this man isn't accused of stealing from just anyone. >> i'm sure they didn't know who i was or who was in the truck. >> reporter: he allegedly stole a truck that belongs to the gilroy police chief. also in the check, the chief's badge, work laptop and gun. >> i drove over to attend a family member's graduation. >> reporter: there was security at the venue, checking bags and purses. >> my concern was if i get challenged at the gate and they make me go back to my car, then they're going to basically -- other people will hear i have a gun. so i dug my stuff out, put it in the bottom of the console, my gun and my badge. i locked my vehicle, turned my alarm on and went to the venue. >> reporter: police arrested the man three days later. he is facing a number of charges. the chief admits he didn't properly put away his gun in his truck. according to california penal

from their homes. eith earthquakes leading to the eruption of the volcano. the epicenter is on the eastern side. the 6.9 quake was felt across the region. new video showing lava as it pours into neighborhoods. burning through trees and spewing more than 100 feet into the air. there are high levels of dangerous sulfuric gas. the national guard is helping with provevacuations. travellers are watching the eruptions. all three bay area airports have flights to the big island. we caught up with one passenger on his way to hawaii. he told us his aunt used to live in an area hit by the lava. he has fond memories of visiting that area as a child. >> earthquake is code for potential tsunami. the fact that there's lava in a

neighborhood, i don't know what to say to that. >> hawaiian airlines is allowing passengers to change their reservation without a service charge. this is a one-time waiver for this weekend. alaska airlines says they are monitoring the situation but not offering anything at this time. our chief meteorologist is checking that. let's go to him with the science of the situation. jeff? >> as we have talked about, it's all the earthquakes this week that has sent the lava spewing into that neighborhood and overall, the past hour, 3.4 magnitude and/or less. the past 24 hours, there have been several. largest one happening today. a 6.8 magnitude at 3:32 pacific times. the epicenter, not too far away. as we have talked about, it's one of the most active volcanos

in the world. it's not extremely unheard of to have activity around this. with the 500 earthquakes, this week, it has started to crack the earth. what you see in a lot of pictures is not a lot of lava spewing up from the center of the volcano. it's happening on the southeast earn rift zone. it's a slit in the earth where this lava is flowing out of. it's a whorizontal fracture. it usually takes about one to four days for that lava to travel one mile. they have those evacuations in place for good order. we will track more at nbcbayarea.com. >> thank you. other headlines, just in, berkeley police officers tell us they have their man. he is accused of targeting two women near the cal campus and sexually assaulting one of them. he is seen here. we told us about him two weeks

ago. a teenage girl was walking blocks away from campus when she says she was grabbed from behind. investigators say that he forced her to a noearby yard and sexually assaulted her. a week later another student was targeted. this is her breaking free from him. tonight, he is in jail. 71 years old and on the ver verge of being evicted. deputies say the disgruntled tenant shot his landlord. this played out yesterday during our 5:00 newscast. >> reporter: that's right. we spoke with deputies today and they say that landlord did come here to speak with the tenant, a 71-year-old man. it escalated and there was a shooting. they are trying to figure out how it unfolded. we spoke with neighbors on the block today and they can't believe something like this turned deadly.

>> i just thought she was a really nice person. i'm really sorry that that happened to her. >> reporter: neighbors near the apartments are stunned after learning an elderly landlord was shot, his daughter shot and killed. >> i'm deeply sorry they're going through all this. i'm really -- i can't believe in this neighborhood. it's so quiet. >> reporter: yesterday the quiet was shattered by the deadly shooting. the suspect, a tenant. identified as a 71-year-old man. >> very tense and uncomfortable. we were told to stay inside. a lot of neighbors were crying. >> reporter: deputies say there was a dispute at the apartments, a pending eviction in progress. the man pulled out a gun and apparently turned it on himself. >> it's very shocking. my heart goes out to them. >> reporter: neighbors say the lus have a home in the area. >> i can't imagine what they

lost their daughter. >> reporter: there was a sense of sadness and loss and trying to understand why. >> there's always means to negotiate or kind of put your complaint in a rational manner. taking a life? >> reporter: we're told the landlord, while he was hospitalized and in intensive care, he is expected to survive. live many miin mill valley. >> thank you. a live look at san francisco where there's a call to action for people. the city's short of the applications needed to assemble a civil grand jury. sam brock explains what's at stake for people looking for people to serve. >> reporter: when you think of jury duty, you probably picture a courtroom. serving on a civil grand jury

taps into a different vein of public service. >> it's the watchdog of the city. >> reporter: this judge is a superior court judge who spoke from his chambers about the critical matters this 19-person voluntary panel can investigate. >> they deal with issues like homelessness, which is so important for all of us. they deal with issues like -- that's important for the city. >> we looked at everything. >> reporter: this woman served on a civil grand jury in 2001. she encourages anybody committed to improving san francisco to give it a look. >> absolutely. you really learn what makes a city run. >> reporter: previous reports have covered car break-ins and the street gangs responsible as well as speeding up san francisco government performance on matters like homelessness and affordable housing. the application is straightforward. you will find questions like, why do you want to be a civil grand juror? do you have experience working as a team member or gathering facts and analyzing data? the city needs 60 applications.

