last month. derk jones was shot by two officers responding to a domestic dispute. jones repeatedly reached into his waistband as he ran for them. turns out he was reaching for a small scale and some marijuana. the police chief is now asking for an independent federal probe in the case. >> to give us an objective viewpoint of what really happened. right now is there too much bias too many contradictions going on. >> federal investigators are already looking into another high profile police killing in oakland, the bart police shooting of oscar grant. >> students of an east bay high school will return to class this morning stunned and saddened after a football player was stabbed to death just off campus. police were asking if it happened because he was trying to be a good samaritan. live at newark memorial high with the latest. >> kristen, so far police have not made any arrests in the

murder of 17-year-old justice, a senior here at newark memorial high school. this morning we found a small memorial where he was stabbed to death, flowers, and a football placed there. the 17-year-old was waiting at the bus stop when he was murdered just after 3:30 yesterday afternoon. he had just gotten out of school. no word on any arrests or a motive but friends say the 17-year-old was targeted because he intervened and broke up a fight last week. >> justice is my bfg my big friendly giant. he always had my back. never, never saw him mad at all. always smiling, said what's up. an occasional hug here and there. helped me through like little problems. >> he was a senior at newark memorial high and a member of the football team. two people wearing dark clothes and hoodies were seen running from the bus stop.

friends say they will be wearing black to school this member to remember and honor the young man. reporting live in newark jenelle wang. >> it's about 6:4. there is new word this morning of a fob terror threat during the holidays. iraqi authorities have obtained confessions from captured insurgents who claim al-queda is planning suicide attacks in the u.s. and europe during the christmas season. u.s. officials confirmed the threat as credible but also say they have no specific target. counterterrorism officials say they're already on high alert during the holiday season especially since last year's failed attack from the so-called underwear bomber who tried to blow up a detroit-bound airliner christmas day. >> workers to get "don't ask, don't tell" repeeled before the end of the year. yesterday they overwhelmingly passed a bill that would end the ban.

the bill must get through the senate. a veteran discharged from the air force says he realizes this will be the repeal's last chance for a while. >> i think if we wait it's all over. it's not going to happen unless it happens now. >> the senate has a full agenda to deal with before the session ends but harry reid has promised to bring this bill to a vote threaten to call senators back after christmas if he has to. >> a monumental change in the california election process, expect parties from all candidates to be on your primary ballots in the next election. the state supreme court has denied a request of prop 14. voters passed the measure back in june. it puts all candidates in the same ballot the first round and the top two make it to the runoff. the green party is filing a lawsuit saying an open primary

could exclude third party candidates from all runoffs. >> an army of predators taking legal action to recoup some of the losses in the lehman brothers bankruptcy. the bank declared bankruptcy two years ago. it's part of a group challenging lehman's plan of distributes its remaining assets. the california public employees requirement system is also part of the filing seeking fair treatment for lehman creditors. >> well it's happened again. in alameda thieves are one get setting their sights on christmas decorations. last weekend they hit dozens of homes mostly on thompson avenue. one woman who had 25 candy canes was apparently hit again. >> think of all the disappoint for kids when they go to

coming up. >> a couple bridges are fog advisory. more news. the chef executive of the much criticize the nonprofit that runs san jose's convention center is expected to see sign today. according to the americay news, dan senten who has team san jose is excepted to resign during a board meeting this morning. the meeting to focus on terms of his severance package. he has been accused of mismanagement and squandering city funds. many of the props were related to the decisions fenton made without consulting the board of directors. >> a new measure that cuts down on those noisy tv commercial. the bill was sponsored by anna esue a palo alto democratic. the commercials have been no

feeding them. an open dog door led to an all-automatic battle at 3:00 in the morning at the cruise familiar kitchen. the nocturnal animals were apparently looking for food and the smaller dog may have been the intended meal. >> she was bit here along the nose. also here on the side. you see where they had tried to bite ahold of her arm. >> i've always known they were around but i never thought they'd come in the house. >> they had ahold of her was pulling back and off like this with the little dog in their mouth. >> it's the tenth raccoon attack this year. most of the cases involving attacks on small dogs while they're being walked. four of the pet owners have been bitten. raccoons on alameda are more concentrated with nowhere else to go. >> let's talk about the weather

situation. you've got a lot to discuss. this morning's chilly weathered and then the big storm. >> yeah. one big mess isn't it. with rain and snow and even may throw thunder in from time to time. good morning to you. 6:16. a live look from ballmer peak looking back to the west. see the fog developing around san francisco. thickest in the north bay, the east bay valleys. with these type of temperatures 32 santa rosa, napa to 29 fairfield. you may see some of that fog freeze on objects. probably too late to freeze on bridges and overpasses because of the fact the morning commute is picking up and that tends to warm the roads. scattered frost throughout the bay area even the bay shore, mid to upper 30s there, 44 san francisco. around the monterey bay, temperatures upper 30s. same thing for salinas but frosty 31 gilroy. let's talk about our highlights afternoon clouds. this will be our last completely dry day.

