we are talking record breakers today, tracy? >> she got out of dodge. she knew it was going to be hot in the bay area. she figured i'll go someplace where it's probably not so warm and i'm using that world mildly. 100 in fairfield, 102 antioch, 103 pleasanton, mid-90s in benicia, 97 in san jose. temperatures warmer than yesterday. in the coastline though in the same ballpark. 70s half moon bay, 90s kentfield, 98 santa rosa, 99 sonoma. so north and east bay location, that's where all the heat is going to be today. anne makovec is already there in walnut creek. it is not so hot right now, what is it like, anne. >> reporter: that's right, it is just below 60 degrees right now. it's especially pleasant to be the morning reporter because everybody working the later

shift are going to be roasting. according to your forecast it will be 102 here in walnut creek today a difference of about 40 degrees from what it is right now. that heat wave will present two issues. it's a "spare the air." number 2, the possibility of power outages. so many people are running their air-conditioning, it can lead to system overload and that's what happened in castro valley this weekend. more than 30,000 pg&e customers lost power for almost three hours on saturday night. pg&e says it was heat-related equipment failure. of course, the mere thought of not having air-conditioning can make those sweat beads form so here are a few ways that you can still have the ac but make things easier on the power grid. these are from pg&e. shut your windows and keep your blinds closed in the morning to keep the cool air from overnight trapped in your home. try to remember to turn off lights and appliances, no- brainer. do your best to use light and appliances now before sun-up or later in the evening when it cools down.

and set the air conditioning at 85 when you're not home. 75 when you are. of course, again, it is a "spare the air" day today which means you're not supposed to drive. but as you can see from the cars zooming past me here people will drive so we have a few tips on making that easier on air quality coming up in the next half hour. tracy, back to you. >> hey, thanks, anne. today is going to be hot. what about the rest of the workweek? we have a big high pressure system well in charge. west coast. that's why between going to be heating up today but the rest of the workweek, not so bad. we'll take a look at your seven- day forecast coming up. and in the meantime, elizabeth, back to you. >> that is a big high pressure! it's huge. the extra large h today. all right, thank you, tracy. congresswoman jackie speier will be in san bruno this morning to introduce a bill that calls for stronger regulation and oversight of natural gas pipeline. it's in response to the explosion and fire this month that killed 7 and destroyed 35

homes. her bill would require automatic or remote shutoff valves in some transmission lines. utilities would also have to tell home owners about the locations of nearby pipelines. federal investigators are looking into the disaster. "los angeles times" reports this morning that pg&e's natural gas leak is more than six times the average of the nation's other large operators. pg&e attributes that to a more rigorous reporting standard. in hours from now, lawyers for a death row inmate will ask a marin county judge to stay the execution of albert greenwood brown. he is scheduled to be executed on wednesday. he will be given a three-drug cocktail in a state's newly renovated death chamber. brown was convicted of killing a 15-year-old girl in southern california. a deadly police shooting in the tenderloin is under investigation this morning. officers were called to the

granada apartments on sutter about an argument. someone started throwing things out the window. during the investigation, they say a man pulled out a weapon and an officer fired. the victim's name hasn't been released. no one else was hurt. rescuers are trying to get to the wreckage of a small twin engine plane that crashed in the mountains of baja, california. mexican officials believe four people were aboard the plane when it went down in rugged terrain near cabo san lucas on saturday. the faa believes that plane departed from san diego. heads down, stay down, heads down, stay down! >> that is the sound of a delta stewardess instructing passengers during an emergency landing at jfk. the flight from atlanta to white planes, new york, had landing gear problems. one of the passengers videotaped the landing from inside the cabin. witnesses say sparks flew as one of the wings dragged on the

tarmac. the plane landed safely. no one was hurt. [ applause ] >> a lot of rattled nerves. the faa is investigating. well, there is a new push to go beyond just limiting cell phone use behind the wheel. the governor's highway safety association is considering a proposal to ban all cell phone use by drivers. california's already banned texting and even holding your cell phone while talking and driving. dangerous stuff. all right. time now is 6:06. let's get another check of weather and your traffic. gianna, how is the commute looking so far? >> we have a brand-new trouble spot to report in the marin county area near san rafael. northbound 101 approaching the central san rafael exit a broken-down big rig blocking the right lane. traffic is slow approaching the area. give yourself some extra time. south 101 no problem, good along the marin county area into the peninsula if you are take 101 to sfo traffic moving

nicely. 280 checking in problem-free down into san jose. we are though seeing some delays westbound 580 the usual stuff this time of the morning. westbound through the altamont pass. let's check the hot forecast. >> i think that was me. walking out the door this morning, clear start inland for the bay and for the coastline a few clouds expected for the morning and also a few clouds for the afternoon. that's going to curve temperatures along the coast. it's on par with yesterday but this is the only location not expected to warm up. the bay warming up to the 80s just near 90. plenty of sunshine but very warm. and sunny and hot temperatures expected inland up to 103 degrees. and today is a "spare the air" day. we'll take a look at bay area cities, who is going to be seeing, feeling that triple- digit heat, that's all coming up. back to you. >> thank you. the time now is 6:07.

