i come down, hit this ledge like this. >> how did it happen to a seasoned pro, and how did he survive that frightening fall on yosemite's el capitan? tonight an east bay climbing legend is sharing with us his near-death story. >> hans florine, 2,300 feet up, suddenly found himself upside down, hanging by a rope with two broken legs. new at 11:00 tonight, terry mcsweeney joins us live from lafayette. terry, how did he manage to get himself out of that mess?

>> reporter: well, hans florine tells me he and his climbing partner stayed calm. he did that by what he says is becoming a spectator to his own life. he was looking at it as if someone else had been going through this ordeal. he stayed so calm up there on el capitan with two broken legs, he shot a video and posted it on instagram. >> i'm pretty sure i've broken one or both my legs. >> reporter: that's hans florine moments after falling 20 feet while climbing the nose of el capitan. this is florine tonight, a shattered right heel, a badly broken left ankle, surgery scheduled on both next week. talking about the accident. >> you're placing gear into a small crack all the way along. you're placing a gear every three to six feet, and i set it in the crack. i tested it. then when i stood up on it, it popped out, and the piece that was only four feet below me

caught me, but the rope didn't come tight until i had already banged my heels, landed on a ledge, and then fell another four or five feet over the ledge. i flipped upside down. i actually had my back against the wall, head down, was in agony pain for a mill i second. then my body pumped me full of endorphins and locked this all up. >> reporter: florine has literally written the book on climbing el capitan. >> we fell right here, and we lowered down 200 feet to a ledge that was a little more comfortable for us to rest. >> reporter: it was 2:00 in the afternoon. a rescue team rappelled down and got florine back to the top of el capitan by 10:00 that night. florine says someday he'll climb back up. >> i know that's possible still. we're following some breaking news in contra costa county. take a look. this horrific crash in brentwood. two people are seriously hurt after those two cars collided at the intersection of brentwood boulevard and sellers avenue. it happened around 9:00 this

evening. we still don't know how it happened or how serious the injuries are. crews do remain on the scene. we will pass along any updates as we get them in. a violent accident involving an ambulance leaves one woman dead and four others hurt. it remains unclear exactly how it happened but that ambulance ended up on its side after colliding with an audi sedan. a 73-year-old woman, a patient inside the ambulance being transported, died. two paramedics and a firefighter were hurt. the accident happened at the intersection of lewelling and hesperian in san lorenzo. a witness says the ambulance did have its lights and sirens on at the time of that crash. the chp is investigating. a gruesome discovery in the north bay this afternoon. two people and a dog found dead inside of a home. tonight, we don't know who those people are or what exactly happened. within the last 15 minutes, investigators left the home at roblar and orchard station in

petaluma. jean elle joins us with the new details. jean? >> reporter: raj, crime scene investigators are gone for the night, but a sheriff's deputy is still here guarding that gate, making sure no one gets into that home to contaminate that crime scene. this investigation all started when the sister of a woman who lived here drove by this afternoon and thought things didn't look right out here. she called the sheriff's department and asked for a welfare check. that's when deputies found two bodies inside the home. crime tape and sheriff's vehicles light up a dark, rural road in petaluma. sonoma county sheriff's deputies in hazmat suits are investigating two suspicious deaths on roblar road, leaving neighbors waiting for answers. >> i'm very sorry, but i have no idea what went on in their home. >> reporter: investigators say the sister of the woman who lives here hadn't heard from her in a month. after she drove by to take a look at the house today, she

called for help. >> noticed the tall grass, excessively tall grass. she saw mail piling up in the mailbox, got really concerned. can you guys come check on my sister's welfare? >> reporter: during a welfare check, deputies found a man and a woman dead inside along with a dead dog and one surviving dog. investigators believe the deceased are the property owners, but they want to make sure. >> we kind of went into it thinking a murder/suicide. we don't know, but we're going to slow down and really process the scene closely to make sure. >> reporter: neighbors say the couple, in their 50s, lived there for at least 20 years and mostly kept to themselves. >> she was a friendly person. she'd be out walking. >> reporter: lots of questions here in petaluma tonight. those crime scene technicians are expected back here in the morning. investigators say they believe the man and woman who died here have been dead for several days. >> thank you, jean. time is up for the iran

