sweltering. >> thank you very much. it is 6:02. a federal judge this morning planning to unveil his decision on whether same-sex marriages can resume in california while proposition 8 moves through the appeals process. let's go to julie watts, in san francisco. that decision is being closely watched at city hall. julie, good morning. >> reporter: good morning, sydnie. yeah, the barricades are stacked here outside city hall, where many are anticipating a rush on same-sex marriage licenses if judge vaughn walker lifts the stay he imposed after overturning the prop 8 gay marriage ban. but legal experts warn those hoping for a same-sex union should proceed with caution. >> it's not a final ruling until the appeal is over. anybody who heard that he denied the stay but then extended time for the ninth circuit to consider it and ran off to try to get married, i think they would be disappointed. >> reporter: that's because even if judge walker lifts the stay this morning, supporters of the prop 8 gay marriage ban could immediately file an appeal with the ninth circuit court, who could issue a stay of their own.

and that would call into question the legality of any licenses issued in the interim. now, this is just the latest chapter in a long legal story that began back in 2000, when voters passed prop 22 which defined marriage as between one man and one woman. in 2004, mayor newsom allowed same-sex marriage license to be issued in san francisco. but the state supreme court put a stop to that about a month later. then in 2008, the same court overturned the ban on same-sex marriage allowing gay couples to wed for about six months until prop 8 passed. which brings us to this morning, as we await judge walker's decision. but no matter what he decides this morning, this is not the end. rather, just the latest chapter in a legal story that's expected to continue for years. sydnie? >> all right, julie. thank you very much, julie watts in san francisco. we invite you to stay with us for complete coverage of today's announcement. again, we hear it's going to come sometime between 9:00 a.m. and 12 noon.

we will have live coverage here on cbs 5 and on cbs5.com just as soon as that decision is made public. a city planning commission has given the go-ahead for a 63- foot-tall minaret at a mosque in santa clara. the minaret at the muslim community center on scott boulevard was previously approved but a nearby business owner appealed the decision saying the tower doesn't fit the neighborhood. for others on both sides of the issue, it was the religious significance. >> to me, to have symbolism, to me it's what happened on 9/11. >> this kind of thinking is very counterproductive, you know, in

a society like this. >> our opposition to the tower is based on our belief that the building addition currently under construction is incompatible with the existing architecture of the rest of the building. >> after hearing those comments the commission voted unanimously to deny the appeal allowing the project go forward. it is the future of bay area transportation. the new transbay terminal. crews are working ton this morning. the $4 billion project will replace the old terminal at first and mission streets. it will become the first high- speed rail station as well as the gateway to nearly a dozen local transit agencies. plans include a new skyscraper. the prong is expected to create some 48,000 new jobs. the terminal scheduled to be completed in 2017. bart has more money left over from last year's budget. $4million extra. the transit agency now has a total of 8.5 million until the bank. -- total of $8.5 million in its pocket. in june the state unexpectedly handed out $4.5 million in transit assistance.

the board of directors will meet today. a decision how they will spend the money probably won't happen for another two weeks. state budget problems may stop $3 billion in road repairs in california. several projects have been put on hold until the budget stalemate is resolved. some bay area projects at risk of being delayed include repaving highway 80 in oakland and widening highway 4 in antioch. the budget could also put a hold on digging that fourth bore of the caldecott tunnel. that just started this week. a warning about a favorite rental for birthday parties. what's in those popular bouncy houses that could make kids sick. >> plus, a little later, everybody back in the pool! the east bay city getting ready to re-open a popular swim center. ,, ,,,,

good morning. we have double trouble now in the south bay. northbound 101 approaching oak road. two separate accidents, one actually in the backup. we'll have details of what's going on plus give you some alternates coming up. elizabeth, thanks very much. 6:10. welcome back, everyone. it will be a 13-way race to determine who will replace oakland mayor ron dellums. the best known candidates in the november contest include

former state senate president don perata and two current members of the city council, jean quan and rebecca kaplan. mayor dellums issued a statement last week saying he will not seek re-election. it's unlikely that any candidate will get more than 50% of the vote in the first count. and in that case, there will be an instant runoff that includes voters' second and third choices to be used to determine a winner. inflatable bouncy houses, you see them all the time, kids jumping in them at birthday parties and special events. the makers of those attactions are now being sued because of concerns about lead. attorney general jerry brown wants manufacturers to stop using vinyl with lead to make the inflatable houses and he also wants rental companies to post warnings. this comes after tests conducted by the center for environmental health recently found some bouncy houses contain more lead than is legally allowed. >> under federal law, for children's products they can't

