home that might have delayed that response. good morning, everybody. it is wednesday, april 13. i'm frank mallicoat. >> i'm sydnie kohara. thanks so much for joining us. your time coming up on 6:00. let's go ahead and get out the door with a quick look at traffic and weather on this wednesday. carry an umbrella. >> this morning, starting to see a few showers out there although the bulk of the rain that we are going to see will be later on this afternoon around noontime. although good idea, grab the umbrella just like you said. here's a look at our temperatures for today. our highs are running cooler than yesterday because of that cloud cover. only making it to 57 today in the city, 60 is the high in oakland. and 61 will be our high in both san jose and concord. we'll have a look at your extended forecast in just a bit but first, here's a look at your traffic with elizabeth. >> thank you. we are going back out towards the carquinez bridge. we understand chp is right now running a traffic break in those eastbound lanes of 80. there is an accident there and it sounds like the car went into the wall. right now it is off to the shoulder. so no lanes blocked at least. again they are running that

quick traffic break for a while at least all lanes will be blocked then hopefully they will get it completely cleared. except for that the bay bridge toll plaza looks great no metering lights no delay. and as of just a short while ago they lifted the wind advisory so no wind advisory in effect either if you are heading into san francisco. that's your traffic. back to you. >> thank you. a garden hose just no match for flames coming from a burning home in the east bay. anne makovec is in bay point where firefighters still there, still looking for hot spots. >> reporter: actually the firefighters just left the scene. contractors are boarding up the property. it's deceiving because the walls are still standing. but the home according to firefighters is a total loss after this fire overnight. take a look at the flames. they broke out at around 2:00 this morning. there were two men and a woman in the house at the time. they all got out okay and a man started trying to fight the fire on his own with a garden hose.

>> i grabbed the hose and i just started squirting it up through the air vent. we don't have a telephone. couldn't dial 911. >> yeah. they don't have a telephone. >> reporter: they also didn't have any working fire alarms according to firefighters. you do see those cages he has there? birds, three birds he got them all out of the house okay. so that is certainly the good news here. three birds, people there, all out of the house okay and no firefighters injured. but the house again a total loss. the real difficulty for firefighters here is that the winds were pushing that fire through the attic and they had to stay on scene for several hours to make sure that all of the insulation was out. and things do appear to be fine this morning. they still need to figure out exactly why this fire started. it looks like it started in a back bedroom. firefighters say nothing suspicious about this fire. frank and sydnie? >> anne, thank you. anne makovec in bay point this morning. a man, woman and 3-year-old

child hurt after the car went over a cliff on the sonoma county coast. the car ran off highway 1 north of bodega bay last night. it dropped about 100 feet to the beach and that's where it remains this morning. an ambulance took the child and one adult to the santa rosa hospital. the other adult had to be taken by helicopter. the father has since been arrested for dui. a suspect in four cold case murders in northern california scheduled to be arraigned this afternoon. investigators believe 77-year- old joseph naso could be a serial killer. they found evidence in his reno home linking him to the deaths of young women in marin, contra costa and yuba counties between 1977 and 1994. investigators are looking into other cold cases across the country as well to see if there might be a connection to that man. all the victims in northern california have the same first and last initials. so did three girls who were killed when naso lived in upstate new york. they continue to investigate. huge rallies will be held

today on all cal state university campuses. students and staff are demonstrating united in their frustration over cuts to college education. kiet do is at san jose state university to tell us their demands. he joins us now with more. kiet, good morning. >> reporter: good morning. governor jerry brown has been working to try and close a $27 billion budget deficit and he is doing that by possibly making huge cuts to hire education. well, now the system is fighting back with what they are branding as a day of class action. this will involve protests at every, single csu campuses. 23 campuses in all we're talking about rallies, teach- ins, demonstrations, all in support of higher education and fairer contracts for university employees. the california faculty association says in recent years student fees have tripled, 3,000 faculty have been laid off and the budget has been cut by $1.5 billion. in fact, campuses like san jose state have cut classes and then taken steps to reduce the

