her stapends. this is a person running for president? maria: new details this morning why the homeland security chief is labeling what hillary clinton did as treason this morning. markets this morning looks like this. we are waiting the job's number. stocks have been down eight days in a row now marketing the longest losing streak since depths of the financial crisis. economists are looking for 115 new jobs to have been added to the economy last month with the unemployment rate dropping 4.9%. one tenth of a percent lower. in europe this morning, global investors concerns over uncertainty in u.s. election. we are looking at declines about 1% across the euro zone.

trump has pulled 8% lead over hillary in which candidate is trust worthy. maria: there is that criminal fbi investigation, chuck, clinton's e-mail controversy causing chatter on both sides of the aisle. watch this yesterday. i have to get your reaction, chuck. >> assuming she wins and the investigation goes forward and it looks like an indictment is pending, at that point in time under the constitution, the house of representatives would engage in an impeachment trial, they would go to the senate and impeachment proceedings and removal would take place. this is in my opinion quite frankly it's treason. >> you have some republicans right now who are suggesting they will impeach hillary, they don't necessarily why but they are just going to impeach her. maria: chairman of the house homeland security representative michael mccaul, you just heard calling clinton's actions treason. can she survive?

>> the people that are going to be most affected are the voters. the congressman from texas is probably going to run for the senate. i'm not making any excuses for hillary clinton or for the server. i think a lot of that is baked in whether that's right or wrong. nobody is above the law either party and i think that that's what the biggest effect is for this particular election it's really right now we have momentum against organization. that's what i'm most intrigued by because i think donald trump definitely has a momentum spike right now at the most opportune time and hillary clinton has built out the organization. 24million people that have already voted. on election day the polls will say what's true and the american people speak. >> hillary clinton believes she's above the law. that's why she's under investigation by the fbi, that's why the house of representatives is investigating her for perjury and obstruction of justice and that's why -- listen to this, hillary clinton is even in

trouble legal hot water with the folks in chapaqqa new york because she decide today renovate the house tt all the little people are supposed to t. she's going to get in trouble if she's elected president for a law she has not broken yet. >> whether it's the campaign laws, protecting national security, destruction of evidence, that's what people have to start asking themselves, do you put somebody in the white house who has just thumbed their nose at the rules that four-star generals and privates have to fly by. they don't. maria: yeah. dagen: you call yourself a mexican redneck. >> yes, do i.

dagen: i want to ask you about the latino vote for hillary clinton because you have in the real clear politics average now you have donald trump up by 2 percentage points in nevada where the latino vote should be coming out for hillary clinton. you have him up in texas and you have him up by 4 percentage points in arizona, so what's happening there? >> so i think what you should pay attention to with the latino vote i would take texas and california out of the equation, there's not a lot of organization going on there. like you said wisely the nevada vote i started digging into and the florida vote because the latino vote that will make a huge difference. what we have seen with overall poll numbers the african-american performance is underperforming 10% in in states. you do see overvote right now with latinos if it's just based off the numbers i'm seeing on early vote and it's breaking dramatically for hillary clinton. what we don't know is that people that have voted or will vote on election day prevoting and we will have a downturn on election day.

that's what's really not known but dagen you're exactly right, she cannot vote without the latino vote in nevada and in orlando particularly in florida. dagen: that's one of the reason that is you see strong rhetoric from president obama on the campaign trail, like you're letting me down if you don't come out to vote for her because they are concerned about the african american vote. it's why he's bringing up the klan. he brought up the klan more than once in the last few days. maria: i don't know if it's resinating though. i feel like people are looking at their own lives whether it's latino and african american and they are saying, how has my life changed in the last eight years. >> the african-american income is down, labor participation is down, home ownership is down, food stamp dependence up a58% under barack obama. he's been very bad for african-american families. >> when you look at the american voters right now they are so frustrated and the concern is that more of this coming out,

