good morning, it's a wednesday. 5:01. thank you for joining us. i'm eric thomas. >> i'm kristen sze. >> san jose state police are investigating a shooting rampage at a university garage last night that left three people dead. terry mcsweeney is live on the campus with the latest. >> reporter: the cleanup is still going on at this garage at san fernando and south tenth street? san jose following a shootout race night. we were inside take a look at the pictures. there is a company on the fifth floor called crime scene cleanup. that is exactly what they are doing. they are removing the blood one of parking spots on the fifth floor. police are quoted as saying all three shooting victims of dead including the gunman. not saying who did shoot the gunman. not saying if any of the victims are students but they are saying some things about the shootings.

>> it was an ordinary evening at san jose state. we hold classes from early in the morning until quite late at night. there were a number of students and employees. this is not a drive-by shooting. it was isolated involving three individuals. >> reporter: the parking garage was closed off at the time of the shooting and some students were not able to get to their cars. the university issued a notice came under criticism and they didn't get any text messages about this situation. university police are saying by the time they knew what they could say the scene was pretty much over. it was quick and three people shot. according to the university police they were all killed. the campus garage here is supposed to open at 6:00 this morning. we'll be out here when it does. university police expected i'm fold to hold on press update in

an hour or so. the budget ax is coming down again in two of the bay area's largest school districts. amy hollyfield is live in alameda. one of the districts protesting education cuts statewide. >> reporter: day three. they are going to kick off in alameda and they are going to start leaf letting. yesterday for part of the state of emergency protest. temperatures across the state made their point in shopping malls. they held what they called grade-ins show how much work they take home. they have been protesting at the capitol all week. cuts for school funding and asking legislators to extend two-year-old temporary taxes so

there won't be more cuts which they say could be devastating. >> it's over 220 students a day a teacher will be seeing. you can imagine what that will do for the students. >> reporter: as they are protesting school boards are cutting. san francisco and mount diablo both met last night and voted to issue pink slips. more than 180 teachers will be getting them and 139 teachers in san francisco. districts say they hope to be able to rescind them but they have to plan for the possibility that the state will be making more cuts. >> kristen: it's official, the school year in palo alto will begin earlier in mid-august. last night the palo alto unified school board narrowly voted to move up the school year by a week and a half. it stretched past midnight.

parents who support it this will allow them to have critics say the new calendar will shorten their summer and cause more stress for seniors focused on getting their college applications done. >> eric: three american hike there's wandered into iran the trial has been delayed hours before it was scheduled to start. janelle wang is live with the latest on the u.c. berkeley graduates and the accusations against them. >> reporter: information is still trickling in but what we snow that josh and shane were not brought into court today from their prison cells. the attorney says he not sure why. they have given no explanation yet. they were scheduled to go on trial along with sara shourd. all three were accused of espionage. shourd was released on bail last year and shed she would not return to the iran for the it

lamar advertising is rolling out 300 billboards featuring those two sketches of the men want wanted for attacking bryan stow. stow a santa cruz county has been in a coma since the attack since opening day. >> a bart board member says it would be too costly to stop the oakland connector project. new interim general manager says pulling the plug on the project would cost bart between 125 to $245 million. board member robert rayburn agrees. he says the next step is the trying to contain the costs. the project would connect the station with the airport replacing the current airbus system. tomorrow night the sharks will play game seven against the

israeli independence day. they announced their separation on monday. >> kristen: google's advertising system is facing a government investigation that is expected to cost the internet search leader $500 million. they made the disclosure yesterday and decided earlier this month to set aside $500 million to cover a possible settlement. regulators have already opened a probe whether google unfairly manipulates search results to favor its own services. >> eric: a builder would let san franciscans opt out of the yellow pages is closer to being law. board of supervisors gave an issue of approval yesterday. it sets up a three-year pilot project under which distributors will have to ask residents and businesses whether they want the directory before delivering it. the city would no longer have to spend million dollars a year

disposing of the yellow pages. they would lose a key source of advertising and threatening to sue. >> bart boards of directors will vote on adding televisions to some of their stations. it would show departing trains and weather forecast and connections to bus lines. they would show advertising slogans. bart could get $3.6 million in annual payments to the deal. >> lady gaga will unveil tracks in farmville. about 46 million people around the world play farmville every month. players will have to complete tasks to hear one exclusive new track per day from may 17th to 19th. album is due to be release order on may 23rd.

next couple of days cool whip laden morning with low clouds and patchy drizzle. once you get above it. pretty nice just about 2600 feet. talk about temperatures as you step outside this morning all of us now in the low to even mid-50s like the 53 in oakland. around the monterey bay and inland 49 or 51. got a full house there. talk about highlights slow sunshine today and much cooler breezes. clouds will see them with minimal drizzle like we're dealing with this morning. wet pattern, very unusual pattern setting up for may. locks in saturday night hangs around until tuesday and bring us waves of showers thunderstorms and even rain. here is the cold front responsible for changing our wind direction along the coast. now it's going to push that cooling even deeper inland.

