the ground and from the air. reporter: by nightfall with over 800 acres burned, it is still hard to tell who is winning this firefight, man or mother nature. >> the fire started right here with, you know, a lot of fuel, a lot of potential for rapid spread because of slope. >> reporter: monday afternoon mount diablo erupted in flames looking more like a volcano with a huge plume of smoke in the air and 50 to 75 homes on the ground in the fire's path starting on sunday afternoon those residents told to lock unand leave immediately. >> especially on morgan territory road they have a long way to go for fire protection and they have a lot of animals in here, you can see there's a lot of fuel for the fires. so, yeah, it's a big concern. >> reporter: on the attack, 250 firefighters, dozens of fire trucks, a handful of aircraft, even a couple of bulldozers to do the heavy lifting. >> temperatures were very high and the fuel and topography on the back side of mount diablo

is fairly extreme so those were the two primary factors that influenced the spread of this fire. >> reporter: the wildfire has burned a lot of land but hasn't done much damage to property only a cell phone tower so far. no homes burned, and nobody hurt. >> yeah. everybody is concerned and wants everyone to be safe, concerned for the safety of those fighting the fire. >> reporter: so there really hasn't been much wind overnight. that's been helping. but let me show you some of what is burning up on the side of the mountain. this is brown brittle brush. it is the fuel to the fire. and there is plenty of it. reporting from mount diablo, brian webb, kpix 5. >> fire crews are expected to resume aerial water drops over the fire after sunrise sometime after 7:00 this morning. now for the latest on the fire danger on mount diablo, brian? >> the danger is the fact that there's a lot of fuel up there and it is september one of the warmest months of the year but at least the temperatures while they're hot, the winds are not

coming out of the driest possible direction. that's the best news. overnight winds were fairly light and right now only out of the northwest to about 10 miles per hour. the forecast is northwest 15 with highs from 90 to 98 and the humidity, you know, it's on the dry side 20 to 30%. but it's not that dry so we are getting good news by virtue of the fact the winds are not that high and dry. so those are two important things and the temperatures, you know, at the peak the temperature high today only 80 degrees so that is not so bad. and the winds aren't going to peak and will stay out of the northwest. that's all good news. >> can you remember the last time diablo -- >> it's been a long time. there's a lot of controversy about not having controlled burns on diablo and things like that so there's a lot of fuel for the fire. dozens of homes are evacuated because of the fire. evacuees were sent to check in at the clayton community library on clayton road where they could get help making

arrangements. and there is a separate evacuation center available for animals. kpix 5 reporter elizabeth wenger reports from the fairgrounds in antioch. >> reporter: so far no animals have been brought to the fairgrounds but i talk to the organizer. they are saying they could see some by later on this morning. this is a country area so a lot of people have horses, cattle, sheep, goats, pigs, you name it and this fairgrounds is equipped to handle large and small animals. so as you mentioned about 75 homes, 75 families, have been evacuated because of the fire and smoke. additional evacuations came overnight. trail ride russelman park, east trail, upper trail and lower trail roads. since yesterday evacuations along oak hill lane, curry canyon road and the curry point area. so far only a handful of families is using the evacuation center at clayton library. evacuees we talked to say the fire was close but they are hopeful firefighters will gain the upper hand soon. >> we didn't see any flames.

we saw a lot of smoke. we are thinking, you know, it's -- we were told about a quarter mile away. now, that seems a little close if the wind changes, it could be dangerous. but, you know, we didn't feel we were in a lot of danger actually. >> reporter: the fairgrounds have been on standby, the contra costa county fairgrounds, since they got a call from the sheriff's department last night around 6:00 that they may need to house some animals and they have been on standby overnight but so far nothing. that could change as day breaks. >> it seems the community is coming together to help. >> reporter: it is a really cool sight to see in situations like this. yeah, volunteers were there along the fireline yesterday and they had their horse trailers coming to transport any stranded animals that might need help. >> all right, elizabeth wenger live in antioch, thank you. now for a look at the roads shut down by the morgan fire. liza battalones? >> hi there. good morning, everybody.

these road closures affect so many communities clayton, some folks also that are in the blackhawk area, brentwood, pleasanton, danville who normally use these back records to get to and through the area just keep in mind that marsh creek road is shut down between camino diablo and regency drive in clayton. also closed is morgan territory road. you can see the freeways in the area 680, 242 all in good shape. as we check on the bay bridge drive, westbound traffic still good leaving oakland heading into san francisco. we are seeing earlier backups as folks make that drive across the new bay bridge. so far none of those delays i- 80 fine through berkeley and emeryville. that's a look at the morning commute. president obama is taking his plans for syria to the people. he will address the nation tomorrow. meanwhile, syrian president bashar assad is speaking exclusively to cbs.

