live from the cbs bay area studios this is kpix5 news. now know about christmas market terror in germany, new clues in the investigation tonight, what we now know about the driver who plowed into dozens of people. good evening. i'm ken bastida. >> and i'm veronica de la cruz. elizabeth cook has the night off. let's give you a live look on the ground in berlin right now. dawn is breaking. that is the semi truck that crashed into a popular christmas market. late tonight german police said the driver acted intentionally and they are investigating this as a suspected terror attack. at least 12 people were killed, 48 others injured. the attack happened outside the kaiser wilhelm church. all this happened after the u.s. called for calm in markets. kpix5's cate cauguiran with the moment the market turned to

mayhem. >> the witnesses told cbs news they had no warning and tonight the white house has condemned this as an act of terror. attack in nice, france last july this battered windshield gives us the look at the damage after an 18 wheeler turned into a deadly weapon. witnesses say the truck jumped the curb straight into berlin's christmas market packed full of people. >> i saw a truck barreling into a crowd of innocent people. >> i helped several other people lift the side of one of the stalls up so that they could pull two other people. >> wooden stalls were flattened. emergency crews struggled to reach victims stuck under the truck. >> i saw one guy being dragged away with blood on his face. >> german police arrested the suspect believed to be the driver near the scene and a passenger inside the truck was found dead. the truck was registered to a polish transportation company. the owner said he feared the vehicle driven by his cousin was hijacked. tonight kpix5 security analyst

and retired fbi assistant agent in charge jeff harp. >> a man carrying a gun is easy to spot because carrying a weapon on the streets isn't something that's ordinary. driving a vehicle on the street is something that is the ordinary. so it's much more difficult to predict which vehicle is the good and which vehicle is the bad. >> harp says americans traveling abroad to europe should expect tighter security and more check points as terrorist groups and sympathizers continue to make threats in the west. some would argue this is exactly what they want. they want to us feel uncomfortable in our own space. are they succeeding? >> people want to say to them hey, you're not going to impact us. you're not going to scare us. you're not going to cause us to not celebrate our christmas season. in the same breath people go out and they're concerned. so they are succeeding at striking some fear in us. >> u.s. officials said the

incident bears the hallmarks of the terrorist attack in nice, france, last july that killed 86 people and just last month the u.s. state department warned that extremist groups including isis and al-qaeda were focusing on the holiday season. cate cauguiran, kpix5. new at 11:00 just hours after the russian ambassador was assassinated in turkey, shots were fires outside the u.s. embassy in ankara. a short time ago turkish police arrested the suspected gunman. the embassy is in the same neighborhood as the art gallery where the ambassador's murder was caught on camera. it it was a -- it was a turkey police officer who opened fire killing russian ambassador andrei karlov. during the attack the shooter yelled remember syria, remember aleppo, a retired general from istanbul who now lives in the bay area says you have to remember russia and turkey are

historic rivals dating back hundreds of years and now they're on opposite sides of the syrian conflict. >> turkey has been at the forefront of calling for bashar al assad's ouster. russia in contrast has been his main defender. so this has led to a lot of tensions. >> tonight the u.n. security council is condemning in strongest terms what it's calling a terrorist attack. moscow is also calling this an act of terror. it's happened again, another shooting along a bay area freeway, this time on 580 eastbound in oakland near lake shore avenue. a driver shot up another car but missed the people inside. tonight kpix5's joe vazquez reports the chp says it's a case of road rage. >> reporter: it happened in the eastbound lanes of 580. the chp says one driver got mad at another following what the police describe as an obscene hand gesture. >> it happened very quickly in the blink of an eye. >> reporter: but it tied up