number of students doing things like shortening application deadlines. this has resulted in overcrowded classrooms and long waiting lists. the teachers union says this amounts to students paying less and getting -- paying more and then getting less. now, the union has a list of demands today. they say they want to bargain with fair contracts for faculty and staff, no more job losses to csu faculty and staff, support laws to make csu more transparent, cut management bloat, and then stop the fee hikes. most of the rallies will start at about noon today and the big question is, will they be peaceful? the teachers union says they do support civil disobedience but not violence. >> hopefully they can help a little bit. kiet do live at san jose state university this morning. thank you. traffic and weather now. kristy, we understand it's going to be a little cold and perhaps a little wet for a lot of people. >> quite different than what we saw yesterday. there was lots of sunshine and blue skies. i know a lot of people enjoyed that but there's going to be a change in store today. you can see here we have a system that's sitting off the

coast bringing a lot of showers actually to the north of us but we will see some showers here, as well. a few sprinkles now out the door and then definitely by this afternoon. temperatures now in the 50s, 48 in san francisco, oakland and fremont. 47 concord and 45 napa. so a little warmer in some places than we were running yesterday but by this evening -- excuse me, by this afternoon, cooler temperatures for the most part, high 50s to low 60s. 57 for the city and pacifica. 62 napa. that's a look at your weather. let's get a look at traffic with elizabeth. >> back towards the carquinez bridge eastbound 80 sounds like they ran a quick traffic break so now this accident is cleared out of lanes. westbound and eastbound 80 crossing the carquinez bridge look great. down towards the south bay still following this car fire northbound 101 approaching mckee. it sounds like chp and fire crews are still there. maybe partially blocking the off-ramp. 280 traffic looks great heading out of downtown san jose.

federal grand jury when he said he never knowingly took steroids. the jury is set to resume deliberations at 8:30 this morning. and the giants fan who was severely beaten outside dodger stadium nearly two weeks ago is showing slight signs of improvement this morning. but doctors say bryan stow remains in a medically-induced coma while they monitor brain activity and swelling. the giants have added nearly $70,000 to the fund established to help pay for stow's medical costs and other expenses. san francisco is considering keeping tabs on animal abuser much the say way sex offenders are tracked. supporters want a public database that would work like megan's law's website. convicted animal abusingers would be required to register and a description of their crime. pet shelters and agencies would use the database to prevent a previous animal abuser from adopting a pet. >> save a lot of animals being

month after the devastating quake and tsunami... things are slowly getting back to a chance of showers throughout the day in the bay area. cloudy and cool this morning. looking at temperatures that are running in the high 40s and low 50s, and a few sprinkles depending where you are. in the afternoon the chance of showers increases for all of the bay area, best chance of seeing some of those around noontime today. and the temperatures for our highs are going to be cooler than we saw yesterday.

breezy conditions as well, particularly at the coastline. here's a look at satellite showing us that cloud cover, that system that's pushing into the north of us bringing the majority of showers to the north. but we will get those showers here in the bay area, as well. that area of low pressure bringing us breezy conditions, cool conditions. you will want to have your umbrella with you throughout the commute this morning and actually into the afternoon. timing out that system on pinpoint weather, you can see that storm pushing in 10:00, 11:00. by noon, seeing all the bands of green, scattered showers throughout the bay. and then we start to see it taper off as we make our way into the late afternoon into the evening. when that storm moves out we are going to see warmer and sunnier conditions but today even those temperatures cool, blow average for this time year. 61 for fairfield and concord. 59 for vallejo. 57 for both the city and for san francisco. a look at your extended forecast as we make our way into thursday. the sun will be back out with a mix of clouds, slight chance of showers friday. then saturday and sunday

