anne makovec will join us live with details. and we have been talking about this jetblue flight attendant couldn't take it anymore after he went on a rampage inside an airliner full of passengers. one passenger wasn't paying attention and doing what he was supposed to and this guy just said i have had it. we'll tell you what he did that led to his arrest. let's check traffic with elizabeth. >> a live look at 880 past the coliseum. your moving fine from hayward to downtown oakland near the coliseum. eastbound 92 at eden landing road sounds like everything is wrapping up. there was a car down the embankment caught fire and started a small grassfire in the area. right now everything is fine towards the san mateo bridge. bay bridge toll plaza, no problems. no metering lights. that is your traffic. for your forecast, here's tracy. >> hey, thanks, elizabeth. a mild forecast, cool to mild

depending where you're located. for the morning out the door low clouds, fog and drizzle for the coastline. cloudy start with fog, drizzle around the bay and low clouds inland. temperatures for the morning ranging from the lower to the upper 50s. so pretty similar to what we have had previous mornings. seven-day forecast, unfortunately, these afternoon temperatures are similar as well no major changes, cool along the coast. mild conditions, that's going to be inland today in the lower 80s. warmer weather is finally back in the forecast and i use the word finally because it's been a couple of weeks we have been unseasonably mild. warming up thursday, friday and saturday and we are going to take that warm weather and kick it up to seasonal through sunday and monday so looking forward to that. >> all right, thank you. back to you. >> thank you. it is 6:02. this morning, an 18-year-old sits in jail for a deadly shooting near san francisco's union square. 50-year-old mechthild schroeer

from germany died instantly when a stray bullet hit her in the head sunday evening. the victim and her husband were celebrating their anniversary when she was shot near their hotel. the husband left san francisco last night. >> we embraced and my heart just went out to him. i began to weep. >> this was the end of the summer party for people 18 and younger. it should be the safest event that anyone sends their kids to. and that's what underscores my anger about this and frustration. >> police say the woman was killed outside a party for teenagers that had been overbooked. she was hit when two groups of young people started shooting at each other. a livermore woman has delayed a plea on felony charges of having sex with underaged teens. 42-year-old christine hubbs was arraigned yesterday in pleasanton. according to a police affidavit, hubbs made advances on one of the boys when he was 14 years old and dating her

daughter. it says the other teen is now 14 and had a "relationship" with hubbs that ended last month. >> i received a significant amount of discovery from the district attorney. i want to review it. i want to go through it very carefully before i can make any comment on the case. >> hubbs remains in jail on more than $4 million bail. the bumper sticker says hang up and drive. anne makovec joins us with today's chp crackdown on distracted drivers. >> reporter: the bumper sticker says it the psas say it, the news reporters say it we have all heard it a million times, do not talk on your cell phone with your hand up to your ear when you're driving but unfortunately, people still do it all of the time. >> this is a zero tolerance crackdown starting today by the california highway patrol. during last year's campaign, they handed out 550 tickets in

the bay area with the chp alone. the biggest number of busts, officers from all the local departments gave out 700 citations in two days. but what exactly does zero tolerance mean? i would think officers would often have zero tolerance when it comes to talk on cell phones when driving. here with trent cross of the california highway patrol, what is this campaign meaning? >> basically what the zero tolerance campaign, it means if you are stopped today for and free violation more than likely you are going to receive a citation. usually on day-to-day operations it's at the officers' discretion of there is a lot of gray. the only thing black and white is usually the patrol cars but today we are going to take a strong approach with our enforcement efforts. >> so officers are actually encouraged to give more tickets? >> absolutely. but what we want people to realize is that enforcement is only one part of the campaign. education is equally as important because that's a pro- active way of getting people to comply with the law and that's why we're here today talking to the media and to the public to remind them of the dangers of

distracted driving and talking on the cell phone. >> so today is a zero tolerance campaign day and there is one more? >> yes, there will be another one on august 18 but we want people to realize that anytime you divert your attention from the road or you're distracted while driving, it could result in tragedy of you possibly killing someone else or killing yourself. >> thanks for that. trent is going to stick with us and join us live again at 6:30. if you have any questions would you like me to ask him, go ahead and email them to mornings@cbs5.com. >> anne, i have a question to ask trent. these are not warnings. these are citations. how much are we talking about? just to let people know. >> reporter: you know, we talk about that a lot because a citation itself is around 30. but when you add in all the fees, what are we talking? >> as far as fines are concerned you're looking at approximately $150 to $200 depending on the county, that's fines, court fees, penalty asisments but no matter how high the fines are, it doesn't bring back a life.

