the patients got vaccines at sutter pacific medical centers between january and june of this year. there is a chance those vaccines were not effective because apparently, they may not have been stored at the proper temperatures but sutter says the vaccines were not harmful. >> in certain circumstances, the refrigerator may be the wrong temperature. in other instances, people didn't log in the proper temperature so we determined better safe than sorry. >> the vaccines were given at 14 sutter health centers, three in san francisco, one in marin county and 10 in lake and sonoma counties. the problem involves nearly 20 different types of vaccines including polio, hepatitis, whooping cough and h1n1. again, the vaccines don't appear to have been harmful, just ineffective. and it's not even for sure that they were ineffective as you heard him mention. they may not have been stored at the proper temperatures. so this is a better safe than

sorry circumstance. but i know a lot of people are going to be sorry if they have to come back for the second vaccine. the people affected will get letters from sutter about this. >> thank you, anne makovec in san francisco. we have a complete list of the centers asking patients to get another vaccination on our website, cbs5.com. more than 200 million eggs are being recalled and hundreds of californians who ate potentially tainted eggs have been sickened with salmonella. the eggs from iowa were sold under several brand names including lucerne, ral ber sons, ralphs, sunshine and fresh farms. health officials say 266 californians have gotten sick. if the carton in the fridge has a plant number 1026, 1413 or 1946 and it's followed by numbers -- this is a lot of work -- followed by numbers ranging from 136 to 225, return the eggs. i'm hoping we are posting that

somewhere for people. a battle between a landlord and tenant. the landlord says out, the tenant says he's staying. that attend is jelly's dance cafe on pier 50 in san francisco. it's where a man was shot to death outside the club last month. another man shot outside the club in 2008. jelly's leases with the port of san francisco. that lease expires today. and the port wants the club closed. port officials say it's because of the violence, the noise and the violations of the club's lease. jelly's says it will fight the eviction. time now 5:05. a hewlett-packard insider ashedding more light on the controversy that led to the resignation of mark hurd, who quit this month. that was after he reached a settlement with a contractor who accused him of sexual harassment. now an anonymous source tells the "associated press" that contractor, jodie fisher, clammed her work with hp dried

up because he rebuffed her advances. hp said he didn't violate the sexual harassment policies but i board still forced him out. a manager for apple is due in a san jose courtroom today to face fraud and other charges. paul shin devine was arrested friday accused of trading secrets in ex-changes for a million dollars in kickbacks. the irs says he sold confidential information to several of apple's suppliers in asia. the fbi is also investigating the case and apple has filed a civil suit against devine. novato high school is setting new requirements for graduation. the high school students there must now do at least 10 hours of community service each year to get a diploma. under a proposal approved tuesday, students must finish 40 hours of service over four years. that includes activities such as volunteering at a retirement home or interning at an nonprofit. students who volunteer more than 40 hours will be able to

confrontation with burlingame police had a history of mental illness. police shot 20-year-old edgar aristondo monday neat outside the myrtle road home he shared with his mother. it was his mother who called police for help. she says her son was suffering from depression, had been drinking and refused to take his medication. police say he charged them with a steak knife. that prompted one officer to tase him. then another officer fired a gun when he refused to be subdued. the mother claimed he had no knife. >> my son walked here, they grabbed him. my son fell this way from there to here holding his heart saying i can't breathe. i was here behind them. and they shoved me and said like this, like this, with the gun. and that's where my son fell. >> it was kind of different story saying he was met by the taser, there was a -- hit by the taser, there was a scream and there were shots. another people were saying there was a scream after the

shots. >> investigators say they recovered the knife aristondo was holding. they also say police have responded to mental health disturbances at that home 13 times in the last 7 years. time now 5:11. syndicated talk show those dr. laura says she is giving up her long running radio show. the announcement comes amid controversy after she referenced a racial slur several times while speaking to a caller on air. she late later apologized and last night told cnn's larry king she will finish out the end of her contract and then leave the show. she is not being fired and she is not retiring. schlessinger said she is frustrated that she can't speak her mind on the radio without backlash from advertisers so she will now turn to the web. her current contract expires at the end of the year a warning this morning for those who text or use a cell phone without a hands-free device while driving. the california highway patrol and local police have another