but we are seeing a slight delay in the cash lanes there. the fastrak is moving well. san mateo bridge no problems. traffic is clears across the span heading into hayward or foster city. south 880 some extra volume into hayward but so far speeds are moving well through the portion. golden gate bridge no troubles there. that earlier trouble spot on 101 in san rafael northbound that big rig now completely cleared out of the way. mass transit not a bad choice today. all checking in problem-free. it is a "spare the air" day so they encourage you to use mass transit. why? it's summer-like temperatures. and tracy has the details. >> yeah. it's going to be hot today. out the door, clear start inland. temperatures ranging from the lower 50s to the lower 60s. clear start around the bay and a few clouds at the coast with cooler temperatures ranging from the lower to the mid-50s. this afternoon, sunny and hot. today is a "spare the air" day and up to 103 degrees. around the bay not as hot but, you know, still worth talking

we have your seven-day forecast coming up. sydnie is on vacation this week. i'm elizabeth wenger. it's 6:22. a citywide ban on toys with fast food meals will get a hearing in san francisco today. restaurant industry reps will meet with city officials to voice concerns about the plan. the proposal would make it illegal for kids' meals to come with toys if those meals are high in calories, fat, sugar and salt, you know, all the bad stuff. it would also require meals that do come with toys to include a cup of fruit and three-quarters cup of vegetables. the american academy of pediatrics is calling for a ban on all tobacco ads and new limits on alcohol advertising. the organization says that more than $25 billion in cigarette, alcohol and prescription drug advertising is working against efforts to keep children and teens off drugs. the group insists legal drugs like alcohol and tobacco pose the greatest danger to children

because they are some of the earliest drugs used. this bud's for you. budweiser is launching a campaign today giving a half a million beers away for free. those drinks will be given away at bars and restaurants in the country including here in the bay area through wednesday as part of national happy hour. the company is targeting the under 30 crowd which hasn't been drinking bud. we weren't able to figure out which bars and restaurants will be giving them away so you will have to research. fine dining has rolled on the street of san francisco. they are called busstrants or broach coaches. the coaches serve a wide array of freshly cooked meals including calorie negative dishes like a jalapeno and citrus mix. >> created new

paradigms. >> very fancy. some restaurant owners say they are worried the meals on the bus will hurt the brick and mortar businesses. however, the busstra unt owners say they serve different clientele. a couple of very tough games for the bay area's pro football teams yesterday. first, the oakland raiders who look like they were going to win on the final play of the game. >> no good. >> instead, kicker sebastian janikowski missed a field goal allowing the arizona cardinals to hang on. 24-23 victory. not much suspense in the san francisco 49ers game. the kansas city chiefs had a lead at halftime and padded it quickly in the 3rd quarter a

on vacaction it's going to be another hot gooch. it is monday, september 27. good morning. i'm elizabeth wenger. sydnie kohara is on vacation. she is getting out of dodge because it is going to be another hot one. the people in the bay area are urged to conserve energy and reduce pollution today. anne makovec joins us from walnut creek where the temperature is expected to go above 100. >> reporter: good morning. it's going to jump 40 degrees today from where i'm standing here in downtown walnut creek.

we are just below 60 right now. tracy says it's supposed to get up to 102 so pacific gas and electric is warning everybody to take it easy. we saw a power outage in castro valley because of so many people running air- conditioning. it's also our fifth "spare the air" of the year and it's coming at the end of the "spare the air" ozone season which runs from early may through the end of september. the time when smog or ground level ozone becomes a real issue for people with breathing problems and even if your air seems fine wind blows pollution into the east and south bay valleys from other areas. that can get nasty. so we have all heard the recommendations on using less power and not driving your vehicle but that's easier said than done. so here's a few thoughts on making your driving less of an issue on air quality. number one, combine trips. your car emits more pollution right after a cold start. you can also run your errands at night. if you have to refuel, do it

after dark and don't top off the tank. drive smoothly, try to stay at the speed limit. and we know everyone is going to be running their air- conditioning. but now is the time before the sun comes up to try to shut your blinds and windows and trap in the cool air that we have right now so you don't have to run your ac as hard because once your a power outage, nobody has ac. that's not what we want to see. >> then you're really sweating. thank you, anne makovec live for us in a so far, so good relatively mild walnut creek. all right. thank you, anne. well, let's get a check with tracy right? we are going to tracy? yeah. when of our possible record- breaking temperatures. good morning, tracy. >> oh, definitely in the forecast today elizabeth because it is going to be so hot we do have some record high temperatures today that are pretty close to being knocked off a little. 98 degrees in san rafael. that's a current record. today we're forecasting 96. that's close. san jose could also see a new record high. mountain view we are forecasting a temperature slightly warmer, so we could

