-judge rules against ac transit... they can't impose a new contract on bus drivers..what it all means for bus riders. good morning. it's tuesday, the 3rd of august. a lot of things going on with the commute. a judge ruled that a.c. transit cannot impose the contract that it did impose on its drivers two weeks ago. we'll tell you what it means, at least what the drivers are telling us this morning. also, empty jail cells in san francisco. it's because there are 450 fewer inmates than there were last year. we have the reasons behind the decline. >> they have new police cars in mill valley. oh, yeah. that's a cannon. no, i'm kidding. it's not a cannon. but they can go 500 police officers. >> really? >> no. [ laughter ] >> that's so cool. we have had a couple of different things going on this morning in the traffic but a lot of little fender-benders and now we are hearing about something in sonoma county a fatal accident near sebastopol on guerneville road at laguna. a car rolled down the embankment, coroner is heading to the scene. there may be possible closures in the area. last night there was a water main break on a major road in petaluma asphalt on the road. took them a while to clear it and making repairs to the infrastructure and as well as making sure there are no sinkholes so both directions of petaluma boulevard north are completely shut down this morning between east washington street and western avenue. not sure how much longer crews will be on scene. but watch out for that. good news is the bay bridge commute actually looks good. so far no delay approaching the toll plaza. that is your traffic.

for your forecast, here's tracy. >> hey, thanks, elizabeth. a little drizzle out there low clouds, so we have a little drizzle for the coast and the bay. inland clouds in the valleys this morning temperatures ranging from the lower to the mid to the upper 50s. heading into our afternoon, temperatures will range from the lower 60s to the lower 90s, yeah. inland today especially well out in the east bay, your temperatures close to average daytime highs. for the rest of us, though, still cool. and we'll continue to be cooler than average for tomorrow and heading into thursday, friday, saturday, sunday and even monday. this previous july, this last month, the coolest july since 1971. and august will also start off a little cool, too. >> unless you're in antioch. it's always hot in antioch and brentwood. >> yes. >> thank you. back to you guys. thank you. 6:02 now. a.c. transit drivers are celebrating a court victory in their

contract dispute with management. anne makovec is in oakland, where passengers hope the ruling means more drivers will be back on the job this morning. good morning, anne. >> reporter: yeah, riders and drivers breathing a sigh of relief this morning that things are going to go back to normal. but a.c. transit says there just isn't the money there to be able to sustain it. now, the court ruling means that the interim contract that had the drivers union so upset is being thrown out for now and that the bus routes and drivers' schedules should return to normal at least temporarily starting in a week, august 10. but i say temporarily because a.c. transit says it can't afford to keep it that way. it's already $16 million in the red. so more service reductions will begin on august 29th. over 7% of existing bus routes will be affected stopping less frequently and a.c. transit may also eliminate all weekend bus service. so back to that court ruling from yesterday. the board might appeal that but they won't decide until their

next scheduled meeting august 18. >> they didn't make any decision with regard to pursuing the litigation. i have to say that i think the board is suffering at this point from litigation fatigue. >> they must take us back to status quo and wait for the neutral arbitrator to decide. >> reporter: that union rep just mentioned an arbitrator and that is where a decision on the drivers' next contract is supposed to come from. the two sides have been battling that out for three months so a neutral party should be helpful in the debate. the district says they are on the brink of bankruptcy. so riders can expect schedule changes. hopefully they will be more planned out, not the unpredictable schedule changes which we had during the sickout which the drivers union still denies was a sickout. >> thank you, anne makovec. muni operators in san francisco are getting a raise,

nearly 6% this year. the "san francisco chronicle" reporting the pay increase will cost the city more than $15 million during the current fiscal year. all other city workers are taking a pay cut something they agreed to do to help balance the city's budget. but the city charter guarantees muni drivers will make no less than the average of the two transit agencies in the nation that pay the most. negotiators for the city of san jose and its firefighters union plan to meet tomorrow afternoon. they will be discussing the union's latest proposal in hopes of getting some laid-off firefighters back to work. 49 lost their jobs last week. the union's latest offer includes a two tier retirement pay structure in which benefits would differ for newly hired employees. but the firefighters pay reduction offer remains at 5.25%. city officials have been calling for a 10% salary concession from all city workers in order to avoid heyoffs.

san jose city council is facing a long session today. it is the deadline to get measures on the november ballot. and councilmembers have several to consider. one would allow less expensive pension plans for new city workers. another would end or limit binding arbitration for police and fire unions over contract disputes. there are two proposed tax measures. one raising the city's sales tax by a quarter cent. the other would put a 10% tax on medical marijuana. palo alto city council voted to put a measure on the november ballot that would take away their own power to lay off members of fire department. lace night councilmembers said the measure robs them of their ability to manage city costs. firefighters maintain they are out to protect the public and the department has been losing important positions. voters will also decide on whether to switch city

