we have developing news out of oakland. a person is dead, another wounded, a third is in police custody after officers opened fire on them late last night. abc7's terry mcsweeney is live near the scene with more on this. terry? >> reporter: police are out here on the scene. ward lane near 35th and coolidge. if you take a look past me onward lane, you can still see officers down at the end of the block here. still investigating what happened last night. there are a lot of questions. take a look at pictures from the aftermath of the shooting. we are told about 10:30 last night, oakland police and reportedly drug enforcement agents were out here and involved in an operation. they are not saying what it was. oakland police officers opened fire and killed one man and gravely wounded a second man. the second man was taken to alameda county hospital and in grey condition. a third person was arrested. third person was arrested and oakland swat team called out at one point. two hours after the shooting 12:30 this morning, a third suspect was arrested hiding

under a tree in the backyard. weapon was recovered from the roof of a building. a number of other weapons found at the scene. just to recap oakland police came out here last night about 10:30. they're not saying exactly why. although dea agents were reportedly involved. one person shot and killed. another person shot gravely wounded. a third taken in to custody. live in oakland terry mcsweeney, abc7 news. >> terry thanks a lot. an autopsy on a man found buried in his backyard in february has not determined what killed him. novato police tell abc7 news they still can't rule out homicide in the death of 74-year-old dale smith. investigators searched smith's home and eventually found his body under a barbecue pit. an attorney for his wife says he died of natural causes. police say the body didn't show any obvious sign of trauma and the toxicology report did not detect poisoning. a major engineering feat this morning as a time piece of the massive new bay bridge tower is put in

place. the crowning glory, if you will, that enables an important function. abc7's amy hollyfield is live on treasure island to show us what is going on. amy? >> reporter: can you imagine their office this morning? it's behind me. they will be working 500 feet above the water today. taking on a project so enormous it will make history. this is such a big undertaking they held a dress rehearsal last month. caltrans officials shot video of their team practicing lifting of 960,000-pound bridge cable saddle. they will move it in place for real today. it will sit on top of the bay bridge's single suspension tower. this is the largest one in the world so they will make history today. it will carry the mile-long, single loop cable over the top of the tower. so another milestone to get it completed.

the eastern span is scheduled to open in 2013. live on treasure island, amy hollyfield, abc7 news. >> amy thank you very much. it's just about 5:04. the largest study ever done on the sex abuse scandal in the catholic church blames mostly get this, the '60s and the '70s for the problem. the study was funded in part by the church and contends the abuse was temporary issue. church abuse victims and other protesters have been vocal in the criticism of the church in recent years. the report by john jay college of criminal justice does chastise the church for ignoring the victims but a former victim says the church is hiding behind the study. >> the bishops by funding this study providing the information for the study only skews what the result of the study is. that is that everyone is to blame but the bishops, but the hierarchy. >> in an e-mail to abc7, diocese of oakland says it has not documented any abuse

by priests in the last 20 years and since 1988 they have taken steps to remove accused clergy from service and increase reporting of sex crime. the message declared the end of the earth of zapatas and they are making millions for those paying for the message. we have the story. >> reporter: the end is coming. or so say the electronic billboard by the bay bridge and interstate 80. people stop to take pictures, as family radio put out the word. >> absolute certainty. may 21 2011. >> on his wednesday night show on family radio, station president harold camping answered questions about the coming apocalypse he is predicting. the station is on haginberger road near oakland airport. the gates and doors were locked. but camping did talk to abc7 news by phone. >> it happens to be we are the generation that is at

the end whether we like it or not. it is going to happen. >> family radio has 66 stations that broadcast around the world. they raised over 100 million. much of it from donations. part of it spent on the flashy trucks and signs. camping claims that based on his complex biblical arithmetic, progressive earthquake will rattle the world this weekend. the faithful will be lifted to heaven and university will be annihilated in -- and the universe will be annihilated in five months. the host of "god talk" on sunday morning and professor of theology at the university and says camping's message will backfire. >> he pieces together little bit and portion of scripture and weaves it in his system that no one else agrees with causing panic and fear. in the end, making a mockery of christianity. >> leslie brinkley abc7 news 5:06. the abundance of rainfall

could be contributing to the death of sharks. dozens of leopard sharks washed up along san francisco bay shoreline over the last few months. a marine biologist with the department of fish and game told abc7 news that low is a lidty in the water -- solidity could be to blame. rainfall, finally say goodbye to us for a little while anyway. >> check in with mike on the forecast. >> i had to tweet breaking news. there is no rain in the forecast today. looking at the live doppler 7 h.d. good morning. it's quiet. talk about how temperatures are cooler than yesterday because of the cloud cover out there. we have 50s hanging around. half moon bay, san francisco, oakland, concord fairfield, antioch at 57. everybody else in the 40s. notice the peninsula coast,