looking nice with temperatures in those inland spots in the low 70s. that's a look at your weather. let's check traffic with elizabeth. >> all right. i had mentioned a phone call from doug with the kcbs phone force. he is telling us about a stall southbound 680 approaching sunol. now we are getting word of an accident farther south near the sheraton exit so a couple of problems on southbound 680 and traffic is stacking up towards the base of the grade. except for that, no other big issues across the bay area right now. a couple of earlier problem spots have all been cleared. all of our wind advisories have been cancelled so here's a live look at the walnut creek near the 24/680 interchange. you're cruising this morning, that's southbound traffic on 680 heading towards the san ramon valley. westbound 24 no delay so far if you're heading towards the caldecott tunnel. i had mentioned a car fire northbound 101 approaching mckee. that is now cleared to the right shoulder. no delay there. and coming out of downtown san jose, here's another live look at northbound traffic on 280. that is moving well as you head out towards cupertino. and at the bay bridge toll plaza, earlier wind advisory

hose in a desperate move to save his house. anne makovec reports from bay point where firefighters are watching for hot spots. she joins us now. >> reporter: talk about challenges for firefighters. frank, no smoke detectors, no phones in the house. the three people who lived in this house smelled smoke, got up and the man tried to fight it himself with a garden hose but the scene here behind me is deceiving because the walls are all standing, lot house is a total loss. a lot of the damage is in the back of the house. the fire started in a back bedroom. look at some of the flames we caught earlier this morning after this fire broke out around 2 a.m. one of the people who lived here tried to put the fire out himself before firefighters got here. >> i grabbed the hose and started squirting it up in the air vent. we don't have a telephone. couldn't dial 911. >> the firefighters also had some challenges because of the

winds overnight pushing that fire into the attic and once it got into the attic it spread. three birds the man was able to get them out of the house all right. no firefighters injured but the house is a total loss. the cause is unknown firefighters say it's not suspicious? >> frank and sydnie. >> okay, anne makovec live in bay point, thank you. a father suspected of drunk driving under arrest, his wife and toddler in the hospital. their car went over a cliff on the sonoma county coast. this morning the car is still on the surf at arched rock beach north of bodega bay. it ran off highway 1 last night, dropped 100 feet to the beach. the father called chp asking for help. the 3-year-old and his mother were taken to the hospital.

this morning really everything quiet throughout the south bay and the guadalupe parkway, 101, a quick trip this morning from morgan hill. and at the bay bridge toll plaza, the metering lights have been on now since just before 6:30 but no backups yet. so pretty good right now, a little bit of slowing on our sensors from the incline towards the "s" curve. if you are continuing along the peninsula, 101, 280, you can have your pick. both are moving well. 63, 72 miles per hour up towards san mateo county. that is your traffic. back to you. >> thank you. for the first time since the earthquake and tsunami, airplanes are landing at the sendai airport in japan. that tsunami on march 11 swamped cars, runways and planes pushed into terminals. now they are opened for daylight flights. nuclear experts are worried that the disaster is worse than chernobyl from 1986. the crippled power plant there has much more fuel than there

was at chernobyl. lawmakers are looking at the japanese plant as a lesson for u.s. nuclear policy. >> it would be unlikely we would have such an accident in california, absolutely very unlikely. "unlikely" that's exactly what they said about japan, to the word. >> the chairman of the nuclear regulatory commission says the situation in japan is not yet stable. in about two hours the jury in the barry bonds perjury trial will try again to reach a verdict. it is the fourth day of deliberation. jurors adjourned at 3:15 yesterday afternoon after they couldn't reach a decision. bonds is accused of lying to a federal grand jury when he said he never knowingly took steroids. and some pot clubs in san jose are about to go up in smoke. the city council has approved sharp new limits for medical marijuana collectives limiting them to industrial and business districts. next week the council will discuss how to select which clubs are allowed to operate.

