crowd, it is a standing room only crowd inside the board room of the fremont unified school district. you can see the open doors. some people are filing out already. most of the people there are speaking out, trying to lock the new curriculum from being adopted by the school board itself. parents against the proposed new sex education program started lining up three hours before special meeting of the school board and a crucial vote on whether to adopt the curriculum. >> i want to make it very clear that we are for sex education. but only at the appropriate curriculum at the right age. >> reporter: it puts a modern- day twist on the old 3rs. it stands for rights, respect, and responsibility. parents are against their fourth, fifth, and sixth graders learning about gender identity and sexual orientation. some parents were shocked by this book, saying it is

perfectly normal. the book, for 10-year-olds and up, shows full-color illustrations of people masturbating and having sex, it has been banned in other school districts across the country. >> reporter: unlike other school districts that wait until middle school, they have been teaching it since fourth grade for years. but now they must comply with the new state law. >> since we start teaching it, we need to talk about to the components of the law, which are about gender identity and sexual orientation -- and other topics that people feel should be for an older group. >> reporter: one supporter says that kids at that age already have sexual awareness and questions. >> at that age, i knew that i was not straight. at that age, one of my friends knew that he was not the girl that people were telling him he was. at that age, it is valid and

pavement condition index. 0 is terrible, 100 is perfect. anything below 50 is considered poor. san jose has plenty of them. to give you a frame of reference, this is considered to be poor condition, not horrible, but not great. this is full of cracks and potholes. this map published in the mercury news shows the worst of the worst. all of the roads with pci scores of 25 or less. but this is fleming avenue. the pci rating is 9 out of 100, it is near the bottom of the barrel. >> congratulations for having the crappy as road in san jose? >> i guess that's true. >> reporter: we have been covering bad roads in san jose for some time.

it took so long for the city to repave the notorious foxworthy avenue, that someone came and put up a sign the said pothole minefield again. there has been reduced funding since a great recessions, so small cheap fixes that have been pushed off have become expensive. >> we have not worked on local and neighborhood streets since 2011. >> reporter: that's right, the city is focused on major roads and have not repave the more quiet residential areas in 7 years, and it shows. thanks to voter approved measure b, money is being collected for street maintenance. the lawsuit is delaying spending on a huge 150 mile repaving program. >> once it is resolved, we are ready to hit the streets and implement the 150 mile program. >> reporter: as for stephen, the thought of one person's lawsuit holding up a city -- >> it is just a shame that

there are so many vested interests they get in the way of government working the way it should. >> reporter: san jose still has the budget to repave the roads. they're on track to repair about 100 miles worth of roads by the end of the year. all of the sales tax money is being held up in the courts, but money is being saved in an escrow account. as soon as the case clears, there will be millions of dollars. and they have a plan to spend the money on repave met. new at 6:00, the evening commute is in full spring backswing. in the rush to catch a ferry is getting more rushed every day. some commuters are out of luck until the next boat roles in. we found out the process is now underway to accommodate more riders.

the golden state killer case. in the north bay, authorities say there have been a rash of home invasion robberies link to marijuana. the latest what happened this morning at 9:30 on primrose court. officers say two men broke into a home, one of them came through the front door, the second suspect entered the back door with a gun and tied up one of the people inside. this is the sixth reported home invasion robbery connected to cannabis in sonoma county this year. >> since prop 64 was passed, where one is abundant in sonoma county. this adds to our rash of home invasion robberies. it is concerning for the neighbors were not involved in the marijuana industry. >> there were two people home at the time. no one was hurt,. students across the country and in the bay area staged a walkout today and a nationwide movement to support the second

snippers nest... just moments after the las vegas massacre. in our top story at 6:30, police releasing video inside the sniper's nest just moments after the las vegas massacre. we have a look at how police closed in on the gunman. >> reporter: it is pretty amazing. the body camera video shows how they stormed his mandalay bay hotel suite. officers burst through the door with the explosion. within seconds. a fire alarm goes off. the carefully entered the room. they found camera set up on a room service cart to monitor the hallway.

