you will have to use park street or fruitvale avenue bridges right now. in the meantime let's check the forecast. here's tracy. >> thank you. a spinning low pressure system keeping us with clouds across the bay area today. even a chance of a shower and cool temperatures. we'll take a look at today's cool temperatures in just a few moments. back to you. >> thank you. a statewide search for a girl taken by a stranger right in front of her own home. a man who matches the description of the suspect is being questioned right now. anne makovec is at the california highway patrol office in san francisco reporting the girl is still missing. anne? >> reporter: yeah. that's right. the girl is still missing. the man that they are questioning this morning, they are not sure if he is the kidnapper. but officers from the california highway patrol all over the state have been looking for this girl and this man all night since 8:30 last night. and the girl again no word on her this morning.

so here's her picture. that's the main goal right now to find this girl. she is 8 years old. her name is elisa cardenaz. police say she was playing outside her home with another little girl in central fresno when a stranger, a man, grabbed her by the arm and pulled her into his truck. that was about 8:30 p.m. he may have first offered to take her to buy some candy but then appeared to take her by force. police believe the same man had exposed himself to a different child 20 minutes before he lisa was kidnapped about 6 blocks away from her home. elisa's mother pleaded to the public through a translator to look for her daughter last night. >> whoever has her daughter to bring her back. all she wants is her daughter back home. >> right now, we have every motor officer, every detective, our airship and all patrol officers that are not responding to basic calls for service have been put on this call. >> reporter: so take a good

look at this picture. elisa, 4 feet tall, weighs 60 pounds, brown hair and brown eyes. she was last seen wearing bluejeans and a light purple sweater with winnie the pooh on the front. this man drove away in an older brown or red late model ford pickup truck with possibly a white pinstripe on the side of the truck. unknown license plate. the suspect either caucasian or light-skinned hispanic male around 25 years old, 6 feet tall, weighing around 200 pounds and he is either bald or combed back hair. he was last seen wearing a white tank top and bluejeans. again, that man may be in custody because overnight, fresno police saw someone driving a vehicle that appeared to be the suspect vehicle and did apprehend that man after a chase. he is being questioned. but no sign of that girl. that is the latest here. we are going to of course keep you posted as this story unfolds and hopefully have some good news for you on the condition of this little girl.

>> we hope so. thank you, anne. there is now a sketch of the suspect wanted for trying to rape a woman at a walnut creek apartment complex saturday night. since june, 5 women have reported being assaulted there. saturday's suspect is described as a white man, 5'8", brown hair and facial hair. he may be the same man who attacked another woman last month. some tenants of the park regency apartments complain that security guards gather at the front entrance. cbs 5 found no guards at a rear entrance where a man walked in after waiting for someone else to open the gate. tenants who want to move out because of safety issues are told they have to pay $3,000 to break their leases. a different suspect is under arrest for three attacks in june, july and august. a fremont police chief is in the hospital this morning after being intentionally run down. police say the driver of the stolen van did it and then ran

away. mark sayre is in fremont with more on the search for this suspect. good morning, mark. >> reporter: good morning, juliette. the good news this morning, this officer is on the road to recovery after undergoing surgery for a broken leg. this incident happened yesterday morning at 10:30 when the officers spotted a stolen van near the intersection of warm springs and mission boulevard. fremont police say the drive of the van then intentionally accelerated and rammed into the officer pinning the officer underneath the van, fire crews did respond. they had to lift the truck up in order to free the officer. this all occurred in a busy commercial corridor and witnesses described what they saw. >> he was pinned underneath and they had to jack the van to get him underneath. his legs were pinned under the van. >> there was a lot of blood, considering it took them so long to get out. >> now, at about 5:0last night a suspect wanted in connection with this incident at 5:30 last

night as arrested on a bart train but we don't know of any charges or if the person who was detained on board that bart train was indeed connected to this incident. the suspect description that we did have from fremont police a man 25 to 30 years old, 6 feet, blue or black baseball hat, red sweatshirt and jeans. the fremont police officer is on the road to recovery this morning. reporting live in fremont, i'm mark sayre, cbs 5. >> thank you. let's check on our weather and traffic. elizabeth has our commute for us and the closure of the webster tube. good morning. >> good morning. yeah, that's a one-way tube that connects oakland to alameda. chopper 5 is still over the scene of this major injury crash that happened just after midnight. here's what happened. alameda police department pulled someone over for a traffic stop. well, that person took off and then went the wrong way in the webster street tunnel heading towards oakland. the person crashed into a driver going the right

