the 7-day forecast, also. >> you'll run into a lot of that thick fog on your drive to work, especially most bay area bridges. here's a live shot of bay bridge toll plaza. traffic light for the holiday but i'll have details on mass transit holiday schedule. >> and "the washington post" reports the federal prosecutors plan to move jared loughner's trial out of arizona to san diego. they said the extensive publicity the tucson shooting rampage has received in arizona. >> good monday morning, everyone. a foggy monday morning as you heard mike say. we'll check more on that coming up. i'm eric thomas. kristen's off. just less than two years into the job, oakland's chief police could be leaving for greener pastures. the top job in a much bigger city. amy holyfield is live at the oakland police department. amy, it would be a big move but not a far move. >> that's right, a bigger city but not that far away. he's thinking of heading south to san jose. word is chief anthony bass is

one of two top finalists for the top job in san jose. the other candidate is the current acting police chief chris moore. bass confirmed he's a finalist but wouldn't comment further. bass came from oakland from long beach. he's considered a rising star, full of promise. but in oakland he has found some challenges. >> well, it's been obviously a tough economic crisis. i think there's a level of politics he probably wasn't prepared for. maybe that's why he's looking. i think during his time there, i don't believe he was given the opportunity to actually exhibit some of the things he wanted to do as far as getting the proper resources and funding. >> bass has been able to make a dent in serious crime here in oakland but it's still a huge concern in this city. there was the murder of a young man just last night. he's had to deal with this with fewer officers than he had when he arrived. city leaders voted to lay off

officers to save money. bass started out with 779 officers. now he has 656. the san jose city manager is expected to make a decision on a new chief within the next couple of weeks. if bass is selected, this will present oakland mayor jean quan with her first huge challenge. abc 7 news. >> it's 5:03 now. a weekend murder/suicide in san jose is connected to the prime suspect in the disappearance of a los gatos woman nearly ten years ago. maurice nesma, the prime suspect of jeannine harms. he first talked with nesma and later confronted him again where nesma was shot and killed. detectives with los gatos who investigated the harms case say it's a shooking and tragic development for everyone

involved. >> this is simply just a terrible tragedy that, you know, because of events that took place beginning in 2001, the sanchez family have lost two children, and now the nesma familiar has lost one of theirs. >> the tenth anniversary will come up in july. concord police are searching for one of two drivers involved in a pedestrian accident that killed a woman and a dog. it happened on solano way on the avenue. the walk walked on the roadway and was hit by one car as the driver got out to check on the woman she was hit by another vehicle. that driver also got out and briefly talked with the first driver. the second person then left the scene. the man was driving a dark-colored four-door sedan with a hatchback and he had a female passenger. san diego may be getting one of the most high-profile trials in the nation.

"the washington post" says federal prosecutors plan to move the trial for suspected arizona gunman jared loughner to california because of extensive pre-trial publicity. arizona's chief federal judge john roll was among those killed in tucson more than a week aago and every federal judge in california has now recused themselves from the case. the new judge will make a final decision within a few weeks. congresswoman gabrielle giffords is breathing on her own this morning after another successful procedure to remove her from a ventilator. doctors upgraded her from critical to serious. they inserted a short tube directly into her windpipe to allow giffords to breathe more comfortably and allow her to speak. >> from the patient's perspective it's more comfortable. therefore there's less sedation. if she's more awake she can participate more in her own care and physical therapy. >> giffords has made gradual improvements. they still caution they do not

know the full extent of her recovery. the father of the nine-year-old girl killed in the shooting says some of her organs have been donated to a young girl in the boston area. christina green was the youngest victim. her father john green says he has no further details about the donation but he says when he learned of the transplant, he and his wife were once again proud parents of their little girl. bay area members of congress are continuing to hold town hall meetings but with increased security. congresswoman zo laughrin held her first and there was a strong police presence. the good friend of giffords say she advocated for better mental health. >> it was clear that young man has serious problems and yet nothing occurred that would allow his illness to be treated.

