esumes for several bay he was okay but then the boat sunk and i was of course in shock. >> renewed hope this morning as the search resumes for several bay area fishermen missing at sea. the stories of survival and the promise three brothers have made. and a very busy night for fire crews. the grassfires causing tense moments in the east bay. good morning, everyone. it is tuesday, the 4th of july is over, we're moving into the 5th. i'm frank mallicoat. >> back to work. i'm anne makovec. thanks for joining us this morning. it's 6:00. breaking news out of oakland. we are getting word right now of a fire near 45th avenue and international boulevard. there is a lot of smoke in that area right now. but chopper 5 is headed to the scene. we are going to bring you more information as soon as that comes in. but, before we do that let's get you caught up on a

little traffic and weather. lawrence, how is tuesday shaping up? >> it is going to be a scorcher in some parts of the bay area. some 90s and low 100s inland. but fog at the coastline much cooler there and we have a big cooldown in the works of more on that in a moment. right now let's check on traffic with elizabeth. >> we are taking a couple of calls from the kcbs phone force letting us know about a small backup it sounds like heading off the bay bridge on the san francisco side. there was a slow-moving car sounds like may have kind of stalled out so they are trying to clear it off to the fremont street. back to you. searchers from the u.s. and mexico are still trying to find seven american tourists this morning. their fishing boat sank this morning in the sea of cortez south of san felipe. 43 people were on board the charter vessel. it was 115 feet long. it included 27 passengers, 16

crewmembers. most of the passengers are from northern california and one of them is confirmed dead this morning. seven others still missing. kristy seifkin is live in our newsroom keeping track of the ongoing search for the missing. and we have heard this has turned from a recovery back to a rescue mission, kristy. >> reporter: right. that's actually very positive news to hear because originally, a recovery mission certainly just means they assume that they will be bodies not living individuals that they find but the u.s. government talked to the mexican government saying we believe these people are alive, continuing to search for them. the weather was nice when these gentlemen left on their fishing trip and then a storm hit two huge waves hitting the boat causing it to capsize around 2:30 in the morning. many of those passengers were asleep at the time that the boat capsized and so they had to jump off or were thrown into the water hanging on for dear life using ice chests for flotation devices or life jackets that they had.

the u.s. coast guard and mexican navy searched for those survivors for more than 36 hours. >> there's a lot of different factors that go into survivability. the age of the person, male or female, whether or not they have life jackets on. >> reporter: those survivors they found are reported to be in good condition but some are certainly sunburned and dehydrated after having to spend 15-plus hours in the water before rescue. one of the survivors is rich sibatari from novato. and he had joined the trip at a last-minute addition and called his wife to tell her that he is safe. >> then he mentioned that he got awakened at about 2:30 and they all just had to jump off the boat and take what they -- life jackets on, and he indicated they had been in the water for about 15 hours. >> michael ng of belmont is another bay area survivor on the boat. he was one of the gentlemen who clung to an ice chest in the water and floated until he was

rescued. and lee ikizami also survived. he was flipped right into the water as soon as the boat capsized. the mexican government has turned this into a recovery mission. they do believe that those missing individuals are still alive. since that ship is 200 feet under water, rescuers have asked for the help of u.s. scuba divers to go under water and look at the debris to figure out if there are any evidence under the water:: a locksmith is on the way to help them get into their cars. when the boat capsized, their driver's licenses, cell phones and car keys were lost in the water. >> we'll be following this developing story for you. kristy seifkin live in the newsroom, thank you. three brothers who survived say they are not leaving until they find the fourth brother. the wife of 55-year-old brian wong of berkeley confirms he is

still missing. he and his brothers gary, glen and craig have taken the annual fishing trip to baja for the last three to four years. among the missing, 62-year-old mark dorland. mark is from twain heart in tuolumne county. his fiancee says he was one of the first to fall into the water. he didn't have a life vest on. the man who organized the trip is bob higgins. he is listed as a survivor. you can find continuing coverage of the search for the missing boaters at our website, cbssf.com. former professional bicyclist from berkeley missing this morning. friends of anthony michael martin says the 29-year-old disappeared while riding his bike in the oakland or berkeley hills on saturday. later that day another cyclist found martin's cell phone on tunnel road in berkeley. anyone that might have some information on his whereabouts is urged to contact the berkeley police. contra costa county firefighters are keeping a watch for hot spots in the east