direction and that driver is the one that suffered major injuries in the hospital right now. the wrong-way driver apparently took off on foot. police were able to catch him. one person was arrested. as far as your commute goes, chp and alameda pd tell us they hope to et get tube re-opened by about 6:30 this morning. in the meantime park street or fruitvale avenue are going to be your best alternates. 880 actually looks okay from the coliseum all the way up towards downtown oakland. here's live look near the oracle and you can see it's about a 15-minute drive time from 238 towards the maze and a quick check of the bay bridge toll plaza which has been looking good all morning and no sign of any metering lights and no delay approaching the pay gates. we'll have a live report on the webster street tube coming up in a couple of minutes. that's a check of your traffic. here's tracy with your forecast. hey, thanks, elizabeth. . >> thank you. forecast for this morning, a few clouds expected along the coastline. partly cloudy conditions around the bay. and partly cloudy but cool in spots inland. temperatures for this morning

as you come onto alameda city streets. we'll take a check of 880 as well as your bridge alternates that's all coming up in a full look at your morning commute. traffic in six minutes. the man who tried to bomb times square faces a mandatory life prison term at his sentencing today. during court proceedings prosecutors showed the detonation of a car bomb similar to the one that failed in times square. the video by the fbi demonstrates what the explosion would have been like if the bomb had gone off as planned in may. faisal shahzad has already pleaded guilty to terrorism and weapons charges. two russian born scientists shared the nobel prize in physics today. the royal swedish academy of

meet the real meg whitman: serving on the board of goldman sachs, whitman was caught reaping millions from insider stock deals. after ebay shareholders sued and a judge cited the obvious conflict of interest she was forced to pay the money back. what kind of person would be involved in deals a fellow republican congressman called corrupt? and in her last year at ebay, whitman paid herself $120 million right before the company laid off 10% of it's workers. we're choosing a governor, shouldn't character matter?

the one way webster tube is the scene of a major injury two- car crash that happened around midnight involving a wrong-way driver. you can see chopper 5 over the

scene as well as holly quan from kcbs who joins us live now over the phone. good morning. can you tell us any more details about what happened? >> reporter: this began around 11:30 last night when alameda police made a traffic stop on the silver suv. that driver with four other people inside took off heading the wrong way into the webster tube slamming head on in a black corolla causing major injuries to that driver. there was a gold corolla with two people inside, they crashed behind that causing moderate injuries to one of them. the male driver of the wrong way suv and his front passenger jumped out, ran and were arrested. in the back seat of their car, three females one suffered minor injuries. 6:30 the projected time of re- opening but they are still waiting for the chp to arrive to assist in the investigation. so 6:30 may get pushed back as well, elizabeth >> i was going to say because 6:30 was -- they had first planned on 5:00 and then 6:30. but it looks like this happened outside of the tunnel? it looks like it happened

as you head out the door, what do you need? well, possibly a light jackets. temperatures ranging from the upper 40s to the mid to the upper 40s 50s with a mix of sun and clouds. cool in spots especially inland and along the coastline just a few clouds expected. for this afternoon, partly cloudy skies, and the chance of an isolated shower. about 20% chance of a shower. and temperatures ranging from the lower 60s for the coast mid- to upper 60s at the bay, and temperatures up to the mid- 70s inland. low pressure system gives us a slight champs showers with instability associated with the system so again we'll keep it in the forecast through the afternoon. temperatures from the lower 70s from union city to fremont to milpitas. upper 60s in palo alto, redwood city and san mateo. and the lower 70s in cupertino and los gatos. these temperatures are

away from the man who grabbed her last night. an amber alert was issued for a red or brown older model ford pickup. police are questioning the man who matches of the suspect. the girl is still missing. a suspected rapest wanted in contra costa county, a fifth person attacked. the suspect is white, 5'8", brown hair and facial hair. a fremont motorcycle officer is in the hospital this morning after authorities say a driver intentionally ran him down. a stole-van slammed into the officer yesterday. the officer and his bike were dragged across two lanes of traffic. hours later on a bart train, police arrested a person described as an associate of the suspect. and it is official. gas prices have been going up. the energy information administration says the national average for a gavel

