>> reporter: pakistan insists it had no idea of bin laden's whereabouts. yet the compound sits a half mile away from a sprawling military academy in a town with more than 100,000 retired and active army officers. so director panetta told lawmakers in closed door briefings on capitol hill yesterday that bin laden was prepared to make a quick exit from that compound at a moment's notice. in fact, he had 500 euro this is cash and two telephone numbers sewn into the clothing that he was wearing at the time. frank, sydnie? >> well, joel, we know we got an election coming up in a couple years. how is this affecting the death of bin laden, how is this affecting his approval numbers, the president's? >> reporter: president obama's approval ratings, numbers, yeah, you take a look at the new cbs news, "new york times" poll just out today, they are calling this is bin laden bump. approval ratings up to 57%. that's up 11 points from just two weeks ago.

suspected drunk drivers could now walk free because of a problem with a very popular breathalyzer used by many police departments across the country including san jose police. in fact, san jose police exclusively uses the so calls alco sensor 5 made by intoximeters. the problem is that they have been developing condensation inside the tube. as a result, the device could give a bad reading. so the d.a. is reviewing every arrest made by san jose police made since november of last year. 865 cases in all. in some instances, where there is no blood test and the faulty breathalyzers is the main piece of evidence, that case could now be thrown out. the santa clara county d.a. began the review after learning that ventura county in southern california was having the same problem. so last friday, san jose police returned the 60 breathalyzers they have been using to the manufacturer and now they got back about 30 older units and they have been working with those since saturday. the d.a. should be done with the review in about a month. frank? >> kiet do live in san jose,

thank you. this morning san mateo police are looking for three suspects in a home invasion and here's the sketch of two of the suspects here. the men are described as hispanic in their late 20s and 30s. police say they knocked on an elderly woman's door on portola drive monday afternoon. they broke in when nobody answered the door. suspects assaulted the woman and burglarized her home and took off in a suv believed to be light green. let's check traffic and weather. kristy, do you think we'll break any records? >> i don't think we'll break any records but we'll definitelyk in the 80s and maybe some 90s in some place 15 degrees above average for this time of year. so definitely warm weather. in fact, temperatures this morning are widespread. you can see we are still at 68 in fairfield where we have some warmer breezes but cool up in santa rosa at 45. 55 in the city right now. 51 for redwood city. 51 for livermore and 52 for

weather. back to you. >> thank you. a man wanted for shooting a police officer is under arrest in the east bay. 27-year-old darrelle wayne jones of pittsburg surrendered four hours after allegedly running over an officer who stopped him. bullet holes on the officer's car show how close he came to being hit but his only injuries came from broken glass. the suspect ran away after crashing his car into a retaining wall and that led to a police search that kept people out of their neighborhood for hours. the suspect is a known gang member on parole for bank robbery. up next, a budget axe hits public safety at one east bay county. the crucial services that are being cut out. >> plus, the search for a rare $23,000 violin. why the thief who took it didn't do the greatest job covering his tracks. what pg&e is trying to do that would pave the way for customers paying for the gas line safety inspections plus some good news in the san bruno neighborhood that was devastated by fire and explosions several months ago. that's coming up. ,,,,,,,,,,,,,,,,

there will be plenty of sunshine throughout the day today seeing temperatures 15 degrees above average for this time of year. 74 the high in daly city, san francisco 80. warmer in alameda at 82. berkeley topping out at 84. soon san bruno residents will start rebuilding a neighborhood destroyed by the massive pipeline explosion. sharon chin live in san bruno with more on when construction work may begin and how residents may pick up the tab for pg&e's pipeline work. she joins us now live. reporter: good morning. we could see groundbreaking as soon as next month because this week san bruno issued its first permit to rebuild a home.

