morning. i'll have an update on one in hayward coming off the san mateo bridge 92. >> it is 6:01 this tuesday morning. thank you for joining us. i'm eric thomas. >> i'm kristen sze. today county supervisors in the east bay and south bay will begin considering legislation that will force pitbull owners in their communities to have pets spayed or neutered. both triggered by the mauling death of a two-year-old concord boy. theresa garcia is live in our san jose bureau with more. >> this morning the board of supervisors of both santa clara and contra costa county will consider this pit-bull related ordinance and could be shaped from a 2006 san francisco law that followed the mauling death of a 12-year-old boy there. this morning the counties will be considering this new law that's being proposed, and it would require all pitbull type dogs in the unincorporated areas to be spayed or neutered. the hope is the mandatory requirement would reduce overbreeding of pitbull and pit

mix dogs plus reduce possible aggressive behavior. there are opponents and what they're saying targeting specific breeds is an infective solution and dog training and owner education is what's needed. steven is the step grandfather of the two year sold concord boy killed by three of his pitbulls in july. in a jailhouse interview last month, he said he has seen aggressive behavior in his dogs but never thought they would attack his family. he's changed his opinion of pitbulls. proponents believe it will reduce the number of neglected pitbulls. it's unclear what the violators would face. a ticket to get the spaying or neutering done or even a fine. in the bay area, there are ordinances requiring pitbulls to be spayed or neutered. in san francisco and also sonoma counties, also the city of gilroy and four other cities in the state of california. theresa garcia, abc 7 news.

>> theresa, thank you very much. we continue to follow breaking news in alameda where fire crews are battling a pier fire at alameda's marina. this is an old, possibly abandoned pier. no other structures are threatened and nobody has been hurt. crews are warning it may take a while to get that fire under control and they've asked for san francisco's fire boat to help put it out. today marks the one-year anniversary of the baffling disappearance of a six year sold fremont boy. both police and the community will take action to make sure the public hasn't forgotten about hasanni campbell. terry mcsweeney is live in oakland's rock ridge neighborhood where hasanni's foster parents say they saw him last. terry? >> sadly it's going to be a homicide investigator meeting with the media today to talk about any new developments in the disappearance of six-year-old hasanni campbell of fremont. but for police in oakland it is no mystery. police think they know what happened to the boy.

they think that he was killed probably closer to fremont before he was ever reported missing. from the time his foster father lewis ross reported him missing from a shoe store on college avenue, police were suspicious. the child hadn't been seen in public for four days. ross then proceeded to fail a polygraph and found e-mails where roles threatened to abandon a boy at a bart station. one member of the citizens for the loss society said ross became a suspect in her mind last december. >> 2009 when our volunteers were in the neighborhood putting up fliers and lewis ross went to the bedroom window and told them to get the hell away from his property. and an innocent person wouldn't do that. i think that was the turning point for everybody. >> ross and a foster mom who's also the boy's aunt, jennifer campbell, were both arrested for hasanni's murder but released a few days later because of lack

of evidence. they have since moved out of state and separated. today the investigators are meeting with the media and members of the lost society meeting with the district attorney. there's also going to be a potluck dinner. there's also going to be a prayer vigil. all this to get hasanni campbell's picture on the news, get people thinking about the boy. did they see him sometime last year, have they seen him since through some miracle. as far as police are concerned this is a homicide investigation and the case right now is cold. live in oakland, terry mcsweeney, abc 7 news. >> terry, thank you. it's 6:05. a san francisco teenager faces a murder charge in the shooting death of a german tourist near union square. san francisco police arrested phillip stewart yesterday. he's accused in the death of a 50-year-old elementary school principal visiting from germany. two other people were injured when a group of teenagers had an altercation and began shooting a block from union square. the dead victim's husband left

for home yesterday. the couple had vacationed in the u.s. since mid-july. >> deep in his heart he's crushed. after being with someone for all these years. and they come to celebrate i believe it was their 25th silver anniversary. >> police also questioned two sorry juveniles and two adults but have not yet arrested any of them. they credit several witnesses and a taxi driver who followed the suspect for helping with the arrest. they say all three shooting victims were unintended targets who just got caught in the crossfire. >> a livermore mother of three accused of something sex with two 14-year-old boys is due back in court next monday to enter a plea. this morning we're learning new details about 42-year-old christine hubs. hubs faces 67 counts of sexual assault for having sex with two boys starting in 2008 when the boys were 13. newly released police documents say the relationship with one of the boys began when she came on to him while he was dating her 14-year-old daughter. during her first court

