faced life in prison. the judge said five of the defendants will be held on forcible rape charges. now here is some of the defendants we're talking about. the judge said there is evidence to have five of the suspects stand trial for forcibly raping the girl. just two of them the judge said the evidence said had sexual intercourse with her. 43-year-old john crane and 19-year-old jose carlos montano. 20-year-old manual ortega forced the girl to have oral sex with him last night. they linked all three suspects to the crime scene. as for the youngest defendant who was 15 at the time they described him as the person who lured the girl to the scene, but the judge tossed out a police interview saying his rights had been violated by a richmond detectives and there was not

enough evidence to show that smith did anything that night other than immoral behavior. there is also robbery and assault for what happened outside the home coming dance last year. the girl willingly drank alcohol to the point where her blood alcohol was a.35 level. both sides laid out very different versions of what happened that night. let's take a look what the prosecutor said today. she said there was a clear picture of a mob mentality almost a complete feeding frenzy and everyone seemed to lose what humanity they had. a lawyer for peters said maybe the richmond high rape case maybe there is no rape at all. the hearing wrapped up. it lasted 20 days and involved 20 witnesses. as for crane the oldest defendant in this case his lawyer just a few minutes ago

dropped a bombshell. many observers how it is a 43-year-old man could have ended up outside a homecoming dance. he said that he may have consensual sex with the victim before that high school dance even happened that night. the youngest defendant cody smith he will be released from jail any time, we're told. animal control officers in san jose need your help in finding two vicious pit bulls that attacked a woman outside her home. a good samaritan came to her rescue. >> the frightening attack happened in this driveway. she was out last night. she was taking her kids into the home and returned to her suv to get something when the dogs attacked. >> these two neighbors share one

terrifying story susan is a victim and also a hero. last night two pit bulls viciously attacked her. she tried desperately to fight them off using her car key, but the dogs kept biting first her legs and back and teeth tore into her arm. >> they bite over there. >> a person heard the commotion and heard the across street. he used a rock on the dog attacking susan. >> when i went to my left i hit him in the head and he let go. >> as neighbors describe it the pit bulls had been terrifying the neighborhood moments before trapping one woman in a car and

acting aggressively toward a man and charging up and down the street. the pit bulls seem to have disappeared as quickly they appeared. officers from san jose animal services spent the day going door to door looking for the dogs. officers say it's possible their owner is now protecting them or honestly doesn't know about the incident. >> if they are just backyard dogs the owner may be too busy to find out. >> before last night warren and susan had never met. today she is in pain but without him it could have been much worse. >> reporter: very difficult indeed. and the animal officers after interviewing several witnesses they are describing them as pit bulls. at least one gray in color. oakland police had some

answers today about a high-speed chase that ended with officers killing one of the suspects. police say they were trying to prevent a gang-related retaliation shooting in a west oakland neighborhood. they were tipped off about a vehicle involved in the attack and started chasing it. four suspects crashed the maroon sedan and took off running. police chased and shot 19-year-old man. >> the event highlights the need for the entire community to come together and stop these young people from carrying guns. intervention is needed for these young people get to this point. >> officers recovered the handgun they say edwards drew and they found an assault weapon in that vehicle, as well. one of the suspects is in custody and two more are still on the loose tonight. prosecutors filed against a man killing a leader last june.

he was shot in hillsdale shopping center june 9th. they charged 58-year-old gregory eman for illegal possession of a firearm and a special circumstance of lying in wait. latter charge would make him eligible for the death penalty. elongs was assigned to a court appointed attorney. >> we are still seeing the consequences of that wet weekend. saturated ground and high tide caused flooding at this spot in mill valley. you see that person going through. as you see the water was several inches deep and was more of an inconvenience than anything else. maintenance workers closed down part of highway 101 in sonoma county to carry out repairs there. large potholes developed in southbound 101 in cotati. recent storm systems weakened the highway and repair crews

numerous lightning strikes off the coast. light rain starting to pick up off the sonoma county coastline. this lightning strike 110 miles off the coast from the golden gate bridge. all of this is moving in our direction. here is the projection and right along the frontal boundary is where some of the heaviest rain will pick up. by 5:00 a.m. in the morning, that is when heavy rain will start to move in across the bay area and that is the leading edge of that frontal system. when we get tomorrow around noontime, liberty to the east of us and that is when we'll start to dry off a bit. this storm is exactly what skiers and snowboarders have been waiting for in the sierra. check this out. they are more than ready for the holiday rush at heavenly. the slopes were crowded with people because of the excellent conditions. they think all this new snow has

from raising your premiums. they would have to justify any more than 10% a year under the proposal. the idea announced by health and human services would take effect sometime in 2011 if approved. since 1999 average premiums for family coverage have increased 131%. under the new health reform act they would exclude insurers that show a pattern of unjustified rate hikes. >> that old adage check in the mail will no longer be true for most of those on social security. the social security administration issued final regulations today switching from paper checks to direct deposit or a debit card. in will all become official march 1 2013. those recipients 90 years or older who are mentally impaired or living in remote areas can still get checks in the mail but everyone else will have to

also more is gathering off the coast. we are, indeed, going to see one more storm system move across the bay area before we get into a brief dry patch for a latter part of the workweek. right now we are all in the 50s. san francisco is at 56. 55 livermore. antioch 52 degrees. here is the highlights. expect rain tonight heavy at times and then we get into the dry period wednesday through friday. then another storm system, a little stronger one will move in on christmas day. here is a look at the setup. we have two areas of low pressure. this is going to split a bit, but this section is going to move in our direction. this is what is going to bring us the rain overnight. here is a look at the timing. overnight tonight, things shut should start to get a little bit more active around 7:00 8:00 9:00 this evening. it will be the overnight hours 3:00 4:00 5:00 when the front

oakland city council is expected to make a big decision that could effect the a's. whether to approve $750,000 to conduct an environmental impact study for a new ballpark along the waterfront. they endorsed the study last week. proposed site for a 39,000 seat stadium known as victory square few blocks south of jack london square. it comes despite efforts a's ownership to get it in san jose. >> po.