you know, the last four days, all the commercials that are out there are tearing each other down and they're not talking about the issues, economy, isis, it is focused on the -- people are saying i'm frustrated and not going to vote. maria: trump is talking about the issues. he's connecting the dots. you don't see her connecting the dots as much because she's on a attack mode. >> her plan to raise corporate taxes is going to push us into a recession. >> she's out there defending obamacare. my gosh, everybody is gets notices, increases between 24 and 200%. they're looking at that. if i elect hillary i'm going to get a gut punch. if i elect trump i'm okay. i looked at it like this, donald trump is a car that might bump into some other cars and i get that, but hillary is like a drunk driver going to wrong way on the freeway, a lot of people are going to get killed or hurt

if she's pointed in the wrong direction. dagen: if trump supporters want to get out the vote -- the campaign does not have the number of offices that the clinton campaign does and you're going to have trump supporters putting people in their suv's and driving them to the polls. do they understand that? >> hillary's people, promise them a sandwich and a soft drink. maria: to your point all the more extraordinary that this is so neck and neck right now. he doesn't have the ground game that she has and yet -- >> he has a youth enthusiasm advantage. dagen: when there was such a gap, you have to throw them all out. now that it's tied and neck and neck and a lot of the swing

maria: welcome back, election jitters shaking investor confidence, it's impacting the stock market and depending on who is voted into office some fear downfall in global trade and global growth. joining us our dear friend, stephanie. >> good to see you. maria: you think we've already gone into recession? >> i do. i think there's alarming things that have happened in the last few months. i was really stunned by some new york city tax receipt data.

new york city is levered to wall street and it's kind of reflective of the high end. it's sort of the 1% and tax receipts from april to august collapsed out of the plus and -- blue, the guys were perplexed on the sudden tax. it was income taxes, corporate taxes, sales tax receipts, so things have started to slow out of no where. maria: is that an indication that people are leaving out of new york, out of a job, what do you think that tells us? >> sales tax repeat maybe that has to do with less foreign tourist but the fact that income and business tax receipts are down suggests that people are leaving the state. maria: taxes do dictate people's behavior. they are looking for lower-tax states.

>> if people want to see taxes go up and be pushed around because people vote with their feet, then they need to vote for hillary because taxes are going up with hillary. that's just the clear picture. donald trump is talking about a huge cut in corporate tax which means job creation. it's that simple. dagen: why haven't we seen the market rally, you have eight trading days in a row. so clearly investors hadn't factored in the possibility that lil ri would lose potentially. maria: uncertainty factor. >> exactly. uncertainty trump's tax policy and it's interesting. i was looking at brexit, rallied 12% since. the economic data in the uk in the upside. things have been much better there post exit.

the reealty turned out to be more positive and i think it'll be the same thing here. if trump wins maybe the markets go up initially. the markets should recover. maria: initially the uncertainty causes a selloff but longer term how do you not think it's a positive for 15% corporate tax role and rollback of regulations. that will be wildly positive for corporate america. >> we see it in the employment market that employers won't make those hires. they might have job openings out there and they're looking, they're interviewing but slow the move. they are cautious. this recession had the worst recoveries of any recoveries. we didn't see wages come back. that's probably what held back consumer spending.

>> that has been the story. >> yes. >> hanging over them all of this time and maybe whether it's trump or hillary just the resolution of that uncertainty might see them finally say, okay, now we know what we are working with, we can make a plan. >> it seems to me this is another classic example, the elitist are typically wrong. they live in their bubble and always picture it one way. it turns out something different. look at brexit, that was a classic example. the world was going to come into the end if the brits vote today get out of the eu. >> right. dagen: we tamp that down. when people would come on and said the sky was going to fall because -- maria: accepted it. dagen: living through the financial crisis we knew how dire it was but some of the predictions, the american people didn't buy it. the financial crisis and the bank bailout gave birth to the tea party movement because people were tired of the elitist in washington and new york

telling them that the world was going hell in a hand basket. maria: there's the hysteria right now that people are not buying. the american people are really smart and they see through all of this. we have the job's report coming two hours from now. what kind of reports would move markets? >> i don't think anything is going to be -- take the fed out from december. i think it would be an enormous disappointment that would change their policy. >> they will raise rates in december is what you're saying? >> 175,000 unless it comes in at zero, i think it's pretty hard for them to get out of the box that they've put themselves in. but the reality is this employment situation has been slowing steadily, you know, job growth, running at 265,000 annual gains, we are now at 165,000 and on our way to lower

