i'm dan ashley. tonight, a federal appeals court decided to leave president trump in command of the troops in los angeles. while california fights its legal battle. both sides are due back in san francisco in a courtroom in just hours. abc seven news reporter tara campbell has reaction from state leaders and the president. >> a federal appeals court handing governor newsom a loss tonight in his battle to regain control of thousands of national guard troops sent to los angeles by president trump. the president, on social media declaring the decision, quote, a big win in the ninth circuit court of appeals on the president's core power to call in the national guard. last week, u.s. district court judge charles breyer ruled trump had overstepped and control was supposed to go back to the governor on friday. however, an appeals court quickly halted that order until it could hold a hearing this past tuesday. in its ruling tonight, the three judge panel agreed with the state and said the chaos in los angeles was worthy for the president to deploy the guard.

the governor issuing a statement reading in part, the president is not a king and is not above the law. we will press forward with our challenge to president trump's authoritarian use of u.s. military soldiers against citizens. attorney general rob bonta reiterating that commitment, stating in part, while it's disappointing that our temporary restraining order has been stayed pending the federal government's appeal, this case is far from over. as for next steps, everything remains on hold pending appeal, and experts expect the case will go all the way to the supreme court. >> the supreme court can decide to take the case, or they can decide to not take the case and let the lower court ruling hold. so just because we know that no matter what, there's probably going to be an appeal, doesn't mean that the supreme court will absolutely make a decision. but they can also make a decision by not making a decision. so if they choose not to take the case, that's saying we don't see a need to reconsider. the ninth circuit decision. we're going to

just let that stand. >> the case goes back to judge breyer's courtroom friday, where he will weigh whether to issue a more detailed order restricting what the president can do with the roughly 4000 national guard troops and 700 active duty marines in los angeles. tara campbell, abc seven news. >> and needless to say, we will be closely watching tomorrow's hearing in san francisco. we'll also keep an eye on whether california appeals tonight's decision to the full ninth circuit, or if it goes straight to the supreme court. we'll send alerts for any significant developments through our abc seven news app. so look for those. well, today's high winds toppled a parklet in san francisco. this was the scene outside the radio habana social club on valencia street in the mission. caution tape was put up to keep pedestrians and cyclists away and safe. also in the city, winds took down a tree on octavia boulevard at oak street. that caused some disruptions for the evening commute. this is the stretch where drivers get into the onto the 101 freeway. police

had to divert traffic as a result. and just two blocks away at oak and buchanan, another tree fell on top of a parked car. no one hurt there, and we are tracking significant power outages in the east bay tonight, on top of planned power shutoffs for fire danger, tens of thousands of people are without power in tracy and manteca. that's the orange on the p-g-and-e's outage map that you see here. it's not clear what caused those outages in the pink. you can see the power shutoffs, the deliberate shutoffs covering parts of eastern contra costa county. here's the power shutoff breakdown by county. 650 customers in alameda. 275 in contra costa and 44 in santa clara. the shutoffs are expected to last until saturday, after which p-g-and-e's crews will inspect the lines before restoring power. well, the fire danger and the windy weather are really not over yet, unfortunately. let's go to abc seven news meteorologist sandhya patel with a look at the dry and

sandy, windy conditions. >> and concerning dan. the winds have been ramping up raising that fire danger today and it's going to remain elevated heading into the weekend. take a look at these live pictures. mount tam is bouncing up and down. kgo roof camera showing you the flag blowing around in the wind. it is certainly gusty over the higher terrain. mount diablo 39 miles an hour 30 at the oakland hills. you will notice even at the lower elevations, winds 32 uh- gusts for concord and 29 right now in oakland, topping 40 miles an hour along the coastline tonight going into tomorrow morning, inland areas. the winds back off just briefly tomorrow morning, only to pick back up again tomorrow afternoon. they will be increasing anywhere between 25 to 41 miles an hour. with that comes a heightened fire danger, and it will be elevated into the high to very high category for parts of our inland areas, the valleys and the hills. and they've already issued a fire weather watch for solano county