check out how far it goes inland. it will take better part of the morning to get rid of it into valleys and about 2:00 finally be back to the coast keeping you in the 50s 50s around the bay and may see a few 70s. south bay it will be close to 69 in los gatos. you see the clouds lingering around the peninsula millbrae 59. palo alto at 65. mid-50s along the coast to upper 50s downtown san francisco and sausalito. low to mid-60s through most of the north bay valleys but the farther you go north into santa rosa and up to clearlake to mid-70s. fog will hold richmond and berkeley around 60 degrees. low to mid 50s for the rest of us. inland we'll see low to mid-70s. same thing with morgan hill

>> eric: it's 5:24. in alameda county they are concerned about an outbreak of the west nile virus. warming temperatures combined with rainy weather has made an ideal breeding ground for mosquitoes. they feed on infected birds and then transmit the virus to people and animals. officials say they are already

seeing more mosquitoes this year and residents are being encouraged to take precautions. experts say clearing stagnant water is key to controlling mosquito larva before they become adults. they recommend wearing long sleeve shirts and pants containing deet to help prevent mosquito bites. >> kristen: a kiatdz go report questions the high speed rail project. high speed rail is threatened by the state's budget crisis as well as questionable financing and management. this is animation provided by high speed rail authorities. they are suggesting the project be turned over to the state project of transportation for evaluation. >> eric: getting to south lake tahoe will be more difficult. for two weeks highway 50 is off-limits as caltrans replaces an old retaining wall. there are detours in place but tough timing for merchants for

a cool breeze dropping temperatures ten degrees today but wait until you see the weekend forecast. i found more chances of rain. >> still looking good at the bay bridge toll plaza but tracking an accident for you in the altamont pass. details coming up. >> kristen: 5:30. thank you for starting your day with us. >> eric: san jose police are looking for a motive behind a triple shooting at san jose state university in a parking garage that left three people dead. terry mcsweeney is live at the campus with the latest. >> reporter: here at south tenth street is where the parking garage is. half the garage is all parking. there are four stories of parking and the ground floor is dedicated to student services offices. the shooting happened on the fifth floor. take a look at the pictures.

cleanup is still underway. crime scene cleanup removing blood from one of parking spots in one of garages. san jose police are quoted as saying all three shooting victims are dead. one of them the gunman. they are not saying if any of the victims are students. they are saying that it was not gang-related. that it was an isolated skin. dozens of zuindz were not allowed to get back into their cars. some were upset with the notification system. >> i'm not part of alert system but nobody got an alert about what happened. i was actually in the classroom and my son heard it in the library. on. >> reporter: campus police are saying the threat was over before they could get the notification out to the

students. they are saying this garage here at south tenth and san fernando is going to open business as usual, as much as usual can be starting at 6:00 this morning. we're expecting a statement from san jose campus police in a short while. >> kristen: teachers are gathering in alameda as part of their week long campaign to secure state funding for schools. it comes in the wake of another two bay area school districts making further teachers cuts last night. amy hollyfield is live at alameda high school. >> reporter: we've seen a variety of protests but this morning here the alameda high school. they will be leafleting. teachers want to show all the work they take home. this is part of the state of emergency. they have floorns a week of protests including sit-ins at

the capitol. they want to extend temporary taxes to help fund education. they warrant warn that more cuts would be devastating. >> i used to have an average class of 29. all my classes are 34 or 35 kids. middle school is challenging enough and that makes a big difference. >> reporter: their protests this week but the cuts are still happening. they met last night both made unpopular decisions, 139 teachers will be getting pink slips from san francisco. more than 180 in mount diablo will be cut. which is why you see the protests like the one scheduled here at alameda high school this morning. >> eric: it's now 5:33. cal state trustee rz considering

a drastic plan to deal with one billion dollars in state budget cuts. it can includes 32% tuition hike but they say it would only happen if they adopt an all cuts budget. they plan to delay state admissions until it's finalized. a 32% increase would make it to over $6,000 a year. 20,000 applicants would be turned away in worse-case scenario. >> kristen: the yemeni man accused of trying to ram his way into cockpit is due back in court. 28-year-old rageh al-murisi. he is accused of trying to storm the cockpit on a flight on sunday night. one of the passengers that tackled him was larry wright a retired san mateo police officer. >> i thought he was trying to get into the flight crew.

>> he is not a terrorist. he is not a terrorist. >> kristen: his cousin says he is a nice man that went to new york to find work to support his wife and children in yemen. he was in federal court yesterday where the prosecutor called him a significant threat. >> eric: two bay area counties are cracking down on dog owners that can't control their pets. contra costa supervisors are considering an ordinance for stray dogs to be spayed or neutered. they would also receive a tracking microchip. an ordinance approved yesterday gives animal control officers wider authority to declare dogs potentially dangerous. it comes after a series of dog attacks including one that killed a child last year. >> kristen: crews are trying to restore water service to

you can see time i had left. to say it was a shock is just a complete understatement. i mean, i don't think there are words. she had put up a really good fight, but it was her time. you... don't have a choice of getting breast cancer. i had no choice. i wanted to do something bigger than myself. that 3-day gave me that opportunity. and i can actually do something to help. i think it's a very bold thing to do. 60 miles in 3 days-- i can do that. i'm sure if it was 100 miles we'd still walk it. it was a big statement for me of... (voice breaks) i'm alive.