deal. tomorrow at the white house, president trump will announce his long awaited decision, just a few days ahead of the may 12th deadline. mr. trump tweeting this. confirming the announcement will be made at 2:00 p.m. eastern time. the iranian foreign ministry spokesperson says that mr. trump will regret his decision if he chooses to withdraw. the deal was signed back in 2015, and it placed strict limits on iran's nuclear program to keep the country from developing nuclear weapons. in return, iran got relief from some economic sanctions. the judge at the center of a recall effort is taking his fight right to the people. tomorrow judge aaron persky will hold a news conference to make his case against the june 5th initiative aimed at recalling him. those recall supporters want judge persky removed from the bench. they maintain that his sentence of brock turner was too lenient. turner served three months in jail for sexual assaulting a woman.

a new era in california politics begins tomorrow night in san jose. tonight the final preparations for this pivotal debate. who's going to be our next governor? we could see fireworks on the stage between the candidates. jerry brown is on his way out, and for the first time in years, there's a wide open race. and this race is getting the attention of washington, d.c., including nbc's political director chuck todd. >> not all politics is local. chuck todd has left the "meet the press" studios and has arrived at the nbc bay area studios. political insiders from the beltway are keeping a close eye on what's happening on this stage in san jose. >> jerry brown got elected governor when i was 2, and i'm 46, and jerry brown's still governor. this is the first election of the post-jerry brown era. >> reporter: the six top candidates will meet face to face. the most recognizable faces, lieutenant governor gavin newsom, and former los angeles mayor antonio villaraigosa.

>> perception out east is this is gavin newsom's race to lose. >> that's not far from the truth. >> barring a stronger than expected challenge from antonio villaraigosa, you can see the path but it's difficult. >> reporter: nothing comes easily, especially in california politics. here's the bottom line. it's a one-two punch. beginning now until june 5th, voters will elect the top two candidates. those two will then advance to the november general election. >> on paper, wow say everybody is going to go after the front-runner. but if the game is for second, it's possible gavin newsom may escape attacks for now because there's so much gaming for second place. >> anything is possible. we'll see what happens tomorrow night. chuck will be moderating this debate. i'll be among the panelists asking questions. we should note ballots are being sent home this week for mail-in voters, so the time is now. some 700 people are expected to watch that debate in person inside the california theater.

tens of thousands of people across the state will be watching the debate live right here on nbc bay area. our cheryl hurd continues the coverage from outside the california theater. a lot of logistics and ground to cover too. >> reporter: that's right. and security will be real tight here at the california theater. the audience will have to walk through these metal detectors. once inside they will hear from six of the top candidates. one of them could very well be the next governor of california. over 100 people working to make this historic theater tv-ready for tomorrow's debate. the six candidates vying to be california's next governor drew numbers to determine which of these podiums they'll stand behind and who will get the first question. >> the office of governor is up for grabs, and for that reason alone, there will be many more people who are tuned to what's going on and interested in voting. >> reporter: tomorrow will be the second day of absentee

developing at this late hour, more concerns in hawaii. take a look. this video is stunning here. this news conference tonight, we learned two new fissures have opened up as rivers of lava consume roads, cars, and homes. that lava spewing from mount kilauea. nearly 2,000 residents have been

evacuated. so far, more than 30 homes and buildings have been destroyed. there's no telling when the lava flow and earthquakes will finally stop. technically, kilauea, the volcano, has been erupting since 1983 with only occasional periods of relative quiet. next bay area responds to complaints about used cars every week. sometimes it happens right after they drive off the lot. >> a lot of people don't know by law, certainly used car dealers have to fix all problems within the first few weeks after you buy that car. let's bring in our consumer investigator who went car shopping to figure out why a lot of us are in the dark. this isn't a lemon law thing, right? >> this is completely different. bottom line here, there are some car sellers who are not providing this important protection. we're talking about car lots that do most of their own financing. those buy here, pay here places. well, they should be telling shoppers about a free warranty,

