nabbed a suspect that was holed up in an apartment complex in san jose. gil diaz reports from the scene. i guess they got their man. >> reporter: yeah. they got their man, probably less than 15 minutes ago. and as you can see behind me that they have taken out the yellow tape here along moorpark. to give us more details about what happened, sergeant jose cardoza from the santa clara county sheriff's department. good morning. do you have the guy? >> yes. we finally about maybe 15 or 20 minutes ago located him nearby in a residence. he was actually hiding near a shed with the assistance of one of the nearby agencies, sunnyvale dps and one of their k-9 units. we located the suspect. he has been arrested and is being transported now to the main jail. >> reporter: hiding near a shed. so any indication that he lived in the area? >> we don't know. we haven't even identified him yet. he wasn't forthcoming with his identity. so we would have to fingerprint him, get him identified. >> reporter: how did this all start, sergeant? >> it started just after 1:00 a.m., one of our sheriff's

deputies attempted to make a car stop for just a regular vehicle infraction. the suspect didn't stop right away, actually drove slowly for a couple of blocks, finally coming to a complete stop. that's the when the driver foot bailed and started the search. >> reporter: why were they pulling him over. a minor vehicle infraction type stuff, i believe tinted windows or something like thats what the original reason for the stop. >> reporter: original reports indicate that he was armed. have you found a weapon? was he armed in the first place? >> there was mention of that but that's unconfirmed. we have not located any weapons or firearms or anything like that. >> reporter: were they of the residents threatened by this whole manhunt? >> no, they weren't. we have everybody in custody including the two occupants. >> reporter: you wouldn't be able to tell us his name or his description of the suspect? >> we don't have him identified and i don't even have a description of him at this point. but i should have that early this morning. >> reporter: thank you so much, sergeant cardoza. he was being stopped for a minor infraction as he was

driving along moorpark. he failed to stop and just gunned it on foot behind us. sergeant cardoza said none of the residents was threatened and they don't believe he was armed even though some occupants reported he was in the first place. we'll have more details later. thank you. >> thank you. at least the search has ended. thank you, gil. another developing story we have been talking about this morning in san francisco. a burglary suspect spending a cold night on a very steep cliff. live pictures here right now police watching the eastern face of telegraph hill a 90- degree hill. the man is in the thick brush holding on for dear life. it's right under coit tower. he has been there since about 6:30 last night. he apparently jumped over a railing at lombard and kearney after an apartment manager encountered him. apparently he had a couple of backpacks with him. police have done all they can to help him off that hill, too. >> hostage negotiators were able to offer him a variety of

services and hear him declining that on the intercom portion of the equipment at the end of the ladder. >> given the thick brush amount sharpness of the rocks it's a little dangerous to try to see if this person is actually there. >> just a few hours ago he asked for the search lights to be turned off by the sfpd and, of course, they said no. they are going to wait him out until it gets light and apparently hopefully try to extract him off that hill. 6:33 now. a man under arrest in san jose is accused of ramming police cars and putting six officers in the hospital. 27-year-old alejandro gonzalez is in jail and it took several officers a taser and a straitjacket just to get him under control. he is accused of punching a 68- year-old man and stealing his car and then ramming any police car he saw. the officers are expected to survive. the man was wanted for failing to serve a few days in jail for

theft. michele bachmann is canceling her campaign trip to south carolina. >> that after she finished a very disappointing 6th place at the iowa caucuses last night garnering less than 5% of the vote. meantime an incrediblably narrow victory for mitt romney by a thin, thin margin in the republican presidential caucuses. he edged rick santorum by eight votes. as susan mcginnis begins reports, results may also be the beginning of the end for a couple of other candidates, as well. reporter: mitt romney barely squeezed out a win in iowa, with rick santorum trailing just eight votes behind. >> we are going to change the white house and get america back on track. >> reporter: the former massachusetts governor is pledging to keep the momentum going in new hampshire, where he homicide a solid lead. >> on to new hampshire, let's get that job done. >> game on. minutes now westbound 580 from the altamont pass to 680. speeds slow down as you approach the dublin interchange. that's a look at traffic. here's lawrence. >> a lot of sunshine coming our way today. not as much fog around the bay area. some partly cloudy skies this morning, some fog showing up in some of the north bay valleys early on but you get a sense of that big ridge of high pressure building in overhead today. that is going to make for a gorgeous afternoon outside. still, chilly in parts of the bay area right now. 37 degrees in concord. 34 in santa rosa. 47 in san francisco and 41 degrees in san jose. this afternoon, those temperatures soaring unmostly sunny skies. well into the 60s, almost 70 degrees in some of the warmest parts of the bay area. there are some changes on the way. we'll have more on that in just a moment. back to you. >> thank you. a quicker commute to san jose. the big step forward for a bart extension. >> and has high-speed rail hit a dead end? why the project could be scrapped altogether in california. >> and weed wars in san jose. why a strict crackdown on pot clubs may be snuffed out.