880 approaching montague. phil with the kcbs phone force tells us two left lanes and possibly one right lane are blocked. one of these cars sounds like rolled over and chp is on scene now. but expect a bet of a delay. this just popped up in our chp reports about two minutes ago so for right now if you are commuting 880 near 237, near that interchange just before the accident, everything is flowing fine on 237 itself but the accident if you approach montague expressway again watch out for delays and lanes blocked there. all right. out to some roadwork eastbound 4 between bay point and railroad avenue this roadwork actually continues until 11:00 this morning. now, it's only in the eastbound lanes, various lanes will be blocked for at least the next few hours. westbound highway 4 no problems, no roadwork, so so far a good commute towards concord. 880 towards past the coliseum fine, mass transit is on time. once you hit the roads remember our radio partners, kcbs 740-am and 106.9-fm.

this morning. about 3100 patients vaccinated at sutter health clinics are being called in to get new vaccinations. the original vaccines for hepatitis, polio and pertussis may not have been effective because they were improperly stored. sutter says the questionable vaccines are not a health threat. the port of san francisco is evicting a dance club today. but the club is fighting the or. since 2008 two men have been shot to death outside jelly's at pier 50. both the port and the police department want the club closed as its lease rubs out today. a funeral is planned today in alaska for former u.s. senator ted stevens. yesterday alaskans filed past his body in repose in anchorage. he was killed in a plane crash last week. there is still a chance furlough fridays could resume this week. governor schwarzenegger asked the state supreme court to overturn a restraining order, issued by an alameda county judge to stop the furloughs.

a decision could be made any day. the governor wants to force many state workers to take off three fridays each month to save california money. the san jose city council has unanimously approve a plan to lower the speed limit near trace elementary school. we told you about the school opening yesterday, the campus the scene of a fire that destroyed the main building last month? yesterday's vote calls for a 15- mile-an-hour maximum speed on dana avenue during school hours, that's because some of the temporary portable classrooms had to be set up across the street from the campus. so students and teachers will be crossing dana avenue much of the day. time now 5:20. up next an airshow mishap. we'll show you what happened when this airplane lost a wing during a stunt. treasure island is now a step closer to getting a major make-over.

>> i'm julie watts in for sydnie who is on vacation. she will be back next week. time now 5:29. everyone is wondering if today is going to be as nice as yesterday. plenty of sunshine in the bay. we have a check of weather. but first a look at that morning commute. >> all right. thanks, guys. yeah, we're off to a rough start commuting through milpitas. they just issued a traffic alert for this section of southbound 880 just before the montague expressway. chp calling this a major injury accident. a big rig and couple of cars involved. one of those cars on its side. so chp is apparently running traffic breaks through the area to help slow some of the other cars in fact area down. we are seeing a little slow traffic on our sensors, not a lot because it's early and traffic is light. no huge delays down southbound 880 from fremont but again they issued that traffic alert so they expect lanes to be blocked for a while. they were able to open one right lane but still have one left lane blocked approaching montague. so a little slow and go near 237 where we have a camera near

phone in california. caltrain is asking its passengers, what's the least painful of two evils? service cuts or fare increases? the commuter railroad will hold public meetings this evening at its stations in san jose, gilroy and san francisco, and its headquarters in san carlos. caltrain says it's still strapped for cash and needs to find more ways to save money. caltrain's board is expected to make decisions in october. republican sam blakesly will be the new state senator in district 15. it's a region that stretches from southern santa clara county to santa barbara county. the state assemblyman from san luis obispo beat democrat john laird in yesterday's special election. blakesly will replace fellow republican abel maldonado who vacated the seat when governor

