whether to charge a toll to drive into the city from the peninsula. this morning, san mateo county is saying two can play that game. don't know who is winner is going to be but the loser could be the drivers. terry mcsweeney is live. >> san francisco is saying it is considering putting in a toll, three dollars each way for drivers coming in and out of san mateo county. san mateo county for its part, we could do san francisco one better. according to the san jose mercury news, san francisco board of supervisors acting as the city transportation authority will be voting tomorrow on whether to study the toll plan. if it is approved by the city and state leaders, it could be in place by 2015 requiring drivers to pay $3 from entering or exiting san francisco from

6:30 to 9:30 in the morning and 3:30 to can the in the evening. but it's 1600 per year per vehicle. people are up in arms. the county is proposing a retaliation toll which would be twice of what san francisco, it would be six dollars each way. an assemblyman he would be too pleased to bring that bill to sacramento because he considers the entire topic so ridiculous. in vacaville police have ready a 14-year-old boy who they say sexually assaulted a 13-year-old girl and then stand her more than 30 times. they say he also stabbed her 18-month-old brother more than ten times. both victims are in critical condition but expected to survive. police say the suspect broke into their homes around 2:30 yesterday morning. the girl ultimately managed to

escape to a neighbor's house. when s.w.a.t. team arrived they found the suspect sleeping inside the master bedroom of the house. >> very unusual. tells me he is probably on something. >> we're accelerating tests to determine whether or not he was under the influence of anything. >> police say the suspect is a friend of the victim's older brother and they are trying to figure out the motive for the attack. >> we expect to find out more today about the man accused of killing a virginia woman and then kidnapping her 12-year-old daughter and driving across the country from roanoke to the bay area. detectives from virginia were in san francisco over the weekend to question 32-year-old jeffrey easley and interview brittany smith. the two were seen panhandling last friday outside the ocean beach safeway. easley is the prime suspect in the murder of brittany's mother, tina smith. she was found dead week.

>> nurses are calling for increased safety measures at napa state hospital. last wednesday a custodian was beaten unconscious and on saturday ux a rehabilitation therapist was attacked. a nurse tells "abc 7 news" that the same patient who beat the custodian also attacked the therapist. and these attacks came less than two months of a murder of a technician. >> it's dangerous. we are losing control. we've lost control. >> napa state hospital says they have immediately added additional measures for escorting patients on the ground. officials say hospital police are investigating last week's attacks. an 18-month-old boy who fell into a san francisco hotel fountain died from his injuries over the weekend. the toddler wandered away from the family while they visited the hyatt regency to see the holiday deck riagsdz. the boy was found eight minutes later floating in the fountain

where the water is two and a half feet deep. they say the boy died at ucsf hospital on saturday. >> a new crackdown on the campus of u.c. berkeley has bike riders crying foul. campus police have been cracking down on moving violations. california law requires cyclists to follow the same rules as cars. student say the crackdown is cruel considering the recent unprecedented tuition hikes. they say they didn't know the bike signs were so high until students complained. now, they will look at less expensive codes to enforce the laws. >> the union representing transit operators is promising a fight if they don't get their year end bonus. they want to cancel or reduce payments because the agency's financial problems. transit operators have received

tougher battle in the house where democrats have promised to reject it. if passed it will extend all bush era tax cuts and unemployment benefits including those for the wealthiest of americans. it would provide $400 billion in cuts and tax credits to stimulate the economy. republicans are in the driver's seat on this deal. >> we're not interested in changing this deal. we're interesting in passing it through. >> with the majority of the house and majority of the senate and control the presidency and we acted like we have a weak hand. >> while democrats oppose changes to the estate tax, they say they are confident it will pass by the end of the year. after months of talks the san jose city council is expected to finally vote tomorrow on a have an ordinance that would ban grocery stores

from providing plastic bags and would charge customers ten cents for disposable paper bags. supporters say it would cut down on litter and the amount of waste in landfills and encourage use of reusable bags. opponents like the american chemistry council says the measure is heavy-handed and that plastic bags can be recycled. if approved the ban would go into effect in january of 2012. joe montana, remember him? and owner eddie debartolo, jr. is making a plan to move 49ers stadium to santa clara. they want to build a luxury hotel next to the stadium. it would including a sports bar. montana and debartolo says they

a courageous young lady. >> s.w.a.t. team made entry into the home and found the suspect asleep in the master bedroom. they say the suspect is friends with the victim's older brother. the suspect's future stepbrother told us off camera he had run-ins with the law but no one would have managed anything like this. >> he is not that person. he wouldn't do anything like that. >> the victim's grandmother told us, my granddaughter was very brave. she was able to think clearly enough to run across the street to get help. as for the children being left alone, she was helping a sick friend and we ask and pray for everyone involved. both victims are expected to survive. the 14-year-old suspect is facing could two counts of