charges against a san jose police officer who has accused a teen of having sex with his stepdaughter according to the mercury news. the officer is accused of handcuffing the 15-year-old and telling him it was a mistake to have sex with a cop's daughter. this is cell phone video the family supplied to the merc. the family reported the incident last week to the internal affairings unit. the teens have been each cited for having sex with a minor the trial of an optometrist convicted of arson in walnut creek is in the second phase. lawyers for scott weinberg will try persuade jurors he was legally insane at the time of the fire a year ago. he has bipolar disorder and pled not guilty by reason of insanity. but jurors have already convicted weinberg of four counts of felony arson. those fires damaged several businesses including a comcast office where cable service was disrupted. this morning, police are searching for a pair of high-

end shoplifters in san francisco. they hit the prada store in union square yesterday afternoon. police say a man and woman in their 30s walked out of the store with several thousand dollars worth of merchandise. however, the store won't confirm that. well, looks like a total ban on cell phone use behind the wheel has been pushed aside. that's what the "washington post" is now reporting this morning. the governor's highway safety association decided not to endorse california's proposal to ban all cell phone use while driving. the issue is enforcing the ban. the group said laws already on the books such as using a hands-free device, always a good idea, and banning texting while driving have yet to be proven effective. distracted driving fatalities caused by cell phone use and texting increased 28% from 2005 to 2008. >> there is a sense out there that this is dangerous, that this should not be done, but yet folks admit 70% that they

have used a cell phone while driving and 24% have knitted that they have texted while driving. so there is a disconnect. >> california banned texting behind the wheel and holding your cell phone while talking and driving. triple-a wants to go even further launching a campaign asking people to turn off their cell phones and get this even put them in the trunk while they drive. you won't even be tempted at all. well, a new report says the u.s. wants to expand wiretaps on the internet. and matt bigler joins us now from kcbs radio silicon valley bureau to explain why the feds may friend you on facebook? is that right? [ laughter ] >> reporter: well, i don't know about that. but we're talking about communications that happen over the internet over sites like facebook and especially mobile communication devices like blackberry device. that seems to be what the government is concerned about. blackberry devices are so encrypted that not even the

mother company, research in motion, can read the messages there is such a high level of encryption meaning that the fbi can't read those messages. the government may change. that according to the "new york times," the obama administration wants to submit a bill to congress that would basically make it legal for the fbi to read those messages requiring the mother companies to have the technology available to deencrypt the messages and allow the fbi to wiretap that. we talked to larry magid about this. he says he sees both sides of this issue. >> i certainly under stand the need for law enforcement to do their work but i think we have an expectation of privacy when we use these devices. and you worry that the people who are listening in could use this authority and infringe on our civil rights. >> reporter: now, according to the times, this wiretap legislation could come down the

pipe sometime next year. if it passes, expect it to be copied around the world because other countries' security agencies basically face the same thing. they want to be able to see if the bad guys are using the technology, what they are saying and, of course, the bad guys are using these devices because they want to evade surveillance. i'm matt bigler live in san jose for cbs 5. >> a little big brother. thank you, matt bigler in san jose. well, the cause of an itchy rash people are getting after swimming at' beach in alameda has been found. researchers traced it to a previously unknown parasite. a report in a government journal says the culprit is a microscopic flat worm carried by an invasive specyes, i did called the japanese bubble snail first discovered in the bay in 1999. swimmers at crown beach have been getting rashes similar to poison oak for this years. the number of cases is only in

the dozens. one of the big local races in the election will decide who will replace ron dellums as mayor of oakland. so far all 10 candidates have been invited to attend a forum and it's actually this evening. it will run from 7:00 a.m. to 9:00 a.m. at semple sinai at 28th and webster streets. if you want to check it out it's free. and it is open to the community. the two major candidates for governor set to debate at uc-davis tomorrow evening, democrat jerry brown the state attorney general expected to tout his experience as a former two-term governor. republican meg whitman former chief of san jose-based ebay will likely talk up her business experience. tomorrow will be the first of three scheduled debates. a new poll shows brown is pulling ahead despite whitman's better financed campaign. the los angeles time-usc survey shows browns with a 49-44% lead over whitman. that's among likely voters.