and at candlestick park it's an it's antiques and collectibles fair. 6:19. let's look at some of the stories in the headlines. the federal judge who overturned proposition 8 expected to release a decision on same-sex marriage this morning. he will determine whether gay marriages can resume in california while prop 8 supporters appeal his ruling. proposition 8 the voter- approved measure that limits marriage to male-female couples. santa clara's planning commission has given the go- ahead to build a 63-foot-tall minaret at a mosque on scott boulevard. that tower was already approved. but a nearby business owner appealed the decision saying it doesn't fit in with the neighborhood. the commission turned down that appeal last night. and bart officials have good news. they have announced another surplus. the agency says they have ended last year's budget year with $4 million left over. 9th comes after the state handed out $4.5 million in

transit assistance last month. bart officials say it will take them, though, another couple of weeks to decide just mao to spend the 8 .5 million dollars. starting next year, aluminum baseball bats will have to meet new safety standards at high schools across california. the move comes after an 18-year- old pitcher from marin county suffered a major head injury when hit by a line drive off a metal bat. the california interscholastic federation also recommends infielders wear protective head gear and encouraging schools to voluntarily require the protective head gear for the spring season. in exchange for these new standards, the state assembly has dropped a bill that would have placed a two-year moratorium on metal bats. 6:20. just in time for the weekend warmup, an east bay city reopens a popular swimming pool. the $7 million face-lift for the historic building. and coming up roses. the national honor given to san jose's rejuvinated rose garden. ll

bay area. berkeley today 63 with some sunshine and some clouds. can't forget those clouds. hayward today 70 degrees with plenty of sunshine. more sunshine to go around in pleasant hill with today's high of 80. 82 san ramon. 85 degrees in antioch. we are still unseasonably mild but warmer weather is just around the corner. the 90s are moving back into the bay area, i can't wait. i'll let you know when coming up. >> i know swimmers will certainly be looking forward to that, tracy. 6:24. east bay swimmers will soon be getting the chance to plunge into a historic indoor swimming pool. the pool in richmond was damaged in the loma prieta earthquake and closed in 2001. it was built back in the '20s. it's become a richmond landmark. the plunge's architect restorer said they made sure to honor its history while making new improvements. it features a mural honoring a

local swim teacher. >> june is our princess of the pool. she is an amazing inspiration for me. >> the plunge costs 7.5 million to rebuild. new addition include solar panels to heat the pool and ultraviolet light that will clean the water instead of using chlorine. san jose's municipal rose garden is the best in the nation. the city beating other floral havens including pasadena and portland. in all, 130 public rose gardens competed nationwide. this competition run by a nonprofit group, all america rose selections. it is a big comeback for this san jose park. it was first established back in 1929 but budget cuts led to a decline in maintenance. by 2005, that rose garden deteriorated so much the group put it on probation. but then there were a lot of great volunteers who came to the rescue and revived it.

and the probation was lifted two years ago. that municipal rose garden in san jose, tops in the nation. the economic numbers this summer less than encouraging. investors are worried, they sent the stock market plunging more than 200 points yesterday. everybody fearing that this recession will continue. it's tough out there. so our question of the day is, with the economy still struggling, what are you doing to save money and cut expenses? you can send us your comments to mornings@cbs5.com. we're also on facebook and

enough money to replace the exterior skin, which had to be removed because it's toxic. kcbs radio's matt bigler is at the silicon valley bureau to explain who is paying. >> reporter: good morning. the source of the cash may be from nasa, which now controls moffett field where hangar one is located. the space agency has long maintained they don't have the money to restore the structure. it's a big building. you can see it on 101 driving northbound off to the right- hand side on moffett field. it will take up to $40 million just to replace the packaging once the navy takes it off this october. and nasa has said they just don't have the money for that. now nasa has submitted a request for information to find out how much it's going to cost so an official at nasa ames has told the daily news they may in fact be able to come up with

good morning. let's start with a quick bridge check. if you are commuting the bay bridge, still no metering lights. we got word of a stall on the upper deck approaching treasure island blocking one lane. so bridge crews are aware of it, heading out there now, but only minor delays to the toll plaza. no problems across the san mateo or golden gate bridges. now we have new issues in san jose. let's go to the maps. we were hoping that things would clear up here shortly.