here's what he had to say to charlie rose about the chemical attack that sparked this debate. >> what happened in your judgment? >> we are not in the area where they unleashed the chemical attack happened. we are not sure that anything happened. >> even at this date you're not sure, even though you have seen the videotape. >> our soldiers in another area were attacked chemically. our soldiers. they went to the hospital as casualties because of chemical weapons. but in the area where they said the government used chemical weapons, we only had video and we only have pictures and allegations. we're not social media administration or government. we are the government that deals with reality. >> and you can see more of that interview on "cbs this morning." it starts at 7:00 right here on kpix 5. some new video out of europe now.

secretary of state john kerry is now in london as he continues to make the case for military action against syria. he says there's very strong evidence that the syrian government used chemical weapons against its people. kerry says he would be confident to take that evidence into any courtroom. he has been responding to comments from president assad that the allegations are a lie. the obama administration is facing a big challenge in winning congressional support for an syrian air strike even within the democratic party. house minority leader nancy pelosi has sent five letters to fellow democrats all in an effort to build support for a military strike. some in congress are staunchly opposed to any attack. this morning, bay area congressman eric swalwell sat down with our phil matier. he suggested he was going to vote with his constituents views in mind. >> my constituents across the board it's a firm solid no, why now, how is this in america's best interests?

>> i think force should be the last option after you exhaust all other remedies. >> according to the latest poll, 36% of americans are in favor of air strikes on syria. happening today a trial gets under way in the shooting and crash in las vegas that killed a man from oakland. 26-year-old ammar harris faces murder charges. police say in february, harris opened fire opened fire on a maserati being driven by kenneth cherry, jr., in oakland. the car sped into an intersection rammed a taxi which burst into flames. cherry and two others died in the taxi. there will be public support for gun control at a church today. nancy skinner of berkeley and robben that of oakland have coauthored a bill that would ban kits that convert guns into assault-type weapons and make it illegal to buy large capacity magazines. they will hold a meeting today. the state senate could vote

on whether to rename the western span of the bay bridge after willie brown. some say it's inappropriate because there's a senate policy against naming roads for people who are still alive. the "san francisco chronicle" where brown is a columnist has editorialized against the move. but some state lawmakers support it. 5:10. a sunny afternoon at a festival in connecticut took a disastrous turn when a ride malfunctioned. as cbs reporter jericka duncan reports, more than a dozen children were injured. >> reporter: connecticut state police are investigating what went wrong when a popular ride malfunctioned in norwalk. the ride's operator believes every believes a mechanical failure caused it to lose power and suddenly stop in midair injuring 18 people, mostly children. >> everything stopped but, of course, when it stops, the swings went all different directions with the children on it and they were bouncing off the steel frames.

>> reporter: police say none of the children fell to the ground but the swings slammed into each other injuring the riders. >> a lot of kids were screaming. it was -- people went out their minds. >> reporter: a doctor at the festival heard children screaming. >> i happen to be a trauma surgeon in town so assessed all the kids at the time. and no one seemed greatly injured. all the kids were moving their extremities. >> reporter: first responders treated the injure children laying them out on the grass. 13 people were transported to area hospitals but all are expected to be okay. jericka duncan, kpix 5. >> investigators inspected all the rides at that festival and every attraction was reopened except for the ride that malfunctioned. time now is 5:11. a new law is now in the crosshairs of the gun control debate. the state that allows blind people to sign up for gun permits. >> and consumer groups sounding the alarm over arsenic found in two common foods. >> and let's take a live look out at the morgan fire on top

[ laughter ] >> starting out with some fog around the spans this morning otherwise clear skies and temperatures unusually mild overnight. so numbers in the early going in the upper 50s and mid-60s inland and plenty of star shine at this hour. this afternoon we have clouds lingering along the shore. it will be sunny, mild, a beautiful monday for the bay. we'll be 100 inland as this high is in place over the eastern pacific. we just look for the numbers to skyrocket inland. not record highs but we'll be up there. it will be hot away from the coast but near the shoreline as per september usual it will be mild. today patchy fog at the airport no delays expected. a high of 72. thunderstorms in houston, denver and new york. new york okay at 73 degrees and sunny. south bay warm, 90 in san jose. a little warmer than average