6:35. get caught once, pay a fine. but california drivers caught on their cell phones a second time may soon face a more severe penalty. kcbs radio's matt bigler on a bay area lawmaker's proposal. matt, good morning. >> reporter: it's estimated that 60 to 70% of california drivers are abiding by california's hands-free cell phone law. but that means that 30 to 40% of drivers are ignoring it. i just talked to maggie santos here in san jose. she says she sees it all the time while she's driving. >> oh, everybody. i hate it when i see the people on the freeway talking on the phone. >> reporter: why? >> why? because it can make an accident. >> reporter: now, one of the reasons that people think they can get away with it or don't mind being caught that the fine for a first offense is only

about $20. but state senator joe simitian the author of the cell phone law has proposed a bill to increase the fines to over $300 and at the same time make a second offense more serious moving violation. that means that if you get caught you have to go to traffic school or face increased insurance rates. that bill has passed a senate committee. we should also note that the chp is conducting a statewide crackdown on cell phone violators this month and they expect to have increased enforcement tomorrow and next tuesday so that's a heads up for all you cell phone scofflaws out there. reporting live in san jose, i'm matt bigler for cbs 5. >> matt, i was just thinking. the first what the first offense $20? parking offenses are triple that and this is a lot more dangerous. thank you, matt. >> i have to be careful because out on the east coast, you can use your cell phone. you can't text and drive but in massachusetts and new hampshire, sure, you just yap it up. >> where do you live now? >> i live in san francisco

former minnesota governor tim pawlenty telling cnn he intends to run for the white house in 2012. his campaign said it was not a formal announcement. that's expected later this spring. the republican launched a presidential exploratory committee last month. let take a look at the latest gop presidential poll. donald trump the donald, at the top, tied with mike huckabee both receiving 19% of the vote from republicans and republican- leaning independents. sarah palin coming in third followed by mitt romney and newt gingrich. it is 6:45. caltrain is trying to come up with some quick cash. it needs to find $3.5 million to prevent any service reductions, fare hikes or station closures in the near future. not clear where the money will come from. the metropolitan transportation commission plans to meet today to discuss possible solutions. and cisco is shutting down its popular flip cam business. it bought the digital video camera company just two years ago but the growing popularity of smart phones and their video has made the need for single

use devices like the flip a lot less desirable. it's part of cisco's larger plan to leave several of its consumer businesses which will result in 550 job cuts. retail sales jumped again last month but most of the increase was for one specific item. >> here now is jason brooks with kcbs and cbsmoneywatch.com. jason, good morning. >> reporter: good morning. it's the one item that most us really don't feel like shelling out more money for but we had no choice if we want to drive around. although retail sales were up .4% in march, when you take away gas sales, this were only up a tenth of a percent. so pretty much a flat month. car sales fell by 1.7% last month. the continuing higher pump prices are a big worry for retailers because they are dealing with all sorts of higher costs on other commodities including things like cotton. we are expecting higher clothing prices but it's going to be tough for retailers to pass those prices onto consumers if consumers are

dealing with higher pump prices and have less money to spend on things like clothes. that's going to hit profit margins of companies like the gap and other big apparel retailers out there. getting some decent earnings news this morning from one of the big banks. jpmorgan chase topped earnings and revenue growth in the 1st quarter. its profit came in at $5.6 billion compared to $3.3 billion a year ago. that's helped lifting the blue chips out there as well as overall financial sector. and looking to rebound after a few real tough days on wall street, dow is up by 48 points right now. nasdaq up 18. s&p higher by 4. the flip side, oil prices are also rising this morning up about 50 cents at near $107 a barrel. they did fall back big time over the past two days more than $6. goldman sachs said they think that oil prices have pretty much hit their tipping point and will probably pull back about 20% but no pull back in gas prices for the next couple of months.

