other side we spoke with the carondelet student. she reported that she was sexually assaulted to the school administrators. >> to be completely honest, my school counselors have helped me a lot and my friends and just knowing that that in the long run i'll be okay. i can't stop this just because it happened. i need to show i'm not going to stop. it's not okay for this to happen to anyone and it's not okay for people around, like, society to make a person feel ashamed. >> contra costa prosecutors decided this afternoon there was not enough evidence to prosecute. they are leaving open the possibility should they get additional evidence. this decision comes as the young man was expected in juvenile court tomorrow. his family was fully expecting that he would have to face a

judge. we are getting reaction to this breaking story right now and have more at 10:00 and 11:00. >> thank you. another breaking story, this one in san francisco. a teenager has been seriously injured after a fall from a muni bus. it happened at powell and lombard at 4:30 p.m. the 13-year-old boy from san francisco middle school fell coming off a crowded bus. it's not clear if he stumbled or was bumped. our crew at the scene was told he hit his head on the curb. paramedics performed cpr and rushed him to the closest hospital. we are working to get an update on his condition. cars have been hauled away from an accident at one of san francisco's busiest intersections. lombard was closed at divisadero for more than 5 hours after the multi-vehicle crash in which one person died. this was the scene earlier. four cars collided one person killed. four others hospitalized. a witness says the white suv

blew through the light and slammed into the prius. the intersection just reopened within the past hour. new at 6:00 a heated fight putting dirt bikes against wildlife. a bay area county is suing to prevent expansion to an off road park. it's a showdown brewing for more than a decade. it would triple the size of the carnegie state vehicular recreational area east of livermore. critics think it could destroy the habitat for wildlife. da lin on the battle now headed for court. >> reporter: carnegie is one of the few parks in the bay area where people can ride dirt bikes, atvs and other off-road vehicles. the state wants to triple its side but alameda wants the state to slam on the brakes. the challenge of going down steep hillsides, dirt bike riders say the experience is unforgettable! >> usually they get to a piece of land like this you have to go up to mendocino or on the

other side of tahoe national forest. >> reporter: last month, the state voted to expand carnegie from about 1500 acres to 4600 acres. they are basically turning the pack next to it, tesla park, into an off road recreational park. >> that's wrong. we can't let that happen! >> reporter: celeste garamendi and nanzcy rod league are with the organization friends of tesla park. they say look at the trails and damage done to carnegie park. they say it's an environmental disaster. >> it scars the land. no matter how much they attempt to manage it or restore it, it's a destructive activity. reporter: the mining town of tesla is long gone but tesla park is home to rare species and native american sites. >> we are the small guys fighting the big state park system with lawsuits. it's our only recourse. >> reporter: but dirt bike riders say the carnegie expansion is a win-win

situation for everyone. they would only be allowed to ride on trails at tesla park. >> riders respect that. if they have a place they will ride on those rather than find an illegal trail and maybe do more damage. >> alameda county, friends of tesla park and other groups filed four lawsuits to stop the expansion. they want the state to preserve tesla park. in alameda county, i'm da lin, kpix 5. new at 6:00 a rematch of sorts today in the stadium showdown between the 49ers and the city of santa clara. the issue, whether taxpayer money is being used to pay the bills at levi's stadium. so are we any closer to an answer? here's what devin fehely found out. >> reporter: a team of auditors pored over financial records at levi's stadium for a second time today. their mission, to better understand the real costs and potential profits from events held at the stadium like this weekend's pac-12 championship game. >> they're not making informed decisions. >> reporter: that's because santa clara place founder says

the 49ers have refused to turn over the financial documents that are at the heart of the legal tug of war between the city -- >> we own the stadium. you cannot keep that information from us. >> reporter: -- and the team. >> no stadium in the country releases this information. >> reporter: kpix 5 has obtained a copy of this demand letter sent on behalf of the city to the 49ers outlining 15 financial documents they want the team to hand over in the next 30 days or else risk losing control of the stadium. it is just the type of transparency deborah says her organization has long been calling for. >> we cannot make an intelligent decision as a community, and i'm saying this as a taxpayer, i don't know how much that place costs to run. right now they are the fox in charge of the henhouse. >> reporter: the 49ers say big name concerts like taylor swift have generated more than $5 million for the city's general fund over the past two years. and they point to clauses in the same contract that say releasing, quote, proprietary

information would put them at a competitive disadvantage when negotiating new contracts with artists and concert promoters. >> it puts the city of santa clara and the stadium authority at a competitive disadvantage. all the profits from nonnfl events go directly to the city of santa clara. >> i understand their hesitation over the nonnfl events. but the people that they are protecting is us. if we as a city are willing to take that risk, it's our business not theirs. >> reporter: in santa clara, devin fehely, kpix 5. >> the 49ers have until a few days before christmas to hand over the documents. otherwise, the dispute will go to court probably. we are getting an inside look at the trashed san jose home where one of the bay area's most wanted a second escaped inmate made his last stand. just inside the doorway you can see the ceiling torn down. the santa clara county sheriff's office got word that rogelio chavez was hiding in the attic last night. they pumped the home full of

