all the details coming up. >> good morning, everyone. it's a monday morning. just about 5:01 a.m.. we thank you for joining us. i'm eric thomas. >> i'm kristen sze. topping our news, the gunman accused of critically wounding a fremont police officer could be back in the bay area today to face charges. the suspected gang member was caught over the weekend trying to escape to mexico. terry mcsweeney is live at highland hospital in oakland. terry, what's the latest on the officer? >> a fremont police officer todd young is listed in critical but stable condition. improving after surgery yesterday and is expected he's going to have having more surgery later this week. officer young's wife and two children have been with him since shortly after he arrived here on friday. the man accused of shooting the father of two could be returned to the bay area as early as today. 20-year-old andrew bariontos, a suspected gang member, was going to be arrested on friday when he

allegedly shot young. again, that happened here in oakland. evenings arrested saturday and we are told he was 15 feet from the mexican border. yesterday a pretty amazing scene. an outpouring of support for officer young as people donated blood where the only blood bank open on sunday, that would be the red cross pleasant hill facility. >> it can happen anytime, anywhere, any type of a call. whether a regular traffic stop, whether it's something more -- something like a search warrant or anything. so you just don't know. >> a fellow officer talking there. she knows what she's talking about. two other arrests in this case, the man with barotos as he tried to cross into mexico and a woman arrested in union city, both accessories. the two male suspects could be back in the bay area today. barinos is being held on attempted murder. terry mcsweeney, abc 7 news. >> terry, thank you.

five red cross agencies accepting donations in officer young's name, including ones in pleasant hill, oakland, pleasanton, san jose and fremont. you'll find a list of blood centers and their addresses on our home page at abc7news.com. >> it's 5:03 now. san jose police are investigating the fatal shooting of analogy suicidal man by their own officers. police were called to a san jose apartment complex early sunday morning where a distraught man threatened to kill himself with a nail gun. after 45 minutes of trying to reach him, police forced their way into his apartment. officers say they had to shoot the man when he came at them with a 10 inch knife. a neighbor says he is stunned by the incident. >> the suspect inside the residence that has a self-inflicted wound was also armed with a 10-inch knife. he confronted the officers in a very close proximity and the officers discharged their weapon. >> police say three officers fired a total of six shots.

they are on administrative leave while the incident is being investigated. >> san jose holding a community meeting to talk about their search for a new police chief. chief rob davis is retiring at the end of october but his replacement not to be announced after that person is chosen. several community groups are calling for a more open process for a department that's come under fire for aggressive tactics. but the city manager argues confidenty is needed to protect their professional standing. >> 45-year-old david garrison was a volunteer with the liver more soccer league and was the head coach of a girl's team. they had been investigating him for three months and found dozens of lewd photos on his home computer. police say so far none of those photos appear to be of local

children. garrison is being held on $40,000 bail. >> san francisco police are investigating a suspicious fire that appears to have caused a woman to jump out a would to her death. the fire started on the 8th floor of a high rise apartment building yesterday morning. investigators say it appears to have started on a mattress. firefighters found the woman's body on the sidewalk at the scene. a second person inside the apartment was taken to the hospital with burns. he's expected to survive though. crews put out the fire before it spread to any other unit. >> crews are making progress for control of a wildfire burning in the tahoe national forest. firefighters had the 1300 acre fire 60% contained as of last night. cooler weather helped stall the fire's progress. evacuation orders were lifted for 40 homes threatened by the flames. most roads in the area have reopened. this prompted governor schwarzenegger to create a state of emergency over the weekend.

that clears the way for additional aid to the area. >> let's see if the cooler weather that helped yesterday will continue today. >> mike? >> the cooler weather will definitely. still pretty breezy and the firefighters have to deal with that. maybe one of those stray showers could come over that fire. that would be nice. good morning to you on this monday. we're staring at a warming trend especially the farther you are away from water. san jose 76 like yesterday but one degree warmer in oakland and san francisco. santa rosa about 2 degrees warmer, fremont 3 and concord the biggest jump from 77 yesterday to 81 today. about 13 hourss, 3 minutes and 36 seconds. here we are mid to upper 60s san francisco, richmond, san mateo. from oakland south we'll have low to mid-70s through the bay with mid to upper 70s in the south bay. same thing in the north bay valley, sunshine and the mid to upper 70s and the east bay valleys we'll have low to mid-80s. accu-weather seven-day forecast. we will slowly warm, especially

if convicted he can face up to 30 years in prison and a $1.5 million fine. >> doctors are seeing an alarming jump in teen athletes treated for concussion. a study shows emergency room visits by 14 to 19 year olds with concussions is have tripled from 7,000 cases in 1997 to nearly 22,000 cases in 2007. doctors say the larger numbers are due to greater awareness and intensifying of teen sports. kids with head injuries should never return to play until all symptoms are gone. the study's published online today in the journal of pediatrics. >> a survey shows economists are divided over what the government should do next to shore up the economy. the report from the national association of business exhibits find that most economists oppose another stimulus package. they are satisfied with the fed's current low interest rate policy and don't believe the bush era tax cuts should be allowed to expire. the people behind the survey say

so obviously parked. suddenly this massive crash. >> one passenger on the bus was taken to the hospital for treatment of minor injuries. the cause of the crash is still under investigation but witnesses say they saw the car run a red light before it slammed into the bus. >> spiderman, not the comic superhero, is in trouble with the law again, this time australia. police arrested the skyscraper climber after he scaled to the top of a 57 story building with his bare hands in downtown sidney. he is known for climbing some of the world's tallist and famous buildings without a rope or other equipment. many of his climbs are resulted in arrests and fines. the 48-year-old has scaled more than 70 skyscrapers around the world. >> two new movies were in a photo finish for the top spot at the box office. the last exsix had a slim lead.