saturday morning, 8 a.m. until 11 a.m. sunday. those winds are going to come out of the north, gusting 30 to 40. relative humidity is low 15 to 25%, and that means the danger for any fires to rapidly spread will be high. you take a look at the pattern here. there's a trough that's been deepening and the wind is coming roaring in off the ocean. that onshore wind will remain with us. i'll let you know exactly how long. coming right up. dan. >> okay, sandhya, thanks very much. let's go back to p-g-and-e's for a moment. facing a new multi-million dollar fine tied to a fire on the peninsula. the edgewood fire sparked near woodside back in 2022. state regulators say the company put off maintenance that could have prevented it. the fine is more than $7 million, which, keep in mind, is less than what p-g-and-e's earned in a day over the first quarter of this year. abc seven news reporter lauren martinez has new details on the investigation. >> behind the. >> p-g-and-e's is being fined $7 million and could potentially

face criminal penalties. it stems from a fire that broke out in woodside in san mateo county in june of 2022. no structures were damaged, but four firefighters were injured. the california public utilities commission began its investigation the day after it broke out through its findings. p-g-and-e's is being cited for ten violations. the cpuc says the cause of the fire was most likely contact or arcing between two circuits. we spoke with mark toney, executive director of the utility reform network. >> we're not talking about a tree falling against the wire. we're not talking about, you know, high winds. we're talking about two lines that got so close together that electricity jumped from one to the other and caused a fire. >> the cpuc's report explains that p-g-and-e's had evidence of the wires not meeting minimum clearance requirements back in 2016. yet for nearly six years, no clear action was taken to address the issue. in that time, the report says the area was

inspected 19 times, but p-g-and-e's logged no additional warnings. >> inspections are good. it's good p-g-and-e's doing inspections, but they need to follow that up with taking the action for safety. >> toney said. the $7 million fine will be paid by shareholders, not customers. we reached out to p-g-and-e's regarding the citation and are waiting to hear back. district attorney stephen wagstaffe told abc seven his office has considered both criminal and civil penalties in the south bay. lauren martinez, abc seven news. >> tonight, a pivotal countdown at the white house as president trump sets a two week window to decide whether to order a strike on iran. israel and iran are still trading attacks tonight. right now, a fire is burning near a microsoft office in israel after reports of falling munitions in that area. abc news reporter zohreen shah explains president trump's options. >> tonight. tension at a

breaking point as israel and iran exchange fire. president trump now says a decision is coming and soon. >> i have a message directly from the president, and i quote, based on the fact that there's a substantial chance of negotiations that may or may not take place with iran in the near future, i will make my decision. whether or not to go within the next two weeks. >> is he saying that if iran does not come back to the negotiating table within the next two weeks, that the president will strike? >> the president is saying that he will make a decision whether or not to go within the next two weeks. it's very clear and direct. >> sources tell abc news the president has now met with his national security team for three straight days in the situation room. the white house warning tonight iran has what it needs to make a nuclear weapon, and that a decision just needs to come from its supreme leader, adding that it could take just a couple of weeks to complete production. but there's currently no evidence to support those claims. one u.s. intelligence official telling

abc the decision also hinges on the timing of u.s. military reinforcements, with key naval forces still days away from the region, and now pressure from within. the president reportedly wrestling with division inside his own party. one aide describing him as trying to psych himself up, needing to convince himself that whatever move he makes is justified. today, a familiar face at the white house, former trump administration chief strategist steve bannon. he's said to be urging caution. and while the president stalls, israel's prime minister appears to grow anxious. >> president trump will do what's best for america. i trust his judgment. >> all this coming as european leaders are set to meet tomorrow in geneva, the first time they will be coming together in person since the conflict in iran and israel escalated. zohreen shah, abc news, los angeles. >> back here. police in the east bay busted a car. break-in crew and the suspects are all kids.