it's cloudy. the north bay coast will clear out due to prevailing northwesterly wind. mid-to-upper 60s around san francisco, san mateo, oakland, richmond. san rafael. mid-70s through the north bay valleys. low to mid-70s. fremont, palo alto and south bay valley. in the east bay valley, the warmest weather, mid-to-upper 70s. we have 60 at monterey. breezy, a few clouds there. mid-to-upper 60s for the rest of the bay salinas and low to mid-70s inland. look at the accuweather seven-day forecast. update for the weekend, breezy and cooler. it looks like most of the rain will as we talk about move to our north. it's taking it out of the forecast. once the wind subside look for the warmer weather tuesday and wednesday. all right. bring frances in to find out about the commute. good morning. >> good morning mike. we head to hayward where there is roadwork blocking lanes on northbound 880 from tennyson to highway 92. that is scheduled until 6:00 this morning. they usually clear it earlier. the roadwork on eastbound 82 has been completely cleared

strauss-kahn denied the charge against him but said he felt compelled to step down. a judge refused him bail earlier in week saying he was a flight risk. three crew members escaped with minor injuries when a jet that refuels military planes burst in flames in southern california. the boeing 707 crashed on take-off from the air station which is 60 miles northwest of los angeles. the plane was carrying about 150,000 pounds of jet fuel. the national transportation safety board launched investigation. the f.d.a. says error by controller almost caused collision at the busy chicago o'hare airport. it happened in the confusion after a plane carrying vice president biden arrived monday. moments later, a sky west jet with 29 people on board was seconds away from touching down at the same time. and express jet plane was rolling toward take-off right in the first plane's path.

"washington post" quotes air traffic control recordings, one controller saying, "oh -- expletive." the angry express jet pilot said, "what -- expletive -- was that?" it was only avoided because a supervisor saw what was happening and ord terd sky jet plane to avert landing. students may see tuition increase in california next year if the governor's budget plan doesn't pan out. u.c. regents meeting at san francisco say in-state, undergraduate tuition may climb by 32% for the winter 2012 term. that is in the university system has to cut a billion dollars out of the budget. california residents would pay nearly $14,700 in annual tuition and that does not include room and board and campus fees. >> increased tuition is not the dilemma facing thousands of bay area college graduates next month. they are going to hit the workforce or try to, anyway. the outlook for new jobs is

grim. abc7's alan wang has the disappointing statistics they are facing but also a few encouraging signs. >> when devon graduates with degree from healthcare sciences from cal state east bay, he will face tough statistics. rutgers poll shows salaries are down and just over half of college grads are being hired. they are also having a harder time paying off student loans. the competition for jobs is fierce. >> they are looking for students who are good communicators. they're looking for students who have some experience. we think internships count for a great deal. >> now more students are contemplating a backup plan. >> i would probably try to get in to the peace corps. or maybe do some military work. >> the situation here at cal state east bay reflects the overall national picture for job prospects. but over at u.c. berkeley things look rosier.

u.c. berkeley said it had so many recruiters this year it had to expand the job fair an extra day. >> we are hearing from employers they have been holding back on their hiring plans and now they're a little bit more confident about their plans. that is why they are showing up at berkeley in larger and larger numbers. >> u.c. says the majority of new jobs are offered by high-tech industries. many of them expect to increase hiring by 13%. they may be picking from the top schools first. but the demand for fresh graduates is expected to trickle down. in the east bay alan wang, abc7 news. it's 5:16 now. the army corps of engineers says it doesn't expect as much floodwater as they previously thought. north of vicksburg mississippi, when the mississippi river crest in the area later on today. downstream in louisiana, officials released more water through a spillway near the town of cross springs to prevent flooding in new orleans and more populated areas.

nearly 5,000 people have been displaced by the record flooding in mississippi. record flooding, we are talking about 1927 1937 era floods. >> as you mentioned it is cresting now to 17 feet. the levees go up to 20. so sor fa, it's doing well -- so far, it's doing well. the tributary like the atchafalaya river is cresting. we still may have problems. >> the rain we have is over. get out and enjoy the sunshine. >> a lot of it. don't forget the sun screen. you may not have had to use it this spring but you will in the next couple of days. definitely this weekend. looking from mount tamalpais. you can see the clouds along the coast. spilling through the golden gate but having a hard time now. so for the most part it's clear. and cooler this morning. take a look at the temperatures. you can see where it was breezy. we just showed you, that is where the temperatures are