regular gasoline is now 2.73. that's four cents more than a week ago. analysts do not expect a steep rise ahead. they say with people driving less, the price of gas may be lower by thanksgiving. san francisco's muni has adopted a tough policy for its drivers. it comes after a high number of employees called in sick over the summer. so here's the new policy. if you're too sick to show up, you have to bring a doctor's note to prove it. since then, the number of sick calls has actually plummeted more than 40%. 6:21 now. good-bye happy meals. san francisco's proposed fast food toy ban. it takes a big step forward. plus, tiger woods takes a swing at the media literally. the shot that nearly knocked a photographer off of his feet. food meals is another step closer to reality in san ,,,,

cool temperatures in just a few moments. 6:24. banning toys from some fast food meals is another step closer to reality in san francisco. the proposal was approved by a supervisors committee yesterday on a 3-0 vote. it would allow toys to be put in with fast food meals only if those meals include fruits and vegetables. those meals must not include excessive amounts of calories, sodium, fat and sugar. a similar ban was passed in santa clara county last spring. the full board votes on the proposal in two weeks. so that brings us to our question of the day: more." another viewer says "don't ban rom happy meals. w sh food restaurants b

juliette? >> we will stay on this all morning long. 6:32 now. the san jose man suspected in an attempted murder and kidnapping has turned himself in to police. 28-year-old brian adrong walked into police headquarters last night with the woman he is accused of kidnapping. investigators say adrong stabbed a man inside a home sunday morning, then he fled taking 18-year-old judy la with him. la did not appear to be harmed. the victim who was stabbed is in stable condition. there is now a sketch of the suspect wanted for trying to rape a woman at a walnut creek apartment complex saturday. since june, five women have reported being assaulted there. saturday's suspect is described as a white man, 5'8", brown hair and facial hair. he may be the same man who attacked another woman last month. some tenants of the park regency apartments complain that security guards gather at the front entrance. cbs 5 found no guards at a rear

entrance. our camera caught a man who waited there and then walked in behind someone who had a key. a different suspect is under arrest for three attacks in june, july and august. this morning, there is a search for a driver accused of intentionally running down a motorcycle officer with a stolen van. mark sayre is in fremont with the story. good morning, mark. >> reporter: good morning, juliette. the good news that fremont police officer is recovering this morning after judged going surgery for a broken leg. thins didn't occurred yesterday morning around 10:30, when the officer spotted a stolen delivery truck near warm springs and mission boulevard, where we are route now. fremont police say the driver of that van then intentionally accelerated and rammed into the officer pinning the officer underneath the truck. fire crews had to respond here to lift the truck up in order to free the officer. this all occurred in a busy commercial area right between the 880 and the 680. witnesses say the entire scene here was simply heartbreaking.

tube re-opened but it has been shut down since just after midnight after the scene of this major injury crash. it happened on surface streets. the tunnel was undamaged. a tow truck just arrived. again, they are telling us maybe in the next 20 minutes or so they are hopefully going to have it re-opened but as you see the investigation does continue. at midnight alameda police department pulled someone over and the driver started going the wrong way inside the tunnel, crashed into another driver going the right direction. and the person who was doing nothing wrong was the person who suffered major injuries and is in the hospital. you will have to use park street or fruitvale bridges as alternates for now. we have been watching 880 traffic so far, so good from the oracle all the way up towards downtown oakland. the bay bridge, check that out, a big backup for this time of

the morning. backed up almost to the 880 overcrossing. the metering lights have been on now for almost a half hour. that's a check of your traffic. here's tracy with your forecast. hey, thanks, elizabeth. our forecast for today let's focus on the temperatures for a moment because they will continue to be pretty cool for most of you. livermore average daytime high this time of the year in the lower 80s, san jose 78. 75 santa rosa. 72 san francisco. today continues to be cool for most. livermore 10 degrees cooler than averages 6 degrees cooler than average in san jose. santa rosa, dead on, look at that. 75 today exactly what it typically feels like. and san francisco expecting temperatures 8 degrees cooler than average so not everyone looking at below average temperatures. some north bay locations pretty close. that's a look at what we expect today as far as some of the cooler temperatures for most of you. we'll take a more detailed look at specific cities across the bay area and who will be feeling what later on today.