"san francisco county jail back now at 6:10. demolition is set to begin this morning on a depression era bay

area jail. san francisco county jail number 3 is actually in the city of san bruno. it was built in 1934. there it is. off moreland drive. now, a lawsuit was filed in the 1990s claiming unsafe conditions at the jail. a settlement of the suit forced san francisco to build a new jail nearby. the old jail building has been empty since 2006, when the new facility opened for business. a swedish construction firm says that its joint venture has won a design-build contract to extend the bart train system to north san jose. the company says its contract is worth $347 million. it would be involved in planning and construction of the extension for fremont's warm springs station to san jose's berryessa area. the 9.9-mile extension is projected to be finished in spring 2016. california's high-speed rail system has hit a speed bump along the way. an independent review board says the plan is not financially feasible and the whole thing should be put on

we have an update on breaking news down in san jose. >> we have a live picture. in just the past half hour, the subject of a manhunt was taken into custody. now, the search began shortly after 1:00 a.m. when deputies tried to pull a

car over. that's the car that you see on the left this. s for a minor infraction. -- that's the car that you see on the left. this is for a minor infraction. he ran into an apartment complex. he is in custody, no identity released. he is facing charges of resisting arrest and apparently possession of stolen property. no injuries were reported. we have a live report coming up in short order. a developing story in san francisco where police fin to watch telegraph hill where a burglary suspect is hiding out. he has been doing that since 6:30. but he is in a very precarious spot. bob melrose reports. >> reporter: well, police are going to wait until the sun comes up, which should be another couple of hours before they make their next move. the hillside is very steep as you can see and the floodlights

have been on this hillside all night, about four hours ago the suspect apparently yelling out and telling police to turn off the lights. the fire department last night about 6:30 asked him if he was hurt or needed help and he said no. police arrived on the scene at that time and started to try to negotiate with him. so far, unsuccessfully. and right now they are going to wait until the sun comes up before they decide on what to do next. >> so this guy is clinging to something on the side of the hill waiting it out? >> reporter: it would appear so. he was confronted by an apartment manager last night about 6:30, allegedly burglarizing some apartments. police say he has two backpacks with him. they don't know if he is armed

or not. they say it's too dangerous to risk injury to the suspects or officers. >> thank you, bob melrose from kcb radio. let's check of traffic and weather. >> we have an accident in san jose over to the right shoulder. northbound 101 couple of cars involved possible injuries but not too many problems on the main freeway line. northbound 280 through downtown san jose, traffic still looks nice. no delays at 880/237. just some extra volume there. no "meet the press" metering lights at the bay bridge toll plaza. looking good into san francisco. no delays on the lower deck. the altamont pass starting to inch up a bit. the drive time busy, westbound 580 all the way towards 680. some slower speeds approaching the dublin interchange. there is a traffic alert so heads up, westbound 205 past i- 5 commuting to tracy or that

area, delays due to an accident with two big rigs alternating lanes through there. expect delays. also, antioch westbound 4 starting to load up, as well. we are seeing delays right around hillcrest and loveridge. it gets better on the westbound side of 4, once you hit pittsburg. no delays headed towards the eastshore freeway. 880 both directions not a bad ride. northbound very light traffic into the maze. southbound though, we're starting to see a few more cars on the roadways so getting a bit busy as you head into hayward. no delays, though, as you approach the san mateo bridge. and the bridge itself looks good in both directions. 14 minutes still to go between 880 and 101. that's traffic. here's lawrence with your forecast. gianna, just some partly cloudy skies around the bay area this morning. couple of patches of fog in the north bay and that's it. we are looking at a great day ahead as high pressure builds in nicely probably the warmest day of the week so far as we'll see these temperatures soaring into the afternoon well into the 60s, almost 70 degrees in some of the warmest spots. still starting with a couple of patches of fog and chilly too. staying dry and looking very nice as we head in toward the

