you might be feeling it right now. the winds are picking up and that means fire crews are at the ready. >> windy and warm conditions as we kick off this mother's day weekend. let's get right to jeff ranieri. jeff, you're tracking the top gusts. what are you thinking here? >> well, we already have seen them anywhere from 40 to 50 miles per hour. you can see our oakland camera behind me shaking around in the wind. it's sustained at about 20. we've seen gusts to about 25 there in oakland, but it has gusted higher here across the bay. some of our max wind gusts, 45 at mount diablo.

mount hamilton, 38. napa, 35. santa rosa, 34. atlas peak, 29. it's not only the wind speed but also the direction. all this wind right there, you can see, has been coming out of the north. it's a very drying wind that's keeping humidity right now in the teens to low 20s. now, the wind advisory will continue at 1,000 feet and above for hills of the northeast and the south bay. that's still where we could get winds as high as 50 miles per hour until 5:00 a.m. on your saturday morning. so let's bring you into the hour by hour forecast. at low elevations, max winds into about 1:00 a.m. max wind gusts may get up to around 25, 26 miles per hour. we'll start to see this try to weaken a little bit there at 5:30 in the morning again tomorrow. we'll track more of this wind, how long it lasts into your saturday forecast, and when we could see maybe a few showers move close to the bay area. that's coming up at 11:19. >> you can track the wind with

our free app. all you have to do is click on the weather tab and you can get your personalized forecast. what happens if you put the wrong type of gas into your car? more than two dozen people in the east bay found out the hard way. the chevron near san ramon valley road made a serious mistake and led to plenty of cars breaking down. tonight chevron is responding. nbc bay area's ian cull joins us at that station in san ramon with the details. >> reporter: if you've ever accidentally put diesel into a gas engine you find out pretty quickly it's not good. the people affected in this case say they had no idea what was going on even after they went to a mechanic. around 30 different people were filling up at this chevron, reaching for the regular, but it was diesel coming through the pump. >> that's crazy. i've never heard of anything happening like that. >> reporter: those drivers complained online after getting gas on saturday, may 5th. their cars stopped working, and now they have rising mechanics bills. tonight chevron explains,

confirming the reports from customers, saying in a statement, a third-party carrier accidentally introduced diesel into the supply of regular gasoline, and we stopped sales immediately when it was discovered. we apologize to anyone who may have been impacted by this matter and are taking all appropriate measures to address any complications. >> pretty careless on behalf of the chevron gas station. i think they need to pay more attention. that could cause severe damage. >> reporter: some say it would be noticeable a block from the station but typically can be fixed. >> the diesel should not permanently damage a car, and i'll say that with the caution that if there's something already wrong with the car to begin with, this may help you find out what that problem is. >> they're going to have a nightmare with the insurance company just to try to prove that it was the gas station's fault. >> reporter: mechanics say generally it could take up to $1,000 to make that fix. as for the gas station, chevron

says that error has been fixed. no specific words, though, yet from the company on if or when reimbursements may be coming. reporting live in san ramon, ian cull. >> thank you, ian. new at 11:00, sfo looking to hike fees for uber and lyft. it's part of a plan to ease congestion by charging more for rides that begin or end at the curb in front of the airport terminal. spokesperson for the airport says exactly how much that hike will be is still being negotiated, but it would go into effect in july. uber telling us tonight, quote, we value our partnership with sfo and sport their efforts to korea great experience for travelers. however, the proposed fee increase goes against the consumer friendly approach and will not help to reduce congestion at the airport. just in, the problems in hawaii have reached the white house. tonight president trump approved a disaster declaration. this means that federal money will go to help these communities impacted by kilauea

volcano and those earthquakes. this is new video now of the lava flow from the air. that volcano began erupting more than a week ago. so far 27 homes have been destroyed. there is a potential for a larger scale eruption. hundreds of patients in san francisco's health system will be getting letters in the mail telling them that some of their medical records were compromised. nbc bay area's sergio quintana is live with more details. do we know the extent of this breach? >> reporter: we know there was hundreds of patients, nearly 900 patients. we also know that this happened last year around november and december. but the notification of patients was actually delayed a little bit because the fbi asked that they could investigate. it took agents a few months to figure out how patients' records were compromised. none of the records were ever accessed here in san francisco. instead, it all happened at a

transcription company in boston called nuance communications. >> an employee of that service got unauthorized access to their medical personal information. so we notified our patients that that had happened. >> reporter: nearly 900 patients' records were accessed. the files include people seen at zuckerberg san francisco general and laguna honda hospitals. investigators say other hospitals in other cities were also affected, but they have not said why. a now former employee of the transcription company accessed thousands of patients' records. >> the good news and what we want to make sure our patients understand is that there is no evidence that this information was put to any use at all, that it wasn't sold or used in any manner, and all of the data has been recovered. >> reporter: the kind of data that was accessed included names, dates of birth, medical record numbers, and even diagnosis and treatment information. now, that transcription company says that it has since tightened its protocols to make it more difficult or hopefully impossible for its employees to