property owner bob hensel reportedly receives the first rebuilding permit nearly eight months after the deadly explosion and fire that killed eight people and destroyed 38 homes. news reports say the 72-year- old retired firefighter told san bruno's mayor days after the blast he wanted to be the first to move back into the neighborhood. the owners of 21 other themes were damaged or destroyed -- the owners of 21 homes that were damaged or destroyed also plan to rebuild. pg&e started high pressure water testing yesterday on pipes in mountain view. in all, pg&e plans to test 152 miles of pipe that did not have paperwork saying it's safe. pg&e is trying to get public utilities commission to allow it to track its expenses. it costs $125,000 to $500,000 a mile. now, here's why the tracking issue is important. if pg&e is allowed to track its spending on a special account, it can ask permission from the

puc to pass the cost to consumers if it chooses. the utility is also asking the puc to let it track spending on its multi-million dollar pipeline 2020 program to upgrade its gas transmission system. now, pg&e accuses the puc of trying to delay getting permission for tracking its spending. the puc is set to vote on this whole issue tomorrow. >> i can imagine consumers aren't too happy about it either, right, sharon? >> reporter: we'll hear more about that tomorrow. >> i'm sure. thank you, sharon chin live in san bruno. prosecutors have dubbed them marijuana grannies. two elderly san bruno women arrested in a major marijuana bust. they are 72 years old and 65 years old. police say the women had 800 marijuana plants growing throughout their house along with an electrical bypass that let the women steal

c-i-a director leon panetta says he believes the white house will eventually release a photo of in the headlines, cia director leon panetta says he believes the white house will eventually release a photo of bin laden's body. skeptics have been calling for photo proo that he is dead. workers have begun putting up equipment at the nuclear facility in japan to allow them to start repairing the cooling system. soldiers have moved to within 6 miles of fukushima to begin searching once again for people still missing from that disaster. and hundreds of drunk driving cases in san jose could be thrown out because of faulty readings from breathalyzers. the police have returned the devices to their maker and now prosecutors are reviewing cases back to november when police started using the breathalyzers

up to 138 county jobs could be eliminated. 82 from the sheriff's and probation departments according to the "contra costa times." the sheriff's department will have to reduce the number and types of calls to which it will respond. cuts to the district attorney's office will likely eliminate a dozen positions, as well. video taken on muni height help san francisco police catch a violin thief. the video on youtube shows the suspect making his escape with a $23,000 instrument last tuesday. that man grabbed the valuable violin from a practice room at the san francisco conservatory of music after its owner had put it down to check her email. rock exit. headlights moving northbound. and bart is all back on time. more traffic coming up in a few minutes. nurses preparing go on strike at children's hospital oakland, they are expected to begin a five-day walkout tomorrow. 800 nurses voting to strike because the hospital is trying to reduce their healthcare coverage. the nurses union says management cancelled the bargaining session last week and has not responded to requests for a new meeting. bay area doctors are now telling patients, your co-pay isn't enough. some doctors are charging patients for annual services for things like phone consultations and dealing with insurance companies expenses doctors say having coming out of their pockets for years. >> all the things that we have asked the patients to pay in our annual administrative fee are noncovered services and if the insurance companies were to pay for all of these services then, we wouldn't really be necessary discussion at all. >> some insurance companies oppose annual fees.

joel brown, cbs news, washington. members of congress are threatening to consult off $1 billion in annual aid to pakistan if it turns out their government knew where bin laden was hiding. the compound was only 35 miles from pakistan's capital and just a half mile from a military academy. and a kuwaiti newspaper says it has seen a copy of bin laden's will dated 10 years ago. it is reportedly dated december of 2001 and specifies bin laden did not want any of his wives to remarry. it also contains advice to bin laden's children not to join al qaeda. the paper has not indicated though how it obtained the document or if it in fact was able to authenticate it. president obama's approval rating getting a boost following bin laden's less. a survey reports a 9% bump from

46 to 55%. other polls show more marginal gains. former president george w. bush declined an invitation to join president obama at ground zero tomorrow. the 9/11 attacks, of course, happened during bush's administration. the former president has stayed out of the public eye since leaving office. stay with cbs 5 and cbssf.com for continuing coverage of the death of osama bin laden. some bad breathalyzers could put hundreds of drunk driving cases in jeopardy in the south bay. kiet do is in san jose where police have sent back the machines in question. joins us now with more. kiet, good morning. reporter: good morning. this affects nearly every, single dui arrest made in san jose since november. we're talking about 865 cases in all. and the problem is with the breathalyzers that officers use in the field. san jose police exclusively use the so-called alco sensor 5 made by intoximeter and the problem is that they have been