and lower because the corporate profits, five quarters in recession employment growth is going to continue to slow. we have much more downside on the job front. maria: wow. real quick, i'm going to ask you later where the growth in jobs is, rr the growth from your standpoint, stephanie? >> i think it's sort of broad-based in the payroll numbers but the quality of the jobs you can characterize as much poorer because the wage numbers, you know, as strong as the headlines job creation has been the wage numbers have been poor. dagen: 7.9 million americans who are unemployed. 2million unemployed longer than 6 months and another 2 million people that are stuck in part-time jobs. >> labor force participation rate is incredibly low but among

found 83 unused ballots addressed to different people, supposedly living in his neighborhood, two bedroom apartment. governor mike huckabee, this is continuing to show its ugly head across the country and now this. >> you can get ballots on amazon prime delivered by the hundreds if you like. democrats say there is no ballot fraud, there is no such thing but there is. let me be quick and fair. i don't think ballot fraud will swing the election one way or another on a national scale. in arkansas, he is paying people $5 a vote, city councilman in arkansas, 125 absentee ballots on his kitchen table, ballot fraud does exist in this country and it is serious. maria: will it swing the election? >> probably not on the national level because it would have to happen in enough precincts to swing precincts to swing states

and electoral votes. i don't think that will happen. liz: a personal story about a week ago, checking to make sure i was supposed to vote, it said there was a problem with my voting registration so i called the board of elections a10:00 in the morning, nobody answered the phone. i called back and the man who answered the phone said, i said i have a question about my voter id, voter registration and he said all the lines are taken, call back and he hung up on me. maria: the biggest city in the entire nation. liz: they can't answer the phone and when they do they hang up on you. if it came up i was conservative, is that why they hung up on me? it came up fox news, is that why you hung up on me?

i am surely not the only one but it speaks to how poorly some of these areas are run in terms of voter registration and dealing with questions like this. >> i had a friend who went to vote early and was frustrated with both candidates but also frustrated that they went in, hardly even looked at his id, he felt like really? do we feel secure that this is going to be valid? already frustrated voters and here they go to vote and don't feel their vote is being counted. maria: a week ago we had a woman from texas who voted republican all the way down the line, got her ballot out of the machine and it said she voted for clinton. she said this is wrong. they embarrassed her. she was embarrassed to come on the show.

there are issues. >> i am more worried about voter machines being mis-programmed than i am somebody voting several times. we do have to realize there are people whose motto is voter early vote often and they do that. maria: the latest wikileaks emails, one email finds john harwood sending an email titled watch out to john podesta and warning him of ben carson in may 2015. in the email here is what he says. ben carson could give you real trouble in general and sent a piece from his interview and carson's other you.. he is sending this email to john podesta about you as well, you are in wikileaks and says, quote, since you probably faced

him the email contains a link of your interview with him in october 2015. you have john harwood trying as hard as he can to help john podesta. >> what i reasoned is john harwood and other people presenting themselves to be journalists when they are nothing more than political hacks for one particular viewpoint. people are supposed to be the referees start wearing team jerseys and tipping the scales the system is rigged. donald trump is right, bernie sanders is right, the american people are disgusted with it. if they want to stop it they can't change the media but they can change the election outcome. john harwood in that nbc debate was the worst example of media bias, a cooked deal where they were going after trying to make all of us attack donald trump. it was a disgusting debate. maria: you are at the debate. >> the question i got is, is donald trump morally fit to be

president? it was a stupid question. we didn't talk about healthcare or transportation or anything. we talked about stupid stuff because those moderators were out there to embarrass the republicans. dagen: if you read the other emails that came out that praised john harwood lavishes on hillary clinton in emails to john podesta, she is over the hump, se has to do this ad infinitum, here is john harwood, she looked more comfortable talking about andrea mitchell. >> on the clinton team. >> this is a new height of but smooching and we have seen that in our lives. some of these journalists want to be liked. >> that is not journalism. if you read a story and you are in a story and it makes you mad

terrible thing about this. you've been there for so long she's supposed to be the top cop in the country. the president appointed her. she's can be loyal to him and stumped on any investigation. it usually hasn't been a problem in the united states. is totally politicized now. the have of the justice department and her minions are really proud of the democratic national committee. just look at the stuff on wikileaks and see the connections. and so should some of the people in on the fbi. the deputy director. the wind have lunch there. the governor of virginia.