>> it looks like it could be a camera of some sort. take both of the cameras. get the camera on the body cam. >> reporter: inside the room, they found several weapons and ammunition and officers were entering the casino, they ordered everyone to evacuate. >> we need to everybody out of here. everybody out. everybody out. there is a shooter out there. he is shot and killed already. >> reporter: a huge building. imagine how hard that was. he opened fire from the 32nd floor. sending terrified concertgoers fleeing for cover. 50 people were killed, hundreds more injured in the attack. he was found dead from a self- inflicted gunshot wound.

on the body cam video, officers can be heard talking about the number of weapons inside the room. and about finding a gas mask. new at 6:00, the los angeles times is reporting san francisco's police chief, bill scott, is scheduled to interview for la's top job. he has been in command for less than 2 years after leaving the lapd. that is where he was deputy chief. when he arrived, chief scott spoke what is left for san francisco. >> my wife and i got married, and we talked about the places we wanted to live. number 1 on my list was the city of san francisco. >> they are not confirming or denying the report, saying that chief scott is focused on the city and its police department. we're joined now with more on how this could go over with the rank and file. >> reporter: so far, not all that well.

i have to tell you, veronica, from the moment chief scott arrived from los angeles, rumors were floating at the hall of justice that it would be a short time. that as soon as the top job opened there, he would be heading back. he has concentrated on reforms here in san francisco, but in recent weeks, rumors started to circulate again and when asked about them, the chief said that he remained committed to san francisco. were at least working here. that is the same response we're getting today with the report from the los angeles times. as city hall, they are wondering . he is not saying yes, but he is definitely not saying now. i spoke with commissioners and city hall sources in the mayor's office and no one has confirmed that he has come forward to say that he is interviewing for the job. there wondering what is happening as well as anyone else. a couple of things have changed since he was brought in. number 1, the city is on the way to reforming the police

department, but the mayor's unexpected passing has change the structure of city government. we have a contested election right now. we don't know who will be the next mayor of san francisco or how they will treat the police department. and in 18 months later, there will be another mayoral election once the term has completed. this is an uncertain time for all department heads, including chief scott. >> are definitely a lot of questions here. you always have your ear to the ground. what you think? you think other department heads could be leaving as well? >> as i said, it is very uncertain. nobody knows whether they have job security right now and the people down and city hall are telling me that anybody who gets a call from los angeles or anywhere else saying come down for an interview, chances are, they're going to take it. the future in san francisco is too uncertain. every time you get a new name -- mayor, there's usually a changing of the guard and this time, people might want to be ahead of the curve.

mid to upper 40s in santa rosa and napa. it is all about the flow from the ocean, which will be at a late -- light to moderate speed. a decent flow from the ocean sitting at 51 degrees. a cloudy morning and a cool breeze throughout the day. eyes will be mainly in the 60s to low 70s. mother nature's air- conditioning is returning. notice the storm going up and over the ridge of high pressure to our west. it will be a blocking rich. the storms will be there, but they will be blocked well to the north. this particular storm is moving away from us. the ridge will settle to our south, which means the flow will be southwest to northeast. that will keep us chilly and move in. this is the prediction for 7:00 tomorrow morning. most of the bay area in this picture is under cloud cover. watch it burn back to the coast rapidly. by 5:00, we all have sunshine. it will push back like a wave.

it is like a tide of clouds. we will see the clouds likely spilling back into san francisco bay and pushing in coming up on friday. the fog and low cloud cover will work its way into the east. the chili ocean breeze will keep temperatures near average. there is no rain in the foreseeable future, i will also keep us dry. how about average weather? look at concord, san jose, and oakland. exactly where we should be for this time of year. only san francisco is the outlier here. fremont, for you tomorrow, 70. dublin is 71. antioch, 78. 71 four san rafael. it will be a cloudy start. some sunshine and 64. highs are little bit warmer as you go to lake county. friday and saturday are more of the same. it 60s near the bay.