earliest. meantime fremont police officer todd young is in critical but stable condition here at highland hospital. officer young underwent surgery yesterday. more surgery is anticipated for later this week. he was shot friday here in oakland while trying to arrest a man on domestic violence warrant. the man is a suspect and he was arrested saturday very close to the mexico border. a blood drive in officer young's honor yesterday brought out a lot of supporters. >> i'm here because i come from a family where there was a police officer. my cousin was killed in 1996. and i just feel like i should pay it back. >> barotos and a man with him at the time of his arrest could be back here in oakland to face charges as early as today. he's being held on no bail and faces a number of charges including attempted murder. live in oakland, terry mcsweeney, abc 7 news. >> terry, thanks a lot.

it's 5:30. a fatal police shooting capped a particularly violent weekend in san jose. three of the city's 18 homicides this year also happened this past weekend. two men were shot saturday night during a shotout in an apartment complex parking lot in west san jose and a 19-year-old woman shot to death friday night. people were called to the apartment complex early sunday morning where a distraught man was threatened to kill himself with a nail gun. after 45 minutes of trying to reach him, police forced their way into the apartment. that's when the deadly confrontation occurred. >> the suspect inside the residence that has a self-inflicted wound was also armed with a 10-inch knife. he confronted the officers in a very close proximity and the officers discharged their weapon. >> three officers fired a total of about six shots killing the man. police say the officers did have tazers but did not use them. why they chose not to use them

will be part of the follow-up investigation. >> a preliminary report by the family violence council shows domestic violence calls in san francisco increased over the past year. according to the san francisco examiner, authorities say calls to 9-1-1 are rising because emergency responders have better training to reach more victims of domestic violence and people are feeling safer about calling. a draft of the report shows 7,000 domestic violence calls were made to 9-1-1 in the fiscal year that ended in june. that's about 600 more calls than the previous year. the report also shows the district attorney's office prosecuted 25% more elder abuse cases this past year. >> elder community activists will hold a new conference to talk about plans to occupy a child care center tomorrow to protest its closure. the san jose child development centers are still set to close because they're out of state funds. the centers provide child care for dozens of low income

families. the bay area community coalition to defend affirmative action plans to hold a sit-in at the child development center and says they're trying to keep the centers open using unpaid volunteers. >> san francisco police are investigating 12 separate thefts of bare copper wire from beneath city streets over the past three weeks. the copper theft has resulted in power outages including this one at ucsf mount zion hospital last week. pg&e repaired and replaced stolen copper wires from an underground vault. police say the copper thefts take place between 2:00 and 6:00 in the morning. the suspects park next to a manhole cover, climb into the vault and cut the 1 inch thick copper wire. >> san jose a fire led police to a fourth marijuana growing operation this month. the fire was reported yesterday at the home of a 4,000 block of plainview court.

when firefighters went inside they discovered the growing operation. investigators think electrical wiring rigged by the growers sparked that fire. firefighters say pg&e service has been bypassed. four rooms in the home were dedicated to growing pot. no one was home at the time of the fire. san jose firefighters have discovered marijuana farms inside three other homes that have caught fire this month. >> time now for a look at the weather, 5:34. let's see what that cooling action is doing for us. >> definitely a little chillier this morning, mike. >> north bay valleys the biggest dropping in temperatures and feeling it around 6 and 7 degrees. temperatures at 8:00, still in the 40s in napa and santa rosa, mid to upper 40s there with low to mid-50s in most neighborhoods and 57 antioch. we'll have clouds along the east bay shore and around the monterey bay. that's where they'll be the thickest. as we look towards noon, our lunchtime temperatures are pretty mild. mid to upper 60s around the bay into the south bay and up to san

on private vehicle traffic on the eastern ends of san francisco's market street is working. the great streets project says the number of cyclists on eastbound market street is increased by more than half and pedestrian traffic is up as well. at the same time there are 46% fewer cars and muni says buses are moving faster in the area. since last fall southbound cars reaching market from 6th, 8th and 10th streets are not allowed to turn left on market and cars heading east are forced to make a right turn at those intersections to avoid the busiest stretch. >> paying to fill up the car is costing less. the national average price for regular unleaded gas is $2.70. that's down nearly 7.5 cents over the last two weeks. california's average price was $3.06. bakersfield still the cheapest averaging $3.01.