livermore police say three children are accused of breaking into 49 cars in less than a month. the kids are 12, 14 and 15 years old. police say all of the burglaries happened overnight in the downtown area from early may to early june. the suspects smashed windows and stole items like wallets, sunglasses, battery packs, whatever they could grab. the children were all cited two weeks ago and released to their parents. police say they could not go to juvenile hall because they are not accused of violent crimes. well, an exciting night for the golden state valkyries. they defeated the indiana fever and the player who is the face of the wnba, caitlin clark. fans at chase center were really fired up for her first visit to the bay area. >> the energy is really good. the fans are here for it. >> the fact that she's as amazing as she is also a big draw. so tonight is really special for everybody. >> we spotted several fans wearing clark's jersey and some signs with her number 22. across

juneteenth block party. they were kicking off a season of unstaged third thursday events on market street. tonight was about creativity, community, fashion and music. it was the first event in the mid market entertainment zone, allowing attendees to grab a drink and go explore the block. bigger celebration to come on sunday in the city. the juneteenth parade will kick off at 11 a.m. at market and spear streets. if you want to snag a good spot to watch, the route runs west toward eighth and market. pro tip there will be floats, street performers, block parties, a kid zone and a car show should be an absolute blast. landslides are delaying the opening of a new public beach park south of half moon bay. don horsley county park at tunitas creek beach was set to open this summer. that was the plan, but that's not going to happen now. it's been pushed back by a year. san mateo county park officials say two large landslides are

undercutting the main access road to the beach. while repairs are underway. work will continue on visitor facilities. the 58 acre coastal property was once owned by singer chris isaak. by the way, tesla is set to launch its automated robo taxi this weekend in austin, but democratic texas lawmakers want to put the brakes on that plan. they're asking tesla to wait until september, when a new autonomous driving law takes effect. if the company decides to move forward with a launch this month, lawmakers ask for detailed information on how tesla will comply with the law. it would require autonomous vehicle companies to apply for authorization to operate in texas. this way, they could revoke permits if the vehicle endangers the public. >> i want to make sure that our community is as safe as possible when they launch the new robo taxis. >> it's not clear whether a letter from democratic leaders will hold much weight with the company in a state where republicans hold the majority.

so we shall see. more than ten years after california became the first state to ban plastic bags, new research shows how it's paying off. turns out you can see the bag ban benefits on our shorelines. a new study tracked how many plastic bags people picked up in beach cleanups. the amount of plastic bag litter dropped by as much as 47% in places with bans, nearly half in those areas with bans. a new california bag ban is kicking in next year, banning the thicker plastic bags that you can still get at stores. all right, let's go back and talk about the forecast. we are concerned about fire danger, of course, and the weekend is upon us as well. sandy is back with that. >> yeah. dan, you know what? the windy pattern and the fire danger will remain elevated going into the weekend. right now i want to show you a live view from our mount tam cam. and this camera is bouncing around as we look towards the city by the bay. this is how you're going to encounter. this is what you're going to encounter

tomorrow morning during the commute as well. peak gusts so far 61. altamont 51 at sfo, 52 sunol ridge. you'll notice 50 there at point reyes oakland airport, 40 sweeney ridge, 54 miles an hour. here are the winds right now. gusty still 30 oakland hills 40, mount diablo 32. at spring valley, even the lower elevations. we are seeing some gusty spots right through this region here. 25 sfo 32 at concord. we're going to go hour by hour. and tonight, if you're a light sleeper, the winds will probably keep you up, especially near the coast and over the higher terrain going into tomorrow morning. 43 there, point reyes, half moon bay 36. the winds will remain gusty even into the afternoon and really increasing through much of the inland area as well. san francisco 3327 discovery bay. you'll notice by the evening topping 40 miles an hour. here's a concern. you've got the dry vegetation humidity values. while they are okay tonight, going into tomorrow morning,

there's still elevated. but look what happens. they really start to drop tomorrow afternoon. 15% fairfield, 17% there in napa. and with this windy pattern, a combination of the lower humidity, the fire danger is running higher than it should be. a low pressure system has been deepening. the winds are really cranking, moving from the ocean towards the land. so we'll keep that pattern going as we head into the next couple of days. on live doppler seven, we are noticing some low clouds right near the coast and around the bay. tomorrow we're going to notice these temperatures are not going to rise a whole lot. today's high temperatures are anywhere from the low 60s to the low 80s. right now you're in the 50s and 60s so cooled off really well. numbers are running lower than where they were yesterday, just about everywhere. 14 degrees in concord. here's a live view from kgo roof, where the flag is blowing around through the next few days. gusty winds, fire danger. tomorrow, summer starts at 742 at night and it's not going to feel like it this weekend. still windy,
