who watched the right tv show today. >> there you can see the 12-year-old girl and 32-year-old kidnapper. >> it was nancy grace that helped crack the case of missing 12-year-old britney smith. she featured britney on her show and urge pleaded for viewers to look for her. a san francisco woman saw grace's show. and then she wept shopping near ocean beach where she spotted 32-year-old jeffrey easley and jeffrey smith. >> the person who contacted police observed a television show on cnn saying these are the people from the show. >> the two were near the grocery carts near the store and they were possibly panhandling. san francisco police took easley into custody without incident and britney is okay. her grandmother says the family is overjoyed. >> thank everybody, bless each

>> four detectives will catch a flight in the morning. they hope to interview easley and personally thank the san francisco shopper. carolyn? >> thanks, amy. a san francisco police officer shot and wounded a man who investigators say refused to stop drinking at a park and put up a fight. it happened this afternoon in garfield square. investigators say the officer approached four men about drinking in public. one scuffled with the officer who shot the man once in the lower body. that man was taken to the hospital, but his injuries are not life-threatening. the officer suffered minor injuries. attorney general eric holder is in the bay area. part of the reason he came was to reach out to the muslim community. holder addressed an organization committed to ending racial and religious profiling. now what the attorney general had to say.

>> organizers were thrilled when their invitation was accepted and by accepting holder made history. until tonight attorney general eric holder never addressed the national muslim organization, and never did his predecessors which may explain the warm reception he received from the muslim advocates. as the country's top law enforcement authority, holder defended the government's recent arrest of suspected it trusts including that of a 19-year-old oregon man who was caught in an fbi sting. he is accused of plotting to blowup portland's tree lighting ceremony. >> i make no apologies for how the fbi agents handled their work in executing the operation that lead to the ores. -- lead to the arrest. he repeatedly expressed his desire and intention to kill innocent americans. >> holder assured the crowd he was just as intent going after people who target the muslim

community. his vision is committed to pursuing hate crimes. >> there can be no us or them among americans. i believe law enforcement has an obligation to make sure members of every religious community enjoy the ability to worship and practice their faith in peace. >> for members of the crowd, those assurances are what they wanted to hear. they say the fact holder came to talk to them in person is a huge first step. >> our community has been identified by the fbi and by federal law enforcement as priority number one frankly for the last few years. it is critically important there be a conversation between the justice department and the american community on these issues. >> the attorney general spent the entire day in the bay area. holder was in san francisco where he attended a conference. live in millbrae, lilian kim, abc7 news. the confusion over state, federal and local laws

concerning medical marijuana dispense res is heating up in san jose. that's where dozens of people openly lit up tonight and city leaders insist it is off limits. lisa amin gulezian reports from the south bay. >> they are lighting up and smoking out in san jose tonight. it is a fundraiser and unity party at a medical marijuana collective. and it is all in response to a series of raids on pot clubs in santa clara county. >> we are trying to protecting every medical marijuana collective in santa clara county. they raided seven collectives yesterday. >> right now no south bay city allows medical marijuana dispense res to legally operate. >> in your mind what you are doing here is legal? >> 100% legal. >> a lot of people think things are legal that are illegal. >> there are currently 99 pot clubs in san jose and they are all illegal because the city doesn't have a zoning ordinance to allow for them. >> we need to provide more

access to more patients. that basically means san jose is completely open on monday. >> they will hold a special meeting to establish zoning regulations so pot clubs can legally open in the city until that happens this is inappropriate. >> there is a lot of haze in this picture. >> what are the odds that everyone needs their medicine at the same time? and is it a medicinal act, or are these people simply using this as an excuse to smoke marijuana? >> everyone inside the collective insists their needs are legitimate. i have fibromyalgia. and my bones are getting deformed. >> and they have the paperwork to prove it. in san jose, lisa amin

gulezian, abc7 news. the dmv clerk accused of sending a letter to a woman. the woman was placed on leave with pay back in october when the dmv started investigating. she said she was sent a letter quoting bible verses and begging her not to get a sex change after she went to the office to change her driver's license. she filed a formal complaint. a saddened to something we reported earlier this week. a 90-year-old man missing since tuesday unfortunately has been found dead. the body of robert liechtenstein was discovered this morning on a wooded path near lincoln square at oakland's redwood heights neighborhood. his family thinks he may have had a heart attack during his daily walk. the street preacher accused of cis napping elizabeth smart could face life in prison. a jury jekted the insanity defense.

he kidnapped and -- kidnapped 14-year-old smart from her home at knifepoint in 2002 and held her for nine months. she said she was kept chained and raped almost daily and forced to drink liquor and smoke pot violating key tenants of her mormon faith. she says she feels vindicated. >> it is possible to move on after something terrible has happened. >> smart plans to return to the mission in france. she left to testify at mitchell's trial. former president clinton made a surprise uh pierce at the white house to support the tax cut deal obama negotiated with republicans. they held an impromptu news conference following a private meeting in the oval office. mr. clinton said if he were president he would have made the same tax deal, and he urges fellow democrats to support it. >> i think this is a much,

much better agreement that would be reached were we to wait. i think we will have a much more positive impact on the economy. >> and while that was going on bernie sanders fought against the tax cut with a marathon speech in the senate lasting more than eight hours. >> you can call what i am doing whatever you want. you can call it a filibuster or a very long speech. it sounds like a good idea for working people. it is actually a bad idea. again, it has to be put within the broad context of what's going on in america. >> the senate is expected to approve the bill next week. but most democrats in the house are refusing to support it because it extends tax cuts for the wealthy. some unseasonably warm temperatures in our forecast. >> that's ahead. and the injured sea lion who is being treated for multiple gunshot wounds.

let's get a check of the forecast. >> sandhya patel is here with the weekend. >> and the weekend is looking beautiful. if you have plans to do any holiday shopping, it is going to be dry. let me show you a time lapse from our sfo camera. this is just about an hour ago. you can see the fog around. no delays being reported, but in some areas you may encounter delays head nooght next couple days. keep this in mind if you are heading out of sfo or actually have somebody you are picking up from there. visibility is poor where they are seeing dense fog. five-mile visibility. we definitely have some fog out there temperatures in the 50s and 60s. also cloud cover as well. a foggy night, dense in spots. a warm up for the weekend, and we are expecting lingering fog in the valleys for sunday

especially we have a few sprinkles and light showers, but it is done and over with. we are looking at a warmer weekend of high pressure that is real starting to take control of our weather. you can see by the curvature of the clouds, that the higher pressure is pushing the tomorrow track to the north. it is a dry weekend and an unseasonably mild weekend. san francisco's high by sunday, 65 degrees and the average high is 59 for this time of year. 6 degrees warmer than average. gilroy 72 degrees. this is more like spring. 61 is the normal. san jose 68 on sunday. 59 is typically what you would see in december. so 9 degrees above where you should be for this time of year. and we deserve it after all we have seen. but we will see some changes. by sunday fog is developing in the central valley, and the fog will spill over into some of our north and east bay

valleys so those areas will see them drop a few degrees in those communities. tonight fog, cloudiness and in the mid40s to the low 50s. tomorrow afternoon it is a delightful day in the south bay. look at these numbers. it is 66 in cupertino and santa clara. you are looking at mid60s. redwood city, palo alto, mountain view, daily city and down down san francisco is 63 degrees. you get up toward the north bay, and you will see the morning fog giving way to partly sunny skies. 64 in santa rosa. east bay, mid60s for castro valley, oakland. inland area 63 in pittsburgh. livermore, pleasanton, 65 degrees. around the monterey bay, 67 in santa cruz. close to 70 in hollister. 69 there.