for pg&e's repairs as well as the groundbreaking. reporter: good morning. san bruno issued its first building permit for this devastated neighborhood earlier this week. and we understand that groundbreaking could begin in june. bob hensel apparently got the first building permit on monday almost eight months after the explosion and fire that killed eight people and destroyed 38 homes. the 72-year-old retired firefighter apparently passed a note to san bruno's mayor days after the blast saying he wanted to move back into the neighborhood first. meanwhile, tomorrow we could find out more about whether pg&e customers could be paying for pipelines to be inspected. pg&e started doing high pressure water testing yesterday on pipes in mountain view. in all, the utility plans to test 152 miles of pipeline that didn't have paperwork saying it's say. the cost $125,000 to $500,000 per mile. pg&e's accusing the puc of delaying and blocking the

utility from officially keeping track of its spending for these inspections in a special account. now, tracking the cost is significant because it would allow pg&e to ask the puc permission to pass the cost on to consumers. now, pg&e has not said whether it plans to pass on that cost but puc staff has recommended the commission reject pg&e's request to track spending. the puc is expected to vote on that issue tomorrow. now, state assemblyman jerry hill, whose district includes san bruno, says that pg&e's proposal is an attempt to pass on to ratepayers the responsibility that should be pg&e's. it should be an interesting meeting tomorrow. >> thank you, sharon chin in san bruno. time now is 5:39. a $23,000 violin is swiped from a student. bodies piling up but not for the reasons you might

dead osama bin laden. the cia has said the decision is up to the white house. meantime, new details show bin laden was not armed but did try to fight back during the raid. today the defense will start calling witnesses in the murder trial of oakland journalist chauncey bailey. yusef bey iv is accused of ordering the killing in between. attorneys say bey will not take the witness stand. closing arguments could begin next week. and bad breathalyzers could mean hundreds of drunk driving cases will be dropped in san jose. police learning last week that the machines they have been using for months were prone to faulty readings. prosecutors are now going over the arrests to decide what to do next. it is 5:46 now. security video could help catch the moon stole a $23,000 violin in san francisco. the video on youtube shows the suspect making hits escape on muni last tuesday. the man apparently grabbed the

valuable violin from a practice room at the san francisco conservatory of music. while its owner was checking her email the suspect got on muni's t line at van ness avenue and market street and got off at powell street station. two san bruno women who prosecutors call the marijuana grand anies are locked up this morning. police arrested 72-year-old and 65-year-old women. they found 800 marijuana plants growing in the house. also say they found an electrical bypass that let the women steal electricity to grow those pot plants. people in sonoma county cannot escape budget cuts even in death. mortuaries say the county is so far behind for death certificates for burials that funerals are being delayed. the office in charge used to have four people working on the certificates but because of cuts and retirements there is only one left. the backlog got worse last week when that one person called in

sick. >> when government officials start cutting and cutting, do they really look at the repercussions? >> the county says it does plan to replace that retired worker but the process has taken a little longer than expected. a rise in whooping cough infections in california has health officials concerned. there have been 733 reported cases statewide so far this year. the "contra costa times" reports 78 of them are in contra costa county. alameda county has had 48 cases. school and health officials are worried that hundreds of thousands of children have not had their required whooping cough vaccinations yet. >> asthma rates are on the rise in the u.s. the number of americans diagnosed with asthma grew more than 4 million between 2001 and 2009. that's according to the centers for disease control. and it is getting more expensive to treat asthma. americans spent up to $56

93- year- old woman who was trapped in her car. she got stuck in the flood waters of the black river when s a rescue in missouri. two national guardsman saved a 93-year-old woman trapped in the car in the rushing water. she got stuck off the black river after she tried to drive over a water covered highway. six boy scouts and their two leaders from louisiana are praised for doing things right when they were trapped by floodwaters in arkansas. they expected good weather for the camping trip but the shallow creek they crossed to get to a camp became raging river by the time they tried to leave. so they took the scouts to higher ground and set up camp. >> we got rained on then there was wind involved and it was coming in with a hypothermia sometimes but, you know, we got out of there, got a fire started even though it rained, dried out our wood and did what we had to do. >> national guard helicopters spotted the scouts' campfire late monday night and as we reported yesterday, they went back and got them out of there