bay this morning. that is after several grassfires broke out within a mile of each other. the biggest was in bay point. it burned several acres of federal land near port chicago highway. a lot of smoke there and kids were seen running from the area. it's not clear if they started the fire. fire investigators say they are trying to determine if illegal fireworks could have been the cause. >> there are a lot of fireworks out. our fire marshals are out trying to determine what the cause of the fires are. but obviously that's one of the reasons that we try and -- we didn't have safe and sane fireworks in the county. they are illegal and that's one of the reasons is to make sure we are not going to have these types of fires. >> now, the fire department there is getting help from other agencies including cal fire and the east bay regional fire district. those hills are mighty dry. today's temperatures aren't going to help very much. we are going to hit another 100 degrees i guess? >> yeah. i think it will be hotter around the bay area today as the temperatures soar into the

90s and low 100s inland today. sun coming up, another glorious day. we have seen patchy fog inside the bay, a hint of it here but it is squashed almost right down to the surface so dense fog at the coast. that fog will keep the coast much cooler, almost 40 degrees cooler than some spots inland. 63 very mild in fairfield right now. 62 in san jose. you have 50s at the coastline. this afternoon, those temperatures again soar inland. 90s and even triple digits today, probably the last day of t much cooler temperatures are on the way. now time for traffic with elizabeth. >> thank you, lawrence. we continue to follow this developing story out of oakland. it's a fire reported -- a structure fire reported near 45th avenue and international boulevard. chopper 5 is heading to the scene with you we are told that it's putting out a plume of black smoke that's visible from the nimitz so it is visible from 880. it sounds like the closest off- ramp would be the high street

chopper 5 continues to fly over this structure fire in oakland. this is a developing story this morning. you're looking live at pictures from 45th and international. it looks like the fire is starting in some sort of junkyard about 40 minutes ago. no injuries reported but at at one point there was a thick plume of black smoke over this fire that was visible from the nimitz freeway. now, as far as road closures go, a stretch of international boulevard is shut down in both directions approaching 45th so that's a busy intersection so avoid the area. in the meantime i mentioned that thick, black smoke visibility from the nimitz. this is just east of the freeway. so apparently not impacting freeway traffic but if you do see something that's what's going on so we'll continue to keep you updated. back to you. >> thank you. a developing story out of iraq this morning. at least 35 people have been killed in two explosions just a

few miles north of baghdad. a car bomb exploded outside of a city council building and a roadside bomb went off shortly after security forces gathered to help the first victims. this is the latest in a series of attacks as the u.s. continues to pull troops out of iraq. it is 6:13 now. a second day of jury deliberations has now begun in the murder trial of casey anthony. the 25-year-old florida woman is accused of killing her 2- year-old daughter three years ago. the jury began deliberating yesterday for six hours but did not reach a verdict on the holiday. they are weighing whether anthony is guilty of first degree premeditated murder which could carry the death penalty. >> the whole point of being on a jury is to make these judgments to have the common sense to look at the evidence and to render that verdict from their own conscious -- being conscious about it. >> the seven women and five men have most of the evidence in the jury room but they can return to the compromise if

men missing off baja californi fishing boat in the headlines, the search on for seven missing men off of the baja california coast. their chartered fishing boat sank sunday. most of them are from northern california. one person is confirmed dead. several grassfires were sparked. the latest was in bay point. firefighters are still watching for hot spots this morning. a second lawsuit has been filed in last month's deadly crash between a truck and an amtrak train. an amtrak attendants accuses negligence on the part of the truck driver. his employer as well as amtrak. in oakland, fire crews are on the scene of the fire that

we understand is pretty much out. these are live pictures from 45th and international. this was a two-alarm fire at one point where you can see there is a bunch of parked cars. we saw tow crews out there as well so we think this may be a holding area for a tow company. the smoke is dissipated. but at one point there was a thick plume of black smoke that was visible from the nimitz freeway. this area is east of 880 in oakland so fire crews are still out there again putting water on the remaining hot spots. but as far as traffic impact goes, you can see that police are out there now. they blocked a stretch of international boulevard right there at 45th. so busy intersection, avoid the area. traffic on 880 is not impacting -- never was even though smoke at one point was visible so thank you for those live pictures fro chopper 5. 880 past the coliseum, no traffic impact, so far so good towards