a 15-year-old redding girl who was reported missing is back with her family after being found in the bay area. police have been searching since last month for jean berlinghoff and her uncle. he is accused of abducting her. girl's cousin who lives in san francisco spotted the pair accidentally. she noticed them in a parked car. she and her boyfriend watched them from a distance until police arrived. the family things that the uncle convinced the fleece to leave home with him. >> drivers already pay a toll to get into san francisco from the north bay and east bay. now, the city is reportedly considering a toll of peninsula drivers to come into the city. that is inviting potential retaliation from san mateo county. terry mcsweeney is live on the san francisco county border.

the bottom line is, they want your money. >> they definitely want your money. san francisco wants three dollars every time you enter san francisco from the south, from san mateo county and three dollars more when you leave san francisco into san mateo county. i guess you could probably figure out san mateo county officials the plan is, quote, ridiculous and vowed retaliation. they are reporting that the san francisco board of supervisors will be voting on a plan to study this toll idea. that vote is tomorrow. it would set up tollbooths on major streets and highways and collect three dollars each way. this would be during commute hours for drivers from san mateo county. for the city it would mean $80 million, for commuters it would mean $1500 per vehicle, per year. not surprisingly a couple folks out here this morning don't like

a 20-year-old was shot. he is recovering in the hospital with non life-threatening injuries and police are searching for the suspects. on saturday night in east oakland, a 19-year-old man was killed and three people with shot on international boulevard between 90th and 92nd avenue. one that was wounded was 32-year-old woman that police believe was a bystander. >> later police say there was a shootout between rival gangs on broadway and 12th in downtown oakland. a 19-year-old man and a 14-year-old bystander were wounded. one of the suspected gunman was arrested. the state's budget crisis will have hundreds of jobs moving out of san francisco. the state compensation insurance fund says it will move 755 jobs out of town to save money. those positions will now be moved to pleasanton and

sacramento. that could mean commute issues because most live in san francisco, daly city or the south bay. agency says operating in san francisco has become very expensive and they also noted difficult attracting enough qualified employees here. tomorrow the contra costa board of supervisors is expected to approve a new contract for the district attorney's office that includes a dozen new furlough days. county prosecutors will have to take 12 unpaid days off by june 30th. prosecutors say the decision would force them to do a superficial job and it would put the public at risk. if duties on pending cases are ignored, they will be released back into the streets without going to trial. time to check the forecast. dry right now but keep the umbrella handy. >> more for tonight and in to tomorrow.

tomorrow morning's commute, rather quiet. we have low clouds lingering from recent rains and fog. we have upper level clouds that are streaming through on the jetstream. that is going to keep us, i would say in the dark but definitely seeing a full complement of sunshine. temperatures will be hover in the upper 40s to low 50s. by noon, temperatures in the upper 50s. by 4:00, hang in the upper 50s after reaching the low 60s around 1:00 or 2:00. these mid to upper 50s, dry with a little bit of sunshine in between those clouds. as far as your accu-weather seven-day forecast, light rain moves in tonight and hangs around tomorrow as the cold front sweeps slowly from north to south across the bay area. 10th to a quarter of an inch. next system slides to our south for wednesday and thursday. those should be the driest days because periods of rain roll back friday, saturday and sunday.

calls for him to be released from military custody. today the u.c. board of regents is scheduled to begin considering a plan to reduce fund for thousands of pension and retirement plans. they say the pension and retirement system has nearly $21 billion deficit. to try to fix it, he is recommending a proposal that raises the minimum retirement age and the age for receiving maximum benefits would rise from 60 to 65. in addition the u.c. would greatly gradually decrease contributions to most retiree heath care premiums. last month they approved an 8% tuition hike. >> holiday shopping habits on the minds of many investors on wall street today. jane king just back from shopping for presents joins us live from the new york stock exchange.

city how they will get you coming and going. >> san francisco is considering a plan that would charge drivers three dollars per vehicle to go into san francisco and three dollars to leave san francisco to come back into san mateo county. san mateo county officials, are saying our toll will be bigger than your toll. they say it's going to be considered by the board of supervisors tomorrow's meeting. a proposal to study the idea of a three dollar toll each way during commute hours. san mateo county businesses and elected officials that is a bad idea. they are promising a six dollar toll each way if the san francisco idea is approved. san francisco toll would raise $80 million for the city per year. it would cost commuters $1500 per year. san mateo county plan would be twice that. if the san francisco plan is
