in the news this friday morning, oakland police nab two would-be burglars trying to break into an illegal pot growing operation tossing plants out of the window. >> today could be the day where hundreds of same sex couples could get married. i'm theresa garcia live in san francisco. there's been a temporary stay for the last two days since prop 8 was overturned. what the judge may decide moving forward. >> good morning. not only a generous stack of low clouds and fog but mist and drizzle keeping our numbers cool again today. for the weekend? stay tuned. >> all right. here's a live shot of the bay bridge toll plaza. no delays right now. there were a few very early morning accidents but i don't think those people were heading into work. hopefully a quieter compute. >> slugger barry bonds heads back to federal court.

a judge is expected to decide when bonds will go on trial on perjury charges. it's 5:00. tgif! thanks for joining us. i'm kristen sze. >> i'm eric thomas. developing news out of oakland. police are investigating a big illegal marijuana growing operation after they arrested two burglary suspects this morning trying to steal pot from the site. it started just after midnight when police went to a restaurant on east 12th street on reports of a burglary. when officers arrived they found two people throwing bags of marijuana out of the second floor window. the site above the restaurant was apparently housing a large pot growing operation. they've arrested two and are confiscating what they say are 100 pot plants along with the equipment used to grow it. >> county clerks throughout the bay area are preparing for a potential flood of applicants for marriage licenses from same sex couples. the federal judge who overturned prop 8 this week could decide as early as today whether to lift a

stay that's keeping the ban in place for now. theresa garcia is live at san francisco city hall. theresa? >> kristen, if and when the stay is lifted city hall in san francisco along with many other bay area county clerk's offices will be a busy place with same sex couples filing for their marriage licenses ♪ going to the chapel and we're going to get married. ♪ >> well, this couple tried applying for licenses in san francisco as soon as the ruling came down wednesday in favor of same sex marriages but they weren't able to because of that stay put in place. even though u.s. district judge vaughan walker ruling overturned prop 8, that's the 2008 voter approved state ban on gay marriage, he also decided to issue a temporary stay and this would prevent same sex marriages while the appeal of prop 8 is pending. one concern is any new marriages could be overturned if a higher court reinstates prop 8.

today is the deadline to submit written arguments whether the ban should remain in place until all the appeals in the case are exhausted. some legal analysts believe judge walker will lift the stay order. >> he is inclined to look at this and say a stay isn't protecting anyone because there's no harm if we let same sex couples start getting married. he may not be disposed to grant the defendant's request. >> to deal with the influx of couples wanting to get married county clerk's offices have been preparing to issue a load of licenses. in san francisco they pleaded for volunteers to help if and when the time comes. if the judge lifts the stay the backers say they're going to ask the appeals court or u.s. supreme court for an emergency stay. now, a decision could come as early as today but many think it probably won't until next week. live in san francisco theresa garcia, abc 7 news. >> theresa thank you. a judge will set a new trial date for former slugger barry

bonds in the perjury case against him after prosecutors lost an appeal that keeps them from using key pieces of evidence against bonds. bonds faces ten counts of false statements and one count of obstructing justice. the testimony went to a grand jury investigating steroids linked to the lab back in 2003. >> many preschool programs in the east bay face the chopping block with no state budget in sight. governor schwarzenegger continues to talk budget cuts and that could threaten prekindergarten and afterschool programs across oakland and berkeley. >> a familiar rallying cry filled the berkley unified school district yard. those here are struggling. >> we wanna make sure we have a fair budget. >> right now there is no state budget and the cuts to prekindergarten and napa school programs the governor is proposing are sending panic through bay area school

districts. >> our total budget for those programs is about $5 billion. this cut is over $3.5 million. >> where does that leave you? >> leaves us desperate frankly. >> berkeley, hayward oakland. they're all trying to save child care. seven oakland child care centers were slated to close last month but got a last-minute reprieve. those centers and all of berkeley unified are now due to shut down august 31st. >> we're low income. i got hit with furloughs last year working for u.c. berkeley and now to have the child care go, it would be hard for us to survive. >> not only myself but all my teaching staff could all lose their jobs. >> the berkeley closures would mean 100 layoffs. >> no income stay home. >> and 650 fewer children in school. parents wrote letters to the governor hoping to change his mind. but for paula butler the impact is devastating. she's a teacher and her daughter is in the afterschool program.