cloudy tonight, not as cold. a few sprungels possible but wet of the weather after the morning commute and stormny from time to time all the way through wednesday. here's what we're looking at upstairs. notice the clouds going to the north, clouds going to the south. the reason why we have high pressure that's bringing us this one last dry day. temperatures don't respond to the sunshine but 'cause we're starting off so cold we'll make it mainly to the mid-50s in the south bay. 56 san jose, campbell and also saratoga. mid-50s on the peninsula with redwood city 55. pacifica daly city, the sunset 52. throughout the north bay we'll have low to mid-50s in your neighborhoods. on the east bay shore mid-50s with oakland being the warm spot at 56. the east bay valleys, 52 or 54 degrees. may hit the mid to upper 50s. for tonight you see the cloud cover keeping the temperatures up. low to mid-40s around the bay

shoreline out to the coast. still mid to upper 30s in the north bay valleys. upper 30s to low 40s in the east bay valleys but temperature too high for any frost to form. two different perspectives what's going to happen tomorrow. here we are at 7:00. some of the rain starting to push into the bay. notice the snow. this is the one i wanna concentrate. starts around 11:00, 12:00 in the sierra. get there before there you'll have pretty easy roads. closer to home by noon all of us getting rain. it will just keep coming in in in waves and waves during the afternoon and even into the evening hours. in fact, it will pick up in intensity on saturday. it will be a little breezy then. we'll see a slightly less intense system for sunday. may get a little break with most of the daylight hours dry on monday. and then tuesday another storm comes in. this one will have the winds necessary, saturated ground for flooding and also for some possible trees to pop and power

are cleaning up after a car crashed through the front door last night. check out. the driver was trying to avoid a big rig truck when she was heading down the street 10:30. that's when she lost control of her car and smashed into the building on market street. investigators are trying to determine the cause of the accident. the woman escaped with just minor injuries. police have still trying to determine what caused a car to veer off interstate 280 and crashed into a house. the homes on trumbull street near the boulevard also in san francisco. investigators say the car smashed through a freeway barricade, hit a tree and barreled into the home's laundry room. the family was there when it happened. >> i don't know what happened. i just hear a noise, like earthquake. and all of a sudden i saw the car inside on my terrace. >> witnesses tell police the car was speeding down the freeway. people on the scene say the driver didn't appear to have suffered major injuries.

>> a state inspector warned pg&e more than a year before the san bruno pipeline disaster that safety problems in its gas distribution system were putting the public at risk. that was outlined in february of last year. the san francisco chronicle obtained the letter which also says pg&e was having trouble following a federal law requiring proper training for workers who check for gas leaks. the document also claims the utility was not keeping track of the designated gas pressure on its distribution lines. the inspector's letter seems to condict the public utility commission's statements during the investigation where they portrayed pg&e's safety record as solid. bulldozers will demolish three more homes in san bruno. on tuesday the city council approved the demolition of the damaged houses. they had been previously been yellow-tagged which meant they were not damaged enough to

there might as well be regulation and taxation. >> i don't think it has a lot of popular support and i don't think the mainstream politicians are going to be attracted to it. >> the next national tea pot party meet is scheduled for january 18th. >> president obama will speak about the latest military report on the fight against terror on pakistan and afghanistan. the president will stay the course with u.s. forces to remain at war until 2014. u.s. troops will begin to leave afghanistan in july but the scope and pace of that withdrawal remain unclear. the report finds that the taliban in afghanistan has seen much of the power halted and reversed over the last 12 months. the pakistan senior lead areship of al-queda at its weakest since the september 11th attacks. it was led with input from government agencies and commanders in the war zone.

the fate of the military's "don't ask, don't tell" is in the state of the u.s. senate. it would end the military's ban on openly gay service members. senate democrats believe they have the votes to pass the bill as well but some republicans are promising to block the measure for coming up for a vote during the session. harry reid as promised to bring the bill to a vote threatening to call senators back after christmas if he has to. >> this afternoon the house of representatives is expected to vote on the continental version tax package that president obama negotiated with republicans. yesterday the tax cut bill sailed through the senate. many democrats complain it's too generous to the wealthy. house democrat leaders say they plan to pass the tax. the bush era tax cuts are set to expire january 1st and would affect americans at every income level. republicans have agreed to restore jobless benefits for people of that been unemployed long-term.

doesn't tell the whole story. >> bloomberg's jane king with the "moneyscope" report. good morning. >> hello. the perfect example where it's the read behind the headlines thing. foreclosure filings actually plunged to a two-year low but most of that is because the banks and other lenders slowed foreclosures as they wept through paperwork procedures and made sure they were on the up and up. one of those troubled states with the most filings in november and a fifth of our nation's total foreclosures more than 57,000. the market so far this morning another one -- had so many lately. modest gains, not a lot of direction here this morning. the bloomberg silicon valley index straighting just slightly higher as well. silicon valley has lost its appetite for sill con. the online gaming companies. investors and chip makers are close to a two-year low.

inland. clouds keep our temperatures up even though chilly with mid to upper 30s santa rosa napa, cloverdale fierld and livermore. the rest of us low to mid-40s. san francisco at 48. 7:00 in the morning you see some of the springless developing around the santa cruz mountains. the water moving ashore and some of us all of us seeing some type of rain. because it's daylight, it will melt. by 5:00 you can see darker green around our neighborhoods. that's when heavier rain is going to move in. may taper during the evening hours but definitely going to hang around. this is just the first push. we'll add winds and even more intensity to the rain on saturday. we'll have less intensity sunday. may get through the daylight hours dry but rain moves back monday night and quite heavy tuesday, windy.

17-year-old, a senior at newark memorial high school. we found a memorial at the bus stop flowers candle and a football have been placed there. the 17-year-old was waiting at the bus stop when he was stabbed to death just after 3:30 yesterday afternoon. he had just gotten out of school. no word on any arrests or a motive but friends say the 17-year-old was targeted because he intervened and broke up a fight last week. police say two people wearing dark clothes and hoodies were seen running from the bus stop. he was a senior at new washing high school and friends say he did play football. they will wear black to school to honor and remember the young man. that's the latest here. reporting live in newark jenelle wang. >> weather and traffic, mike. >> the big story, the temperature, the frost inland valleys. 29 the cool spot fairfield to 44 san francisco. this afternoon we'll see an increase in the high clouds and