weekend. still those temperatures cold in spots, down into the 30s in some of the valleys, 37 degrees in concord. 39 in livermore. 34 santa rosa. 47 degrees in san francisco. that ridge of high pressure bringing in sunshine, will continue to send this energy well to the north of the bay area. going to make for mild conditions and mostly sun in this skies around the bay area today. soaring temperatures by the afternoon, a good 10 to 12 degrees above average as high as 68 degrees today in morgan hill. 67 mountain view. 64 san mateo. east bay temperatures in the 60s, plenty of sunshine there. 60s inside the bay, cooler at the coast. cooler temperatures on the way into thursday. more of a sea breeze kicking in bringing with it more clouds as a weak system slides by the bay area. warming up and looking good into the weekend. >> nice. new this morning, sunny- veil balessed yahoo has named a new ceo and it is scott thompson, the president of ebay's paypal division. the struggling internet company has been without a permanent ceo since early september. that was when carol bartz was abruptly fired. thompson's new job starts monday. we'll check in with jason brooks with more on this in his moneywatch report at 6:45. and the future of san jose's medical marijuana law is in question. opponents of the law to limit pot clubs in and force them to grow all their marijuana on site have collected enough signatures to put it up for a vote. the "mercury news" reports that there could be a vote as soon as june. or the city council could decide to rescind the ordinance altogether. up next, college students and their families getting more bang for the buck. why uc-berkeley is getting recognized with a national honor. >> and did you get a lot of junk mail? the unusual recipient who is getting hounded for decades by junk mail. p

gil, what are deputies say happened? >> reporter: well, they are happening because of a minor infraction trying to get pulled over but more about that in just a moment. but yeah, it happened less than an hour ago. they don't believe he was armed as they had originally thought. but we're also learning this morning that he has been sent to the hospital because he got hurt during the search. we don't know the extent or the severity of his injuries. it all happened in this apartment complex behind me. the sheriff's deputies tell us that he found him hiding near a shed. they found him with also the help of k-9s and a lot of manpower searching for him in this complex. i counted about 2 or 3 dozen of them here. they don't know if he lived in this complex but the drama began unfolding around 1 a.m. when the man failed to pull over for a sheriff's deputy. >> it started just after 1:00 this morning. one of our sheriff's deputies attempted to make a car stop for just a regular vehicle

infraction. the suspects didn't stop right away, drove slowly for a couple of blocks, finally stopping completely when the driver foot- bailed and that's what started the search. >> reporter: around sergeant cardoza says that that minor infraction may have been the fact that the windows on the car were too dark. when they searched the trunk of the car, they found some stolen goods. the suspect wasn't the only person in the car. there were two other people in the car and they are taken mo custody for questioning. as for the suspect himself, after he gets out of the hospital, chances are he will be charged with resisting arrest and possessing stolen goods. back to you. >> thank you. , gil diaz in san jose. 6:31. we are following a developing story in san francisco. for with 12 hours now a man has been hanging on the side of a cliff. the burglary suspect has been on the eastern face of telegraph hill near chestnut

street. you can see police have spotlights on him. here's a live look. but they are going to wait for him to make a move. they say it's too dangerous on the hillsides because it's so steep. the man landed on the side of the cliff around 6:30 last night. that's when an apartment manager saw him carrying two backpacks. the man jumped over a railing trying to get away at lombard around kearney streets and he ended up hidden here under some heavy brush on the side of the hill. this is just below coit tower. we'll have a live report and update from the city in a few minutes. michele bachmann is now canceling her campaign trip to south carolina after a disappointing sixth place finish for her in iowa. >> she is expected to hold a news conference this morning. rick perry said he is reassessing his campaign. he is going back to texas to think it over. the winner in iowa last night of course, mitt romney edged out rick santorum by 8 votes.

a big seesaw battle went on all night. >> romney won despite campaigning very little in iowa. the close second place finisher is considered a big boost for rick santorum. he has been the big story in the last few days. just weeks ago polls showed him lagging in the single digits while santorum made campaign symptoms in all of iowa's 99 counties. some say he will have a tough time riding the momentum because he lacks a solid national infrastructure but you know what? never say never. >> made a lot of visits to new hampshire, i think 30, he said last night. romney will spend today in new hampshire where the first primary will be held six days from today. he is a heavy favorite in the granite state. they know him well. of course, borders his home in massachusetts. he owns a home on lake winnipesaukee in new hampshire. expected to greet him, this man, senator john mccain, expected to endorse him today. on "the early show" romney defended his record which newt