for this time of the year. 95 at morgan hill. and 89 at los altos. in the east bay we'll still be in the mid-90s today for the most part down at pleasanton though 98 degrees. 100 at brentwood and livermore. up in the north bay we'll be looking at numbers only 70 degrees in bodega bay but 86 in san rafael. 96 in sonoma in wine country today. extended forecast is calling for numbers to still be warm today but finally we begin to nudge the marine air farther inland bringing temperatures down to just the upper 90s. so finally we'll begin to ease it off by wednesday, thursday and friday in the east bay back down to the upper 80s. as we look to next weekend the numbers are back to about where they should be for this time of the year upper 80s inland. 70s all week during the week for the bay. it's going to be a lovely, lovely week for september. >> thank you. in this morning's healthwatch, many consumer groups have raised concerns about arsenic in rice products. now government health officials

are out with a new study and cbs reporter marlie hall has details on the findings. >> reporter: the food and drug administration says the levels of inorganic arsenic found in rice are too low to cause health damage. the agency has released the results of a study of 1300 samples of rice and rice products. the largest study to date. there are two forms of arsenic and both occur naturally in the environment. the organic type is essentially harmless but the inorganic type is toxic and high levels potentially cause cancer. rice is grown in water on the ground and can absorb higher levels of arsenic than other foods. the study showed levels vary significantly in the product with the most inorganic arsenic found in brown rice and lowest in instant rice. consumer groups have urged the government to create standards for the amount of arsenic in rice products. >> all the fda is saying is it won't cause health problems in

minutes ahead. >> i'll have information on road closures because of the morgan fire. in the meantime san mateo bridge traffic looking good. i'll have more traffic in a few minutes. >> good morning. it's monday, september 9. i'm michelle griego. >> hi, everyone. i'm frank mallicoat. time now 5:30. 800 acres have burned up the very dry steep slopes of mount diablo sending smoke into bay area skies. this fire is still raging this morning. we have team coverage for you on this monday morning. brian hackney keeping an eye on the weather conditions in the area, but we kick it off this morning with cate caugiran with the very latest now on the fire. >> as we were driving to clayton we could see the fire burning over around mount diablo. i can it to you over my shoulder right now. you can see a faint glow but a little bit of smoke over that mountain right there. we know that again, that this fire is still very active in this area. meanwhile, the morgan fire has caused another round of evacuations. the sheriff's office says about 24 homes in the trail ride

russelman park east trail upper and lower trail roads are among the latest round of evacuations. the first round started almost immediately after the fire was reported off of morgan territory road around 1:30 yesterday. cal fire says yesterday's temperatures in the 90s and just a little bit of wind caused this fire to spread quickly. temperatures were very high. the fuel and topography were very extreme so those were the two primary factors that influenced the spread of this fire. >> reporter: the last update we got 800 acres were still burning and the fire was just about 10% contained. cal fire says about 50 to 70 buildings are threatened by the growing flames. now, we know an evacuation center is set up at the clayton community library for anyone who needs a place to stay because as of now it's still not certain when these people will be able to return to their homes. the latest information we got is we should be getting an

update from cal fire on the status of this fire in just about five minutes and we'll bring that update to you in the next half hour. live in clayton, cate caugiran, kpix 5. >> still very active up there in a big way. >> it's not going to hurt that much. the temperatures are still hot but the good news is we are not getting those east winds and that could be deadly but at least the winds are out of the northwest. it's not the driest direction. so that's good news. the temperatures today are hot. but they are not that hot. the latest on all of this northwest winds at 10 miles an hour, glad they are not out of the east. the forecast is for winds to be up to 15 miles an hour and highs not at the top of mount diablo but where they are fighting the fire highs 90 to 98 degrees and humidity 20 to 30% but not that low. it could be worse. the winds won't top out at 30 or 40 miles per hour so the two things, it's not that dry and

it's not that windy. so that's good news. >> thank you. some people in homes not threatened by the fire have offered rooms to those who had to flee. evacuees we talked to were not too worried about their homes. >> we didn't see any flames. we saw a lot of smoke. we're thinking you know -- we were told about a quarter mile away. that seems a little close if the wind changed it could be dangerous. but, you know, we didn't feel we were in a lot of danger actually. >> while evacuees were sent to the clayton community library, some of their animals went to the contra costa county fairgrounds in antioch. facilities are available there for livestock including cattle, goats, hogs, horses and sheep. some roads are closed because of evacuations. let's get the latest from liza battalones. >> reporter: these roads affecting so many communities now especially in the clayton area but also marsh creek and

morgan territory the back roads in the area, other areas will be affected. marsh creek closed between camino diablo. morgan territory closed to highland road in alameda county. not too far from there, highway 4 traffic of the typical slowing you would see for this hour of the morning with westbound traffic heavy from "a" street in antioch just as you approach pittsburg. no delays down the willow pass. bay bridge commute backups at the toll plaza. a brief delay with the metering lights off. another fire burned in sonoma county over the weekend sending flames and plumes of smoke up into the air. it started yesterday afternoon as the fire was in a ditch and burned a pallet factory between broadway and 8th street east near sonoma. sparks were seen coming from a tow truck. it's not clear what started the fire. more than 40 acres have burned. we have cell phone video. check this out.

