shooting a man in the back. a warning, some viewers may find the images disturbing. the patrolman michael slager fired eight shots at walter scott on saturday morning. officer slager is white. scott is black. slager claims scott tried to grab his stun gun after a traffic stop. after the shooting, slager appears to drop his stun gun next to the body. north charleston's mayor says the video played a crucial role in the arrest. >> if you make a bad decision, don't care if you are behind the shield or just a citizen on the street, you have to live by that decision. >> if convicted, slager could spend life in prison. originally slager claimed that he feared for his life when he opened fire. that is provoking strong reaction here in the bay area. >> we can't have any longer, um, standards that are set so low that all that an officer needs to do is say he feared for his life as a justification for taking a life.

>> you are not supposed to use deadly force. you're not supposed to do that. it's for the defense of others, defense of yourself. >> some are calling for changes to the current system that allows police departments to investigate themselves after deadly shootings. an escaped santa clara county inmate is finally back in custody after a month on the run. 40-year-old johnell carter is a suspected child molester. in early march owe overpowered a deputy during an appointment in san jose. that led to a search that involved dozens of deputies, san jose officers and the chp for two days but there was no sign of him until yesterday. he is arrested in mississippi with the help of u.s. marshals. not clear how he got that far. but carter's brother is charged now with helping him avoid authorities. contra costa water district will meet today to discuss the bay area regional desalinization project. the area's five largest water agencies are working to come up with a system. it would create an additional

water source to help the bay area during drought years like this one. and despite the mandate to save water, it appears that a lot of people are not doing much to conserve. a new report says water use statewide was down just 3% in february compared to the same month in 2013. and the drought is still getting worse. you can actually see from this map it's extreme or exceptional in two-thirds of our state. the bay area has unseasonably cool temperatures this morning from the trailing edge of that storm that rolled through on tuesday. we saw hail in vallejo and in san francisco, the problem was flooding. drivers had to navigate through this big pool of water on the 280 on-ramp. that's at geneva avenue. gusty winds caused construction scaffolding to collapse in san francisco's laurel heights. nobody hurt but firefighters had to rescue a man that was stuck up on the roof. >> besides those problems i love seeing the rain.

>> we have seen a rainbow. i was getting text messages from you yesterday. we had gusty winds treasure island to san francisco at 40 miles per hour. higher elevations winds up to 53. this morning those winds are easing up. good morning, everybody! taking a look at our hi-def doppler radar, this is from 2:30 a.m. until about right now and you will see we still have some cells racing across the santa cruz mountains and a cell that just developed outside of union city at alvarado niles shore and eden shores boulevard. take note of that. mostly cloudy skies toward norman mineta international airport. levi's stadium, as well. temperatures anywhere from the 30s in santa rosa and in napa to the 40s in concord and into the 50s in oakland through san francisco. it is currently 50 in livermore. here's what you need to know as far as temperatures are concerned today with the gradual clearing of the skies into the 50s and into the 60s. 64 degrees in morgan hill and through gilroy.

we'll see a northwest wind at 15 late day in our eastern portion of the bay area. numbers stacking up into the mid-60s. 62 degrees once the clouds clear in stinson beach to the mid-60s in novato. we have some lingering showers this morning in lake sonoma and napa counties. otherwise in the mid-60s, the seven-day forecast, jules, that's still coming up. >> thank you, ro. yesterday's storm dumped more than a foot of snow in the sierra and the foothills, even got some unexpected snowfall. heavy wet snow covered the spring flowers in colfax at an elevation of just 2400 feet. people were surprised after no snow all winters but one man said the spring snow was inevitable. >> it wasn't supposed to get this low but i knew it was going to come down because my dogwoods are in bloom. last snow always falls when the dogwood blooms. >> the snow also caught some drivers off guard as they headed over donner summit. for example, a big rig driver from southern california was wearing shorts on the slopes at

valley. slow again once you hit the dublin interchange. antioch slow and go westbound 4. looks like it starts around hillcrest. you will see brake lights through there on the westbound side. eases up as you approach the eastshore freeway. we'll take a look at the san mateo bridge coming up. back to you guys. >> thank you. today the showdown begins in sacramento over a bill to eliminate most vaccine exemptions. anne makovec has more on the proposal and some controversial comments sure to rile up supporters of the bill. >> reporter: the bill would require that kids get immunized for diseases like measles and whoops cough unless the vaccine threatens their health. last night the berkeley city council weighed in. berkeley has one of the lowest vaccination rates in the state. the city council voted to send letters to california lawmakers demanding they close that vaccine loophole. that loophole allows parents to reject vaccines if they don't match up with their personal beliefs. >> it's very emotional to people on both sides of this issue and so i think they will remember political stands that are taken today.