overpass. the cash lanes are where most of those delays are, fastrak a little better. traffic alert in effect for westbound 205 past i-5. this is going to affect travelers into tracy, stockton, lathrop. two big rigs one overturned on the eastbound side, all eastbound lanes blocked so if you are traveling out of the altamont pass towards this way, connecting to 205 to get to i-5 you will see big delays this morning westbound two lanes blocked because of the big rig accident. so westbound commuters also affected but most of the trouble will be for the folks heading out of the altamont pass. we'll continue to keep you updated on that. again, two big rigs involved in the accident. and again, the altamont pass starting to see some delays on the westbound side. looks like slow and go there. that's traffic. here's lawrence. >> gianna, high pressure continuing to be the story. no rain in sight. temperatures going to be well above the average for this time of year, as much as 10 degrees to 12 degrees above the average as high pressure continues to compress the area, temperatures

on the rise. chilly in some spots to start the day, 34 in santa rosa and 39 livermore. by the afternoon, these temperatures soaring under mostly sunny skies, well into the 60s by the afternoon. some places near 70 degrees. looks like tomorrow will start to cool down a little bit. more clouds on the way and a sea breeze, too. temperatures dropping through about friday. then we warm up looks like dry weather and warmer conditions offered to next weekend. that's a look at weather. back to you. a swedish construction firm says its joint venture has won a contract to build the extension it san jose. the contract is worth $347 million. it would be involved in planning and construction of the bart extension from fremont's warm springs station to san jose's berryessa area. that 9.9-mile extension is projected to be finished in spring of 2016. 6:36 now. an old bay area jail has a meeting with a wrecking ball this morning. it's coming down. san francisco's county jail 3 actually sits in the city of

allegedly caught by a building manager near coit tower burglarizing some apartments and he fled over the side of the hill. that's where he has been ever since. the police say it's too dangerous to go in there until sun-up so they can see what's going on. >> is it possible this guy could escape even with the spotlights and big hill or is it all surrounded? >> well, they have the area cordoned off. it's kind of a strange area. it's not flat. the steepest part of telegraph hill, i suppose he probably could have escaped -- he may have gotten out but police believe he is still cornered on the hillside. he talked to the fire department last night before clock and said he didn't need their help and he wasn't hurt. so they have been trying to negotiate and talk to him to come out without them having to go in after him and i'm not sure they are going to do that anyway. but right now, they say time is on their side. they are waiting for the sun to come up. it's -- they believe like i

said that they have the area surrounded and he is in this perimeter. >> that's a strange story to hear about. bob, you talked a little bit about this hill. we can see it's very steep, almost 90 degrees? >> reporter: just about 90 degrees, straight up and down. the police say that during the night they didn't want anything to do with going inside after this man. they don't believe that he is armed but you never know. they certainly didn't want confrontation on a hillside like that. >> understandable. bob melrose from kcbs with the latest on the man trapped on the hillside there, thank you. 6:39 now. two bone marrow drives set for a bay area boy diagnosed with a deadly disease. his unique ethnic background now proving very difficult for doctors to cure him. 4-year-old kyle crawford has aplastic anemia. he could possibly live five to ten more years about aggressive medical treatment but a bone marrow match could cure the young boy. the crawfords have also learned that because their son is half

there in both directions. we'll continue to keep you updated on that as soon as chp arrives on the scene. the rest of the south bay checking in problem-free. extra volume though northbound 280 as you head through downtown san jose. bay bridge metering lights are on, traffic is starting to stack up. you're backed up at least to the 880 overpass. not quite to the maze just yet. and looks like traffic is sluggish westbound through the altamont pass. tim cal this time of the morning towards -- typical this time of the morning towards the 680. flip side eastbound we have the traffic alert affecting both directions of 205. heads up, there is a pretty big accident involving two big rigs on 205 past i-5. it's causing delays in both directions, all eastbound lanes on 205 are completely shut down for this overturned concrete truck. westbound lanes only two lanes are open so plan for that. pittsburgh 4 through antioch delays through there and the

eastshore freeway. and the golden gate bridge, one of our bright spots not too bad's nice ride out of marin county into san francisco. lawrence has your forecast. >> gianna, you like that sunshine? >> yes! >> you are going to love today. probably the nicest day of the week as we're seeing high pressure building overhead. those temperatures running well above the average for this time of year. and well, just a couple of patches of clouds making their way across the bay area this morning. definitely not seeing that heavy thick fog that we had yesterday. so a weak offshore wind developing, that means we are going to watch those skies clear out nicely and by the afternoon, probably the warmest day of the week. high pressure building in for the weekend after weakening somewhat tomorrow meaning great weather come our way and no rain in sight. outside the sun coming up, lots of sunshine coming our way today and those temperatures, it's chilly in spots so grab your jacket if you are headed out the door. 37 degrees in concord. 39 in livermore. 41 in san jose. and 34 degrees in santa rosa. still that ridge strong enough to bring you plenty of sunshine

