>> we are waking up to a lot of low clouds around the bay area and misty skies. 60 in san jose, mainly cloudy skies between san francisco and the coast. you know the story about the weather. drizzle for the morning, for the afternoon, more mild weather. mid 70s san jose, 60s san francisco. the seven-day forecast perhaps finally showing signs of summer coming back. brent? >> new this morning, a violent night in san francisco. two shootings and one person is dead, as many as five people were hit. both shootings happened near city nightclubs about a mile apart. kris sanchez is live in san francisco now. she has a look at what happened. kris? >> reporter: good morning to you. police quick to say they don't think the two shootings, one that happened last night and one this morning, are related. but we know they happened outside popular nightclubs in san francisco. the latest happened about three hours ago outside the 1015 nightclub. the building with the green light. now, the shooting did not happen

there. rather down the way in an alley a few doors down. here, two women were shot in the gunfire but are expected to be okay. they are being transported to the hospital. that's not the case for the woman who was shot earlier last night outside another nightclub. this woman shot outside the ruby sky nightclub, that nightclub was closed at the time, but that woman died from her injuries. another woman and a man were also treated but will survive. in each shooting, police are investigating and have not identified suspects. but we can tell you last months there was a deadly shooting outside a different nightclub. six months ago there were almost 50 rounds fired outside the suede nightclub. that club is still shut down. all of these shootings in the last six months are likely to fuel the debate about what should happen with violent nightclubs and who should have the right to shut down the party. kris sanchez, nbc bay area news. last night's shooting makes five people killed near san francisco nightclubs this past year.

police are trying to make things safer, but until now that process to shut down a dangerous nightclub has been limited. that's why the city is trying to form a new entertainment commission t would have the power to revoke a club's license if there are continuing problems that make the club a public nuisance. one member of the commission says most nightclubs responsible however there are a few he would like to shut down. >> you want to take these guys and say you don't belong running a nightclub. find another line of work. i can't name names because some of them are still operating. but i can tell you definitely i can think of three or four. san jose police are looking for a gunman that shot at an suv on 680 injuring a passenger. the shooting happened just

before 9:00 saturday night. first at the mckee road exit near san jose. the driver of a white chevy trailblazer opened fire on a silver dodge durango hitting the car four times. a passenger riding in the back seat was shot once in the back. the suspect, the man said to be in his mid 20s, was rushed to the hospital where he is expected to survive. police say the incident happened -- started on city streets and then moved to the freeway. from what i was told, they stopped at a stop light. one person had his music really loud. they were looking at each other. i want to say some words were mouthed to each other. i don't know if the windows were down. they were screaming at each other. that made somebody angry and it escalated from there. police continue to look for a suspect, a man and a woman who was riding with him in the car. we are learning more about the woman at the center of a

scandal that cost one of the country's highest profile ceos his job. jodie fisher unexpectedly announced her role in a controversy at hewlett-packard on sunday. kimberly tere tells us more about fisher. >> reporter: the woman whose sexual harassment claim led to mark hurd's downfall said she never intended for him to lose his job. >> pleasure to meet you. >> great to meet you. >> reporter: jodie fisher, a 50-year-old actress who appear in the reality show "age of love" said she was surprised and saddened hurd stepped down friday. lawyers for fisher reportedly contacted hp in june alleging sexual harassment by hurd. the tech giant's board found the former ceo falsified expenses to hide numerous dinners with fisher. fisher said in a statement through her attorney that she and the former ceo did not have

an affair or intimate sexual relationship. she also said "i resolved my claim with mark privately. without litigation. and i do not intend to comment on it further. i wish mark, his family and hp the best." fisher claims she knew hurd through her work with hp's marketing department. she was reportedly paid up to $5,000 for each event she was hired to put together for the silicon valley company. part of her job was to greet people and make introductions among executives. according to allred, fisher is a single mom focused on raising her young son. in addition to appearing in small films and commercials, allred said fisher has worked in sales and served as vice president of a commercial real estate company. kimberly tere, nbc bay area news. hewlett packet has been forced toed a just several new leaders over the past decade. hurd became ceo after the hb board ousted carly fiorina.

a little year after taking the reins, hurd also became chairman of the board after patricia dunn left. she was forced out after boardroom leaks to the media. we will look at how wall street is reacting to this new news coming up. we are still waiting to find out if same-sex marriages can resume across the state. there is a stay in place while last week's overruling of proposition 8 is appealed. a decision is not expected until later this week. give alcohol to a minor and you could face hefty fines. the teen alcohol safety act is now on governor schwarzenegger's desk. it would allow parents to sue party hosts if they serve alcohol to a miner who is subsequently injured or killed. current law protects adults over 21 from being sued even if they knowingly give alcohol that results in injury or death to a minor.

the new law would not apply to licensed commercial alcohol vendors. drilling for the fourth bore of the caldecott tunnel starts in the east bay this november. it comes with a $420 million price tag even though it is not expected to save most traditional commuters any time. that's because two tunnels are open for commuters headed into the city and four are open for them to leave at night. the new fourth bore will simply mean four lanes will be open at all times and will only ease traffic for the reverse commute. >> it's an awful lot of money. and it's only going to help the reverse commute. the morning commute from orinda into the city will be as bad as it has ever been. same at night when it's even worse coming up the hill, out of the tunnel out of the city. >> they need a whole new tunnel. the reverse commute can have major back-ups, especially on the weekend when people are trying to get to san francisco. the project is expected to be done in three years.