right now is well short of that. >> i think getting the word out so people know that that's out there is really important. it's not something we're thinking about on a daily basis. >> i think we can get 60. i think out of 900,000 people, there should be 60 people who says, you know, i can change things. i can help change things and make policy changes. >> reporter: the california constitution requires that every county in the state empanel a civil grand jury. the judge doesn't know if they don't reach their numbers. they have outreach going on to churches and communities. they are confident they will get there. sam brock, nbc bay area news. not just hockey but also politics. the sharks are filing a lawsuit against the planned bart extension to downtown san jose. the team is worried about the events at the sap center being disrupted by construction of an f underground tunnel.

but an east bay rock climber won )t be able to walk on his on he has broken records. but a rock climber won't be able to walk on his own for a while, after suffering a scary fall yesterday. melissa colorado joins us live from the rock climbing gym in concord where he works. >> reporter: it's a reminder that even the world's best rock climbers can get hurt. there is his photo on the wall. he is the manager of this rock climbing gym here. he is known for his speed. today, the big lesson he is teaching his fellow rock climbers is that safety comes first. >> he is a professional climber. i was surprised to hear that him that fell. >> reporter: hans is the steph curry of the climbing world.

he broke a speed climbing record for scaling the legendary rock formation. this man rock climbs in concord where hans is the manager. >> a local climbing hero. >> reporter: he is making headlines for a different reason. he took a serious fall on thursday while trying to reach the top. >> it's a risk that all climbers take. it's a shock for someone who is so advanced. >> reporter: according to his climbing partner, he took a fall at 2,300 feet from the ground. his harness and ropes caught him just in time. he hit a ledge and broke one leg, maybe the other as well. he is smiling and with two thumbs up. >> i know hans is a strong person. >> reporter: national park service said it happened too late in the day to rescue him. he had to spend the night where temperatures can get as low as the 40s.

emergency crews found him and flew him to a hospital. >> the injury can be bad but not getting treatment immediately can be what's really detrimental. >> reporter: i'm told that hans is recovering at a hospital. it goes without saying, but all his colleagues here are wishing for a speedy recovery. that's the latest here in concord, i'm million lis meliss. cinco de mayo is tomorrow. the celebration begins tonight. as you might know, san jose is the hot spot in the bay area. you mix in tonight's sharks and warriors game, sjpd is gearing up for what could be a wild 24 hours. what's the plan? >> reporter: some restaurants started celebrating on may 1. they stocked up for the weekend and so have police officers. it's the time of year when these

colors cover the streets of san jose. a celebratory occasion for the first capital of california. that celebration began on wednesday here. they stocked up on food and beverages and on security. >> this is the busiest week of the year for us. this year, we started the 1st of may and go to the 6th. >> reporter: they are calling in security guards early this weekend to keep patrons safe over the busy weekend. the rest of the city, police are beefing up staffing. these probation officers met with sheriff's deputies and the gang unit this morning. they strategized how to keep trouble makers out. >> we aren't going to disclose our tactics. we are assigning additional police officers here in san jose, in plain and in uniform. >> reporter: with the sharks party tonight and a game on sunday, officers know the crowds will be out in force. so they're geared up, vowing to protect those who come out to

temperatures have been warm and sunny today. really nice. across the south bay, currently 75 in san jose. stay with 70s through 7:00. then we drop to 60s, 8:00, 9:00 and 10:00 tonight. let's move into the big change. that's the cloud cover returning as we head throughout saturday morning. we will see widespread areas of clouds to the north bay, coast, east bay, also down here to the peninsula and south bay. the billing chang change in tom weather, we will not see a lot of sun. you can see, once we hit 1:00 in the afternoon, we're still dealing with a mostly cloudy sky here throughout the bay area. we may see breaks of sun for the east bay peninsula and south bay. but not nearly as sunny as what we experienced today. once we hit the late afternoon into early evening, we will get clearing. you maybe eek out a little sunshine around 5:00 or 6:00. temperatures tomorrow do cool off as we see the clouds moving on in. no 80s for the interior valley.

next year, it will begin at 8:30 or 10:05 depends on the day. it comes after the american academy of pediatrics recommended they have later start times. it will allow staff to better collaborate. to a story you will see only on nbc bay area. preschoolers are heartbroken after thieves ransacked their school garden as the churn were g getting ready to pick the garden. >> not cool. what do we know? >> reporter: that's right. i can tell you the children who planted this garden here are crushed and confused. after months of hard work, they have to start all over again b somebody ribbed their plants out. >> they have to apologize and say sorry and not do that anymore.