elections from odd to even numbered years. hey recent drop in the san francisco jail population has some officials wondering why the cells are suddenly so empty. in the past four months the number of inmates in san francisco gels has dropped 21%, around 450 fewer inmates a day. some believe the drop can be traced back to the closure of the city's drug lab. >> a large number of drug cases was dropped and i believe that probably fewer drug cases are being prosecuted and processed because of a lack of an operating crime lab here. >> it's very unusual. there aren't many jails in california or any jails in california that i know of that are empty so it's a pretty unusual situation. >> not all law enforcement authorities are in agreement. they say the city has just been doing a better job on crime prevention. there are now more eyes watching for crimes in marin county. mill valley police recently rolled out some new crime

cameras. four are on police cars. i misspoke saying earlier saying the new police cars. there are new cameras on the cars. the devices automatically scan passing license plate numbers for stolen vehicles, felonies and kidnapping alerts. the officers say the cameras will save them time and free them up to watch for other problems. >> i can go ahead and look out into the roadway and not be distracted by my computer by also looking at -- for people flagging us down. >> the cameras only pull up crimes listed in the department of justice database. that does not include unpaid parking tickets or expired registrations so you're safe there. >> the lists are updated every four hours, though. 6:08. closing in on the kill. coming up next, the important test bp is running today and why it could clear the way to permanently plug the leaking oil pipeline in the gulf.

powerful earthquake struck offer the eastern coast of indonesia. it hit in the past hour. it had a magnitude of 6.5 centered 54 miles off an island, the closest city is menado and so far there are no reports of any injuries or damage. indonesia rests on a series of fault lines that make it one of the most earthquake-prone area on earth. today bp engineers planning to do a test to help them determine whether they can plug their broken oil well. the plan is to pump the well full of heavy mud and then concrete. the static kill method is similar to top kill, which failed in june but now that the well is capped, crews won't have to try to overcome the force of gushin oil. more than 200 million gallons of oil leaked from the well before it was capped 19 days ago. the united states senate is expected to vote this week on whether to confirm supreme

court nominee elena kagan. it appears there will be enough votes for kagan. president obama's choice to replease justice john paul stevens, who is retiring. almost all senate democrats and some republicans are expected to vote in favor of the former harvard law school dean. republican critics are concerned about her lack of experience as a judge and her liberal political views. her supporters say she will help bring consensus to the high court. republican meg whitman is approaching the $100 million mark in the campaign spending now. >> the republican nominee says her campaign has shelled out $99 million, including $71 million for the june primary race. her democratic opponent on the november ballot jerry brown has spent $450,000. he had no major competition on the primary. brown does have $23 million on hand, whitman has $10.3 million. she has already put $91 million of her own money into her

stories: good morning. let's start off with a look at the golden gate bridge where traffic is flowing freely in all directions. the only thing going on is the fog. so some low visibility traveling through the waldo grade this morning. let's go a little farther north. up to sonoma county there was a bad accident. that's a fatal accident on guerneville road and laguna road happened around 5:10 this morning. a minivan went down the embankment. there may be lanes blocked in the area. chp is searching for a person who ran from the scene so that may make the investigation take

in a few days whether to appeal. service cuts are still planned later this month. also negotiators for the city of san jose and its firefighters union plan to meet tomorrow afternoon. they will discuss the union's latest proposal in hopes of getting some laid-off firefighters back to work. 49 lost their jobs last week. and the the jail population -- and the jail population in san francisco has dropped 21% in the past four months. numbers show there are now 450 fewer inmates a day. some authorities say the closure of the city's drug lab has resulted in fewer cases being prosecuted. 6:21. the new temporary transbay terminal in san francisco is opening its doors today to show commuters how to use the facility. while the terminal won't be ready for business until saturday, a.c. transit is holding an open house at 4:00 today. the facility is located off howard and main.

anything there. out of downtown san jose, no problems on 280. much better news now if you are commuting from petaluma. there was a water main break last night and they shut down a major thoroughfare. petaluma boulevard north is re- opened within the last half hour between east washington and western. so that's good news. southbound 101 looks good through maren county. no big problems there. at the bay bridge, no metering lights, no delays. that's a check of your traffic. here's tracy with your forecast. hey, thanks, elizabeth. forecast this morning, how about sunshine? some sunshine. this is a look from our mount vaca cam. and one of the few locations where we are seeing a whole lot of sunshine. much of the bay area is still shrouded in clouds along the coast around the bay, even inland. so much so we got disease on arrivals at sfo of 40 minutes. 90 in pleasanton. 74 benicia. 67 oakland. 73 hayward, near 80 in san

jose. still below average. 75 in palo alto. 63 in san francisco. we are typically closer to 70. today the lower 60s. and just near 80 degrees in santa rosa and in sonoma. traveling today headed to fresno going to be hot. 101. 96 in sacramento. 102 redding. 83 lake tahoe. 96 degrees in yosemite. moving back closer to the coastline, you can see 65 in monterey today with some morning fog. 96 in ukiah with plenty of sunshine. and morning fog in eureka with a daytime high of 58 degrees. seven-day forecast cooler than average today, ever so slightly for the coast and the bay. and temperatures will continue to cool down as we move into tomorrow and for the bulk of the workweek into the weekend. that's a look at your weather. back up to you. >> thank you. the bus drivers win, that's the ruling in alameda county court in the contract dispute between a.c. transit and its drivers. anne makovec is in oakland and

