reward for leading to the arrest of the killer. a vigil last night for javan. it was held where he was killed at bancroft avenue and 61st avenue. a friend called for help because he ran out of gas. javan and his brother went to help. relatives are saying the whole thing was a setup. he died blocks from the middle school where he was a track star. his coach and friends remember. >> to see something like this happen to a young man that was so energetic, you know. in other words, he was so full of energy is just heartbreaking. >> my friends dying left and right. i just hope to god that none of my other friends are. >> comment there from a 16-year-old boy. and the backdrop of this, hours before javan was killed, the oakland police issued a statement saying the crime is up

this july compared to last july following the layoff of 80 police officers. that was for a $40 million city budget gap. a union rep says he's not saying more police equals fewer homicides. and that led to a response from city councilmen saying this is nothing more than a scare tactic. other council members piling on, other officers now commenting on this. a big war of words about the significance of those police layoffs and would it have made a difference. what it comes down to, this young man clark would have been in skyline high school for his first day of class on monday and he would have been 14 next wednesday. live in oakland, terry mcsweeney, abc 7 news. >> terry, thank you very much. it's 6:03. a 48-hour strike by trash collectors in san mateo county ends this morning. garbage is piled up at thousands of homes and businesses in san carlos, hillsdale and burlingame.

300 trash collectored with allied waste walked off to support a strike by landfill workers. workers will begin the cleanup. there's a big backlog and some people won't get their garbage picked up until sunday. >> this morning one of the bay area's bigger school districts is wading into the political debate over one of the most controversial issues on the upcoming november ballot: whether to legalize marijuana in california. theresa garcia is live at the san mateo union high school district headquarters with more why they're joining the debate. theresa? >> they're joining this debate because they worry even though legalizing pot use for adult personal use is certainly there, they're worrying about substance abuse and other problems at school. now they're taking action. this is resolution or proposition 19, resolution to oppose it. so what happened last night is the san mateo union high school district board met to discuss whether to form an official opinion about proposition 19.

that's the november ballot measure which aims to legalize adult recreational use of marijuana. at the heart of the discussion is whether it would hurt students, staff and schools. one concern if prop 19 passes, people can start growing pot inside their homes which may be near a school. but marijuana proponents don't belief growing plants for personal use will harm students. >> not something to be concerned about. it's like any other plant. it's not some kind of dangerous thing that's going to cause a problem in the enabled. >> it's a drug it's not a tomato. and there's a big difference. >> well, if prop 19 passes, anyone over 21 could legally have an ounce of pot in their possession although they cannot smoke it on campus. if a staffer brings pot to work, federal funding could be in jeopardy because it could mean a violation of the federal drug-free workplace act. trustees worry that unlike alcohol, there's no way to measure how high someone is at work. so the school movement to

politicize against prop 19 seems to be gaining momentum. >> it's 6:06. a city commission will discuss the creation of a new registry that will track legal pot growers. the oversight commit says the public health department currently has a list of medical marijuana growers but doesn't share that information with police. and that's led to confusion after police find marijuana and arrest the growers only to find out later it was a legal growing operation. >> bart has voted to spend millions in surplus funds to give riders a break on an upcoming fare increase and spruce up trains as well. the board decided to use $4.5 million in surplus money to keep ticket prices where they are until 2012.

we're hearing and bond prices slipping after a reading on economic growth came in better than expected. the commerce department lowered its estimate how much the economy grew in the second quarter but not by as much as analysts expected. the dow finished under 10,000 yesterday. may react positively. we'll see in a live report from the new york stock exchange in about 15 minutes. >> our top story this morning, oakland police saying it's going to take help from the public to find the gunman who shot and killed a 13-year-old oakland boy this week. terry mcsweeney is live at oakland police headquarters. there was an emotional vigil last night for the victim, terry. >> people left the vigil praying for the soul of 13-year-old javan clark. they say this is where they draw the line of violence here in oakland. solving the case may not be easy. take a look at the vigil that took place at the exact same spot he was shot and killed, bancroft and 61st avenue. he was on his way to help a friends who had called to say he

