, their clearance would have been pulled and they would have been under investigation. it's entirely possible they could be in pretrial confinement for that matter. deirdre: an october 2013 letter to charts grassley confirmed her client has quote an active top-secret clearance. and the reporting that the clearance was no longer wrong and due to an administrative error. the state department is set to release the batch of emails according to the court mandated issue. >> this is not a double standard. people have had their clearances suspended for so much less pending the outcome an
5:35 pm
investigation. >> your question presupposes anout come. as i said, clearance determinations are made on a days by case * basis. and i'm not going to comments further than that. deirdre: two more emails will be withheld from public release. one from law enforcement and another between clinton and obama. just to emphasize, so far 1,800 of the emails have contained classified information and 22 had top secret information which will never be seen under any circumstances. deirdre: thank you so much. catherine herridge joining us from d.c. how this email release may affect hillary clinton's campaign. i will bring in kirsten has has-

5:37 pm
unless he feels it's a strong winnable case. if he recommends felony charges, the attorney general has to say do i respect the rule of law and indict hillary clinton or does she side with the president and hillary clinton. in a politically charged year like this one, how cot administration recommend to indict her. deirdre: we have been talking about the discussion between privacy and security. there is a judge siding with apple. it's been apple versus the f.b.i. on apple's challenge against the government's use of the all writs act to force apple to provide the data from that san bernardino shooter's iphone. >> i look at apple under a business that operates under incentives related to that. their biggest markets will be china, india, and abroad.
5:38 pm
they care if their phone gets involved in a government probe, will they be able to rely on apple to protect their dat. i think all americans agree they would rather be safe than sorry. deirdre: tim cook is doing a job for apple. he's not a constitutionalist or constitutionalist or politician. deirdre: the former head of the nsa and c.i.a. thinks one of donald trump's campaign orders is so unlawful the military could not follow it. >> the american armed forces would refuse to acts. deirdre: four-star retired general jack keane is with me next.
5:39 pm
we'll talk about the possibility of president obama down playing isis' role across the world. >> there are fewer isil fighters on the battlefield and those who are there, it's harder for them to recruit and replenish their ranks. they are not a caliphate, they are a crime. >> it's not fair that will was this good and not get nominated. it's also not fair that will was paid $20 million for wild, wildh west. .at t. rowe price... ...we've helped our investors stay confident for over 75 years. call us or your advisor. t. rowe price. invest with confidence.