>> reporter: children here want an apology. the kids are crushed after discovering somebody ransacked their school garden stealing nearly all of the fruit and vegetable plants they had been growing for months. >> i felt sad because none of the food was there. we worked so hard on it. >> i think it was terrible. >> four tomatoes, different cucumbers. we had onions, different kinds of peppers. >> reporter: the kitd kids wer supposed to pick their tomatoes today and eat them. but not anymore. >> very worried that we won't get to make them grow and get to eat them to see what they taste like. >> they were -- t >> reporter: up the street, kyle's row of plants got ripped out. other neighbors have been victimized as well.

he is not fit to head up an organization of so many women. >> at 6:30, morally unfit to lead. the passionate message from this group of women about a well-known local politician. south bay democratic leaders are turning up the heat on one of their own. >> they announced their decis n decision. robert handa joins us to tell us about past allegations of sexual harassment. >> reporter: that's right. supervisor hopeful oliverio is facing a heated ju eed june pri. he's finding out a case settled in the past can be unsettling for a campaign now. he was once a rising political star. now in the eyes of his local party, he has fallen. >> we can't move forward with gender respect and equity without settling some of these things that have happened in the

past. >> reporter: calling their action a part of the me too movement, members of the democratic party officially condemned the conduct and candidacy of supervisor hopeful oliverio. at the heart of the complaint, allegations from a lawsuit several years ago by a staffer when he was on the city council when he was accused of sexual and verbal harassment including saying -- >> he never has denied the words said to the victim. in my line of work as a local prosecutor, that's what we call an adoptive admission. >> by electing him, we are saying, sexual harassment is okay. time is up for mr. oliverio, at least it should be. >> reporter: he declined to address the allegation, pointing out it was from a case he was dismissed from and settled financially with the city of san jose. in a letter through his attorney, he said the democratic

central committee resolution is about how my voting record did not align with union position. he just released a film with women he worked with showing their support. he says the local democratic party has no room for a moderate democrat. in his view that's consider people are leaving the party. regardless, the hot spotlight won't go away soon. leaders say today's action is just the first. live in san jose, robert handa, nbc bay area news. >> robert was tweeting updates from the rally. we will follow the latest on these allegations. president trump today embraced the nra less than three months after promising action to survivors of the florida high school shooti ining massacre. he was the keynote speaker. after that shooting, that killed 17 people, the president hosted

grieving parents and children at the white house. it was different than the stand he took today in dallas. >> i want to listen. after i listen, we will get things done. we strongly believe in allowing highly trained teachers to carry concealed weapons. they're highly trained. >> in february, the president seemed open to raising age limits on some gun purchases and expanding background checks for guns sold at shows and online. in march, the president did sign the so-called fix nix act which improves data sharing for criminal background checks. fremont and oakland are the late toast to join california's census lawsuit against the trump administration. los angeles signing on today. it opposes adding a citizenship question to the 2020 census. it says that that could deter people from participating. fewer people means cities get less federal money for local services. san jose and san francisco have

filed lawsuits previously. elon musk taking to twitter to explain some unusual behavior. earlier this week, he was on a conference call talking about his company earnings. analysts asked questions musk said were dry and boring. his comments caused tesla shares to drop more than 5%. this morning, musk was on twitter explaining why he didn't want to answer questions about tesla's financial situation. shares for the company rose about 3%. here is the up side, those tech buses get a lot of cars off the roadways. thousands commute to tech companies. nearly 400 of the buses each weekday. are they paying their fair share for using public bus stops and damaging city streets? >> we have been looking into the story. what did you find? >> reporter: anyone who paid a parking ticket or been towed in

san francisco knows the city doesn't shy away from pricey fees and fines. some argue the city's tech buses have pretty much been getting a free ride. how long you hahave you been di? >> since 1983. >> reporter: this man owns green cab. he knows his way around san francisco. it's bureaucracy he has trouble navigating. >> there's a lot in government that doesn't make sense. >> reporter: including he says the high price taxicab drivers have to pay to operate in san francisco. the city charges taxis $250,000 for permits. that allows cabbies to use public streets for private gain. he wonders why some of the world's richest tech companies aren't having to shell out similar fees since the private bus companies they hire make more than 3,000 stops a day in san francisco. shuttling employees to and from work.