>> i won't have a summer job. i won't have a place to go to work at and then i won't have child care for my daughter during the year. it's really bad. we really need to get this budget passed. >> the state's budget conference committee voted to save child care. their recommendations could go before the assembly as early as next week. in berkeley, lisa amin gulezian. >> word from washington might help save jobs of police firefighters and teachers. the u.s. senate has cleared the way for billions of dollars in emergency aid to local government. the $26 billion measure earmarks $10 billion to schools. san francisco unified school districts expects to use its share of the money to rehire some of its 300 laid off teachers and employees. but first it will cancel four planned furlough days. >> first we would want to bring back those four days half been cut which means having the funding to reinstate the pay for all of those teachers who have had to take four furlough days.

>> the bill also provides another $16 billion to help save other public service jobs. san jose says it probably won't be able to rehire firefighters or reopen closed stations. oakland does not expect to reinstate the police officers it's been forced to let go. the bill now goes to the house for approval. >> a new report from san francisco's department of human resources shows police officers and firefighters are among the highest paid in the state. according to the san francisco examiner the minimum pay for a police officer is now more than $82,000 a year. that's tops in california at 26% higher than the state average. a city firefighter's pay starts at $73,000 a year and that's 30% higher than the state average. they say they're in line with the city's cost of living among the highest in the nation. if you add benefits like healthcare and pensions, the pay of san francisco's police officers is just average compared to other bay area

68 in san rafael, low 70s on the peninsula. 10 degrees below the average. san jose only 75 instead of that 85. that steady sea breeze allowing for that thick deck of low clouds and fog. little change in the next several days. here's frances with an update. >> quite a few accidents this morning. this new one came in northbound 101 at the freitas parkway. there's a live shot of this right now. looks like it's a motorcycle crash off to the shoulder here. you can see some activity there. and northbound traffic is light. now, most people are heading in the southbound direction. so far southbound traffic is still looking great out of novato all the way to the golden gate bridge. we'll keep an eye on that northbound accident to see if it causes delays. actually i think i see more emergency crews heading towards the scene. we'll keep you posted on this. let's head to the golden gate bridge where we see traffic flowing well into san francisco. if you're heading across the san

demonstrating the legitimate nondiscriminatory reasons why mr. reid was let go. >> trading in a light range before the labor department releases its month employment report in the next half hour. economists expect the unemployment rate in june to rise slightly to 9.6% to 9.5. with the rest of the morning's "moneyscope" news. >> fannie mae is requesting an additional $1.5 billion in federal aid. the mortgage giant lost $1.2 billion in the second quarter of this year. that is its smallest one quarter loss in three years. fannie mae says its recent loans are lower delishsy rates than in the decade. >> a crisis in russia means americans could be paying more for bread. they're temporarily ending wheat exports after a drought destroyed 20% of its crop. the announcement set up wheat prices in the commodities market. overseas demand is likely to

keep driving prices even higher. >> crayola is putting a little sunshine into its colors. it has completed a 15 acre solar farm behind its headquarters in even pennsylvania. the facility should produce enough energy to pilot one-third of its production. they make 3 billion crayons a year. >> 5:16 now. there's good news for the i-phone 4. a survey conducted by change wave research found 72% of the 213 users in question are very satisfied with their i-phone 4's. 21% said they were somewhat satisfied. the satisfaction rate is not as big as it was for the i-phone 3 g when it launched last summer. 82% of users said they were satisfied with it. the i-4 had been plagued with antenna problems. >> the like in a day project is a huge success. the online video giant said it received 80,000 entries by last

temperatures ranging from the low 50s in the north bay and napa. 62 novato, san francisco with upper 50s down by san jose. and the clouds have moved into the concord and livermore area. so they're very widespread this morning. we will look at that mist and drizzle along the peninsula, the north bay san francisco. you need the wipers and the jacket this morning for sure. coast won't clear. temperatures in the 50s. mild numbers in inland valleys with some 80s. don't think you'll need the air. it was cooler than average numbers continuing over the weekend. the middle of next week but by the end of next week, a new forecast model suggesting, hinting at a warm-up. wouldn't that be nice. high temperatures today across the state. we're dry and we're mild with low 80s in the sierra novato. the heat a little in fresno but even sacramento cool for valley standards. 88 there. 62 monterey. look for late afternoon sun