it just shows awful judgment. that's what has the agents upset. it's not trump bill. people are frustrated with the fact that the rule of law has been cast to the curb. what you think went on within the ranks of the fbi. it feels like someone is leaking information.

i don't even know who they are. but typically they are people with a lot of people mixed in there. i think the lower level rank-and-file are just. about the fact that they have not been able to do their job. it's not political. the fbi is never political. i've been there for 28 years. i never heard anything about politics or groups that supported this or that. it's like everybody else in the population. they keep that to themselves. they're not doing things for political reasons. they're doing things to protect people in the united states of america. is that the investigator's fault. it's the people that are high-level in both the justice department and the fbi. to make one current agent told them that the fbi's trump land that there's a lot of agents that are for trump and they were comfortable with the fact

that they were being pressured not to do the investigation. i think they're they are looking at the so-called investigation and they're looking at the stuff that wasn't even there. the violation of the federal records act it all starts on the table there. special access programs. back in world war ii they lined you up with a firing squad for that type of stuff. that is the most sensitive thing in the united states. it could involve identities of agents overseas. i could be it could be all kinds of stuff. now it's probably russia and china. they probably have all of the

stuff. because they apparently said that there's a 99% chance that five foreign governments hacked her server. a lot of these countries you can buy someinor alrithms. she has a thing in the wide open. he said something earlier that i also saw and was outraged by. they only gave 6% of the revenue to the places where there was need. so where did the other 904% go. >> on the whole clinton family cabal is on the payroll there. >> you don't see that in the media at all by the way. if they drop below 50%.

>> do you think donald trump will surround himself with the right people in terms of national security should he write -- win the presidency quacks. >> he's can bring other smart people. he will bring people like rudy giuliani and a homeland security or the justice department or something like that. have bring some great people into the treasury. that's why he is so successful because he surrounds himself with very good people. they're they are willing to take a risk on the unknown. they want an end to the corruption. >> he's more concerned with what is good for the united states of america our culture they had been neglected for decades. as an outreach. look what goes on in chicago. you can't count them on your

indecisive. >> steven is never surprised. >> there you go. >> so on minimum wage, it is interesting i was just in seattle this week maria as you probably know, seattle has one of the highest minimum wages in the country just implemented that about a year ago evidence coming in from university of washington that indicates just as economists would have thought governor -- the impact of this has been that there has been a reduction of hiring, and a lot of young people have been priced out of the with every i am against raising minimum wage especially nationally, because it is one thing to say raise minimum wage in california, it is another thing to have that same wage, in a state like governor like arkansas mississippi where costs are much lower, so i think it i think the people are going to be most adversely

affected by increases in minimum wage going to be young workers especially teens continue to may be justify 10, 11, 12 dollar an hour wage. >> trump said he wants to leave minimum wage to the states. >>. >> i agree with that, i think look arizona wants to raise minimum wage i don't think a very good idea but that is the right of the people, that state, but, as i said earlier, you know some states have a lot higher comforts, and different labor market situation than others who, they have a national average, is going to hurt the poorer states don't you think governor. >> yeah i do steve i think the republicans need to change the rhetoric on that rather than arguing over minineed to say why fighting over lowest let's talk about a maximum wage. >> i agree. >> how do you get to maximum wage you get educated you get prepared for a job, if you don't like one that base 9 bucks an hour hey well there is 40 bucks an hour how do you get trained to be a wholesalered get you into that. >> you are exactly right about that that is the really the key, issue, in this whole

election i would say not about the minimum wage it is about the median wage in this country you look at stats the census bureau came out with maria you looked at this is numbers now 15 years, you go back to something like, the year 2002 since the average american worker got a pay raise when you add to that that higher costs of obamacare when comes out of the bottom line of workers, workers are doing worse that i than before not the minimum wage that average wage. >> that is great analysis that is why you are looking at wages in this reported coming out this morning. >> absolutely wages probably one of the key indicators, because we did see that consumer spending also wasn't as strong, when you look at you know the overall job market i would say wages are starting to move in certain sectors, health care has been very strong, even seen it in truck drivers, those we just have not seen the growth