but not all of them are. and we learned the state agency responsible for enforcing the law hasn't been lately. >> my audi a6. >> jonathan fry calls the luxury sedan his dream car. >> i wanted it bad. i couldn't -- yeah, everything in me. so i went and tried to scrape up everything i could to get it. >> reporter: he found the a6 online and drove across the bay to phantom motors in hayward to buy it. but problems started as soon as he left the lot, quite literally. >> in the process of me going home, the check engine light came on. >> on your way home from the dealer? >> on my way home from the dealer. >> reporter: jonathan took the audi back for repairs. he says phantom motors told him it was fixed. >> on my way driving home, guess what happened? >> the check engine light came on again? >> again. >> again? >> so now i'm, okay, here we go again. repeat story.

rewind. >> reporter: so he took it back a second time and a third. jonathan's dream car at this point, four-door nightmare. did you know at that point that you could have turned that car in and they were supposed to give you a full refund? >> no. >> they never told you that? >> no. >> reporter: california law requires buy here/pay here dealers like phantom motors to provide all buyers a written warranty that covers you bumper to bumper for the first 30 days or 1,000 miles. and if they can't or won't fix it, they have to take the car back and give you a refund. but there's a problem. >> unfortunately a lot of people don't know they have rights. >> reporter: mark anderson sues car dealers. he says many buy here/pay here lots don't tell customers about the warranty. we wanted to see for ourselves, so we visited several buy here/pay here lots around the bay area and checked their window stickers. some checked the warranty box,

but some checked as is, no dealer warranty. anderson says those dealers are breaking the law and stiffing customers. >> they're misrepresenting a fact that there is a warranty. >> reporter: the dmv is empowered to make sure car lots offer you that warranty. but the agency says its records show it issued nine warnings to dealers in 2013 and 2014. not a single one since. consumer advocate rosemary shea han says that is unacceptable. she helped write the warranty law and says consumers need to speak up. >> they should complain to the dmv. they should complain to their member of the california legislature and tell them to get on the dmv's case. and they should get some legal advice from an auto fraud attorney. >> reporter: that's what jonathan did. he's suing phantom motors and driving his old car. >> i've had that car for seven years. guess how many times it's been

>> we do have some changes cupping our way as we head throughout tomorrow. still going to be a really nice day but definitely some cooler air moving on in. let's take a look at our mic microclimate forecast tonight. i want to start off with that change on tuesday. what i'm keeping a close eye on is the jet stream. it has some cooler air and clouds southerned with it and it's going to drop closer to the bay area for tomorrow. so the biggest thing you'll notice, it's not going to be quite as warm as we head through your tuesday forecast. let's go ahead and get a look as you head off commuting tomorrow morning. we'll start with a few patchy clouds, 56 in the south bay. 55 for the peninsula. the tri-valley at 53. if you're heading into san francisco for work, 52 to start. and also the east bay at 54. you need a light jacket as you begin the day. then throughout the afternoon, it really is going to be beautiful outside. the biggest difference again, i've dropped temperatures about 2 to 7 degrees for that afternoon forecast, but you can still see across the south bay, nearly perfect weather. 77 in downtown san jose.

you're looking at low 80s for morgan hill, also down to gilroy. a few low 80s here across the east bay from antioch over to concord. and notice what a difference the day breeze will make tomorrow. when that kicks up, it's only going to keep oakland at 68 degrees. large differences there. oakland to concord, well, a pretty good sizeable difference there. right across the peninsula, 74 in palo alto. 63 in daly city. more cool 60s for san francisco and when that wind comes up out of the west at 18, it will make these low to mid-60s feel like the upper 50s so take your jacket into san francisco. wine country, 79 in santa rosa. upper 70s in napa. that cold ocean breeze in place will keep point reyes at 60 degrees. only problem you've probably had with the weather has been your allergies. pollen off the charts the past week. but we have seen oak and walnut trees going down to the moderate category. also grasses down to low.