do you see this as fair? >> i see it as terribly inconsistent and extremely unfair. >> reporter: stopping in a bus zone will get you a $288 ticket. the city's commuter shuttle program allows tech buses to pay $7.31. each time they use any of roughly 100 stops across san francisco. most are public bus stops. the city allows those private buses to share the space. >> they are coddling them because they're not applying the same standards as they do to taxis. >> reporter: in march, members of the public urged the city to charge tech buses more. >> consider raising fees to fair market value. >> reporter: san francisco's transit agency has yet to take action. >> $6 million every year from these operators. >> reporter: this man is the director with the sfmta and oversees the shuttle program. he says tech bus permits are capped by california law.

the city can only charge what it costs to run the shuttle program. critic disagree and argue state law does allow san francisco to charge more. >> i don't want to get into a legal argument about this. >> reporter: he says even if the city raised fees, tech companies could just drop out of the voluntary program and stop paying all together. is this an example of the city bending over backwards for these large tech companies? >> i would argue that the fact that we are generating $6 million of permit fee revenue for mode of transportation that carries 10,000 people a day shows that we have actually taken a strong approach to regulation. >> reporter: the argument it is could be millions more. >> there's nothing i can do if a shuttle operator decided tomorrow they were going to drop out of the program, stop sending us checks and start operating on narrow streets. nothing we could do. >> reporter: you could issue

violations. >> parking tickets. we could never issue parking tickets close to what they pay in permit fees. >> reporter: our previous reporting exposed how they may be putting drivers, bikers and pedest y efestrians at risk. we obtained two years of records that showed tech buses received more than 800 citations for violations like obstructing traffic and blocking bus zones and bike lanes. they have ties to tech companies, including google, facebook, apple, yahoo. just last year, the city issues more than $900,000 worth of citations to commuter shuttles. can you understand why some feel like these tech company are taking advantage of san francisco? >> i certainly understand the concern that people have about the shuttles and their size and perhaps even what they symbolize. i also am aware that they're taking 10,000 cars off the street.

>> i've been asking for three years to justify how they come up with cost recovery. i have asked why a shuttle bus can use one of our public bus stops and pay $7 a stop and why a mother dropping off their kid to school gets a $100 ticket when using same bus stop. >> i think there needs to be fairness across the board. >> reporter: mark is still paying for the taxi permits. each month his cab company spends close to $800 per driver to lease them. it's a burden, he says, that continues to drive up costs. >> seeps a little like cab drivers as a cash cow and tech industry is the sacred cow. >> part of next year's budget, they plan to increase the fee for commuter shuttles by 34 cents, to hire more enforcement officers to keep watch over the buses. the board of supervisors has until june 30th to approve the plan. >> thanks.

joyride. . nbc bay area responds to a driver who says a mechanic took his car for a joyride. >> he turned to our team for accountable. we looked into it. what did you find? >> when you are going to a shop, you expect the mechanic to take the car out for a test drive. but this one seemed to be off the charts. jeff took his dodge in for minor work. when he picked up his challenger, the computer said someone had driven it 20 miles.

>> how is the weekend looking? >> it's going to be changing. overall, temperatures will stay comfortable. not as much sunshine. we did promise you another update on any new earthquake activity. the largest over the past hour in hawaii has been now a 4.7 magnitude. largest overall today and really over the series of earthquakes has been a 6.9 magnitude. that epicenter was extremely close by. we have been talking about kilauea. it's one of the most active. 500 earthquakes this week putting things off the chart. it's cracking the ground. that's what the lava is spewing out. it's on the southeastern rift zone. the interesting thing about video is it's not lava spews from the center of the volcano like you think you would see.

it's actually on what's known as a horizontal fracture. it's a slit in the earth's surface. that lava is flowing out from that. i did calculations. historical averages of lava flow. it takes from one to four days for it to travel one mile. that's why they do have evacuations in place. you can count on us for continuing updates at nbcbayarea.com. back to our forecast. tomorrow, we start with the clouds across the bay. temps in the low to mid 50s from the south bay to tri-valley. more extensive overcast from the east bay to san francisco and the north bay. the big change as we head into saturday is the fact that from the morning hours, as you can see as we advance into the afternoon, we keep the clouds with us. more of a mostly cloudy sky into 1:00 p.m., if you have a late afternoon, early evening barbecue, we will get clearing. it should shape up decent.