tear gas to flush him out. deputies eventually found him inside. he was high on drugs and had crack cocaine and marijuana on him. >> the only place to hide is either in a closet or in an attic. so they go to the attic in desperation. but it's like painting yourself into a corner. >> deputies also arrested this woman, charged with harboring a fugitive. the other escapee was arrested tuesday night. u.s. marshals got him. they escaped the night before thanksgiving by sawing through these metal bars using clothing knotted together shimmying down from the second story window. also in san jose, hazmat workers rushed to santa clara valley medical center to decontaminate a woman as she lay on the stretcher. she had been exposed to two chemicals both containing lead while she was in hollister. she is now in stable condition. there's been an arrest in a murder of a bay area dad shot and killed while cleaning up graffiti in san francisco.

kpix 5's jessica flores spoke with the victim's family today. >> reporter: jermaine jackson's daughter is painting him a picture. the 27-year-old father of two was shot dead in san francisco just doing his job. painting over graffiti at 25th and vermont streets. >> jermaine was a very good father. he was a great friend. we loved him in this community. >> reporter: his aunt says from their bayview neighborhood, his family is devastated. >> he had a bright future in front of him. you know, we really thought he made it out of this mess. and for him to be at work and someone to shoot him down, it's unfathomable. >> reporter: san francisco police today announced 26-year- old michael higginbotham has been arrested in connection with the shooting. they found the suspect in vallejo. >> it's bittersweet for us because it doesn't bring back jermaine. but yeah, we are relieved and hopefully justice will be served. >> reporter: jackson was an

apprentice with the department of public works since 2015 expected to graduate from the program next year. he was proud of his job. >> back at it again, man. >> reporter: posting about it on social media. his family says he got his life together for his two young children. >> and we don't know what we gonna say to the children. they don't understand. they just know that he didn't come home last night. and it's just -- hearing them ask for him over and over, you don't know what to say. >> reporter: his life taken while he painted. now his daughter working on a brighter happier picture for her father. in san francisco, i'm jessica flores, kpix 5. >> starting tonight, south san francisco police will have more help spotting bad guys. dog walkers will double as crimestoppers. police are training people who walk their dogs in the neighborhood to become that eyes an ears. they are showing people how to look out for suspicious activity and how to report it. but they also want to remind people not to try to chase down suspects themselves. new at 6:00, facebook's

compound may be expanding. in the works, a dorm so that employees can live close to work. but not everyone is on board with that. kpix 5 reporter len ramirez talked to neighbors, who have other ideas for menlo park. >> reporter: the approval of menlo park's updated master plan clears the way for facebook to expand. on the drawing boards a sort of company town on the bay front, hundreds of apartments and dorm style rooms for facebook employees all a quick walk or bike ride from the main campus. >> we need housing. i was just hoping it would be more mouse house. >> reporter: she is a teacher at bellhaven school and lives in the neighborhood. she says facebook has been supportive of the school donating laptops. but her feelings are mixed. >> i just wish menlo park had a lot more foresight into what their plans were when they considered having facebook build here. >> reporter: neither the city of menlo park nor facebook have responded to our emails and calls asking for comment on this story. but neighbors have been quick

to respond to questions about how facebook's expansion and future growth plans are affecting them. traffic and skyrocketing housing costs are the prices neighbors pay. >> yes, they are putting in money into menlo park but it's not for us. >> reporter: leslie ramos grew up in bellhaven and is raising her family here, too. she says if you don't have a facebook salary your days here are numbered. >> there's hard working people that live here for many years that are getting kicked out that are getting pushed away, you know, um, going to modesto, going an hour two hours away and that have to drive all the way here to work because they can't afford to live here anymore. >> utter irony of it is that facebook corporation its employees need those workers as much as the rest of us. >> reporter: the palo alto neighborhood activist says the housing crisis is a regional problem. >> to not have the spectrum of housing means low quality in the community.