had run out of gas. the question is was he set up? relatives say he was and that he was robbed of the $2 he had on him by the gunman on foot. police are checking out those theories. we have to find out about the middle school track star after his death. >> javan was a cool kid. went to school. >> he ran track. in the sports festival he beat the teachers. >> in his death, a controversy erupts. now, hours before he was shot and killed, the oakland police union came out with a statistic that crime is up this july compared to last july. and the difference is 80 police officers were laid off. now they're saying that there's not else inially a connection between fewer killings and more cops, but more cops with only help. councilman came out with a comment saying this is nothing more than a scare tactic. other city council members,

other police officers all chiming in on that aspect of the controversy but what we can say for sure is that javan clark would have started his high school career, possibly been a track star over at skyline high school on monday. his birthday would have been wednesday. live in oakland, terry mcsweeney, abc 7 news. >> terry, thanks a lot. it's 6:32. a livermore man accused of possessing and distributing child pornography is under arrest. 45-year-old david gars soon was the head coach of the girl's soccer team. they found the lewd pictures on garyson's computer, the culmination of a three-month investigation. he's held at the jail. >> police are asking the public help them catch a driverwho may have run over a man in san francisco. a 52-year-old man is in critical condition. the victim was at a crosswalk at 18th street when a driver nearly hit him. the two men yelled at each other and started to fight. the driver then struck the victim and drove away.

witnesses described the car as possibly a geoor integra with a license plate that begins with 5 xm or 5 sm. anyone with information should call san francisco police. people in custody after a chase with a dramatic end. the driver of this white pickup truck took off when the police tried to pull the driver over. it hit a car. the truck ended up perched on the guy wire of a power pole. three people in the car were injured. the three people in the stolen pickup weren't hurt but were arrested at the scene. >> a cluster of fires in san jose yesterday is fueling the debate now over recent firefighter job cuts and the time it takes to respond to a blaze. a house on del monte place was destroyed and pets inside were killed during the worst of the early morning fires yesterday. crews say a gas leak contributed to its spread.

no one was hurt -- no person was hurt in that fire nor another on rockdale drive. a third fire also did a million dollars damage at a construction company. the fire just weeks after the city laid off 49 firefighters and many are now debating whether those layoffs affected response time yesterday. councilwoman is now demanding a detailed accounting of the fire response from the city manager by monday and is again criticizing mayor chuck reid's budget cuts that led to the layoffs. meantime we should get results by late today on a vote by the firefighters union that would restore those 49 lost jobs. the union is voting whether to accept a 9% pay cut and changes in their retirement benefits. if the measures pass, city officials say all 49 firefighters will be rehired. >> in emeryville, several angry residents say they'll appeal a planning commission's decision to allow swedish home furnishing giant ikea to open a warehouse a few blocks from its existing

store. last night the planning commission allowed ikea to move forward with its plan. some don't want the store to expand in their neighborhood. it will cause more traffic in their neighborhood and pose a safety risk to bicyclist and children. >> there's no way it's not going to drastically reduce our quality of life. >> we've always worked with the city. we have always acted in good faith with the city. >> the residents say the fight is not over. they plan to appeal the decision to the city council and will go to court if necessary. >> this morning federal investigators are determined one source of the salmonella that triggered a massive nationwide egg recall. fda officials say they found salmonella in chicken feed sold to the sue iowa farms that distributed the eggs. tests show the contaminated feed is one source of the outbreak but possibly not the only source. more than 550 million eggs from the farms were recalled this month after being linked to

nearly 1500 cases of salmonella poisoning nationwide. >> this morning the national transportation and safety board is investigating a jetblue flight's hard landing at sacramento international airport that left 15 passengers injured. officials say brake problems likely caused that hard landing. flight 262 from long beach blew at least two tires starting a fire while touching down yesterday. the 86 passengers and five crew members on the airbus 8320 had to escape by inflatable emergency slides. five people were taken to the hospital with minor injuries, many caused by the slides. others took it all in stride. >> we had to come down the chute. it was pretty exciting. i'm only 89 and i think it's a thrill. (laughter) >> one passenger says that during takeoff in long beach, the tires didn't feel right to him. but you know what, that lady we heard from, love her use of the word only, i'm only 89. that's great. >> that's true. it was fun for her, that's