>> the town hall was organized by the jewish federation of silicon valley. it's now just about 5:07. bay area residents are getting ready to board the freedom train this morning in honor of the late civil rights leader dr. martin luther king jr. the 27th annual freedom train is scheduled at the bart caltran station at 9:30 and head to san francisco for a day of celebration at the gardens. the freedom train is a way for people to memorialize dr. king's historic 1965 march in alabama. it's one of the last remaining in the country because of the economy. and there are a number of other events in the bay area to observe the king holiday. you can find them on our website abc7news.com. 5:07 the time. trying to take a look at the weather forecast? i find patches of clear, mike, but then dense, dense fog. >> really dense this morning. we'll start off kind of in the dark if you will because of the dense fog. by the end of the day we will

definitely see the light. as far as our advisories, the thickest fog according to the weather service is going to be around the santa clara valley, the bay shoreline and the north bay valleys. i know for sure in the east bay valleys we have visibilities lower than a quarter of a mile on a pretty wide-spread area. keep that in mind if you haven't looked outside or left for work this morning. the fog is just about everywhere. it will be around until 11:00. and you can see right there is concord at half mile and livermore a quarter mile. technically they should be in the dense fog advisory, also. napa, the best visibility there. inland one mile, two and a half at half moon bay. 1-16th at sfo. most limited visibility there. flight arrival delays. pretty mild this morning. this afternoon you can see what the fog does. kind of pushes right through the heart of the bay keeping anywhere from san mateo, san francisco, san rafael through the delta community and the east bay valleys in the 50s while

everybody else the low to mid-60s. 7-day forecast, we'll see a repeat of the fog tonight. looks like tomorrow will be probably the warmest day in the forecast. pretty mild wednesday and thursday. then the cooling trend without any rain for the weekend. good morning, frances. >> good morning, mike. many of our traffic cameras are socked in with the fog so we can't even show you them because you can't see anything. this is one where we can see something. this is san joses northbound 101 for the headlights across your screen. give you an idea how thick the fog is out there. we can also see the golden gate bridge. not much of it but a very thick fog advisory for all bay area bridges exempt the golden gate bridge, although you will find fog here as well. for the holiday bart is running on a saturday schedule. keep that in mind. ace, muni, caltrain and vta all running on a regular weekday schedule and various service, for example no service on the alameda harbor bay ferry but the

greenhornette got the loudest buzz and the most in ticket sales. true grit held on to the number 3 spot. that's your "moneyscope" report. >> it's 5:14. good morning, everyone. consumer advocates are worried about what may soon be in your online checking account. a few banks have begun accepting ads that pop up in your account, and the practice is expected to grow. mcdonald's has been testing an ad that tracks your spending and offers you 10% cash back the next time you use your debit cards at the fast food restaurant. consumer advocates call it an invasion of privacy because the user doesn't know who is tracking them and most users also don't know they have to op out. former governor arnold schwarzenegger is telling an austrian newspaper his time as governor cost him a huge pile of money and could have cost him his family. governor schwarzenegger says he missed out on at least $200 million in acting roles and hollywood films.

he says his family life is damaged and needs to be repaired. schwarzenegger recalled evenings when his wife maria and their children broke down in tears at his heavy work schedule. schwarzenegger says the sacrifices were worth what he was able to accomplish as governor. many movie theaters in the bay area will be getting a new sound system in the coming months to go along with the 3-d movies. it's dubbed 7.1 and richard hart reports on the drive to discover 3-d sound. >> which come first, the chicken or the egg? or is it the rooster? this is the try lem ma faced by the 3-d movie a few years. exhibiters couldn't show movies until content creators made them but they couldn't make the movies until an audience demanded to buy tickets but the audience couldn't buy tickets to the movies the exhibitteres weren't showing in the theaters and so on.