>> reporter: the debate gained traction during the most recent measles outbreak in disneyland. california has one of the lowest immunization rates in the nation and the state is seeing increases in preventable diseases but the bill faces stiff opposition from parents, who say they have the right to decide how to care for their own children. it also has some celebrity backing. robert kennedy, jr., had some sharp words in sacramento at a screening of a film that links vaccines to autism. he said: >> robert kennedy, jr., plans to rally against the bill in sacramento. the senate health committee is only the first hurdle for this bill. if it passes there, it goes through three other panels and on to the state assembly. >> we have seen some other states try to pass similar bills. how did they do? >> not well. in fact, just last month, democrats in oregon and washington state tried to end vaccine exemptions. both efforts have failed. live in the newsroom, anne makovec, kpix 5.

supporters say san francisco's toilets on wheels program is going smoothly so far. the mobile solar-powered toilets are brought into the tenderloin neighborhood a few days a week. it's to provide places for homeless people to take care of human needs rather than on the sidewalks. supporters say the program has worked so well a few other cities have expressed interest. tour bus drivers in san francisco are about to be silenced. the board of supervisors voted yesterday to prohibit drivers from also narrating during bus tours. the ordinance is designed to prevent distracted driving. the move comes after a woman was killed by a san francisco tour bus last october. it is 6:08. the election for a san jose city council seat going to a runoff. 86% of the votes are in and tim orozco is leading the field of ten candidates with more than 22% of the vote in. mann nguyen is in second place

for the other runoff spot. winner of the special election could swing the balance of power on pension reform and other big issues. today in boston the jury beginning a second day of deliberations in the trial of boston marathon bomber dzhokhar tsarnaev. the jurors deliberated for about 7 hours yesterday. they have to consider 30 federal counts. during the trial tsarnaev's lawyer admitted his client took part in the april 2013 attack but says his late brother was the mastermind. three people were killed, 260 wounded. in massachusetts the case of former football star aaron hernandez is also in the hands of a jury. the former new england patriot is charged with the 2013 killing of a man who was dating his fiancee's sister. the jury deliberated for just an hour and a half yesterday after hearing closing arguments. new this morning, the parent company of shell oil has agreed to purchase bg group an oil and gas company in britain. the price tag $69.7 billion.

believed the victim knew the suspect and that the crime was not random. the victim was pronounced dead at the scene. a police officer in south carolina is facing murder charges after witness video appears to show him shooting a man in the back. as susan mcginnis reports, the death of another unarmed black man is adding to the outrage over police use of force and a warning, the images may be disturbing. >> not well. a judge ruled there is no appropriate place to house a sexually violent predator in solano counties. fraisure smith was sentenced to four years in prison in 1995 for assault with intent to commit rape. he later violated parole three times. smith was declared qualified for release from the state mental hospital in november of 2013. but he is still in the hospital because no appropriate home has been found. the proposed locations have either been too close to schools or too expensive. so yesterday the judge ordered smith to be placed in an adjacent county. a hearing on the progress of the search is set for june. berkeley is dealing with a sudden rash of home burglaries. the hardest-hit areas include francisco and grant streets, dwight way and ellsworth and woolsey and lewiston avenue. homes have been hit so many times notices are on polls. -- on poles warning neighbors to be alert. burglaries are up 220% from last year. in many cases, the victims could have taken steps to

prevent them. >> a lot of times people maybe are leaving valuables that they can clearly see from the street. >> berkeley police are sending out extra patrols. officers have made some arrests and in some cases stolen items have been returned. vice president joe biden is coming to the bay area this week to and it a political fundraiser -- to attend a political fundraiser in san francisco on thursday. on friday he will go to a pg&e facility in oakland. the vice president's wife is also making the trip visiting de anza college in cupertino. call it paul for president the sequel. this time it's rand paul entering the race for the white house. the kentucky senator's father former presidential candidate ron paul was on hand for yesterday's kickoff events in louisville. like his father, rand paul is a republican with support from many libertarians. he is calling for less u.s. involvement in other nations. >> let's quit building bridges