appearance yesterday, her defense attorney asked for a week to look over the evidence before entering a plea. many of her friends came to court to show their support. >> shocked. i am just shocked. and devastated for her family. >> the christine that my husz and i know and have known for years and years is a loving mother who is still hard to believe this is even happening. i would say don't jump to conclusions until you know everything. >> police arrested hubs last week after nude pictures of her were found on the cellphone of one of the alleged victims. she's currently being held on more than $4 million bail. >> oracle chief larry ellison is blasting fellow silicon valley giant h. p.'s decision to fire their ceo mark hurd. hurd was force the out last friday because of falsified reports he turned in following dinners with event planner jody fisher. he calls the ousting cowardly and the worst decision since apple fired steve jobs 25 years

sunday. that's mainly away from the coast. when we peak on sunday we should be low 90s inland, mid-70s around the bay and 60 at the coast. frances. >> a close call for altamont pass commuters. there's an injury accident westbound 580 north livermore avenue. a real bad spot. apparently they just cleared it from the left lane. so all lanes now open. so that was great news. in fact, the drive time now from 205 to 680 is 25 minutes. as you make your way through the sunol grade, southbound 680 looking good from 580 to 101. less than a half hour but a new crash reported in the south bay. it's on the capitol expressway on-ramp. look out for that. minor slowing in antioch, westbound 4. lone tree to loveridge and the entire way to 242, 17 minutes. if you want to take mass transit, reporting no delays. let's go outside and check out the live camera shots for you. westbound 80, looks a little

big effort to remind everybody hasanni campbell is still missing. following the report of his disappearance, a big push to find him. 10,000 fliers, his pictures on t-shirts. but from the beginning police were not buying the story by foster dad lewis ross that the child was kidnapped from his car at rock ridge. ross and the child's aunt and foster mom jennifer campbell were in fact arrested for murder, held for a few dales but the d.a. looked at the evidence and said it's not enough to get a conviction. over the months, interest in the case has waned but a leader for the group citizens for the lost society says her search will never end. >> i made a promise to lewis ross and jennifer campbell i will not stop until hasanni is found. and i meant that. i won't stop until he's found. if that means both of them go to prison or turns out that they're not involved, i still won't stop. >> well, today citizens for the lost society are going to meet

with the alameda county district attorney to find out where exactly the investigation stands. also going to be a rally, a dinner, a vigil. all of this to put hasanni campbell's picture back on the tv screen or back in the newspapers, get people thinking about campbell reported missing for one year. police believe the child was murdered by his foster father who did fail a polygraph exam and did send compromising e-mails to the foster mother about abandoning the child at a bart station. in any event, the effort today to get you thinking about missing hasanni campbell. terry mcsweeney, abc 7 news. >> thanks a lot. we're following breaking news from alaska where officials say former u.s. senator ted stevens may be among the people on board a small plane that crashed in a remote area yesterday. rescue crews still haven't been able to reach the area. the plane was spotted by a passing aircraft last night. a national spokesman say there

were eight or nine people on board and possible fatalities. ted stevens was indicted by grand jury in 2008 on ethics violations before losing re-election. a san francisco man faces a murder charge for the shooting death of a german tourist near union square sunday night. two other people were injured when police say a group of teens had an altercation and began shooting. alan wong reports. >> the husband of murder victim shore left the king george hotel around 7:00 and flew back to share home in germany. >> deep in his heart he's crushed. after being with someone for all these years and they come to celebrate i believe it was the 25th silver anniversary. >> around 9:00 sunday night a hail of bullets was fired just a half block away from the couple's hotel at mason and gary

street. a private party was being held for teenagers between 13 and 17 years of age. surveillance cameras captured people running for cover. >> there was another man over here that i saw. he had gotten like glanced in the neck. he was bleeding. >> police say it was a 15 year sold boy and a 19-year-old woman wounded. but the 50-year-old tourist and elementary school principal was hit in the head and died at the scene. ♪ the owner of biscuits and blues across the street from the shooting believes the suspects were waiting in front of his establishment. >> they were young teenagers. and they are like for some reason they are outside our door. >> police say they recovered a gun, detained five teenager suspects and arrested an 18-year-old san francisco man, phillip stewart. >> back here where the party was held at the native sons building, we're told there was security here and ironically the party promoter says she held