that's what this is all about. >> reporter: anything else? >> no. just wanted to let people know they'll pay if they break the law. thank you, anne makovec at the bay bridge. today a santa clara county supervisor is calling for a law that would require pit bull owners to have their dogs spayed or neuter. ken yeager says it was inspired by the recent attack in contra costa county where pit bulls killed a 2-year-old boy. elected officials there are also planning legislation in response. some local governments already have similar ordinances including gilroy, san francisco and sonoma counties. if passed in santa clara county, it would only apply to the unincorporated areas of that county. governor schwarzenegger's plan to furlough state workers is on hold now. an alameda county judge has issued a temporary restraining order to block the furloughs scheduled to begin this friday.

the plan would force state workers to take 3 fridays off a month without pay. the governor's office will appeal the ruling. in the last year and a half, stat workers have been furloughed a total of 46 days which means they lost about 14% of their pay. a new deal could help put more cops back on the streets of oakland. oakland police officers have agreed to increase payments into the retirement plans to 9% by 2013. in return, they will get a guarantee of no layoffs for three years. the agreement depends, though, on passage of a november ballot measure. it would tax oakland property owners $360 per parcel per year for four years. that will be one of four tax measures on the oakland ballot in november. 6:08. why weather is a big concern for bp crews drilling in the gulf. and later, that fed-up flight attendant who loses it and jumps down the plane's emergency chute. we'll tell you what caused him

of crews still on the scene of a fire burning by alameda pier. looks like the fire right now is mostly out. earlier we were getting a lot of phone calls and e-mails about smoke that was visible along the 880 nimitz freeway in the area. fortunately no other structures or boats were threatened. that pier is kind of off to itself. but obviously emergency crews still on scene so we'll continue to bring you update throughout the rest of the hour. >> all right, elizabeth. we'll be watching that. 6:12. they are close to finishing that relief well that should finish plugging the leak in the gulf of mexico. crews have drilled more than 2 miles under the floor of the gulf. they hope to finish it by the end of the week. after the drill gets to the well, they plan to plug the hole with more mud and cement. they did have some concern about thunderstorms in the eastern gulf of mexico. but for now, bp says it is not planning to stop that operation. voters in four states casting ballots today in primary elections. senate seats up for grabs in

colorado and connecticut. minnesota and george have high- profile governor races. some experts say today's voter turnout could provide clues to how the major parties will perform in november. a recent pugh poll shows 77% of republicans plan to vote compared with just 65% of democrats. house democrats are convening in emergency session interrupting congress' summer vacation. they want to pass a bill aimed at saving hundreds of thousands of jobs. the bill is meant to save teachers and other public workers from unemployment. today's one day session may also address border security. a $600 million bill would increase surveillance along the u.s./mexico border. a crackdown on bay area freeways this morning. the fines for distracted drivers. and crews digging a fourth bore for the caldecott tunnel. the very large machine being used and the very long extension cord it needs. it seems like it's been a

and, of course, the clouds along the coastline. areas of fog and cool. let's talk about cool. we have had a cool summer. so we picked three locations. average daytime high in san jose is 84 degrees. oakland at 73. san francisco at 69. the last time all three locations actually saw temperatures that warm, july 15th. almost a month ago. and i put this thermometer on here with its freezing with the icicles. i know that's a bit much but i was trying to bring home my point a bit. it's going to be warming up. so we'll have more seasonal temperatures back in the forecast in time for the weekend. so it's been about a month. it's about time. 76 degrees in santa clara today. 73 in fremont. lower 70s in palo alto and in redwood city. these temperatures pretty much like yesterday. 70s walnut creek, 81 san ramon, 83 pleasanton, 78 dublin. north bay 72 novato, 74 san an sell mole, 70 mill valley, 61