the audio it matters even more that sounds made by something emanate from its physical location. home movie systems have a sweet spot because the side and rear speakers share a channel. what does that mean for 3-d? that truck sounds it's coming directly over you or should or slightly left or right could depend where you're seated in the theater. but now dobie digital is rolling out a 7.1 surround system that gives the left back and right back speakers their own channels, hence the number 7. and it is seating movie makers with new editing tools like this setup with more than 36 channels. >> where as the first movie released in 7.1 sound but so far only one movie has been shot and produced in 7.1 surround. toy story 3. for theater owners who already have a 5.1 system like this installed, it's just a matter of

two more speakers and a slight rearrangement of existing ones. for dobie it's a matter of heading off competition in the home end theater and using a pig to beat the chicken or the egg. >> we have 3-d fog out there this morning, right? >> if you can see through it. >> it's all around you. >> it is surrounding you, very good point there, eric. we'll show you what it looks like from above, from ballmer peak looking back from the west. it's in the bay, it's in our valleys. it's going to be around through at least 11:00 and it will lead to hazy sunshine and the cap that's producing this fog can also produce poor air quality. we have that to contend with today, too. let's talk temperatures. very mild this morning. we have oakland, half moon bay, san jose around 50 degrees. everybody else mid to upper 40s. around the monterey bay, the fog not nearly as thick or widespread. we have 55 santa cruz. everybody else in the upper 40s

to near 50 degrees. so we'll have hazy sunshine. starting around noon. and that poor air quality, no burning until midnight at least if they give the okay. dense fog forms again tonight and the extended period, all the storms stay north of us. inland areas of the east bay valley and also the santa clara valley but it's a spare the air day for everybody even if you're not going to have some of the poor air quality. 59 sunnyvale. low 60s for everybody else. if we didn't have the fog today, temperatures would probably run about 5 to 8 degrees warmer than what you're seeing. that means some of us could have been near 70 today. upper 50s to near 60 along the peninsula with low to mid-60s abeing lo the coast. downtown south san francisco upper 50s. some fog will hang around bodega bay, petaluma and sausalito. upper 50s to near 60 throughout

the east bay shore. into the east bay valleys, stubborn with the fog because some is drifting in through the central valley. hard to get rid of it probably here with the mid to upper 50s. monterey bay, mid to upper 60s near 70 watsonville, about 62 carmel. take a look at tonight, more tulie fog in the central valley. some fills in and more fog will form around bay shoreline and low to mid-40s inland. mid to upper 40s the bay shore and out to the coast. storm track stays well to the north thanks to these two areas of high pressure once again dominating our weather and moving all the storm systems away from us. tomorrow we could realize some of that warmth and get into the upper 60s around the bay, mid to upper 60s at the coast and low 60s inland. low to mid-60s wednesday and into thursday. possibly even friday. a wind shift will bring us cooler weather for saturday and

dense. america's strong opposition to president obama's healthcare reform plan has diminished. that's according to a new associated press poll. the number of those adamantly opposed to the plan has dropped to 30%, the lowest level registered in a. p. polls. opposition in general has dropped from 47% to 41%. 40% of people surveyed support the reforms. the gop-led house is expected to vote this week on repealing the new law, even if the house approves the repeal, it will need the approval of the democratic-controlled senate. in brazil thousands are in shelterers after mud slight wiped out whole neighborhoods while others live in homes and threatened areas. heavy rains caused the landslides outside rio de janeiro. the death toll has risen to 600 and many people are still missing. the government has approved $72 million to build homes and shore up areas at risk for more slides. the rains that set off the

department and less crime. anthony bass has confirmed that he is a finalist but he wouldn't comment further. he's up against san jose police veteran chris moore, the current police chief. bass came to the oakland police department in 2009 from long beach with big ideas but city leaders have not given him exactly what he has asked for. the oakland union president said it could be bad for the department but he understands why bass would be drawn to san jose. >> anthony bass. >> do you solemnly swear or affirm -- (applause) >> thank you. thank you for coming. >> oakland has one of the highest murder rates in the country. san jose has one of the lowest. the crime rate has gone down since bass became chief, but it's still a huge issue. there was a murder just last night on east 15th street. also consider the new mayor jean