we actually had two separate accidents on that stretch of northbound 101. so all lanes are open now northbound 101 at oakland road. a second accident the backup has also been cleared. now, right before i came on air we just heard of a third accident now report of an accident. so chp heading out now. northbound 101 at mckie that may be blocking one lane. so obviously, very slow right now in those northbound lanes of 101 through san jose. this is for sure been our hotspot all morning long at least since 6:00. so the guadalupe parkway looks great. extra heavy traffic this morning for the guadalupe parkway this time of the morning. but relatively delay-free. and 280 check this out. we have a live camera showing you how good it looks as you approach the 880 interchange. so yeah, avoid101 for right now. watch out for cows commuting by infineon. we got word of this accident. it sounds like the cow is off to the shoulder. highway 121 at infineon raceway, car versus cow. sad but wanted to throw up my little cow tab. and if you are commuting the

lower to the mid-90s. near 70 around the bay. i'll take it. downtown san jose, jazz festival going on this weekend. 80 degrees for saturday, 83 for sunday, and i also have a birthday shoutout to claudia hall from her husband phil. he says happy birthday! that's a look at your weather. back up to you. thank you. it is 6:45. more bad news for the economy. the market is falling again. and so are employment numbers. let's go to jason brooks with kcbs and cbsmoneywatch.com. how's it looking? >> reporter: good morning, sydnie. it doesn't look as bad as yesterday. that's not saying a lot. the numbers are still down. we have another look at unemployment and weekly jobless claims headed higher by 2,000 to 484,000. that's the highest number since early january. so really not seeing a lot of improvement in the employment picture. that's adding to the slowing economy. that's what dragged down the numbers big time when the dow

lost 265 points yesterday. market heading lower right now. dow lower by 66. nasdaq down 28. s&p off by 9. cisco shares getting hit really hard down 9.5%. company reported its quarterly earnings yesterday. while the numbers weren't that bad, profit was up big time from last year at 1.9 billion. revenue of 10.8 billion a little under expectations. it's what ceo john chambers said about future growths. he says he has seen mixed signals from business customers around the world and if there is a reduction in tech spending, that's another factor that could hurt the economy even further. investors are selling off on the stocks based off what chambers had to say about future growth. >> research in motion the blackberry maker is besieged these days. india says it must compromise on its highly secured messenger services by august 31 or india will shut off blackberry services. there are about 1 million

blackberry users in india. it's one of research in motion's fastest growing markets. this after the company just reached a compromise to keep its blackberrys running in saudi arabia. >> thank you very much, we'll be watching wall street today, jason brooks with kcbs and cbsmoneywatch.com. local housing prices though, this is just a bit of good news. those prices on the rise and in dramatic fashion. in the 2nd quarter of this year, the median price for a home in the san jose-sunnyvale, santa clara area was 630 thousand dollars. the national association of realtors says that is a 26% increase from a year earlier and the second biggest jump in the nation. in third place, the san francisco-oakland fremont area where the median price was $591,000. that's a 25% jump. now the largest increase by the way was in akron, ohio area, 36% jump in home prices. a gathering of chefs in san

top stories: the federal judge who overturned "proposition eight" is expected to release a d let's check today's top stories. the federal judge who overturned proposition 8 is expected to release a decision on same-sex marriages this morning. judge vaughn walker will decide whether gay marriages can resume in california while prop 8 supporters appeal his ruling. proposition 8 is a voter- approved measure that limits marriage to male-female couples. santa clara's planning commission has given the go- ahead to build a 63-foot-tall minaret at a mosque on scott boulevard. that tower was already approved but then a nearby business

owner appealed the decision saying it doesn't fit in the neighborhood. the commission though turned down the appeal last night. good news for bart. it has another surplus. the transit agency says it ended the budget year with $4 million left over. this comes after the state handed out $4.5 million to it just last month. bart officials say it's going to take them a couple of weeks to decide how they want to spend the $8.5 million. northbound 11 in san jose just not looking good at all. look at that big line of red on our traffic sensors now. some speeds still hovering around 10 miles per hour. we have heard of three or four accidents all fender-benders in the stretch. is there were several accidents in the backup. it all started around 6:00 a.m. with an accident approaching old oakland road. all the accidents right now are cleared so no lanes are blocked. but it's still just jammed from at least tully road so the guadalupe parkway or 280 going
