they got out of the plane on their own. no one was hurt. we will continue to follow that story for you and bring you new information. >> now our other top story. the search for a man accused of setting his girlfriend on fire in san francisco. police want to find 22-year-old dexter oliver after a young woman was found with severe burns. amy hollyfield joins from the burn center. how is she doing? >> i spoke with two sisters. the family hasn't been in to see her yet this morning but are waiting for more relatives to arrive from sacramento and trying to brace themselves for an afternoon visit here at the hospital. they have been told she can expect to be in the hospital for four to five months. >> we kept talking about it all night. it was hard to go to sleep. >> this has been so tough to deal with she hasn't even been able to bring herself to visit

her sister, starr lamare. she was set on fire yesterday and is in the hospital with burns do her face. witnesses, relatives and police believe her boyfriend, dexter oliver, is to blame. this morning, her family was shocked when oliver's grandmother called her mother. >> my mother thought she trusted him and let him survey in -- sty in the house and fed him, why would he do something like that to her baby. she tried to, the grandmother, she tried to defend her grandson and my mother wasn't hearing it. >> they think the grandmother is trying to get an update on the investigation and they called police. >> officers say there are no new developments but the family feels confident he will be found and hope he is taken alive the. >> death is too easy. you burned my sister alive. you stood there and poured gasoline on her and you set her

on fire. death is too good. he needs to it is and jail and think about what he did. >> i spoke with police. they are still looking for him. if and when they find minimum they plan to charge him with arson and attempted murder. starr lamare has three young children. her relatives are worried her five-year-old son may have seen her when she was on fire. they say if he did see it he isn't talking about it. he hasn't said anything. >> amy, thank you. police remain at the scene in hayward where a man and his dog were struck and killed while walking on train tracks. we were over the tracks follow the accident at 7:45. the man described as being to his 20's or 30's was walking his dog and pushing a bicycle across the tracks when a track southbound hit them. the man's identity has not been released. in san jose, thieves stole a van

belonging to a dog difficult spa operation and ran it into a head shop called "up in smoke." the place was demolished and witnesses saw several men running from the scene. while the damage is assessed the owner reports the thieves took off with a water pipe from the store. >> the f.b.i. is planning to excavate a well in central california where bone fragments connected to a northern california disappearance were found. this is in linden, an investigation scene since two convicted killers told the sheriff deputies where victims were disposed. the so-called speed freak killers convicted of serial murders from the 80's and in knew's, and nine-year-old michaela disappeared from a gracery store in 1998 and the family is waiting to see if d.n.a. recovered from the bone fragments could solve their case. >> oakland lawmaker take steps to tighten sales of ammunition in the state.

assembly woman of the state joined a host others to introduce state bill ab48, that regulates all ammunition sales and require those who buy it to show identification. it would also ban conversion kits. >> the kits that allow you to convert a weapon to be able to shoot bullets fast without reloading. that's another thing that this bill does, eliminates that. >> oakland mayor also spoke to the ground. the bill requires ammunition dealers to be licensed and they be required to report those sales to the justice department. >> happening now the oakland city council is getting a brand new look, free new city council members are sworn into office at this hour and two them have never held elected office before. environmental advocate and an affordable housing advocate who will replace a council veteran from west oakland. the third new member will

some are already proving to be controversial. our reporter is live in the newsroom with the latest. >> the last hour, president obama announced the nomination for two very important cabinet positions. republican chuck hagel for secretary of against and john brennan for director of the c.i.a. both picks are criticized by both parties. decorated vietnam veteran and former nebraska senator hagel has made comments not forgotten and could lead to tough questioning and a long confirmation process. back in 2010 he called the troop surge in iraq a "mistake," drawing criticism great his party. today, president obama stands by his decision saying "chuck hagel is the leader our troops deserve identity noting the involvement with the v.a. and uso he would be the first of enlisted rank to serve as secretary of defense. one of the few secretary whose have been wounded in war. and the first vietnam veteran to

the f.a.a. is sending an investigator to find out what happened. there were two people on board, both of those people are safe. we have been here and the ambulance came and left. they did not require treatment. so they got out okay. we have checked the records of the tail number and found the aircraft, a single engine colombia aircraft is registered to a private owner in scottsdal, arizona. now we will pull back and see more of the scene here. we have had responses from the fire and of course from other emergency agencies and we will try to track down the owners and see if they are able to talk to us. we are live in san carlos for abc7 news. >> david, thank you very much. the chairman of mountain view based google is in north korea right now for a mysterious and

controversial visit. this video from north korean news agency showing he and former new mexico governor richardson arriving in pyongyang. the two are in the country if four days. richardson travels to north korea frequently but the participation of schmidt is drawing speculation they may try to negotiate the release of an american figure. >> schmidt is a friend of mine, interested in foreign policy. this is not a google trip. he is interested in foreign policy. i am sure he is interested in the economic issues there and the social media aspect. this is why we have teamed up on this trip. >> the u.s. state department is criticizing the google chairman's timing and the visit comes weeks after a controversial north korean rocket launch. >> the fog just hanging tough for us this morning and visibility was low. did you encounter anything?

morning. the temperatures are in the upper 40's to low 50's here and also around the monterey bay. hazy sunshine. filtered sunshine. it is hazy because of the clouds you saw at the lower end of the atmosphere. and filtered because of the high clouds. tomorrow is the warmest day ahead of a mid-week cool snap that brings a chance of scattered showers. the snow levels could drop to 2,000 feet. today, we will have temperatures from 56 in antioch. san francisco is on the cool end and 60 in napa and santa rosa is 61. upper 50's around the monterey bay and headed inland. tonight, there will be fog again and i don't think we will be freezing like this morning. frost is going to be minimal, and freezing fog not tonight. 39 is the cool end at santa

rosa, the low yesterday was headed toward the baja with the high clouds coming in as the next system is pushed to the northern of us because of this area of high pressure and this area of high pressure. here is what is going to happen going forward. wednesday, at 5:00, remember this is a very large grid on this because the further you go out you cannot crunch so much. this is painting a wide picture of light rain on wednesday evening. the bulk of the storm stays over the mountains and over the beaches and toward the ocean. it looks like wednesday night into thursday morning is our best chance of seeing anything we as far as precipitation that is measurable. we will have scattered showers on thursday. that can bump into the higher elevation. after frost is possible on friday morning, saturday and sunday will be warmer in the afternoon. now the big