quan wants to negotiate with the police department to get officers to contribute 9% of their pay to their pensions. that's a source of contention here. the union president says morale is down and officers here are looking for jobs knowing that the chief is also looking for a job, he says, is just going to make things worse. amy holyfield, abc 7 news. >> amy, thank you very much. it's 5:31 now. south bay detectives say a weekend murder/suicide in san jose means we may never know what happened to a los gatos woman who disappeared ten years ago. the crime suspect in the disappearance of jeannine harms walls shot to death saturday night by harms brother who then took his own life. lillian kim reports. >> maurice has long maintained his innocence but he had nothing to do with the 2001 murder of jeannine harms of los gatos. it was a shopping center in san jose. wane sanchez accused nesma of

killing his sister. they ran into each other at a restaurant where the confrontation occurred. >> we have information that makes us believe that the suspect was accusatory towards the victim. >> sanchez left the restaurant but returned but nesma was already gone. he was headed to pete's coffee nearby. >> he followed him and they had a second conversation. we don't know what the conversation was about but the suspect retrieved a handgun and fatally shot the victim. >> bystanders called 9-1-1 and as soon as police arrived more gunshots. sanchez was in a parking lot when he shot and killed himself. s those who investigated the harms murder case took the unless you hard. >> this is simply a terrible tragedy that because of events that took place beginning in 2001, the sanchez family have lost two children and now the nesma family has lost one of theirs. >> nesma had been the only one charged with the murder of

jeannine harms although her body was never found. he was one of two men out drinking with her the night before she disappeared. yet despite having found what investigators say were key carpet fibers in his car charges were dropped. a technician who tested the fibers failed a proficiency test in fiber analysis. it's unclear what will happen to the harms murder case. the tenth anniversary when harms disappeared is coming up in july. before last need's murder/suicide, friends and family were trying to think of ways to bring renewed attention to the case. >> federal prosecutors say they now plan to move the trial of the arizona shooting suspect to san diego, california, because of extensive pre-trial publicity in arizona. "the washington post" says the trial of 23-year-old jared loughner will move out of the state within several weeks. arizona's chief federal judge

john roll is one killed january 8th and every federal judge in arizona has recused themselves from the case. the new judge will make the final decision of any venue change in a few weeks. gabrielle giffords is now breathing on her own and continuing to show signs of recovery at tucson's medical center. doctors upgraded her condition from critical to serious after they removed the breathing tube. they performed a procedure that allows her to breathe without the ventilator. we'll get a personal insight into congresswoman's recovery from her husband in an exclusive interview tomorrow here on abc 7. she talked with diane sawyer. the interview will air during a special edition of 20/20 that begins at 10 p.m.. a soldier from danville has lost his life in afghanistan. 47-year-old army major evan molddick died last wednesday in

a non-combat-related incident. he had been in afghanistan a year and was supposed to come back home to danville in just two weeks. >> he was a great man, great father. you know, when you first told me about what had happened, i was just really devastated for his kids because i knew how much they loved their dad. >> major holddick is married with three children. before going to afghanistan, he served in iraq as a member of the national guard. 5:35 now. the nation honors the late civil rights leader dr. martin luther king jr. today. the 27th annual freedom train is scheduled to depart san jose's caltrain station at 9:30 this morning. it will make stops along the way before arriving in san francisco for a full day of celebrations at the gardens. the freedom trains were established all over the country as a way for residents to memorialize dr. king's historic 1965 march in alabama. the san francisco examiner reports the bay area freedom train is now one of the last

remaining because of the economy. there are a number of other bay area events to observe this king holiday. you can find them on our website at abc7news.com. right now you can find fog. and lots of it! just take a look all over the bay area. mike's here now to look at the forecast. >> take a look where we have purple this morning, kind of pinkish-purple there. a dense fog advisory for the bay shoreline and the santa clara valley dense fog until 11:00. visibility's well below a quarter of a mile many areas. sfo has some of the lowest visibility now, 1-16th of a mile. oakland 1-8th. you can see a quarter of a mile novato, half moon bay, mountain view, hayward. the east bay valley just as bad. not sure why they are not in a dense fog advisory but you should be if you just look at the numbers right there. as far as our temperatures, here's more numbers. most of them say mid to upper