jones us to explain, it doesn't necessarily mean the buses are going to be running on time. does it? >> reporter: no. the drivers union says we can expect things to be back to normal today, but that injunction that the court ordered doesn't take effect until one week from today august 10. still, the drivers union this morning celebrating a victory. [ chanting ] the imposed contract is being thrown out for now and that the bus routes and driver schedules should be returning to normal. but a.c. transit says it can't afford to keep it that way, it's already $16 million in the red. so more service reductions will begin on august 29. over 7% of existing bus routes will be affected stopping less frequently. a.c. transit may also eliminate all weekend bus service. so riders can expect further

disruptions. but they will get a temporary reprieve from this. >> had to wait extensively like on the 40. after 40 minutes i get out to the 57, i have to wait another extra 25, 40 minutes and many times the buses do not come. they are punishing the people. >> reporter: an arbitrator will come in to arbitrate the new contract. a neutral party should be helpful in the debate. what means a lot to a lot of folks watching this report right now is what is the morning commute going to be like? again, the drivers union says it is going to be back to normal even though they are still working on the contract that they say was causing all the problems because again, that injunction doesn't come into effect for a week. but unions saying it's going to be okay. we shall see. s across the bay muni

me. we just talked to some folks inside. they are waiting this morning to find out if in fact the regularly scheduled flight from san jose to guadalajara is a go. at this point, it's a big question mark. over the weekend one of the two regular flight was cancelled. last night a mexicana flight was cancelled. passengers are left in the lurch. ticket agents have been trying to find them seats on other airlines. but the only other flight out of san jose was packed last night. this is not just happening here in the bay area. all over california, in sacramento all 11 regular weekly flights have been dropped by mexicana. so sacramento international airport no longer has any international flights. the big question, what's going on in mexicana? a spokesman for the airline says that this is happening due to operational needs. but news reports have indicated that mexicana is facing financial tough times. they may soon file for bankruptcy. we'll see what happens this

westbound 37 near the 101. change. it was an accident involving a motorcycle. the accident was cleared to the shoulder quickly. but then fire crews got there and they are blocking the connector ramp right now from westbound 237 getting on to northbound 101. watch out for slow traffic there in the next few minutes. usually we see slow traffic on westbound 237 close to 880 but

report on our consumer spending. here's jason brooks with kcbs and cbsmoneywatch.com. good morning to you. >> good morning, juliette. good morning, john. i think investors would like to see a return to the 80s as far as spending goes because it's been awfully flat over the past few months. more evidence of that in june. it was flat from may. also incomes were flat in that month leading to the fact that people just didn't have much more money to spend. this is going to be an issue that will continue in the months going forward as unemployment is expected to stay right where it is until employers start hiring and paying bigger salaries. consumers aren't going to be spending a lot of money until then. that's going to influence the markets. earnings, oakland-based clorox saw its profit and revenue come in line with analyst expectations. profit of $171 million on revenue of 1.5 billion. right now, the stock market is down on the consumer news. dow lower by 27, nasdaq off 11, s&p down by 4. this is also coming off a huge day yesterday when the dow was up over 200.

windfall for boston. >> there are a couple of cranes that the port of oakland no longer needs. they began their journey to boston yesterday sailing under the bay bridge. oakland replaced them with bigger state-of-the-art equipment. the old cranes were shorter but did that to aon come date the flight path of the alameda naval air station. so now these cranes will travel through the panama canal and they will arrive in boston sometime in mid-september. the port there needs these cranes because of its proximity to boston's main airport. each crane apparently weighs about 5 million pounds. we have some fierce competition going on right now for the smart phone customers and three companies certainly battling it out. >> that's our tomorrow inning for the question of the day. which smart phone do you prefer? says: i prefer the blackberry... it does everything i need it to do and unlike the iphone, i can make and complete my phone calls.

earthquake struck off the eastern coast of indonesia. it today's top stories. a powerful earthquake struck off the eastern coast of indonesia. it had a magnitude of 6.3. no injuries have been record. a.c. transit's directors plan to decide whether to appeal a court ruling against the contract that was imposed on bus drivers. drivers who have been calling in second are expected back at work today. a.c. transit plans to reduce service later this month. and negotiators for the city of san jose and its firefighter union plan to meet tomorrow afternoon. they will discuss the union's latest proposal in hopes getting some laid-off

firefighters back to work. 49 lost their jobs last week. in just a few hours, oakland airport will roll out its new body scanners. it has the ability to pinpoint hidden explosives and other contraband. the body scanners will be in terminal one which serves alaska, delta and jetblue among other airlines. passengers who decline the scan will have to submit to a patdown. we are just hearing about a new accident on highway 1. southbound highway 1 at devil's slide. there was an accident there. an ambulance is heading to the scene. but expect some delays if you are traveling between pacifica and half moon bay. westbound 237 we are following this accident as well in sunnyvale. fire crews are still blocking that connector ramp from westbound 237 to northbound 101 and members of the kcbs phone force say traffic is backing up about three-quarters of a mile. we've camera near 880/237 and traffic is backing up out to