san francisco, 74 san anselmo. i liked the cold thermometer. i thought it brought the point home. that's billy poone our graphics extraordinaire over there. we'll begin to warm up thursday, friday and saturday and there you go, seasonal temperatures back in the forecast just in time for the weekend. that's a look at your weather. back up to you. >> i like that thermometer. we never get to use it that often. okay, tracy, thanks investment it's 6:20. let's take a look at today's top stories. an 18-year-old under arrest now for sunday night's deadly shooting near union square in san francisco. a tourist from germany walking with her husband was hit and killed by a stray bullet. members of oakland's police union say they are willing to pay more into their retirement accounts in exchange for a no layoff guarantee. the concession depends on oakland voters approving a parcel tax in november. hang up and drive or pay. today the chp cracking down on drivers who talk on their cell phones without a hands-free device. it is a zero tolerance campaign

in the bay area. officers are going to be stopping drivers who are illegally using cell phones behind the wheel. you get caught, you are going to face fines up to $200. crews have begun drilling the fourth bore of the caldecott tunnel. they are making their way through 3400 feet of rock. the plan is to cut 10 feet a day. that big machine, a road header, the largest machine of its kind in north america. it's a green machine, as well. it's all electric. and get this. it takes six people just to handle the giant extension cord which is more than 3,000 feet long. it will take three years and may leave congestion on highway 24. 6:21. it was the last straw for this long-time flight attendant. his on the job tirade that landed him in jail.

[ yelling ] >> mr. slater, why are you smiling? >> that is steven slater. he used a plane's p.a. system to curse at a passenger and escaped on an emergency chute. he is a flight attendant. he got into an argument with someone who opened the overhead bin while the plane was still taxying to the gate. the bag apparently hit him in the head and he got fed up. he announced he wouldn't take it anymore. he grabbed some beer and hit the slide after cursing.

he is facing charges of criminal mischief and reckless endangerment. there is now a facebook page in his support. you can check it out on facebook. and the "new york times" is even asking people for their last straw stories of when they finally hit the wall at work, which leads us to our question of the day, do you think the jetblue flight attendant's actions were justified? no, most flight attendants feel they can have attitude and get away with it. none of it is justified considering how some flight attendants talk to passengers. this was bound to happen someday. i don't feel that the flight attendant should have been arrested. then there is michael. i hope somebody gives him a reward. i deal with people who are abusive all day long because there are no consequences to the way they treat people. i think he probably had just had enough. he is a working class hero to me. and on facebook, you know, customers can really make you go there sometimes. go, steve!

she's his fan. a british man has become the first to walk the entire length of the amazon river. ed stafford ending his 2.5-year journey yesterday by leaping into the atlantic ocean in northern brazil. he started back in april of 2008 in the peruvian andes and for most of his walk, he had some company, accompanied by a peruvian forestry worker and together they dealt with 18- foot crocodiles, anna conned das, food shorted angles,dages, threat of food poisoning, drowning. the deal that could bring back police officers in oakland. what officers have agreed to do to ease a budget crunch. and we all know it's dangerous to talk on the phone when you're out on the highway but today it's even more dangerous because you could be

that crashed in alaska. the "associated press" says former alaska senator ted stevens was possibly one of the eight people on that plane. the ex-senator was reportedly traveling in the area to a resort but that's not confirmed. this plane crashed southwest of anchorage. the national transportation safety board sending an investigative team to the area. several people are said to be in the area helping victims. but there is no word on how many, if any, of those passengers survived. again, this is a plane crash in alaska. many fearing that former alaska senator ted stevens was on board. we'll keep you updated. in other news, there is an arrest now for sunday night's murder of a german tourist in san francisco's theater district. as joe vazquez reports, an 18- year-old from san francisco is now charged with killing a woman near union square. >> reporter: his wife was