40s. still pretty mild this morning. 50 half moon bay. afternoon numbers will be held back by the fog. we could be in the 60s and 70s, instead the 50s and 60s. still fairly pleasant. longest and hazy sunshine, possible poor air quality today, too. east bay valleys mid to upper 50s. monterey bay and inland, mid to upper 60s. poor air quality ended at midnight but the fog will return tonight. and then we'll wake up to that tomorrow. it will burn off and then we'll see some sunshine tuesday all the way through the end of the forecast which is sunday. a slight cooling trend during the weekend but dry all seven days. here's frances. >> hi, mike. it's so foggy out there. we're really limited in terms of what cameras we can show you. but here's a live shot of 101 in san rafael. traffic is flowing well southbound. we have light traffic around the bay area and really no accidents to slow you down. but you'll encounter a lot of that thick fog, especially

cable and davis barely spoke to each other the last half of the season. cable left the team after cable failed to extend his contract next season. along with the prestige of hosting the america's cup 2013, san francisco may be forced to move some high-profile tenants from their waterfront locations. the piers in question 19, 29 as well as 30 and 32. cecilia talked to some of the businesses that may be forced to pull up stakes. >> larry ellison's cup race is expected to bring in millions, some say more than a billion when it comes to san francisco in 2013. but it turns out what's good for the city by the bay isn't necessarily good for the bases by it. from the petty cabs that cruise the embarcadero. to the soccer players in the parking lot at piers 27 and 29. >> mr. toe's vintage car tours. they're all included in a list

of businesses along san francisco's waterfront that are about to begin a wild ride. the port of san francisco says as many as 80 businesses could be forced to move to make room for the regatta. but san francisco board of supervisor president david chew said they shouldn't worry. >> the city absolutely values these businesses and we are going to do what we need to do to assist some of these businesses in row location. businesses like bower's limousine and transportation are sitting on piers where ellison's team wants to hold a public viewing area for the regatta. moving out of his 1400 square foot space will mean a major headache. >> i have like 65 licenses all over the country that are all posted to that address. if i move, i have to move 'em all. >> the port of san francisco has yet to decide which of the 80 businesses will get to stay and which will have to move. nonetheless, the first round of businesses could be forced to relocate by the end of this

and discounts and force drivers to pay hundreds more a month to park. enforcing the ordinance would generate $6 million a year more for the city. this morning the social network has some new golden trends and big buzz heading into the oscars. the hollywood foreign press association golden globe awards were held last night. george looks at who's got the new hardware this morning. >> social network. don't forget about the poor air quality is possible. dense fog reforms again tonight. the extended period looking dry. the poor air quality will build in the inland areas of the east bay and also the santa clara valley. but everybody's under a spare the air until at least midnight which means it's illegal to burn the wood unless you want to pay a $400 fine. the fog is thick even though you're not under for some reason the dense fog advisory. the fog will remain here longer and that's why your temperatures are cooler than just about everybody else's, mid to upper 50s. east bay shore some fog hanging around during the afternoon hours. santa clara valley for the most part will be the low 60s. sunnyvale and may see the fog hanging on a little longer, keep you at 59. low 60s on the peninsula. more sunshine at the coast. look at half moon bay, 63 degrees. a little fog around sunset and daly city. even more so downtown south san francisco upper 50s.

where we're in the 50s, that's because of fog. everybody else in the low to mid-60s with more sunshine. we'll be more 70 watsonville today with mid to upper 60s for the rest the monterey bay and you see the fog re-form especially the bay shore. tulie fog in the north bay, low to mid-40s there. mid to upper 40s around the bay shore and out to the coast. you see the jet stream and the clouds associated with it in the upper parts of the atmosphere well to our north. another sunny day after the fog. we'll repeat it again tomorrow but i think the fog will burn off a little quicker, temperatures a little warmer and hang out in the low to mid-60s with sunshine wednesday, thursday and friday. the storm system will get close over the weekend but i think it will head more to the sierra. it will drop our temperatures back to the upper 50s and low 60s. good morning, frances. >> good morning, mike. yep, fog the biggest trouble for your morning commute. here's a live shot at 101 and