these events so teens would have a safe place to socialize. the german couple had been traveling through the u.s. since mid-july and we're told they had plans to return to germany this saturday. reporting in san francisco, alan wong, abc 7 news. >> it's 6:35 now. furlough fridays for state workers will not begin this week as planned after an alameda judge blocked them. judge steven brick says the order is inconsistent with state law. it will force workers to take three days off until a budget is passed. the second furlough ordered by the governor since last year. >> as long as it fails to produce a budget and we're facing iou's, unfortunately we have no choice but to do the furloughs so we can cut back on spending just like every california family and business is doing. >> the governor's office will appeal the ruling hoping to lift the restraining order in time to have furlough fridays resume

this week. oakland police officers have now approved a deal that could save the jobs of as many as 200 cops. they have agreed to pay 9% into their pension plans by 2013 and work longer before they can retire. the three-year deal gives the city council the green light to place a $620 parcel member on the november ballot. the city would rehire 80 officers let go next month. if the measure fails, the deal falls apart and 120 additional officers could be laid off in january. >> 6:36. the contra costa board of supervisors voting on a smoking ban. it would expand to include a ban on smoking inside all new apartments and condos with four or more units built after january 1st. the ordinance would also ban smoking in carports, outdoor balconies, porches, decks and patios in those housing units. >> san francisco's moving forward with plans to ban bottled water or at least classic water bottles,

single-use bottles at public events. the problem is too many plastic bottles winding up in the trash instead of being recycled. an effort to get people to bring their own containers and just fill them up at public events. the environment looking for ways to implement the idea that not everybody thinks is necessary. >> tickets could say bring your own bottle. when you go online to buy tickets, there could be all kinds of information online about what to expect when you get to the event. >> too unusual, too quirky. it's unnecessary. >> promoters of bring your own bottles, the concept successful with sporting events of 3,000 participants. >> san francisco police officers teaming up to crack down on fare cheaters. the san francisco examiner reports teams of fare inspectors will stop muni vehicles and demand passengers show proof of

payment. violators without a transit receipt or fast pass face a $75 fine. fare evaders cost the system $19 million a year in lost revenue. >> highway patrol and police across the state will be specifically targeting drivers using their cellphones without a hands-free device. california made it illegal to talk while driving two years ago. remains one of the most ignored laws in the state with an estimated half a million citations issued since the law went into effect. cellphone use was a factor in at least 1200 accidents during that time. they resulted in 16 fatalities and more than 850 injuries. penalties are likely to double to $250 in january under legislation expected to be signed into law. >> no need to pick up that cellphone. we've got your 411 on the weather forecast right here. >> we're going to 411 our way over to where mike is. >> i'll be your app for the morning hours.

a bill aimed at saving hundreds of thousands of teacher and public worker jobs. the senate passed a similar bill last week. republicans claim it's a payback to public employee unions that supported president obama and his presidential campaign. a leading democratic says the bill was supported by 45 governors and democrats who helped avert massive layoffs. >> investors waiting to see what the fed does today. >> our "moneyscope" report, jane, we've seen the dow off at the start of the day. >> we are, eric and kristen. there's a lot of focusing on the federal reserve. the last few meetings of the fed have been kind of uneventful. today real drama and worry about what these policymakers may do. will they take action and if so what? got a lot of data showing things slowing down and interest rates already near record slows. the fed can't do anything there. what else could they do to

stimulate things? one option is buy u.s. treasure bonds. that would release extra cash into the economy and perhaps stimulate spending. but some significant concern the fed is not going do do anything. that's one of the reasons we're here this morning. we'll get the official word from the fed at 11:15 pacific today. also a government report with expected drop in worker productivity. that's weighing on stocks. you can see we've got pretty significant losses here early in the session. the bloomberg silicon valley index also trading quite a bit lower. watch out for computer viruses. an all-time high according to santa clara-based. meantime there's a new book out cataloging high calorie, high fat meals. domino's chickel bread bowl pasta.