freeway traffic for hours. it started around 1:00 near the grand avenue exit where a honda and mercedes began angrily maneuvering around each other. >> we had a honda that was occupied by two people that apparently was tailgating a mercedes and tried to pass that mercedes. >> reporter: the chp says somebody inside the honda displayed a rude hand gesture. the driver of the mercedes then displayed a handgun. >> the suspect began firing towards the honda and striking the honda several times. >> reporter: nobody was hurt, but is this level of anger even worth it? >> i don't understand what could cause that kind of road rage where you'd want to pull out a gun. >> well, that's the only place where i will swear. i'll say that. >> reporter: when you're driving. >> yes. because people drive so crazy and erratic. >> reporter: but now you can't flip somebody off. >> no, i don't. i keep it to myself or scream inside the car. >> reporter: the driver of the black four door mercedes sedan got away. if he's ever caught, he could face attempted murder charges. if you have any information regarding the driver or the

mercedes itself, you're asked to call the chp. in oakland i'm joe vasquez, kpix5. a live look now towards san francisco, we are in store for another chilly night in the bay area. >> brian hackney alongside for chief meteorologist paul deanno tonight. >> we're not showing you frost and freeze advisories because they were lifted yesterday. tonight we will be below freezing at santa rosa, at freezing in livermore and fairfield. the bad news, though, air quality forecast is second day in a row spare the air alerts posted for unhealthful levels of pollutants in the north bay. so the temperatures come down to freezing tonight, something else going to be come down by friday. we'll have the details in the forecast in a few minutes. our water supply got an impressive boost from the biggest storm of the season. check it out. after last week's drenching many reservoirs are now above

average which is a huge difference from last year. the soggy ground may have contributed to a massive eucalyptus tree come down near the golden gate bridge on veterans boulevard right before the macarthur tunnel and san francisco's presidio. the chp raced to cut the tree branches blocking all three southbound lanes. in the meantime traffic was at a standstill for hours. they got the mess cleaned up in time for evening rush hour and no one was injured. it's official tonight. donald trump has cemented his win with the formal vote by the electoral college. here's the report. >> reporter: electoral college voters cop conveniented in state capitols across the country and officially voted donald trump in as the next president of the united states. >> texas now puts president trump over the top. cases of that disease have been reported at three palo alto schools. jordan middle school and gunn and palo alto high school. the district says it's following public health protocol. tonight a woman is in the hospital after getting wedged under a muni bus in san francisco. yellow caution tape surrounds the intersection on market and third streets where she was hit. it's not clear what led up to that crash, no word on the woman's condition. a major bay area crackdown on illegal ivory. 377 items were seized in san francisco in alameda county. the california department of fish and wildlife intercepted the contraband believed to have come from indonesia. they found ivory and dozens of statuettess like this one. the suspected -- statuettes like this one. the suspected smugglers will face charges. this photo shows black

plumes of smoke pouring from a complex on laguna street. firefighters rescued two people from a balcony after the fire blocked their escape route. the fire was out in about 30 minutes, but you see the damage left behind by flames. a girl at this complex was rushed to the hospital with smoke inhalation and is expected to be okay. >> the last minute rush is on to get last minute packages shipped for christmas, the deadline you need to know about. >> two thieves were caught on camera stealing christmas presents from a little girl. >> and how the oakland raiders are giving back tonight to special bay area kids in need for a happy holiday. ,, once i heard i was going to

police say somebody has vandalized at least eight cars in the past few weeks in north beach in russian hill. police say they've beefed up patrols in the area and are determined to find whoever is responsible. tonight the bay area judge behind a hotly contested ruling has been cleared of any wrongdoing. a state judicial panel has cleared judge aaron persky accused of gender and racial bias after sentencing an ex- stanford swimmer brock turner to six months for sexual assault. the judge still faces a recall effort that could be on the ballot next year. tonight we're getting our first look at the minivans of the future that drive themselves. chrysler says that it has just delivered 100 of these pacifica hybrids to google's self- driving car division. now workers at that division called wamo will install sensors on the corners and roof to help map the vehicle surroundings. the new fleet of minivans will begin testing on public roads next year.