that's coming up. back to you. >> thank you. a gubernatorial debate that was to occur today on a bay area radio station has been cancelled. kgo a.m. had been touting a debate between jerry brown and meg whitman for weeks but now the two campaigns say the plans were never finalized. a third and final televised debate is next tuesday in san rafael. it appears the controversy over the maid for meg whitman who was in the country illegally may not have hurt the candidate much. in our exclusive eyewitness news poll taken after the maid story broke, brown maintains a slight lead over whitman by about the same margin as a poll taken before the scandal. people there in cococounty have been diagnosed with west nile virus. the first human cases in the county this year. contra costa health services says two women from east county and a man from west county are now recovering from the disease. the health department says everyone should assume west nile is in their communities.

people should protect themselves from mosquitos by wearing insect repellent and staying away from standing water. several cities on the peninsula are going to court to try derail a high-speed rail project. they filed a lawsuit yesterday in sacramento county. k kcbs radio's matt bigler is in san jose with more on the suit. >> reporter: good morning. at least three peninsula cities and coalition of some other groups are basically trying to put the brakes on high-speed rail at least in its current form. right now, bullet trains are projected to go through from the central valley through the pacheco pass near gilroy to san jose up the plains to san francisco. it would be the least expensive route but would cut through communities and residential areas through the area. we speak for the leader of the group filing the lawsuit. >> the idea of going through

and building this aerial structure in the center where in the very heart of this residential area, you know, it's just driving people crazy. this is not something that was handling well by the authority. >> reporter: a lawsuit filed by palo alto, menlo park and atherton claims that the authority hasn't adequately explored the negative impacts that the high-speed rail project would have on their communities. these elevated systems would probably be some sort of elevated track or even an earth berm leading to eminent domain and other issues on the peninsula. the lawsuit is asking that the high speed rate authority take a better look at some of the negative impacts. this group would rather have the high-speed rail project go through the altamont pass in the east bay to the dumbarton bridge to redwood city and then up to san francisco. the authority hasn't commented on the lawsuit but we expect to hear from them shortly. i'm matt bigler in san jose, live for cbs 5. still to come, the new cars

shut down for almost 7 hours the one way tube commuters going oakland to alameda. with me on the phone is holly quan from kcbs. i know you just talk to an investigator. did he give you any new information. >> reporter: yeah. they are saying that 7:30 is now the latest they say that the tube will re-open. the tow trucks have arrived as well as that other investigator. police say it's just before midnight. the silver traverse suv was speeding out of the webster tube when he was -- the driver was pulled over by alameda police. now, as officers approached the driver with four others in the car took off heading back into the wrong way into the webster tube slamming into a black corolla causing that driver major injuries. a gold car behind him also crashed causing moderate injuries to one person there. now, the driver of that wrong way suv along with the front passenger then jumped out and tried to run. they were then pursued and captured and arrested.

they are looking at some felony drunk driving hit-and-run and a number of other charges. alameda police are still trying to sort out the details but 7:30 they say is the latest they should be able to reon the webster tube. elizabeth? >> that's good. they were waiting for tow trucks. it looked like it happened just outside the tunnel so the tunnel itself wasn't damaged. >> reporter: the tunnel is okay. it happened at the mouth of the tunnel. so they are not really concerned about guardrail repair or anything like that. they just want to make sure that they remove the debris and they want to be sure that they very carefully and completely go through the accident scene before they start to haul the cars away. >> thank you, holly quan from kcbs joining us by phone this morning. the driver going in the right direction has major injuries. at 7:30 they hope to open the tube. park street or fruitvale avenue bridges are a good alternate.