good morning. san francisco sun/cloud mix at 60 degrees. 50s at the seashore. 65 degrees in campbell. winds will increase out of the northwest 15 miles per hour after widely scattered morning showers. sunshine and clouds in the 60s north of the golden gate bridge. and 68 degrees today in cloverdale. investigators are looking into the cause of a fire that engulfed the top of a six-story building in l.a. firefighters had to rescue two people from upper floors by ladder last night. a reporter and a news helicopter described that scene: >> what makes this even more scary is that there are people inside this building calling the fire department saying that they are trapped in lower floors. >> crews have determined there was no one left inside the

building. one person being treated for injuries. the fire department says the building houses several different businesses. a bay area web company is making a surprising move to prevent gender discrimination. reddit says it's eliminating salary negotiations during the recruiting process. ellen pao is the interim ceo the san francisco company. she lost a sex discrimination suit against her former employee a venture capital firm, kleiner perkins. >> without a lot of of diversity on our team we do use more. we are excited to have different perspectives. >> she says men negotiate harder than women and women sometimes get penalized pushing for higher salaries. pao told the "wall street journal" we come up with an offer we think is fair. if you want more equity we'll let you swap a little bit of your cash ral i have for equity but we aren't going to reward people who are better negotiators with better compensation.

let's check traffic. >> reporter: it's business as usual for a wednesday morning commute. we are seeing some brake lights as you work your way along the eastshore freeway this morning. looks like slow spots away from the carquinez bridge as you head towards the maze. an extra 10 minutes for your ride this morning. slow out of berkeley into emeryville. over to the bay bridge right now, metering lights are on. slow-and-go conditions at the maze. we have a cameo from our special correspondent the spider on the right-hand side of the screen. traffic is backed up as you work your way through there. looking at your drive on 880 northbound. we have some pretty good conditions actually here. most of the brake lights along 880 are southbound as you work your way towards hayward. we have reports of an accident near 238 blocking lanes. you can see traffic is slow-and- go on our screen here as a result. so heading towards the san mateo bridge this morning give yourself some extra time. lots of red which indicates speeds under 25 miles per hour through there. once you hit the bridge you will see brake lights as well through that area. san mateo bridge slow-and-go on that westbound side headed out

pressure to build in from the pacific. once weather we get rid of the scattered showers we'll -- once we get rid of the scattered showers, we'll have dry weather through tuesday. everything is out of here by 1 p.m. and clear skies for the evening commute today. temperatures today into the 60s in throughout the central valley into the 40s in the greater lake tahoe area. currently it's 27 degrees and it's snowing in truckee. low 60s in monterey bay. here's your sun-up at 6:45. by the time it sets 50s and 60s close to average. northwest breeze 15 miles per hour. sunny thursday through tuesday. oakland a's baseball action, dress in layers cool in the 50s. >> thank you. due to the drought it's important to save whatever rain we get. reporter anjali hemphill shows us how some californians are capturing the water so it doesn't go to waste.

>> this is my water and i can do what i want with it. >> reporter: david is watering his plants the day before a big storm with rainwater he collected weeks ago. he built his rain recycler system himself by installing piping along his house that collects rainwater off his roof. and this pump helps direct it through his garden hose. >> it's incredible amount of water we get from the rain. i mean, it's like 18,000 gallons off my roof alone this year and we have only had two storms. >> reporter: he says it only takes half inch of rain to fill up his 1100-gallon tank overnight. >> there's a lot of water. when you see it, you know how much we're wasting. i expect these barrels to fill again and have water here to water this irrigation zone for the next few months. >> reporter: clyde says the rain doesn't put a damper on his online business blue barrel systems where he sells do it yourself rain barrels kits. sales have shot up since governor jerry brown ordered a 25% mandatory cut in water use. >> the phone is ringing and emails and sales are going. >> reporter: even a small storm brings in big business. >> particularly when there's a forecast of rain there's a feeding frenzy.

supports it. it voted last night to send letters to lawmakers demanding they close the "personal belief" exemption loophole in the current law. the new bill, parents would be required to vaccinate for diseases like measles and whoopi goldberg unless whooping cough unless it threatens health. >> it's emotional. they will remember political stands taken today. >> the debate gained traction during the most recent measles outbreak in disneyland. california has one of the lowest immunization rates in the nation and we are seeing increases in preventable diseases but this bill faces stiff opposition from people who say the vaccine is dangerous like robert kennedy, jr. who said the kids get the shot, that night they have a fever of 103, they go to sleep and three months later their brain is gone. this is the holocaust, what this is doing to our country." now, that bill still has to go through four committee vote, the full senate and then on on to the state assembly. live in the newsroom, anne