high street and towards downtown oakland. about 15 minutes from that stretch from hayward. and the bay bridge still "meet the press." now, they will likely be turned on -- still no metering lights. now, they will likely be turned on in a few minutes. remember kcbs, our radio partners, at 740-am and 106.9- fm. we share all our information with them. that's your traffic, for a check on your weather forecast, let's go to lawrence. >> elizabeth, another hot one around the bay area but we have patchy fog at the coastline but boy that is squashed so low you don't get it in san francisco right now. you have blue skies and temperatures soaring around much of the bay area today. by the afternoon, again flirting with the century mark. temperatures very mild to begin with inalameda. you have 60s in the warmest spots. 50s at the coast with that patchy fog. out at the beaches, almost 40 degrees cooler. the many spots inland soaring near or above 100 degrees in the latter part of the day. so it looks like this is the last in the hot days and then

we'll cool down the temperatures outside now. right now 61 degrees in livermore, 57 in san rafael and 61 in mountain view. i think if you are traveling around the state, be prepared for hot weather away from the coast. 104 degrees today in fresno, 103 in sacramento, 106 in redding. high pressure strengthening for today. and then it's going to start to weaken but for today we'll see warmer temperatures especially inland. cooler at the coast because of low clouds and fog that moved onshore and that will keep those temperatures down there. so we have 60s at the beaches. but you get just inside the bay some 80s and 90s in toward the san jose area. east bay temperatures soaring to low 100s into brentwood, 98 in antioch, 98 livermore, north bay temperatures in the 80s and 90s toward santa rosa, 60s at the coast. next couple of days we'll watch cooling temperatures around the bay area, much cooler more low clouds and fog toward the next weekend. that's a look at weather.

weather and calm waters, warm water, as well. the boat sank in the sea of cortez south of san felipe on mexico's baja, california peninsula. 43 people were on board. 27 passengers, 16 crewmembers. most of the passengers are from northern california. one is confirmed dead, seven others still missing. kristy seifkin live in the newsroom with why it is still being called a rescue mission rather than a recovery. and that's offering some home this morning. >> reporter: definitely offering some hope. those nice conditions are allowing rescuers to actually get deeper into the rescue mission. the weather that has those nice it calm weather and warm water similar to the weather when they started the trip. the storm that hit them was unexpected. 2:30 in the morning is when that storm hit and two large waves capsized the boat. most of the men on the boat

were asleep. they got off quickly or were thrown from the boat. some went to secluded islands, others floated with empty ice chests or they had life vests on and float the in the water until rescuers found them. the u.s. coast guard and the mexican navy searched for survivors for more than 36 hours. >> they conducted their search until they were -- the first crew reached their limit. the second crew was flown out there via coast guard c-130 to meet them and then they got in the same helicopter and the second crew, the new crew, took that helicopter down and conducted their search. >> >> reporter: the survivors they found are reported to be in good condition but some are certainly sunburned and dehydrated after spending more than 15 hours floating in the water before the rescue. two people from tuolumne county were on board the boat. one has been found, the other mark dorland is still missing. >> i'm just going with my gut

of 2008. well, today it would have been his 40th birthday. so for the day the restaurant is donating a quarter of its proceeds toward a reward for information. it's currently at $40,000. the chief of bart police says it appears that sunday night's fatal shooting by one of its officers was justified. two officers arrived at the san francisco civic center on a train shortly after there was a call about a man armed with a knife and a broken bottle. within about a minute of confronting that man sunday night, one of the officers shot him. investigators are still not saying exactly what led up to the shooting. one of the officers, though, was cut on the arm. china is calling on the silicon valley's talent to build an ambitious big brother surveillance network. kcbs radio's matt bigler is in san jose with cisco systems' new project and the controversy. good morning. >> reporter: good morning. china has plans to build this very ambitious -- one of the

largest video surveillance projects ever put together over a city. we are talking about 500,000 cameras that would be set up at intersections, parks, neighborhoods, pretty much blanketing the city of chong king in surveillance cameras. the chinese government says they would be used for crime control, watch over illegal activities, any sort of illegal crime that might be going on. but, of course, human rights advocates warn these could be used to watch over and crush political dissent. according to the "wall street journal" both cisco and hp are both bidding to supply networking equipment for the surveillance project. larry magid points out this seems like a good deal from a purely business standpoint. >> means more money coming into the united states and silicon valley all very good but the cost, the cost is that whether they think they are or not, cisco is participating in

good morning, folks. we are getting up to a day of extremes. we have some cool weather out at the coast with some patchy fog there. you can see some of that fog lingering in over the bay but it is going to be a scorcher in some spots inland. on of those temperatures again well into the 90s, probably even some triple digits by the afternoon. kind of a mild start inland. 60s already beginning to show up clear skies there patchy dense fog at the coast in the 50s. this afternoon highs only in the 60s at the coast. but inland temperatures soar in a hurry even inside the bay 70s in oakland and alameda, some 90s into the santa clara valley. numbers right now, 63 degrees in fairfield, 62 san jose very mild there. 55 in oakland and 52 in san francisco. it will be hot in the central valley today, 103 degrees in sacramento. 104 in fresno. the high country on the hot side, too. 92 in yosemite and 84 degrees in lake tahoe.