pleased about that, too. susie, see appreciate it, thank you. another hot property up for sale. it could be a sign colin kaepernick's making a play to leave the bay area. his 4600-square-foot home in san jose is on the market. the price tag $2.9 million. among the features, there's the pool, outdoor dining room, second floor alcove with a glass bottom floor that looks down on the entryway. kaepernick restructured his contract with the 49ers in october so he can opted out at the end of the season home prices have gone down in the area. one city is the exception. john ramos reports. >> reporter: take a drive- through the solano county city of vallejo and you know what you don't see? a lot of for sale signs. there aren't a lot of homes on the market right now. it's a far cry from a few years ago when this area was awash in foreclosed homes. >> it took us a longer time to

come back to liven up after the downturn in the economy so in a way we have a lot more to catch up on. our prices are low so inventory took a time to absorb. >> reporter: right now it's a boom. data from the first nine months of this yearez over last shows bay area counties with at or near double-digit declines in home sales. san francisco sales have dropped a whopping 13%. >> we thought oh, the end of september, october, things seem to be calming down a little bit. >> reporter: this realtor says vallejo's market is more stable because of its affordability. this how is 2800 square feet with views of napa and sonoma counties in the distance. is listing price, $680,000. but that's expensive in

vallejo. and after a few months on the market, it's still had no offers. it appears the bay area feeding frenzy for homes is over. >> now we are seeing a balancing out and buyers coming in sellers more reasonable. >> reporter: will it hold? yes. unless it doesn't. because the only certain thing about bay area real estate is that no one really knows what will happen next. in vallejo, john ramos, kpix 5. bart is prepared to pay a fortune to make the system safe. the board approved a $267 million contract to retrofit the nearly four-mile tunnel. work is expected to begin in 2018. it will take two years. and yes, you can expect delays. let's get to the weather. paul, we have had rain disrupted by cold clear weather. >> we have the cold part down.

years ago is heading back to mark the anniversary.

a bay area man who survived the attack on pearl harbor nearly 75 years ago is marking the anniversary. he was on the arizona when it hit. as wilson walker reports his memories of that day are still vivid. >> here is the motion picture record released by the united states navy. >> the first bombs start, we knew what was going on immediately. >> reporter: 95-year-old lou doesn't need a newsreel to know what happened at pearl harbor. he was right in the middle of it. >> i was the quartermaster third class on the 7th of december and uss arizona. we only lasted, you know, nine minutes. >> here's the actual bombing of the mighty uss arizona. >> and we took the bomb down on the starboard side forward by number 2 turret and went through five decks into the lower handling room of the forward magazines and it blew up the forward magazines. that's where you see the blast.

>> reporter: 1,177 men died that morning on the arizona. and of the 335 survivors, only five are left. >> reporter: today he was given a grand sendoff to the 75th anniversary ceremony in hawaii but isn't traveling alone. he is taking the ashes of another arizona survivor who died earlier this year at the age of 92. >> five of us left and there's three of us are going to be buried on the ship with our ashes. >> reporter: and that, he says, will be his tribute to the men he considers heroes. >> they call us heroes. we're not the heroes. the heroes are the ones who gave everything and gave their lives that day. they are still there. we came home and got married, children, grandchildren, great- grandchildren and, um, so, uhm, we're just lucky. >> reporter: in san francisco,

the state assembly until 1992. then he was elected to congress where he now represents the 34th district. if he is confirmed xavier becerra would be the state's first latino attorney general. a woman accused of having sex with a student. corine audiat start communicating with the victim at the beginning of the year and according to officers their conversations became more inappropriate over time and then they had sex. audiat is on unpaid leave. she is charged with six felonies and a misdemeanor. >> it's an unfortunate incident. it doesn't reflect on washington high school as a whole. >> how are teachers reacting today? ? >> they are focusing on bringing back normalcy. >> the superintendent does not believe there are any other victims. a man with a shotgun opened fire on indian land in lake county killing a woman and wounding three other people.

police believe 24-year-old ezekiel bravo was the shooter. he is in jail charged with murder. authorities caught up with him this morning in clearlake a few hours after the shooting in clearlake oakes >> reporter: it happened here in clearlake oakes in that house behind me. it stemmed from a dispute between a husband and we have. she left her house and came here to hide with families. her husband bravo followed her. he walked into the home with a shotgun and a mask looking for his wife. when he couldn't find her deputies say he shot and killed the wife's aunt. shot an uncle and their 6-year- old daughter. then he tried to kidnap the wife's mother. she managed to get away and as sheriff's deputies arrived, bravo ran. they found him in a school six hours later and took him into custody without incident.

>> he is charged with murder, kidnapping, a number of violations regarding the use of a firearm in the commission of a felony and he is looking at some very, very significant charges. >> reporter: bravo is in police custody and he is not answering questions about this shooting deputies say. in lake county, emily turner, kpix 5. an apparent case of road rage ends in gunfire near the bay bridge. police say 21-year-old man was rear-ended as he was exiting the bridge in san francisco around 10:00 last night. he pulled over at fremont and folsom streets. that's when police say the other driver shot him. the suspect fled. the victim will survive. a first listen to the frantic 911 call the night rapper kanye west was hospitalized. what it is revealing about the concern for his mental health. >> and a legendary astronaut's emergency in antarctica. buzz aldrin's scare in the south pole. >> there's still time to vote in our snapshot poll. now.