there. our clearing today well it should be around 10:00 around the bay. once again 60s and 70s there. we will look at high temperatures then only in the mid-70s. no changes really from san jose, palo alto mountain view. low 70s, 72. 57 pacifica the sunset district a gray cool day. petaluma only 6 san rafael. you tide a record yesterday in oakland. a couple degrees warmer for you but still on the chilly side at 65. 77 dublin walnut creek with 64 watsonville and our look ahead no real warmth yet. you have to head well inland. frances has details on road work this morning. >> at least it's still pretty cool on the roads now. not a lot of slow spots even though we've had a few accidents this morning. but you always find delays overnight through the half moon bay bay area, highway 92 where we've had one-way traffic control usually from 10 p.m. to 6:00. a few more nights that we have

good morning, everyone. about 5:24 on the abc 7 morning news a friday morning. once again cloud cover and some mist. you might have the to tap the wipers once or twice. interstate 680 in the walnut creek area. taillights heading southbound and traffic starting to pick up in terms of volume. frances keeping track of things. >> it was like something out of a monster truck show except it was an s.u.v. climbing over a cop car. police released video of this high-speed chase that came to a dramatic ends in rockville, maryland. the officer was chasing an s.u.v. when he trapped it on a one-lane bridge. he knew the driver couldn't get out and run but he didn't expect what came next. >> first i thought this is great. the driver's side door is pinned on the car and the passenger side pinned on the bridge. can't get out, can't even run.

next i see the reverse. this is good. and it came at me. at first i thought if it hit me, it would hit me. i didn't think it would drive over me like big foot. >> well, it did. pulled into reverse and tried to run into the squad car. he saw it coming and ducked down as low as possible in his squad car. the three teenagers in the car have been charged with stealing the car and marijuana possession. >> looks like he's okay though. one of the greatest 49ers of all times, jerry rice will join the game's pro football hall of fame in canton, ohio. won three super bowls during the glor years in the early '90s. held career and receiving records including the most yards ever more than 22,000. former teammate dwight clark lined up with rice for three seasons. >> he's san unbelievable competitor. he competes with himself.

35. the plane was built in 1951. the plane crashed in the raul lings pass area after taking off from boulder on wednesday. nobody on the ground was hurt. >> san francisco's trans bay terminal will close at midnight. outreach workers hope to persuade the last few homeless people to leave the doomed building for shelterers. social workers made their rounds last night in and around the building. s terminal served commuters since the 1930s. one man gladly left for a shelter while another prefers living on the streets. >> as far as not wanting to to leave? i don't know why anybody would want to leave. >> you got your freedom. that's what i really care about. you know, i mean i come and go when i want. wake up when i want. play my make, you know when i want. >> several transit agencies will relocate from the current terminal to a temporary one located at main and howard.

the eventual plan is a facility that can serve buses, cal tran and eventually high-speed rail. >> two vallejo residents are under arrest in connection with the arson at the solano county courthouse in june. the fire was started with a molotov cocktail. flames badly damaged the building and destroyed thousands of files. a 40-year-old and 31-year-old are held on $100,000 bail. nearly 50 gang members are off the streets this morning following a massive sweep by state parole agents. 100 law enforcement officers raided several locations in the east bay yesterday. 20 of the people arrested were wearing gps ankle bracelets. the tracking devices helped those suspects to tie those suspects to new crimes.

commuters have been waiting to hear. contractors plan to start digging out the fourth bore of the caldecott tunnel deep below the oakland berkeley hills on monday. engineers will fire up a giant digging machine like this one called a road header. meanwhile a machine will work its way eastward from the oakland side. those machines feed tons of dirt and rocks on the conveyor belt. trucks deliver that material to landfill sites. cal tran expects to open the fourth bore in 2013. >> california's high-speed rail authority released its most detailed construction plan yet and some bay area residents want officials to go back to the drawing board. engineers plan to build much of the line between san francisco and san jose either at grade level alongside cal train's tracks or on elevated structures that resemble three-way overpasses. people in several communities prefer sinking the tracks into open trenches and tunnels. less noise but higher costs. the state's only come up with

>> u.c. berkeley economists could see roamer resigning as a key adviser for president obama to return to teaching. roamer heads the president's council of economic advisers. she's been one of the administration's most prominent voices on the economy but reports roamer has been frustrated by her lack of access to the president. roamer plans to return to cal when she steps down next month. jerry brown and meg whitman have tentatively agreed to a forth debate a month before the november election. it will be carried on kgo radio. it's schedule to take place on the ron owens program which airs from 9:00 to noon. the candidates have agreed to debate at u.c. davis and dominican university in san rafael. whitman and brown have been add odds over the number of times they'll debate before the election. former hotdog eating king kobayasi will spends the next six months on probation for