murdered while they celebrated their anniversary. tonight, stefan is leaving san francisco, a hotel spokesman saying he is devastated. >> we embraced and my heart just went out to him. my heart went out to him. i began to weep. >> reporter: police say an independent party promoting overbooked this venue called the clubhouse on mason near geary for a sunday night party. the crowd that couldn't get in grew restless on the sidewalk. just before 9:00, two groups of young people started shooting at each other. 50-year-old mechthild schroeer of germany was walking back to her hotel with her husband when a stray bullet hit her in the head. she died instantly. two others were wounded. >> the police were very carefully shiuing shooing people away. they thought that someone might still be in the area with a firearm. >> customers were trying to get a smoke outside and heard the gunshots. >> reporter: the owner of biscuits and blues showed us

surveillance video of people about to leave his club reacting to the gunshots outside. a clerk ducks for cover. across the street, the manager of the clubhouse also showed us video. >> here's where they all run back in. they had been out in the street and the shots were being fired and everybody ran back in. >> reporter: young people mobbed the lobby once bullets started flying. >> this was the end of the summer party for people 18 and younger. it should be a safe event and that underscores my anger about this and frustration. >> reporter: city leaders say recent legislation is holding club own, accountable for violence. now they want to do the same thing for independent party promoters. supervisor david chu said he is soon introduce legislation that will require these independent promoters to register their names with the city. after that if they have trouble with violence, they will then be required to buy insurance and beef up security. >> often times, these fly by night operators throw these

tolerance crackdown. anne, good morning. >> reporter: good morning. yeah, if the safety factor doesn't get you, perhaps it's hitting you in the pocketbook because they are going to be giving out more tickets than normal today. i'm joined here with chp officer trent cross to answer some of your questions about the laws on cell phone driving because they have been in place for a couple of years and you still see a lot of drivers not following them? >> yeah. unfortunately, we see people still driving with hand-held cell phones up to their ear which is extremely dangerous because not only are they distracted but they are creating a blind spot. >> donna says if i pull over and make a call on the side of the road but leave the car running can i get a ticket? >> yes. you can receive a citation for unsafe stopping on a highway if pull off to the right shoulder and it's not an emergency. we strongly recommend people if you need to make the phone call, pull off the freeway to a

safe location on city streets and make the call and head to your destination. >> reporter: so on a city street you're okay? >> along a city street you're fine but you cannot stop on a highway unless it's an emergency. >> reporter: then we have a question from mark in san bruno asking, you know, a lot of people do this, i got to do a little demonstration. they hold the cell phone in front of them like a microphone while driving and say i don't have the cell phone up to my ear so does this work? >> no. no. holding the cell phone up on speaker phone is a violation. law and the way i like to explain it is plain and simple. you have to be hands-free. you have to have both hands available. the safest way is to have both hands on the wheel. if you are holding that phone on speaker phone you can get a citation. >> reporter: zero tolerance campaign in effect today. thank you for join us, trent cross. thanks for your questions. sydnie. >> stay safe. don't want you to get those big fines and be very careful out there. anne, thank you. anne makovec at the bay bridge. it is 6:38.

let's go to san francisco now. first reports of a residential structure fire and san francisco police department is doing traffic control in the area duboce between guerrero and valencia. the right lane of duboce may be blocked. don't have a lot of information but fire crews continue to stay on scene. expect northbound 101 traffic to back upcoming off the

central freeway in that area. four cars were just cleared off to the shoulder on westbound 580 approaching north livermore but you can see that some speeds where the red is are actually below 20 miles per hour. so traffic is pretty slow going from norad flynn looks like past the accident scene a bit. if you are continuing towards the dublin interchange, closer to tassajara traffic is heavy but speeds are moving along. drive time through the area 23 minutes on westbound 580 from the altamont pass to 680. ten-minute delays there. mckie road, san jose, no delay even though two lanes are blocked from an accident. that may be on the mckie road on-ramp and that's why we are not seeing any big delays. in fact, overall, your drive looks good throughout the south bay. here's a look out of downtown san jose on those northbound lanes of 280. that is your traffic. for your forecast, here's tracy. >> hey, thanks, elizabeth.