high pressure strengthening for one last day here then it looks like it is going to start to weaken but i think a warmer day today than yesterday in spots inland cooler at the coastline with that patchy fog. with that in mind, this is how it's going to break down. we'll keep 60s in toward the beaches here with the fog. you get inside the bay though 80s and even 90s into the santa clara valley. east bay temperatures, wow, these numbers are going to soar in a hurry. 98 degrees in antioch. 101 degrees predicted in brentwood today. about 96 in pittsburg. and 96 in pleasant hill. 60s toward the north coast but 80s and many 90s showing up in the valleys. next couple of days looks like it may be couple of clouds from subtropical moisture moving in. temperatures will cool down. low clouds and fog really going to ramp up as we head in toward the weekend and i think by then we see temperatures well below average. let's check traffic with elizabeth. >> thank you, lawrence. and we are going to go back out to chopper 5. now they are overcast cast over our second structure fire so far this morning so obviously a big fire

danger out there today with all these hot temperatures that lawrence has been talk about. you can see fire crews out there now, it's a little difficult to tell what exactly was burning. it looks like no longer any smoke or flames visible. this is near the intersection of center street just south of grove way. again, this is in castro valley a few blocks from 580 so 580 traffic not impacted. there may be lanes blocked right there right around that intersection of center and grove but again the main lines of the freeway in the area not impacted. second fire that chopper 5 spotted so far since we have been on the air since 4:30. thank you, chopper 5. to our maps, elsewhere we are also just getting word of new delays for mass transit. bart, ace, muni metro and caltrain all on time. but if you are a capitol corridor rider, train number 523 is delayed by about a half hour or so between fairfield and martinez due to police activity. so we'll continue to follow that, as well. continue to keep you up to date

the week. best week for the stock market in about two years. obviously, a lot of relief over the new austerity measure this is greece in order to get a bailout. plenty of fireworks for the stock market last week. and also, we saw some improving manufacturing signs around this country which was really important after that started to slump a bit in the spring. looks like the japanese crisis more of a hangover of a couple of months so there are some good signs there. this week has a couple of very important reports. factory orders and a little bit, most importantly on friday, the june jobs report. job market has stalled for three months. unemployment consistently above 400,000. need to be below that to show solid signs of hiring and that's the key factor in sustaining the economy's growth in the coming years. netflix may be expanding. last year it broke into canada for the first time with the streaming-only service. now the los gatos company says it's going to start streaming at some point this year to all

of the caribbean, mexico, central and south america. in all, 43 countries. that's another big move for the company whose stock is resulting in strong gains this morning. their shares are up over 5%. stock market is mixed in general. the dow lower by 6, nasdaq up by 1, s&p lower by a couple of points. frank and anne? >> wow. okay, thank you. >> jason brooks with kcbs and cbsmoneywatch.com thank you. well, a few days ago we told you that facebook was gearing up to make a very big announcement. >> the only thing we knew was that it was being called awesome. this morning, we are learning a little bit more about that announcement. cnet's editor at large brian cooley joining us this morning. >> you always set the bar high when you tell the world we have something awesome. that's part of the culture. >> do you know more than we know? >> reporter: i have some good guesses. first of all, one of the odds on things they may announce

tomorrow a 10 a.m. press conference at the palo alto headquarters might be an app. this is the current facebook app for the ipad. it's an iphone app that's tiny so that's one of the first things is to get an ipad app that fill your screen and use up the real estate. >> people will be surprised. >> reporter: just the iphone app so this is probably a lock if they are going to announce that tomorrow i hope or they are really late. now, what's going to be in that app is what's interesting. they may announce a video calling service like you use skype now with your webcam? that might be built into this app, as well. so it would be good for them to leapfrog and do something that keeps you in facebook when you want to do video calls. right now a lot of us pop over to skype. when that happens they lose us as an advertising target. they hate that at facebook. >> so that would be one of the chat things, you can either join chat -- i usually hide myself. >> you can message. >> your friends are already there. it would be nice to say i want