>> never quite works out that way, does it? >> reporter: no. always a big lag. >> jay songs, thank you. jason brooks with kcbs and cbsmoneywatch.com. a video of a 6-year-old girl getting a tsa patdown has gone viral. this morning her parents are demanding the tsa change how it screens children. the couple was going through security at new orleans when the daughter anna was selected for a patdown. the father said she was crying thinking she did something wrong. some say the process was too intense for a young child even though the screener told her what was happening. others say it's part of the tsa's job to examine everyone. >> a 6-year-old child shouldn't be subjected to this kind of treatment in the first place if there is no reason to suspect her or her parents of being criminals. >> that took all of, what, 20 seconds to get done? you know? suck it u it's a part of travel right now. >> the tsa says children have been used to carry explosives in the past and they are

subject to the same restrictions as adults in order to ensure everyone's safety. the sacramento kings may play their final home game today for good. >> yeah, could be true. the team is hosting the lakers. the owners, the maloof brothers, will make a pitch tomorrow to the nba. they want to move the team down to anaheim to start making some money. sacramento's mayor kevin johnson a former nba-er and cal grad, will make one last plea to keep the team in sacramento. a sellout crowd is expected for tonight's game. >> and the giants closing their three-game series against the dodgers tonight. >> home team hoping to build on last night's big winner. they did it in the 7th inning at at&t park. wild pitch here paved the road for rowan with a triple who scores the game winning run and then brian wilson struck out all three batters he faced in the 9th inning including the final right there. it's his first save and the giants get a big win over the dodgers 5-4 the final. >> you sound like you've done sports before. >> did you notice that? a little bit? yeah. i am a big sports fan.

their battle cry -- stop making cuts today students and faculty will hold rallies on the cal state university campus. their battle cry, stop making cuts to our college education. kiet do is at san jose state university this morning with more on that. kiet, good morning. >> reporter: good morning. we heard from the protest organizers and they say here at san jose state they are expecting about 500 people.

in the past those numbers have gotten up to about 700 but for today they are going to settle on about 500 and now with the light rain falling at this point we'll have to wait to see how that will affect attendance. all this as governor jerry brown is trying to balance the statewide budget deficit of $27 billion. he has promised to make huge cuts to hire ed so now they are pushing back with what they say is a day of class action. it will take place on all 23 csu campuses, rallies, teach- ins and marches all in support of higher education and fair contracts for university employees. the california faculty association says student feeds have trippedled, 3,000 faculty have been laid off and the school system's budget has been cut by $1.5 billion. in fact, campuses like san jose state have cut a lot of classes and then tried to reduce the number of students trying to get in the door doing things like shortening application deadlines. this resulted in overcrowded

classrooms and waiting lists. the union says this amounts to students paying more and getting less so they have a list of demands. they want the state to bargain fair contracts with faculty and staff. no more job losses. support laws to make the csu system more transparent. and cut management bloat. basically, stop the fee hikes. the rallies start at noon and one of the big questions will be, will it be peaceful? the california faculty association says they support civil disobedience but not violence. >> thank you, kiet do live at san jose state university. kiet, thank you. contra costa fire investigators at work in bay point this morning. they are trying to find the cause of a house fire on madison street. two people got out safely. a neighbor called the fire department while the residents tried to put out the fire with a garden hose. no one was hurt. the house had about $100,000 worth of damage. the suspect in four cold case murders set to be arraigned in marin county this

afternoon. investigators found evidence linking 77-year-old joseph naso of reno to the deaths of young women between 1977 and 1994. their bodies were found in marin, contra costa and yuba counties. and now investigators across the country are checking other cold cases to see if there is any link to naso. in about an hour and a half, the jury in the barry bonds perjury trial will meet once again for a fourth day of deliberations. jurors adjourning yesterday afternoon after they could not reach a verdict. bonds is accused of lying to a federal grand jury when he said he never knowingly took steroids. well, kristy was two for two her first two days here doing weather. sunshine, you know, and i guess you have to give us a -- >> i had to give you a little more breadth to the weather today, a little bit of rain today. showers out there already. there are sprinkles in san jose and we are tracking that here on hi-def doppler. also starting to see some sprinkles in santa rosa and we'll continue to see more of those showers as we make our way into the noon hour.