access patients' information. i asked if the department of public health is satisfied with that. they say yes, and they are continuing to work with this company. reporting live in san francisco, sergio quintana, nbc bay area news. >> thank you. all lanes of the san mateo bridge are now open this evening after a major traffic mess earlier today. this is a live look from our bridge camera. you can see it's a peaceful friday night. but take a look at the situation this afternoon. a crash involving several cars, including a ferrari down below, it shut down all eastbound lanes for about an hour. this is the peninsula going into the east bay. at one point, traffic was backed up about eight miles. it happened right around 3:00 p.m. thankfully no major injuries. new at 11:00 tonight, be on alert. morgan hill police are investigating an attempted kidnapping. a 15-year-old boy says he was walking home from sobrato high on thursday when a man supposedly approached him from behind and grabbed him.

the boy said he fought off his attacker and ran to a nearby relative's house for help. a deadly hit-and-run has a local family pleading for help. the family of andrew bufka shared these photos of him. he was killed by a hit-and-run driver. this happened last friday night along highway 4 in discovery bay. bufka's family is praying that someone will come forward. >> we just need people out there to have hearts and just go out of their way to do something good to give us all closure. >> chp says they're looking for a toyota sequoia or tundra with a broken right headlight and front end damage. it's not your average getaway vehicle. police are investigating an attack and robbery in san francisco involving those scooters. it happened wednesday evening near powell and washington in chinatown. police say two men approached the victim, attacked him, and then grabbed his bag. the suspect then fled on two nearby scooters. police say that victim is okay. the suspects have not been

caught. an east bay high school student is facing federal charges after hacking into a school computer and changing his classmates grades. we first reported this story last night at 11:00. today we got a look at the family's surveillance camera which captured a team of police and federal agents raiding the teen's home. agents say the 16-year-old altered grades of more than a dozen fellow students at ignacio valley high in concord. the boy's father agreed his son should be punished but he says the raid may have been overkill. >> he changed grades for his colleag colleagues and but not for him. other than that, he didn't do anything. he doesn't have any criminal records. >> aside from those federal charges, the teenager has been suspended from school until wednesday. a follow-up to a frightening accident at heritage high school in brentwood. a student was hit in the head by a shot put right there on the

track yesterday. tonight that teenager's father said his son is home and is doing just fine. he was airlifted to a local hospital where he received three staples in the back of his head. still ahead, she says they were meant to inspire other people, but photos on one teen's instagram account got her kicked out of school right before graduation. tonight, though, she's holding her ground. why didn't you just refund them in full? >> we confront a contractor who is accused of cashing a five-figure check for a job someone else did. i'm consumer investigator chris chmura. how a savvy move backfired on a family. plus the red line you should never cross with a contractor. i'm tracking the next change in our weekend forecast, plus when some rainfall might actually make it back to the bay area in my seven-day forecast coming up in about eight minutes. posts that officials sae

a san jose high school senior reprimanded for social media posts that school officials say are just too sexy for school. natasha has been disenrolled from archbishop midi high school just weeks before graduation. these are photos from her instagram page. you can see her in her workout gear. some of the pictures that we're not showing you show the teenager in her underwear, though. it is a private high school. officials asked her to take down the post, which they say violated school rules. she's protesting the decision and started a petition to help get her reenrolled. she says her posts were meant to inspire others and herself about fitness goals. we did reach out to the school but officials have not contacted us yet. a frightening scene in oakland. two people were injured after a deck collapsed. our sky ranger was overhead this afternoon. this happened at a home on morcom avenue about a block away from mills college. firefighters then tweeted out this photo. you can see the deck there collapsed.

we don't know the extent of the injuries at this time. imagine paying thousands of dollars to the wrong company by mistake and then that company won't give you your money back. >> that's exactly what happened to a family in vac aville. so they turned to us for help. let's bring in our consumer investigator chris chmura, who confronted that company. chris, what happened next? >> reporter: you often hear me say you always need to get multiple bids before you sign on the dotted line for somebody to do a remodeling project for you. well, in this case that savvy move actually backfired with a five-figure price tag. >> it's a rental. >> reporter: the duncan family condo needed some remodeling. >> it was painting. >> reporter: after a tenant moved out last year. >> the kitchen had to be pretty much redone. >> reporter: the duncans did their homework and got several estimates, including a quote from carpets and more in vac aville. >> they had good reviews. >> reporter: ultimately they chose a different company, but