warmer as the air is mixing this morning, because of the winds. 52 at half moon bay. 50 at san francisco, fairfield. oakland, 51. 57 in antioch. the rest of us in the mid-to-upper 40s. until you get to napa. 42 degrees. cool spot. gilroy the cool spot around the monterey bay, inland neighborhood. 41 there. we have mid-to-upper 40s. santa cruz and watsonville and salinas and monterey in the low to mid-50s. sunshine warmer weather that dominates the first highlight. that happens this afternoon. breezy to windy. notice it doesn't say anything about rain. we talk about most of the rain missed us. i took it out of the forecast so you don't worry about it. let's start down in the south bay. the temperatures are getting back to average today. low to mid-70s here. cupertino and san jose, 72 degrees. on the peninsula, mid-to-upper 60s for the most part. menlo park and redwood city 69. farther south, palo alto and mountain view should touch

70 if not 71. clouds linger along the coast. pacifica and daly city may struggle to upper 50s. saucelito, low to mid-60s for you. beaches, breezy and sunshine. upper 50s. on the east bay shore, castro valley and fremont is 70. warmest weather is east bay valleys. mid-to-upper 70s. concord and 76. low to mid-70s morgan hill, gilroy and hollister. monterey at 60. watsonville is 65. santa cruz, 67. tonight, clouds along the peninsula coast. some of it will spill in the bay. it will be 50 in san francisco, oakland and antioch. mid-to-upper 40s for the rest of us. let's see the change in the pattern take place as we look at the satellite and the radar here. high pressure building over the entire west coast. pushing the jetstream or the storm track up north. this cold front will have an effect on our weather.

it will bring the breezes and the cooler conditions in. but all the energy and moisture will stay well north. we'll drop 6 to 8 degrees by monday. we will start gaining that back tuesday and wednesday when the winds come. have a great day. frances? >> a good looking seven-day forecast. you will find an easy ride this morning on bay area freeways. here is interstate 80 where the drive-time for headlights moving westbound is 18 minutes from the carquinez bridge to the maze. it's also been a good commute through contra costa county. 680 and walnut creek. no trouble at all as you move southbound. all the way down through the san ramon valley. and sunol grade to the south bay. we have a live shot in san jose at the 101 and 880 interchange. these headlights are north 101. and that's 880 right across the screen. mass transit systems report nothing delays. if you caught us earlier you know you can now refill clipper cards at any bart ticket machine. you can always get the

potatoes. the national potato council is not happy, they issued a statement saying there are no bad fruit or vegetables. in the stanley cup playoffs, sharks hope returning home to their fans will give them a lift. they're trailing 2-none in the western conference finals after last night's rout in vancouver. the canucks went ahead 3-2 in the second period and then broke the game open in the third. they scored four more goals. they beat the sharks 7-3. this morning, stage five of the tour of california kicks off this morning in monterey county. stage four started in downtown livermore yesterday, where merchants paid $50,000 to attract fans to the starting line and shop and restaurant. the punishing two-mile 1700-foot climb to the observatory was followed by a 3-1/2-mile dash down the

from where the shooting took place. look at the pictures from the aftermath of the shooting. it happened 10:30. oakland police and reportedly drug enforcement agents were out here involved in an operation. oakland police not saying much about what the operation was about. we know at 10:30 two oakland police officers opened fire, killing one man and gravely wounding a second man. he was taken to alameda county hospital. the oakland swat team came out and two hours after the shooting, 12:30 this morning, a third suspect was found hiding under a tree in the backyard of the house where the shootings had gone on. the weapon were seized at the scene. one was recovered on the roof of the building on curan avenue. oakland p.d. not explaining the operation the officers were involved in, what, or if the drug enforcement agents were out here as well. what we have right now the oakland police officers opened fire last night out here near 35th and coolidge. they killed one man. gravely wounded another.

twice. anyone with information about this man is urged to contact san jose police. the contra costa county health department is waiting for test results from the richmond health center. that is where an employee has died from legionnaires' disease. health officials say the disease is triggered when people breathe in infected steam or water vapor. it can be fatal between 5-30% of the time. contra costa county averages nearly ten cases per year. legionnaires' disease is caused by bacteria. it's not contagious, but similar bacteria made a richmond health center worker sick back in 2008. the center is still open pending the results of those tests. u.s. transportation secretary ray lahood and peninsula congresswoman jackie speier will visit san bruno this afternoon. they want to see the rupture site where last september pipeline exploded killing eight people and destroying dozens of homes. meantime, pg&e is warning state regulators again cutting pressure any further from the utilities national gas pipeline as a safety