for october, and the expectations call for jobs of 175,000, for the last month, expecting unemployment rate have to tick down, to 4.9% this is the last major report before the election guys, we are going to get to peter barnes the number live as soon as hits tape in washington now. >>. reporter: 161,000 new jobs in october. maria 161,000 new nonfarm payroll jobs the last jobs' report before election, a bit below economists expectations, for 175,000 jobs, in october, the unemployment rate did tick back down to 4.9% from 5%, in september previous jobs numbers for august and september were revised up by a total of 44,000 new jobs, workers got a nice bufrn in pay october average hourly wages up 10 cents an hour 0.4% to 25.92 an hour, back to you. maria: peter thank you so

much, the numbers below expectations, we were expecting 175,000 steve but look what we got, we actually got a weaker than expected number even though people were expecting a pretty good number ahead of there ex. >> maria not only always interesting to find out where economy is heading especially with election people wondering what kind of economy do we want forward more of the same or something new last time four years ago good numbers criminal impacted positively for president obama didn't. >> it sure did because you did get a sense that maybe there was promise things would turn around the bottom line when you look at two candidates, when approach will be better, as it relates to economic growth and jobs, we know donald trump wants to lower taxes he wants to roll back regulations, we know that hillary clinton wants to raise taxes wants to raise wages. this is what voters are thinking about as they head to the polls as we see number underwhelming. >> will is make a difference come tuesday. >> it is very close, to you know, the election, so you

every year except for one year when ross perot ran stock market down 90 days going into election i think jobs' report on the thing people don't know numbers but feel them live them don't have to be economists but understand this what we see the just makes official what main street knows. >> i want to make a point, because you know, i work with hundreds of companies across the u.s. and they do have jobs, and they want to hire. we still have a challenge with labor participation. there are people that don't want to participate in the economy charles we've talked about this before. maria: given up. >> we have more people on food stamps in this country than ever before. we have more people on social assistance programs. i am disappointed that we have only created 161,000 jobs, but we have some other issues, that really need to be fixed, as people back in -- essentially. >> -- crunch numbers for example if you are a single

mom with children you effectively could get to the tune of 60,000 dollars benefits so in other words, between food stamps between the -- various form of welfare you are talking about money that is -- if you were to go out -- >> as -- as telephone operator assistant you know i don't know if you would get 60,000 guess what you are going to be gone if your kids all day. >> -- people are in some cases to your point making choices that are based on frankly perverse incentives that we are setting up. >> peter barnes, broke the news at the about whom of the hour about the 161,000 jobs created below expectations, peter what else do you have? >> well, a couple other things, 142000 of those private sector so 19,000 government about split between the federal government and state and local governments, private sector job a creation not as strong as expected,

also, labor force participation rate you were talking about did tick back down in october to 62.8% because labor force shrank about 200,000 people we have seen this bounce around in months but stuck at excise 40-year lows since coming out of the out of the great recession, one piece of good news, u6 of a largest measure of the job market total unemployed marginally troochd to workforce people part time fell to 9.5% in october lowest level since april 2008, is to -- go ahead. maria: dagen was looking at wages do you want to give your color on wages there peter, because obviously -- over the last year, you look at wages having moved up 2.6% but month over month, 3/10 of a percent what are you seeing. >> so it was up 4/10 of a percent in october made year over year increase go up

slightly to 2.8%, that is not you know, it is not the 3 to 4% that we like to see, in a really healthy economy but it is not the 2% that we saw you know few years ago so it is getting better, but it is not it is not where janet yellen for example would like it to be. >> creeping up dagen. dagen: 2.8% nice tiekup at 2.6% month of september 2.8%, question, of course, is lasting or is it momentary, peter is there anything in the release i am reading it, about in terms of why the top line number missed about the hurricane? there was some expectation that there would be 10,000 jobs weren't counted. >> yes, so there is a -- there is a question that the -- the labor department asked about bad weather the hurricane in one survey 238,000 people said that they still had a job