those cities actually saw or felt like a seasonal high for this time of the year, july 15th to july 14th. so that was well close to a month ago. i bring that up because we are still unseasonably cool but we will be returning to more seasonal highs by the weekend. 77 degrees today in milpitas. 74 in sunnyvale. 73 los altos. 60 in half moon bay. lower to the mid-60s in berkeley and alameda. inland temperatures moving up and the colors changing from yellow to orange showing us that we are moving to the 80s in danville, san ramon, pleasanton and in livermore. north bay locations, green in san rafael, light shade of green showing lower 70s. mid-70s in kentfield and mid- 70s in sonoma and napa. seven-day forecast, so unseasonable temperatures remain in the forecast today and tomorrow. those of you inland probably like it. we are going to be warming things up to the 90s over the weekend so it's going to feel more seasonal but also pretty hot. 60s at the bay and the coast.

that's a look at your weather. back up to you. more fallout from the surprising change of command at hewlett-packard. here now is jason brooks with kcbs and cbsmoneywatch.com. jason, good morning. >> good morning, sydnie. you have to love ceos who are willing to speak their mind. such is the case with oracle's larry ellison a good friend of recently resigned mark hurd of hewlett-packard he called the board's decision the worst since the board at apple ousted steve jobs 25 years. he called it cowardly, political correctness on the part of hp's board to do so with mark hurd. hp's shares fell 8% yesterday. shareholders obviously very nervous about what that means for the company. but several large customers of hp told the wall street journal that they plan to stick with hp as long as its business model stays true to what it's doing now.

stock market heading south quickly on a number of different factors. productivity in the 2nd quarter dropped almost 1% when it was expected to rise. that will have an immediate short-term impact on earnings reports for companies but it could be a signal that hiring could resume at some point in the future. companies simply have squeezed as much out of their employees as they can. they need more help there. also, chinese imports slowed down. that could hurt growth in that country in the global economy as well. the dow is lower by 126. nasdaq down by 37. s&p off by 14. hp shares treating even. the federal reserve meets today. investors typically cautious ahead of an announcement coming from the fed. also saudi arabia says it's working out an agreement with research in motion about continuing blackberry service in that country. what that means we didn't know but there is some sort of compromis compromise.

research in motion wasn't willing to compromise earlier. >> blackberrys are highly encrypted, tough for countries to capital email and web browsing services, a good ad for blackberry as they sell those to business customers. >> thank you, jason brooks with kcbs and cbsmoneywatch.com. within the past hour the world health organization has declared that the swine flu pandemic is over. the organization's director general said the world is now moving into a post pandemic phase. manage get chan says it's largely run its course. more than 18,000 people around the world died since the outbreak began in april of last year. medical researchers are making progress detecting early signs of alzheimer's disease before there are symptoms. proteins called amyloid and tau short-circuit communication between nerve cells and destroy brain tissue. spinal fluid taken from a patient's back can reveal combinations of those proteins that are typical for the

disease. in a new study, those indicators appeared in 90% of people with alzheimer's and 72% with mild cognitive impairment. and they also appeared in 36% of people who appeared normal. now the doctors hope that the test can pave the way to early preemptive treatments for alzheimer's. okay. we have been talking about this story all morning. that jetblue flight attendant arrested after he lost his temper and stormed off a plane on the tarmac. which leads us to our question of the day: do you think the flight attendant's actions were justified? on facebook, rose says totally justified. at least he didn't use a gun to make his point. the hard els jobs i have had are dealing with customers who say they want what they want when they want. david says he completely cracked, nervous breakdown, i don't think what he did was correct. but i will say i see passengers disrespect flight crews often. respect the flight crew, they

there are reports that former alaska senator ted stevens let's take a a look at some of today's top stories. there are reports that former alaska senator ted stevens may have been aboard a plane that crashed near dillingham, alaska, yesterday evening. the "associated press" says it got word from a u.s. government official who wants to remain anonymous. federal investigators are expected on the crash scene this morning. san francisco police have a suspect in sunday night's murder of a german tourist near union square. an 18-year-old is suspected of firing the shot that hit the woman in the head. police say two groups of young people were shooting at each other. and keep your hands on the wheel and off your cell phone. bay area law officers cracking down today on people caught driving while holding their cell phones.