keith's mom, who is in her 80s, got confused. >> she sent a check to carpets and more for $24,000. >> how much work had they done? >> they had not done anything because we did not use them. >> keith says he discovered the mistake a few weeks later, after carpets & more had already cashed the check and too late to stop payment. he asked carpets & more for a refund, and it responded with a check. >> the check was returned for insufficient funds. >> it bounced? >> it bounced. >> keith says carpets and more then gave him a certified check but not for $24,000. it was for $12,000, half of what his mom sent them by mistake. keith says he repeatedly tried to collect the remaining $12,000 with no success. >> they will not respond to me. >> reporter: so he contacted us. we called carpets & more repeatedly over several months. we too did not get a response. >> how are you doing? >> so we went to the showroom. fortunately the owner was on hand to address the duncan

family's concerns. >> what is it going to take for them to get their money back? >> well, i already talked to him. >> we pressed alexander for answers about why the company cashed the $24,000 check, where the money went, and why the duncans were still waiting for a refund. >> i don't know what you want me to tell you. >> i want to know why it's taken almost a year to get them their money. >> um, we've just been struggling to pay them back. that's all. that's all i have to say. >> reporter: the state contractor's board says carpets & more had an obligation to return the duncans' full $24,000 as soon as keith told them his mom sent the check by mistake. alexander said the company might have cashed the check as a deposit, believing it was just about to start the duncan job. >> well, we took a deposit for a job. >> reporter: if it was a deposit check, the state says it would have been illegal for carpets & more to accept a deposit of $24,000. >> they can require you to pay no more than 10% or $1,000.

>> reporter: whichever is less. the contractor board encouraged keith to file an official complaint, which could prompt a state investigation. keith can also try another route. he can file a claim against the carpets & more bond. >> all contractors are required to carry a $15,000 surety bond, so there's a level of protection you're going to get with that if you do have a problem as well. >> reporter: keith is weighing that option to finally settle the 365-day dispute over unit 806. >> it's unbelievable. >> reporter: he also hired an attorney, who is trying to broker a payment plan with carpets & more. but keith has low expectations the business will actually pay even with the threat of legal action. >> it's at this point, i don't think anything would surprise me with this guy. >> reporter: we have an update. keith wrote us tonight and said carpets & more paid him earlier today, but not in full. he is owed $12,000, remember? today he said he got $3,000. >> he's getting there. >> yeah, he's getting there.

hour by hour forecast again. down at the lower elevations, it's going to be gusty but really not the worst across the bay area. 1:30 in the morning we still could see wind gusts up to about 26 in napa, 20 in redwood city. maybe not that gusty in san jose. you really still have to go above 1,000 feet to get potential winds topping 50 miles per hour. so that's the scenario at 1:30 in the morning. as we take this into 5:30, it's still breezy to gusty, anywhere from 4 to 23 miles per hour. then eventually as we hit 10:00 in the morning, we'll begin to see this wind kick on out of here. that eventually will set us up with a really nice day. so our primary fire danger concern is really for about the next six hours, and then we should be again looking at some nice weather coming our way. so as we get you into your saturday morning forecast, temperatures will start off milder with that drier wind in place. 66 for the tri-valley and 64 for the south bay. san francisco also in the low 60s. no fog. lots of sunshine and right here

in the north bay, 64 degrees. through the day for tomorrow, it's going to be a mix of 70s and 80s for most of the bay area. right down here across the south bay, 80 in san jose. 79 in morgan hill. right there for milpitas, 76. contra costa, alameda counties, a few isolated mid-80s for us here. concord at 84. danville, 84. livermore, 79. back towards the bay, oakland at 73. sunshine right over to the peninsula. 78 in palo alto. heading to the beach, nice, cool day. 62 there in half moon bay. most of san francisco in the 60s except the mission, which will pop up to 70. and right in marin, napa, and sonoma counties, we have 83 here in napa and 76 in mill valley. let's take you to that extended forecast. we talked about the possibility of some rainfall. it's not a big storm system, but what we're starting to look at here is maybe some showers close to the bay area by monday of next week. we'll see those showers hang near us all the way through next friday, then potentially some

asked to leave the plane after an altercation with another passenger who said she smelled pungent and wasn't comfortable flying with her. the woman has filed a civil rights lawsuit. united airlines says they're unable to comment on pending litigation. new video tonight of a man getting down with his bad self. watch him after he broke into this building in fresno. he celebrated with a dance of course. he's accused of stealing a lap ton from the building. police believe he was in and out several times but don't know how he got the keys. but they know he's a dancer. tonight the dancing bandit is in police custody. state taxes on legal marijuana sales in california are coming in shorter than expected. the first quarter of this year netted $34 million, about a third of the revenue state officials anticipated. governor brown's january budget proposal predicted $175 million would pour in in the first six months of the new legal recreational pot market. three, two, one, zero.