it was shot by a firefighter. it shows a plea pain tank that exploded as he was battling the fire. nobody was hurt. it showed a propane tank that exploded as the firefighter was battling the fire. >> it was an intense difficult firefight. we had over 30 trailers, commercial trailers, involved. >> highway 121 at 116 shut down as crews worked to kept that fire under control. 6 structures were burned. firefighters managed to save 10 other structures in that area. president obama takes his syria strike plans to the people. tomorrow, he will address the nation. the syrian president bashar assad is also talking exclusively to "cbs this morning" with charlie rose. this is his reaction to secretary of state john kerry's report on who is responsible for the chemical attack. >> secretary kerry has presented what he concludes is conclusive evidence. >> he presented his confidence

and convictions. it's not about confidence. it's about evidence. the russians have completely opposite evidence that the missiles were thrown from area where the rebels controlled. that reminds me about what kerry said about the big lie that colin powell said in front of the world on satellite about the wmd in iraq saying this is our evidence. actually he gets false evidence. in this case, kerry didn't even present any evidence. >> president assad also says syria will retaliate if the u.s. attacks. you can see more of that interview on "cbs this morning." it starts at 7 a.m. right here on kpix 5. new details this morning on the discovery of a body at san jose state university. the victim found dead in a parked car on humboldt street at 10 a.m. yesterday morning. the city and university police consider the death a homicide although they are not releasing any information on a cause just

yet. the killing is the 37th homicide in san jose this year. only the fourth ever investigated by school authorities. berkeley police are investigating their city's fourth murder of the year. officers responded to several shots that had been fired near the intersection of 8th and page street last night around 8:00. a man was found suffering from multiple gunshot wounds and died at the hospital. the victim's name hasn't been released. so far no suspects have been identified. news around the bay area. a man fell to his death outside candlestick park just after the 49ers game started yesterday afternoon. the man was walking with his brother when he fell from the elevated jamestown pedestrian walkway. witnesses told san francisco police the man appeared to be intoxicated. the man was in his 30s. today oakland's mayor and police chief will answer media questions regarding this helicopter. the police chopper was grounded in between because of budget

cuts but earlier this year a nonprofit group called fueling california donated $10,000 to help buy gas to put it in the air. the nonprofit represents consumers when it comes to fuel costs. a sierra getaway once used by the rat pack will get a major makeover. >> and some people use the new bay bridge to get to work or events but others are just curious about it. how the bridge is becoming a destination in itself. are morning on promising economic news from asia. today china reports inflation eased last month. marlie hall of cbsmoneywatch.com joins us now. good morning. >> reporter: good morning. the federal reserve will release consumer credit data for july this afternoon. tomorrow investors will get a look at the labor department's job openings and labor turnover survey for july. a disappointing jobs report for august and the ongoing tensions between the u.s. and syria caused stocks to end last week unchanged. the dow was down 15 last session and the nasdaq composite rose just 1 point. business forecasters say 2014 will bring better fiscal health. top economists surveyed by the national association of business economics predict the economy will grow 3% by the 2nd quarter of next year. in a report released today, they also say there will be low inflation and employment will improve. nissan is working on a smartwatch that will monitor

both its car and the drivers. the watch will provide realtime data like a driver's heart rate and the car's speed. it's designed specifically for drivers of nissan's line of sport cars. the smartwatch will be on display at a motor show in germany this week. no word on when the new iwatch will be available to the public. starting today microsoft is making its xbox music streaming service available for free on the web. even if you don't use windows 8. the company hopes the move will attract new customers to its devices and services as well as help it compete with other digital music offerings like itunes and spotify. >> we know that xbox music is trending on at which time they are morning. how is it different from other music services? >> reporter: xbox music allows users to choose from 30 million tracks, create their own playlist of songs and stream them for free with apps of