kfc's chicken meal with macaroni and cheese and combo meal, among the worst offenders. also some of these restaurants from pulling out low-cal alternatives as well. life on the floor of the new york stock exchange, i'm jane king. need some pepto-bismol. >> thanks a lot! >> jane, thank you very much. we'll see you later. >> thanks. >> 6:48 now. a jetblue flight attendant is in police custody after blowing his top. steven slater began arguing with a passenger at new york's jfk airport yesterday after a man grabbed a bag from an overhead compartment. the bag or the door of the overhead hit slater in the head. passengers say slater asked for an apology but then the passengers cursed at him so slater got on the p. a. system, the public address system, yelled profanities, grabbed two beers from the cart, deployed the emergency escape chute and ran off. police later arrested him at his home in queens on a charge of

above the clouds that are keeping us in the 50s this morning here on ground level. same thing around the monterey bay. it will take forever to get here. again like yesterday slightly warmer in just a few areas. coastal drizzle will develop. look for mist around the bay and higher elevations. a slow warming trend away from the coast thursday, friday, saturday and sunday. for now watching the clouds continue to push to the east through 8:00 and start that retreat out of the east bay valleys and the south bay and to a lesser extent the north bay by noon. heavy arounds the bay. by 1:00, 2:00, dominating most of the bay. head to the east bay valleys. low to mid-80s. dublin close to 79. mid to upper 60s for the northern half of the east bay shore. san leandro, castro valley, mid to upper 70s with sunshine.

los gatos and saratoga about 82, 81 degrees there. low to mid-70s for the peninsula under a mostly sunny sky. millbrae about 68. you can see the clouds along the coast today, temperatures upper 50s. a slight bit of sunshine around downtown south san francisco and sausalito. keep you in the low 60s. san rafael the upper 60s and low to mid-70s through a mostly sunny north bay valley. temperatures the upper 50s at your coast. mainly cloudy around the monterey bay. sunshine morgan hill and gilroy about 80 for you. cubs still in town, 7:15 first pitch. cloudy and cool. kind of damp at at&t park. 61 dropping to 57. all of our temperatures will be in the 50s tomorrow morning. the temperatures in the afternoon will be about the same as today. what i meant by slow warming trend, we gain about 2 degrees thursday, again friday, again saturday, again sunday. when the heat peaks we'll be in the low 90s inland over the weekend. mid-70s around the bay and low 60s at the coast.

july of last year. this past week he was found wandering the streets of new york city and identified through an implant and microchip by a local organization. jetblue offered to fly jack home free of charge. an annual tradition at the san francisco zoo this morning. the march of the penguining will take place 10 a.m.. that's when penguin chicks graduate and make their journey to penguin colony. >> nice tuxedos. recapping our top stories, pitbull owners in the east and south bay could soon be forced to spay or neuter their pets. >> theresa garcia live with details. >> good morning. prompted by the state, that two-year-old concord boy last month mauled. both santa clara and contra costa counties considering pitbull-related ordinances. both counties look for a proposal that requires all

pitbull type dogs to be spayed or neutered. similar laws already exist in sonoma county and four other cities in the state. the requirement would reduce overbreeding of pitbull and pit mix dogs plus reduce possible aggressive behavior. there are opponents saying targeting specific breeds is an infective solution. a concord boy was killed in july. he says he saw aggressive behavior in his dogs but never thought those dogs would attack the family. he's changed his opinion of the pitbulls. aside from reducing possible aggressive dog attacks, the hope of the law is it will reduce the number of unwanted and neglected pitbulls. for more on top stories, let's join terry mcsweeney live in oakland. >> it was one year ago today campbell disappeared here on

college avenue. today a big push to get this story back in the public eye but police think they know what happened. didn't buy the story of the boy's foster father ross. the boy was kidnapped from behind the store, left in a car for a short time. the child hadn't been seen in public four days before the report. ross failed a polygraph and police found e-mails very incriminating. ross and foster mom jennifer campbell were arrested, held for a few days but released for a lack of evidence. homicide investigators are going to meet with the media. there's going to be a meeting between the citizens for the lose society and alameda district attorney, a prayer vigil and a dinner. all for people in the bay area. hasanni campbell is still missing. live in oakland, terry mcsweeney, abc 7 news. >> checking another top story, firefighters battling a pier fire at alameda's fort bend marina. started at an old possibly abandoned pier on the alameda side of the oakland estuary.
