>> announcer: live where you live, this is "abc 7 news." ♪ a south bay man gund down inside his own store. tonight grieving friends, family and customers gathered to honor the man they say was fiercely protective of his family. i'm dan ashley. >> i'm ama daetz. the vigil came hours after police announced they made an arrest, but tonight focus was on the victim. >> charlie ly was shot and killed inside his own store on monday night. "abc 7 news" reporter katie marzullo is live at the san jose police department with new developments this evening. d, a ly was much more than a liquor store owner to his customers. tonight they told stories of his generosity and friendship. >> kyle, david, jacob will continue to live out his enduring legacy. >> reporter: more than 100 people gathered at jim's liquor

mart to honor the long-time owner. >> he helped me tear apart my entire vehicle in his parking lot and helped me fix it. has given me things when i was in need. >> even when you don't have the right money to pay for him, he said, bring it later. he trusted the people that goes around his store. >> reporter: ly was known to be fiercely protective of his family. his wife was working alongside him when he was shot and killed monday night. thursday police arrested 21 year old muniumee in merced. they recovered a handgun they believe was used in the shooting. >> unbelievable investigative work. i'm giving you the tip of the iceberg of what the detectives had and did. >> reporter: he said video surveillance from the v vital i investigation. during the investigation he was trying to sell personal items that linked him to the crime. >> at least have closure and relief for the family that

justice has been served. >> reporter: hendrix was on probation for possession of a loaded firearm. in san jose, katie marzullo, "abc 7 news." developing news tonight. napa county where sky 7 shows a 114 acre grass fire threatening homes and forced evacuations of people and at least 50 horses. the canyon fire started around 1:00 this afternoon near highway 128 in sage canyon road on the west side of lake bariessa. one firefighters suffered minor injury. containment is up to 95% thanks to light wind and cooler temperature also. >> what can firefighters expect on the fire lines as they continue to deal with this all weekend? how about the forecast? >> here is meteorologist sandhya patel with the latest. >> dan and ama, let's check out current conditions near the fire line. it is much cooler and the humidity has come up. 74 degrees right now, 25% relative humidity. what is not so great is this is the wind condition right now. winds are gusting to 16 miles an hour, making it a challenge for

the fire crews there. the gusty winds will taper overnight tonight, only to pick back up again tomorrow afternoon/evening. hopefully they get a handle on the fire before tomorrow afternoon and as you look here, forecast definitely running monday rat near that area. when you check out the rest of the bay area, yes, we are looking at some areas of yellow, indicating high fire danger this weekend. i will be back with a complete look at the forecast coming up. dan, ama. >> thank, sandhya. in morgan hill firefighters will be watching hot spots overnight from a 100 acre fire on the north end of the city. the tilton started just before 3:00 this afternoon. you can see the smoke drifting over the homes on morgan hill webcam. this fire is just 5% contained for the third night in a row, the nuclear threat from north korea is front and center. president trump and north korean leader kim jong-un continue to trade barbs and tensions continue to rise. the president's latest promise saying the military is locked

and loaded. abc news reporter emily rowe is in washington. >> reporter: as president trump met with his national security team at his new jersey golf club, b-1 bombers were flying practice missions above the pacific. >> if he does anything with respect to guam or any place else that's an american territory or an american ally, he will truly regret it, and he will regret it fast. >> reporter: for the third day in a row, the president sending a clear message. >> if anything happens to guam, there's going to be big, big trouble in north korea. >> reporter: u.s. officials insisting they're ready. >> the u.s. military has been planning for north korean aggression for 60 years. they're ready and not going to get caught off guard. >> reporter: but the u.s. territory of guam sitting in the crosshairs. >> it is pretty scary, the thought of it. >> reporter: the government distributing pamphlets detailing how to shelter in place in case of attack by sealing off doors and windows, and families trying

to go about their lives with that specific threat from north korea fast approaching. >> we are staying calm, living our lives, but, yet at the same time making preparations. >> reporter: president trump is staying tight lipped about specific military options, but we do know those back channel negotiations that have been going on with north korea for months continue. emily rowe, abc news, washington. roanoke parks department of public safety is warning people tonight a convicted sexual predator wants to move to the sonoma county city. take a look at 33 year old daniel sicilley. detectives fear he poses a high risk of convicting another sex crime. he has called himself a downtown l.a. predator. he is not allowed to be around schools or playgrounds. in san francisco police hope you will recognize this man. police suspect him of attacking a woman by dumping bleach on her. it happened around 7:30 in the

evening on july 30th. these surveillance images were captured nearby outside the bart station. >> you are looking at a car fire that delayed commuters headed toward the tunnel in oakland. the car burst into flames near highway 13 just after 5:00 as the evening commute was getting under way. emergency vehicles blocked the two right lanes while crews fought the fire and a tow truck removed the car the effort to recall judge aaron persky is on hold tonight. supporters of the recall believe he has a pattern of bias in cases involving sex crimes and violence against women including the brock turner case. persky's lawyers obtained a new court order temporarily blocking the recall committee from collecting signature they say the petition was not properly certified by the state. "abc 7 news" spoke with both sides today. >> the recall is going forward no matter how much taxparye per

waste. >> he deserves his day in court. he deserves a fair hearing. he deserves fair consideration by the people of this county. >> a judge will rule on the petition on august 23rd. new at 11:00, a marine recruiter and his family relocated to the north bay only to have the u haul carrying all belongings stolen. >> making the situation worst, the marine says he was charged for damage to the stolen vehicle. >> katie utehs has the story from santa rosa. >> reporter: marine corps sergeant located to santa rosa with his wife and four-year-old daughter. >> i came with the mission to try to help people, you know, change their lives for the better. >> reporter: but his latest mission has been replacing all of their belongings after someone stole their u haul. >> we got here pretty late in the night, and for the military move i have to weigh my belongings as part of the process for our logistics. so it was too late in the day to

trt a weight ticket for the uc cargo area and parked it on the street near their apartment. the thieves hot wired the van and ditched it here, however the shop center's cameras were broken. >> i think the hardest was like her baby pictures, her newborn pictures and videos. to like not be able to get those back, i think that's very upsetting. >> the sergeant, his wife and their four-year-old didn't lose a u haul, they lost everything. >> reporter: the nonprofit wine country marines got permission from the marines corps to fund raise for the family. >> the very best is gift cards because that way you don't get two sets of something. >> there's a lot of brotherhood. >> reporter: the sergeant says he bought the extra u haul insurance but he's told it doesn't cover his property and he's being charged for the damage to the truck. we reached out to u haul this evening and are awaiting word back on the details of the insurance policy. in santa rosa, katie "abc
