sharie johnson talked with the attorney behind the lawsuit... who says the school district's actions we're negligent. ((sharie johnson)) the attorney behind this case is a high-profile attorney... and a las vegas native who is a product of the clark county school district. robert eglet. before i run down the lawsuit... let me give you the background of the teacher at the center of the controversy. you might remember jeremiah mazo. he was first arrested in 2008 by north las vegas police for allegedly molesting students. at that time he taught at simmons elementary school. the case was dismissed because of a lack of evidence. ccsd transferred him to hayden elementary. but last year... he was arrested again.. pleading guilty to lesser charges... sentenced to 60 years in prison. parents of alleged victims filed the suit... believing the district should have warned all parents of mazo's past... preventing inapproprate sex acts at school. ((robert eglet, senior partner, eglet prince

((sharie johnson)) eglet says they want to make sure this never happens to another child. ((denise valdez)) sharie, what procedures should have been followed? sharie johnson ccsd wouldn't say anything beyond the statement. but eglet says it's clear the school district either doesn't have the proper procedures in place... or they're not following them. the las vegas strip is getting a lot of attention across the country. now the attorney representing the woman in this case is explaining why he thinks his client is being unfairly prosecuted. paul joncich joins us with more about the incident. ((paul joncich)) the attorney for 21-year-old chloe scardianos says the two were drunk... and thought no one would see them when they decided to have sex in one of the pods of the high roller. this all happened on friday afternoon.. around 3 p-m. scardianos and 27 year old philip panzicas were inside a pod....when according to the police report an attendant noticed they started to undress and have sex. the attendent told them over the intercom to stop and get dressed, but the couple only stopped momentarily and then continued on. scardinanos attorney chris rasmussen says they could not understand the commands and says they had no ill intent in their actions... he spoke via facetime to our affiliate in houston.. ((chris rasmussen/attorne y for chloe scordianos) "they didn't enter this cabin to commit a sex act, this wasn't their intent. they were intoxicated which

such as this, and i believe as they are charged they are not guilty." "in 18 years of practicing, i've never seen this charge" )) ((paul joncich)) people in the pod next to them noticed what was happening and some took out their phones to record it. security and the manager for the high roller told police sex acts in the pods are happening more often and they fear it will impact their reputation and business. we're also learning a little more about panzica... it turns out this is not his first run in with the law... about ten years ago in texas, where he is from, he faced numerous charges including possession of marijuana, burglary and d-u-i. ((paul joncich)) the pair faces charges of commissions of certain sex acts in public. and while the couple thought the spacing of the pods and the slow speed protected them from being seen... the pods are encased in floor to ceiling windows allowing numerous opportunities for those inside to be seen. they're scheduled to be back in court next month./// ((dave courvoisier)) > we asked

it happened inside the rosemont gated community near hualapai and desert inn.. at around 4 o'clock this morning. a man and a teenage girl were both shot and are in critical condition. police think the suspects and victims knew each other.. and say this was not a random incident. a handgun was found in a park across the street. but they do not have a suspect description.. and are asking people to call crimestoppers if they know anything./// ((dave courvoisier)) > the county clerk is expecting a lot of valentine's day weddings over the weekend. the county says making it a long holiday because of president's day.. will only make it busier. they are encouraging couples to complete the marriage license pre- application on their website. valentine's day.. and the day right before... are typically the busiest days of the year to get married. last year they issued more than 16-hundred licenses over the weekend./// ((denise valdez)) > a water heater on the fritz: (( we had a problem with um abnormal color coming out of our faucet it was brownish orange color))

company had a local woman turning to 8 on your side for help. her water heater broke and she wanted a new one ... but the warranty company said no. ((denise valdez)) consumer advocate michelle mortensen uncovered the reason why... and it might just have you questioning your home warranty contract if you have one ((michelle mortensen)) we get these complaints a lot. people buy home warranties and think they're a get out of jail get out of jail free card. but that's not how it always works.

and even if you do get a replacement ... it might not be what you think it is. < your water heater might just be the least talked about item in your home.... unless it stops working. ((we had a problem with um abnormal color coming out of our faucet it was brownish orange color. )) sarahetta thompson's water heater first went on the fritz in 2011. back then her home warranty company offered to replace it for her ... and it only cost her $55. but fast forward to the end of 2015 .... and the gross colored water was back. ((so i called and i requested a service call)) once again she needed a new water heater ... but this time... ((they said they can replace it for 2300 dollars)) why the big difference? well ... lets rewind to 2011. ((they installed a 2004 water heater in 2011 )) yep ... they gave her a much older model when they offered that practically free replacement. sarahetta turned to 8 on your side seeking justice ...
6:15 pm
justice had been served. the fine print spelled out everything. the company contractually didn't have to replace anything in her home with something new ... just something "similar" and the contract strictly states the company has sole discretion in everything. ((sarhetta: so basically they aren't responsible for much)) sarahetta ended up buying a new water heater ... but as a concession ... the home warranty did chip in $500. ((what do you think of home warranties now? well i canceled another .. so that's what i think (laughs) )) > ((michelle mortensen)) the take away here is ... if you invest in a home warranty company .. research the one you pick and read all the fine print of the contract. you'll lower the risk for surprises ... and disappointments .. if you do.

clinton will leave the state with more delegates. the reason is super- delegates. they are party officials or sitting members of congress who can support the candidate of thier choice... and nearly all of them across the country have pledged themselves to clinton. adding in those who have already declared their support... clinton has 394 delegates already. sanders has 42. 2-thousand 382 are needed for the democratic nomination. republicans do not have super delegates... so their delegate count stands like this: donald trump: 17 ted cruz: 10 marco rubio: 7 john kasich: 4 jeb bush: 3 one thousand- ,237 delegates are needed for a republican to win. carly fiorina and chris christie both dropped out of the race today./// ((denise valdez)) > don't forget... we are your local election headquarters throughout the season... on air and online./// > ((dave courvoisier)) the rebels are back on the court