and a quick update on bart. we are just hearing about 15- minute bart delays on the richmond line because of an earlier power outage. all other lines are on time. that's a check of your traffic. here's tracy with your forecast. hey, thanks, elizabeth. out the door this morning, partly cloudy conditions with cool temperatures inland. overnight lows, early-morning lows in the upper 50s to the mid-50s -- upper 40s not mid- 50s. clouds at the coast, temperatures this morning 49 to 53. this afternoon temperatures really don't warm up much. lower 60s at the coast, sun and clouds, maybe an isolated shower. that's also going to be the chance for the bay and also inland. 20% likelihood, not a washout. temperatures around the bay in the mid- to upper 60s. inland the mid-70s. so still cool. here we go. here's what we're watching. low pressure system well off to the east a bit.

still churning nice counterclockwise circulation pushing in the clouds and also pushing in as you can see a little rain there so that's why we have this small chance of a shower in the forecast and we are going to keep it in there throughout the day. temperatures lower 70s from union city to milpitas. lower 70s from santa clara to sunnyvale. and the upper 60s in palo alto, redwood city and also in san mateo. east bay locations, yesterday in the 60s. you're warming up just a little today. upper 60s to the lower 70s in dublin and pleasanton. lower 70s in danville and walnut creek. and then we move back closer to the bay with the mid-60s from richmond to berkeley and the 70s in oakland and san leandro. north bay location, your temperatures pretty close to what you enjoyed yesterday. still mild, lower 70s in napa, sonoma and petaluma. 70 degrees in san an sell more, 60 in stinson beach, 64 in san francisco. five-day forecast, we keep the clouds in the forecast and the cooler-than-average temperatures wednesday, thursday and friday and that is because we do still have that low pressure system out there.

if anybody is going to do it it would be twitter in 140 characters. they have moved cofounder evan williams from his ceo spot into a different role overseeing product strategy and the chief operating officer over the past year will now become the ceo. the idea there is that the new chief will grow twitter as a business. under williams they grew as a product going from 1.2 million tweets a day to 90 million tweets a day in just two years. now the key is making it profitable. it's privately held but now growing a communication system into a bigger advertising platform. a lot of tech people out there think that costello the person that can handle that job. chevron is a san ramon based oil company is looking to boost its share value announcing a big share repurchase program starting in the current quarter up to a billion dollars per quarter. and it's open-ended. there is no time set as to when chevron will stop doing that.

in fresno saying they have thought they had their man earlier overnight. and it turns out they do not believe that this was the kidnapper. so at this hour, the kidnapper and the little girl still on the loose and we are hoping that this little girl is going to be found safe. here's her picture. she is eight years old. her name is elisa cardenaz. police say she was playing at home with another girl in central fresno way a stranger, man, grabbed her by the arm and pulled her into the truck. police believe the same man exposed himself to a different child 20 minutes before elisa was kidnapped about 6 blocks away from her home. here are the descriptions. this is what police are looking for. elise sacks, 4 feet tall weighing 60 pounds, brown hair and brown eyes, last seen wearing bluejeans and a light purple sweater with winnie the pooh on the front. this man drove away in an older brown or red 1990 late model ford pickup truck.

but the description is very shady and police don't have a license plate number and that is causing them a lot of difficulty. they haven't been able to put the amber alert up on the highway signs that you normally see. the suspect is white or hispanic, 6 feet, 200 pounds, bald or combed back hair. he was last seen wearing a tank top and bluejeans. this 8-year-old girl, people all over the state are looking for her and in neighboring states because she was kidnapped from fresno but police have no idea where this unknown man was headed. juliette? >> we will follow this all morning long. anne makovec, thank you. 6:56 now. this morning, there is a sketch of the suspect accused of trying to rape a woman at a walnut creek apartment complex saturday. since june, 5 women have been assaulted there. saturday's suspect is white

male, 5'8", brown hair and facial hair. a fremont motorcycle officer is in the hospital this morning after authorities say a driver intentionally ran him down. the stolen delivery van slammed into the officer yesterday dragging him and his bike across two lanes of traffic on warm springs boulevard. hours later police stopped a bart train at the south hayward station and arrested a man who knows the suspect. the officer is in good condition. the latest word from chp is now 7:30 before they can re- open the webster street tube connecting oakland to alameda. that tunnel has been shut down since midnight for the vex of a major injury accident involving a wrong way driver. you can see investigators still on scene there. so in the meantime, park street, fruitvale avenue, these are your best bridge alternates. by the way, the posey street tunnel connecting into oakland,