course. >> thank you, marlie hall of cbsmoneywatch.com. hard to keep up with all that stuff. not hard to keep up with traffic, although you have been kind of busy for a monday, right? >> reporter: it is shaping up to be a busy monday. we are getting information now, frank and michelle, on a structure fire that's burning in the fremont area and it is visible from the freeway so heads up if you normally make the 880 commute you will see this approaching mowry avenue. smoke visible from the freeway now. the structure fire burning along farwell drive and apparently power lines are down in the area. this is causing a small power outage. this affects fremont about 2,000 pg&e customers affected. we do know that at least farwell drive is shut down outside the structure fire. as we get for information we'll let you know. if you approach an intersection that's blacked out remember to treat that as a four-way stop. bay bridge toll plaza is backed up ever since the new bay bridge opened we have been seeing earlier delays longer

delays getting into san francisco. right now the toll plaza is backed up beyond the 880 overcrossing. san mateo bridge no problems out of hayward to foster city. over at the golden gate bridge, southbound traffic fine leaving southern marin. we haven't had any major problems to report to you approaching the toll plaza. it's a little foggy out there though. 880/237 interchange in the silicon valley, no problems to report to you. fremont and milpitas at the speed limit. and mass transit in good shape no delays for bart, ace, muni and caltrain. we are starting out with fairly mild readings around the bay area on this monday morning. some fog along the shoreline. you will see that when you come across the span at the golden gate bridge. otherwise, inland clear and mild and 64 degrees right now. temperatures elsewhere just in the 50s. by this afternoon, though, we are still going to be near 100 degrees inland around livermore sunny and hot, mild around the bay it's going to be a beautiful monday and right

along the shoreline some sun but not exactly hot. temperatures will be mostly in the mid- to upper 60s. high pressure is in place in the eastern pacific. and as long as it sits out there, we continue to get warm temperatures b12 degrees warmer than -- about 12 degrees warmer than average inland. if you need relief head to the beach. down if the south bay warm 90 in santa clara, 90 san jose, 95 in morgan hill. redwood city today 88 degrees. over in the east bay the numbers will be in the mid-90s for the most part. but to livermore 100 degrees. 89 vallejo, 95 danville, stinson beach 67. 90 petaluma. 92 in santa rosa. the extended forecast we stay at 100 degrees today in the warmest spots inland but as the week goes on we begin to bring the temperatures down into the upper 80s wednesday, thursday and friday. that's back about where we should inland for this time of the year the bay in the 70s

increase oxygen levels but it hasn't helped. 5:47 now. the new eastern span of the bay bridge is still making news. the bridge has been packed all weekend, sometimes even late into the night. a lot of people used it to get to the sporting events going on with the 9ers playing of course and america's cup. but others just wanted to check it out for the first time. >> came in today to pick my son up from lacrosse practice because i wanted to come over the bridge. >> today is a big day for us to see the bay bridge to be honest with you. it's very awesome. >> well at times, traffic has jammed up on every approach to the span on both sides of the bay for thousands of commuters leaving san francisco, it has taken as long as an hour just to get on the bridge from just a couple of blocks away. oracle team u soviet union a scored a win this weekend in the america's cup competition but they have a long way to go. oracle won the sprint to the finish line in yesterday's second race.

but emirates team new zealand still has the overall lead winning the first race of the day. new zealand needs 6 more wins to get the cup. team usa needs 10 more. new developments in the haggling over new stadiums for the raiders and the a's. the "oakland tribune" reports the raiders want a football- only stadium where the coliseum stands right now. but that could interfere with the a's ability to stay there and push them to san jose. the raiders have not commented on this. the a's are negotiating a new lease at the coliseum that would have an out clause depending on the raiders stadium plan. how about the 49ers? their win over the green bay packers was the team's final home opener at candlestick and there were some feelings of nostalgia. fans remembered the days when the stick was brand-new. used to go to kezar stadium and followed the move to the stick more than 40 years ago. they have been coming up tailgating ever since. it's a very sad time because it's been in this area

for so long and now it's going to move away and all of these people who have supported team all these years are now being sort of shut out. >> got to go to santa clara now. many of the fans lamented the last season at candlestick saying they already have tickets for the new stadium in the south bay. as for the future of the stick, it's due to be imploded next year to make way for a new shopping center. in your healthwatch this morning, obese teens are more likely to develop eating disorders as they lose weight. that's according to mayo clinic's study that shows the teens had severe dieting patterns that turned into anorexia and bulemia. it's also difficult to identify the problem. research also found obese children on a weight loss regimen have medical issues. harvard researchers say most breast cancer deaths occur in women under 50. that's because younger women do not get regular mammograms. that study goes against a 2009 recommendation that only women