president of paypal, a division of ebay. a bit of a surprise. he was not really on the short list. never bandied about by prognosticators and yahoo ramped up its search to replace the ousted carol bartz of last september. thompson doing good things at paypal. its revenue in the 3rd quarter up 32%. paypal on pace to become the biggest revenue generator at ebay over marketplace. he also has a very solid tech back ground, something bartz didn't have. they are continuing their options about selling off investments and other ideas. apple announcing this morning that the iphone 4s will be made available in china and 21 other countries beginning on friday, january 13. ceo tim cook releasing a salt saying that customer demand for apple products in china has

been off the charts, releasing that stay. . dow up 180 points yesterday thanks to positive economic news in the u.s. and elsewhere. pulling back now, dow down by 18, nasdaq down 14, s&p down 4. yahoo shares are down by 2%. >> you must have had a good vacation if you are using the word prognosticators this early in the morning. >> sometimes it comes out, you know, we'll go with that. it doesn't always work out very well. >> i like that word. >> thank you. republican presidential hopeful michele bachmann is canceling her campaign trip to south carolina after a very poor showing in the iowa caucuses last night. >> and rick perry is also showing signs that he may end his efforts for the white house. >> susan mcginnis is in des moines, has been all week, with more on the narrow victory by mitt romney. 8 votes, can you believe it? >> reporter: yeah, can you believe that, eight votes. this is the smallest margin in iowa caucus history, also the largest turnout in history ever

last night for any iowa caucus ever. so couple of records here. it was quite an exciting night. really came down to the wire just watching the lead between romney and santorum go back and forth all night until about 2:30 a.m. we finally find out we have this 8-vote margin. it was really quite a night here. [ applause and cheers ] reporter: mitt romney barely squeezed out a win in iowa with santorum trailing just eight votes behind. >> we are going to change the white house and get america back on track. >> reporter: the former massachusetts governor is pledging to keep the momentum going in new hampshire where he holds a solid lead. >> on to new hampshire, let's get that job done. >> game on. >> reporter: but santorum is also ready to compete following his surprising late surge in iowa. >> i have been to new hampshire 30 times and been more times and done more events than anybody but jon huntsman and he cheats, he lives there. [ pause ] >> reporter: so, romney does appear to be in the best position for new hampshire especially now he has a key endorsement from john mccain, coming out in favor of romney. he won new hampshire twice and was the nominee the last time around. >> we hear michele bachmann is going to have a press conference not going to south carolina. she was going to bypass new

francisco. police know exactly where their suspect is, but they are planning to wait until he comes to them. the man is among the dense growth on the side of telegraph hill near coit tower. this is live look. you can see the sun starting to brighten the skies a little bit. the suspect jumped off the edge of the hill around 6:30 last night when an apartment manager caught him trying to collar him for burglary. police have been talking to him. they have negotiators in there. he turned down their offers for help of getting off the cliff so now police say they are waiting for the sun to come up and hoping that he will climb down or back up so they don't have to go in and get him. just too dangerous. >> he has to be a little tired. probably clinging to a bush now thinking what do i do? >> at least he is not hurt, probably. it is 6:57. one last look at traffic and weather and gianna, guess you got busy there, huh? >> there's a couple of things going on to look out for. the first one in the south bay northbound 101 at de la cruz boulevard. four-car crash two left lanes

are blocked and traffic is really starting to stack up there. speeds dipping in under 25 miles per hour in some spots so give yourself some extra time if you plan on taking 101 or use an alternate. eastbound out of the altamont pass towards 205, there is an accident in both directions just past i-5. it's involving two big rigs. one of these big rigs overturned and i'm getting word that there's a lot of concrete spilled in the road so all eastbound lanes are blocked on 205, westbound only 2 lanes are open so it's going to affect your drive for eastbound commuters heading through the altamont pass. westbound business as usual as you work your way towards 680. 16-minute ride through there. all our mass transit is on time. caltrain no problems, bart, ace, muni and ferries looking good and the rest of the bridges doing okay. bay bridge metering lights are on. that's traffic. here's lawrence. >> weather looking good outside today, going to see plenty of sunshine as we head in toward the afternoon. couple of patches of fog in the napa valley right now but nothing but sunshine later on today, about 67 degrees in