schwarzenegger appointed him the lieutenant governor. time now 5:37. federal prosecutors want to get former illinois governor rod blagojevich back in court as soon as possible. they are planning a retrial after a federal jury in chicago failed to reach a verdict on 23 out of 24 corruption charges. as whit johnson reports, it's all because of one holdout juror. reporter: rod blagojevich's courtroom battle is far from over. >> we are going to continue to fight and again i just want to express my gratitude to the men and women of the jury and remind the people of illinois i didn't let you down. >> reporter: after two weeks of deliberations, a federal jury found the former illinois governor guilty tuesday on just one count, lying to the fbi. the jurors couldn't reach an agreement on the 23 other corruption charges leading the judge to declare a mistrial. >> it was a very arduous process. >> reporter: blagojevich plans to appeal the single

conviction, which could get him five years in prison. federal prosecutors already have a retrial in the works. >> we have a court date set for next week, next thursday to set a trial date. >> reporter: blagojevich will face several corruption charges in the retrial including the most serious of them all, that he tried to sell president obama's old senate seat. the former governor was already under investigation when fbi wiretaps captured this phone conversation. >> i mean, i've got this thing and it's [ bleep ] golden. and i'm just not giving it up [ bleep ] for nothing. i'm not going to do it and i can always use it [ bleep ] parachute... in alaska for former senator ted stevens. the long-time lawmaker was 86 years old when he died in a plane crash last week that killed four other people, as well. yesterday, alaskans filed past stevens' closed casket as his body lay in repose. vice president joe biden will speak at the funeral. new york's governor is involved in the debate over a mosque planned near ground zero in new york. governor david paterson suggests a swap. he says the state might be able to offer some public property farther from ground zero in exchange for the building where the facility is planned. a meeting is expected soon. a spokesman for the cultural center project says he appreciates the governor's interest. a new survey finds 61% of americans think the economy has gotten worse or stayed the same under president obama. three-quarters say it's

unrealistic to expect noticeable improvements after 18 months of his presidency. the "associated press"/gfk poll finds that 41% now approve of the president's performance on the economy. that is down though from had 44% in april. 56% disapprove the president's handling of the economy. the president's overall approval rating is 49%. more than a month after the leak was capped in the gulf of mexico there are conflicting reports now on the amount of oil still polluting the waters. scientist are fighting government claims that half the oil has disappeared from the system. researchers have found toxicity in plankton from 900 to more than 3,000 feet deep. scientists say they are concerned because plant plankton is an important part of the food chain in the gulf. 5:41. >> coming up, the simple way to

charges. paul shin devine was arrested friday. the irs says devine sold confidential apple information to several apple suppliers in asia. a zero tolerance crackdown on drivers illegally using cell phones continues today. the chp and local police in the bay area started the special enforcement last week and wrote 900 citations so now they are pretty good at it. today they are looking for people talking and texting on hand-held phones. a new study shows teenagers have more hearing loss today than 20 years ago. now, experts are urging teens to turn down the volume. researchers found teens have 30% hearing lot, a big increase. doctors say teens who don't know they have a problem need to be identified.

one is possibly different placement in a classroom or they may need amplification or hearing eights. i'm not surprised because they are constantly connected to ipods computers. we are constantly on them to turn them down. >> this latest study doesn't look specifically at noise and hearing loss. previous music shows loud music can put listeners at risk. if you have a teenaged boy who is depressed get little to eat some fish. a new study from japan found boys who ate the most fish were less likely to develop depression. the same isn't true for girls. researchers aren't sure why. fish oil is known to help brain function but it could have a different effect on different genders when it comes to depression. how about a cholesterol- lowering drug with a burger and fries? it's an idea that british scientists are floating. there is a new study that says

taking a statin pill when you eat a cheeseburger and shake could neutralize the increased risk of heart disease from that food. might achieve the same results by not eating that food. scientists with the national heart and lung institute in london say it would cost just under 7 cents per customer it hand out statins with meals. just a bit more than a packet of ketchup. the uk has an over-the-counter statin but the u.s. doesn't. they have run into problems with statins here, too. so it will be interesting to see if they take flight. >> wonder if they can come up with a pill to cancel out the calories. i'd buy that.