welcome back, 5:13 right now. nice shot of the bay bridge, what you can't see there is what it feels like. it's cool around the bay area. cool temperatures hanging aro d around. two teens trying to get high sparked more than their marijuana cigarettes. fire investigators arrested a 14-year-old boy and his friend for sparking a 40-acre fire on a hillside in santa clarita. the 14-year-old was trying to smoke marijuana with a friend when he apparently dropped the lighter. the fire was contained before it could cause serious damage. two men who escaped from a private arizona prison and an accomplice may be hiding in

yellowstone national park. there is evidence linking the escaped inmates and the accomplice to the killing of a couple in new mexico. u.s. marshals say the three may be hiding in portions of yellowstone. >> we consider them extremely armed and dangerous and we pray upon the public to be vigilant. >> deputies say it does not appear any of the three are expert campers or have wilderness survival skills. province was serving a life sentence for murder and robbery after stabbing a man 51 times. it is 5:14 now. violence in iraq this weekend killed at least 69 people. the shootings and bombings ramped up fears of an insurgent comebat when the u.s. ends its combat mission in iraq later this month.

officials expect the violence to get worse as the august 31st deadline approaches. four of every five bases have been closed or handed over to iraqi forces, with 100 still under u.s. control. one u.s. soldier was killed. attempts to permanently seal the broken well in the gulf of mexico are moving forward this morning. bp says the bottom kill is now underway. engineers will spend this week drilling the final leg of the relief well. when it intersects with the blown-out well, then bp can shove more mud and cement into it. the company says that once that is done, oil will not be able to league into the ocean ever again. bp says it has spent $6.1 billion responding to the spill. a vote could come tomorrow to send $26 billion to states for schools and medicaid. as tracie potts reports, the money is supposed to have saved jobs, but opponents claim it

will add to what america already owes. >> reporter: the house plans to vote tomorrow on sending states $26 billion to save teachers job. to treat seniors in community health centers instead of expensive nursing homes to provide medicine for poor people, essentially freeing up state budgets to prevent more government layoffs. this is for real people who need real help out here. >> reporter: supporters say it's not just about jobs. >> it's also about consumers an consumer confidence. >> reporter: expect opposition from republicans who say washington can't keep spending its way out of debt. >> the american people are screaming at washington to stop the spending. >> an unsustainable level of spending. >> reporter: the congressional budget office says the plan won't cost a dime over ten years, paid for by scaling back foreign tax credits and food

nightclubs and how quickly that process should happen. kris sanchez, nbc bay area news. >> thanks. an east bay mother suspected in court today facing dozens of charges that she had sex with two very young boys. 42-year-old christine hubs is charged with 67 counts of sexual assault. police say she had sex with two 13-year-old boys. the livermore mom also sent sexual text messages and nude pictures of herself to the boys. hubs is in jail now on more than $4 million bail. she will answer to charges today. tomorrow is the one-year disappearance of a fremont boy. hasani campbell was reported missing from a rockridge area of oakland by his foster father last year. a search turned up nothing. a few weeks later the police arrested the foster parents on suspicion of murder but were forced to release them because of lack of evidence.

>> reporter: good morning to you. this latest shooting happened outside a nightclub where inside the nightclub a couple years ago a shooting did happen. this shooting did not happen inside the nightclub but a few doors down in an ally way. the latest happened about three hours ago outside the 1015 nightclub. the building with the green light. now, the shooting did not happen here, two women were shot in the gunfire but are expected to be okay. police are quick to say they don't think the shooting where i am now is related to the one that happened last night around 9:00 outside a different nightclub about a mile away near union square. the woman shot outside the ruby sky nightclub did die from her injuries. another woman and man were also treated at the hospital but will survive. in each shooting, police are investigating and have not identified suspects.

last month there was another deadly shooting outside a different nightclub. six months ago someone died outside the suede nightclub where 50 rounds were fired. this is likely to fuel the debate about who can shut down the party in san francisco when the crowds at nightclubs get unruly. kris sanchez, nbc bay area news. >> thanks for the update. violence around san francisco nightclubs is up in the past year. police are trying to make things safer, but until now that process to shut down a dangerous nightclub has been limited. that's why the city is trying to give the entertainment commission new powers. it would have the power to revoke licenses if there's a risk of physical harm to people or there are continuing problems that make the club a public nuisance. one member of the commission says most nightclubs responsible however there are a few he would like to shut down. >> you want to take these guys and say you don't belong running a nightclub. find another line of work.

i can't name names because some of them are still operating. but i can tell you definitely i can think of three or four. >> mayor gavin newsom is expecteded to give the entertainment commission that new power sometime next week. the woman who accused one of the country's highest profile ceos of sexual harassment said she didn't intend for him to lose his job. jodie fisher, an actress on a reality show called "age of love" said she was surprised and saddened mark hurd stepped down last friday. fisher said in a statement through her attorney that she and the former ceo did not have an affair or intimate sexual relationship. she also said "i resolved my claim with mark privately without litigation. and i do not intend to comment on it further. i wish mark, his family and hp the best." fisher claims she knew hurd

through jobs with hp's marketing department in which she reportedly earned to $5,000 an event. this news sent hp stock into a free fall after trading on friday. courtney reg season joining us live at cnbc headquarters. i wonder if we can expect that to happen again today. >> hp stock fell 10% on friday, but so far the stock is slated to open slightly higher. we are less than an hour from that opening bell. hurd's camp is asserting there was no sex, harassment or abuse of hp resources, he just lost confidence of the board and decided to step down. a webcast is scheduled for employees at 11:00 a.m. eastern time today. in a case like this, severance pay is in focus. it appears mark hurd is walking

away with an estimated $34.5 million, 12 million of this in a cash severance payment. la it should be noted hp stock has doubled in hurd's five-year run as ceo. the apple executive in charge of the iphone has quit after several stumbles with the iphone 4. mark papermaster was with apple for four months and said he had a falling out with steve jobs and was not a part of the decisionmaking for a while. you guys are making us busy out the there. >> the wild, wild west. >> manufacturing are revving up