to do a video call. yeah, let's go ahead and chat. it didn't happen on facebook. they might also announce a photo sharing service which they don't have right now all that he robust, you can post photos. but a sharing network they don't have. they might go deeper into having streaming tv and movies. >> we have been talking about the older generation getting into the system. it's scary to me to hear about all these features. >> if they don't do it elegantly, it will be complicated. large parts of facebook are already complicated especially trying to take back your privacy, have to work on the settings but it's possible that this is something when it's app based will be easier to use and one of the other questions is, will they do an app or will they do something where they have a mobile website that looks like an app? kind of gets geeky but it's a big difference because it allows them to stay liberated from apple more and the rules of apples's app store which

[ male announcer ] who's your car's best friend? gasoline that cleans. chevron with techron. care for your car. fishermen missing since their searchers back out off of the coast of baja, california, today trying to find a number of fishermen missing since their boat sank on sunday morning. 43 people were on board this 115-foot charter boat. 27 passengers, 16 crewmembers, most of the passengers are from northern california and one of them is confirmed dead this morning. seven others are still missing. kristy seifkin in the newsroom why this is being called a

rescue mission. >> reporter: definitely hopeful news. that means that there's still hope that these people are still alive. part of the reason they are starting that rescue mission again is the weather outside is nice, calm water, warm weather, similar to the conditions that were in place when these gentlemen took off on their trip and it was only at 2:30 a.m. when this unexpected storm hit two large waves crashing down onto the boat about 2:30 in the morning. most of the men were asleep at the time and had to get off the boat quickly leaving belongings behind. some were able to make their way to islands. others floating in the water on ice chests or with their life vests and some had to jump into the water without a life vest at all. the u.s. coast guard and mexican navy search for for them for more than 36 hours and as you can imagine, those survivors had some bad sunburns and were pretty dehydrated after being in the water for so long. among the survivors from the bay area are david levin of bodega bay, a man from novato, michael ng of belmont and lee

ikagami. the mexican government originally announced this as a recovery mission but changed its mind to make this a rescue mission with better weather conditions and after a conversation with the u.s. government. it's important to note that the california's secretary of state website says baja's fishing license was suspended. the search continues today. locksmiths going down to baja to help those individuals who did survive get into their cars and get back to northern california to reunite with their families. >> thank you, kristy seifkin in the newsroom. a former professional bicyclist from berkeley is missing this morning. friends of anthony michael martin say the 29-year-old disappeared while riding his bike in oakland saturday. his cell phone was found on tunnel road in berkeley later that day.

east oakland firefighters are they scene of the holding yard that torched several cars this morning. firefighters are the at 45th and international boulevard investigating the two-alarm fire that broke out about an hour and a half ago. no word on where the fire started or what caused it. no reports of injuries. but as you can see, a number of cars have been destroyed. to minutes before 7:00. let's -- two minutes before 7:00. let's check weather. >> it's hot in spots today but almost 40 degrees cooler at the coastline so big changes in the weather coming up today. lots of sunshine to start out the day and the temperatures getting cooking and it is going to soar near 100 degrees in many spots inland. a different story as you begin to approach the coastline. we have some of that right there. you can see the fog over the bay. yup. we have a couple of patches there. that is going to burn off and head back toward the coastline but at the beaches today, you will see temperatures mainly into the 60s. so yeah, we are looking at the extremes today and then as we head in toward tomorrow, temperatures begin to cool off. more cooling as we head into the weekend. more low clouds and fog on the

way. i think as we head toward saturday and sunday, temperatures headed below normal. time for a traffic check with elizabeth. >> talking about the fire danger with all these hot temperatures, well, chopper 5 continues to fly over the scene of this one-alarm fire. it is in castro valley and we understand that there are street closures. this is at the intersection of center street and grove. and actually center is shut down in both directions as you can see there between grove way and b street. this is our second fire of the morning. a lot of activity for chopper 5 and fire crews in the east bay so far this morning. to our maps, let's show you what else is going on. westbound 580 slow out of livermore. we have a couple of accidents out there right now. one near the livermore truck scales, that was just chloride to the shoulder but we have another one in pleasanton, as well. so it's an extra heavy commute right now on westbound 580 coming out of the