everyone is hoping to hear. >> ben bernanke has some explaining to do. in a major address today, analysts say the head of the federal reserve needs to boost confidence in the stalled economy. new signs show a weakening housing market as wall street opens with a dow below 10,000 for the first time in two months and as the top republican in the house is calling for the president to fire his entire economic team. >> listen, this cannot continue. i've had enough. >> new unemployment report thursday showed the first decline in jobless claims in a month but investors focussed on the big picture driving the dow down 74 points over fears of a sputtering economy the white house pains to explain. still the bad news keeps coming, including a 27% drop in sales of pre-owned homes. >> at the annual fed gathering in wyoming, bernanke is expected to share his outlook on the economy and what the fed plans to do to halt the slide. so far wall street is

unimpressed. just moments ago we got word that palo alto-based h. p. has just boosted its offer for fremont base free par topping dell's latest bid. that's the fourth time those two companies have upped their bids in the last 24 hours. >> jane king is live at the new york stock exchange with more on the morning's "moneyscope" report. jane, are we back over 10,000 on the dow? >> hi, eric and kristen. we are in fact. not by much but we are above 10,000 here. a lot of the reason for this was that this report on gross domestic product. this is the broadest measure we have of the u.s. economy. it did slow down compared to what we initially thought a few months back. but economists have ratcheted it down so much and it came in a little better than what was expected. so that's boosting here this morning. and about the fear of these economic reports that came in a little better and giving us a boost. as you mentioned the fed

chairman ben bernanke will address central bangers in jackson hole, wyoming today. here's how the markets look oversaul here this morning. we are higher across the board. the dow at the moment up by 31, 32 points. at the moment the dow and the nasdaq and s & p trading a little higher. the bloomberg silicon valley index trading up slightly higher as well. the tug of war over three par continues. just about 20 minutes ago hewlett-packard raised its offer for the company to $30 a share. the total value $2 billion of that possible takeover. earlier today three par said yes to dell's increased bid of $27 a share. that by the way matched h. p.'s previous bid for the disk storage systems provider. so here's how all these stocks are moving here. certainly very interesting to watch them all this week. three par up sharply again, more than $5 higher, hewlett-packard

down slightly. the original bid of $18 a share, that came august 16th. the odds are in hewlett-packard's favor. told investors at h. p. likely to win the bidding war against dell because of its cash balance and distribution and cross-sale. stay tuned on that one. more interesting every day. i'm jane king. >> jane, thank you very much. it's 6:47. oakland officials bought time but seven day-care centers that serve low income kids are going to have to close. all part of the oakland's unified school district. served 500 preschool and elementary-aged kids. state funding ran out in august but the district scraped together $400,000 to keep the centers open this month. some parents say they won't be able to keep their jobs if the low-cost centers shut down. for the first time in nearly two months, governor schwarzenegger called in leaders from both parties for a budget meeting.

mile underground. this trapped chilean miner says he's calm because he knows he'll be rescued. he and two dozen other men trapped since august 5th. a small hole for communication. another small hole used for food, a third provides ventilation. the men have now been told it could take up to four months for rescuers to drill down to them. >> per a judge's order, cs su has released the entire contract connected to sarah palin's june speech at the school. this is the first time the entire nine-page document has been made public and follows a long battle. it lays out palin's $75,000 speaking fee, her mandate to fly first class or on a private aircraft. that's a leer 60 or larger and her requirement that the podium

13-year-old javan clark that took place last night. dozens of people turned up at bancroft and 63rd avenue, the exact spot where clark was shot in the head wednesday night. he was on his way to help a friend who called to say i've run out of gas, can you give me a hand. he was on his way with his brother when he was shot and killed. he was a track store at the middle school. he was a good student, not a gang banger. he was expected to start high school on monday. the controversy, oakland police came out with a statement before his killing saying that crime is up in oakland because of 80 officers laid off. the difference may have been the laying off of 80 police officers. some council members say stop it with the scare tactics. we don't have the money. we have a $42 million deficit and that's how we dealt with it. that controversy going on. clark would have turned 14 this coming wednesday. live in oakland, terry