couldn't go to work because of the bad weather. in the -- in the payroll survey, 161,000 number we did see for example retail retailers shed 1,000 jobs were up 22000 september we saw very little growth in leisure hospitality, construction was up 11,000 but up 23,000 in september, so in some of the payroll numbers, you can see where hurricane might have prevented employers from hiring people in certain sectors, knowing the hurricane was coming. >> good you mentioned construction an area we have been seeing jobs moving up market reaction is interesting charles payne, down and worsened after this report what is this telling you -- >> i have been saying a long time particularly valuations are the market really does need good news to be good news you can talk about fed all you want listen, in japan, they have negative rates, the nikkei getting smoked. maria: smoked.

>> europe, has trillions of dollars negative rates markets getting smoked, so there is this so much that central bankers can do at this particular point, with valuations over market is right now you have to have better economic data to justify at these levels for the most part. >> earnings o off a traction third quarter really good news -- >> -- right the year over year declines in earnings, that goes back to the 2014, so you know again this is all sort of stuff we used to rely on, to we could see green chutes, this far so-called recovery we should have oak trees. >> that is blast from the past. >> jack how do you see it market reaction negative. >> i don't think that frankly this is a big enough number to make the market think anything has really changed, so, for instance, the market thinks hik december, this is not a bad enough number, to make us say

wait a minute they are not going to move nor great enough to say definitely going to move you know one reality is in the hour after the comey news came out that he was looking at anthony weiner's laptop the market lost the 1%, has been down every day since then. i think this -- this is not quite election moving number but probably confirms the trend which is trump closing in on hillary the market sees that in the short term that is not a positive for the market it is uncertainty market doesn't like it long term might be great short term not positive. >> maria this is so fascinating to watch, because -- jack is absolutely right we have seen market start to decline as polls narrow odd what that thelz you investors are worried, they are worried because donald trump is unpresentabu ununpredickble. >> if hillary rodham clinton goes in there assuming doesn't take senate doesn't take house

you get what you have. maria: gridlock. >> janet yellen to continue acting aggressively you have warnings charles on japan europe but, nonetheless, servers thinking staystive -- >> another thing investors are worried about if donald trump declares war on companies like ford, or -- >> carrier, or -- >> essentially you are saying we know ultimately earnings move markets if you are saying you can't lower your costs, because you know, where ford wants to build that plant in mexico 12 other automakers there, 8 hundred million dollars plants to build, they saw that in america, two or three grabbed less than ford, ford doesn't silt doesn't make money. >> put that to steve moore he is with us, steve you hearing the conversation? >> i am hearing it and just. >> what do you have to say to charles. >> we talked about -- >> investment, wall street

perspective beyond the status quo, you know corporate earnings or listen, i think corporate earnings is having problemsonet candidate obviously the core of donald trump's economic plan fewer regulations lower taxes that is music to the ears of investors. >> should it be. >> carrier other companies they would rather see carrot rather than stick. >> i don't o that is part of the story here, but i think the bigger part of the story is that wall street i know i think trish nailed it, wall street doesn't want change, i went back looked what happened to the stock market when ronald reagan was -- i am not saying donald trump is ronald reagan but rein rein a change agent same way donald trump a change agent, at first the markets didn't like it very much, look what happened, in the year after ronald reagan was elected stock market fell then once policies went into play maria we saw biggest boom in the stock market you ever saw i think this is mostly just fear of anything -- that is going to change, now i want

to say something about this report. you know. i am looking at these numbers where the jobs are being created because we haven't talked about that yet. and again, what we are seeing is no pickup in manufacturing, no pickup in construction jobs did you know we have lost at a million and 1/2 manufacturing jobs in the last 8 years, those see trish i think this gets to the heart of the matter what you were saying we are not creating the middle class colombians affecting pennsylvania, ohio rockford illinois places i have gone with donald trump they are not feeling love because those joebs there aren't that you can raise middle class family with. >> this is what needs to be fixed, somehow, we have increasingly gotten away from valuing labor in this economy and that is in part because of these structuring changing more technological economy you can't leave all these people behind you still need to find a way to he he incentivize