but that lead is within the poll's margin of error. meanwhile, democrat barbara boxer has widened her margin over gop candidate carly fiorina for california's u.s. senate seat. that same poll shows boxer leading fiorina 51% to 43% among likely voter with a 3- point margin of error. caltrain is host offing a safety event to introduce new suicide prevention signs at the track. the signs line a 10-mile stretch of railroad between menlo park and mountain view. they were created with the help of mental health experts and list a crisis intervention center phone number. time now 6:41. a check on you wall street when we come back. plus, first it was toyota, now hyundai. the problem that's sparked a massive recall.

that's what we are going to get. right now temperatures in the 50s and 60s. fog at the coast in the 50s. this afternoon, those temperatures are going to be hot up to 103 inland. up to 89 around the bay. strong high pressure dominating the weather. nice dry offshore winds. warm winds, hot temperatures for the bay, and inland. warmer than yesterday. 100 morgan hill, 96 los gatos, 94 los altos, lower to the mid- 70s for pacifica to half moon bay. east bay along the bay mid-80s in berkeley, 88 in oakland, lower 90s in san leandro and in hayward. and once you cross the east bay hills, triple digits heat from concord to danville to

brooks with kcbs and cbsmoneywatch.com. hi, jason. >> reporter: good morning. it's been a rough two years for the banking industry. it was two years ago this week that washington mutual failed. it was the biggest bank failure in u.s. history. since that time another 278 banks have also gone by the wayside. and as a result, that's contracted the banking industry's assets by 4.5% during that time. that's a big reason why it's been much harder to get a loan from banks. it's had a big impact on employment. we have lost 188,000 banking jobs in three years, 11,000 through failures. an it's not as if the problem is getting better. in the 2nd quarter of this year, the fdic increased its problem list of banks by 6% up to 829. and there are analysts out there who say that they could go from a current banking sector of 7900 down to about 5,000 eventually. stock market is on an absolute roll in the month of

september. the dow is up over 8% for the month. coming off a nice day on friday when it was up almost 200 points. quiet day for economic news. but we have several deals under way that could spur action. we have southwest buying airtran for $1.4 billion. unilever is buying alberto culver a beauty products maker for $3.4 billion. and wal-mart wants to buy a south african distributor of goods for another $4.2 billion. wall street at the moment is pulling back. dow down by 24. nasdaq down 8. s&p down 3. several silicon valley tech giants are coming to a proposed settlement with the department of justice over anti-employee poaching allegations against those companies. apple, google, intuit, adobe and pixar. for five years they cannot agree enter into nonpoaching agreements. allegations are that the companies did that in order to keep workers' salaries down. as part of the settlement, they don't have to admit any

wrongdoing. >> thank you, jason brooks with kcbs and cbsmoneywatch.com. well, hyundai is recalling thousands of cars in the united states to correct a manufacturing defect that could cause drivers to lose steering control. that recall covers nearly 140,000 sonata sedans built since december of last year. the company says some of the cars have steering column shafts with assembly problems. the recall comes after the government opened an investigation last month. so far hyundai says there have been no related accidents. rutgers university has begun an initiative to bring civility to new jersey. the two-year program is designed to encourage students and faculty to have better manners. that can't hurt, right? well, that leads us to our question of the day. what are some of the ways people can be more polite to each other? on facebook, susan writes:

take action in the wake of the san bruno explosion and fire. democrat jackie speier plans to introduce a bill this morning. it calls for stronger regulation and oversight of natural gas pipeline. federal investigators are looking into pg&e's handling of the disaster. that blast killed 7 people and destroyed 35 homes. well, it is going to be a scorcher, a sizzler so people are being asked to "spare the air" and their air-conditioners and anne makovec is in walnut creek where it's expected to hit 102. so far, so good, though, right? >> reporter: yeah, very refreshing right now not even 60 degrees hanging around 58 as you can see in the live time and temperature sign here behind me but tracy says it's going to be up to 102 here in walnut creek by the end of the day. this heat wave is creating two issues. it's a "spare the air" day and also the possibility of power outages. that's what happened in castro valley this weekend. more than 30,000 pg&e customers

lost power for almost three hours on saturday evening. pg&e says it was a heat-related equipment failure issue caused of course by too many people running their air-conditioning. so it is a bit of a catch-22. it was also our fifth "spare the air" day of the year coming at the end of the "spare the air" ozone season the time when smog or ground level ozone becomes a real issue for people with breathing problems. even if your city's air seems fine, winds blow pollution from the city and other urban areas into the east and south bay valleys. and that can get nasty. now, we have all heard the recommendations on using less power and not driving your vehicles. but it can all be easier said than done. so the easiest advice, try to do most things right now or at night. the coolest parts of the day. combine trips because your car emits more pollution right after a cold start. try to run your errands at night and if you have to refuel, do it after dark. don't top off the tank. and drive smoothly. try to stay at the speed limit.
