working the story for months now. he is here with word of a major lawsuit. this 67 page complaint that was served today alleges that bank of america acted negligently and failed to protect tens of thousands of edd clients from fraudulent transactions as the civil lawsuit in a class-action lawsuit was filed today. >> this lawsuit is intended to be a wake-up call for bank of america. >> reporter: since last fall hundreds of thousands of edd accounts have been locked by either bank of america or the employment development department to weed out fraudulent, on the planet claims in suspicious activity. forcing legitimate recipients to call the bank. >> as soon as i told her there is fraud on my edd card, she said, i'm sorry, i am unable to

help you. >> there working to solve the they admit is at least a $2 billion fraud problem involving the debit cards. >> i want america to be accountable, i want our voices to be heard, i don't want to feel like i am second-class just because i have an edd card. and that is how they made me feel. >> reporter: the complaint filed in federal court alleges bank of america failed to provide basic security measures like chip technology for its edd debit cards. that they did not respond in a timely manner to fraud of customers and breached the contract with edd. >> i do think this is a very useful step forward in making sure that the bank is aware of just how serious the problem is, making sure that the public is aware of just how serious the problem is. >> reporter: he is back to work in real estate but says it is the principle of not having her case resolved that bothers her and worries others have lost much more. >> when i heard 4700 of these people lost, i'm thinking, what is the recourse for these

people? with families and rent to pay? >> tell me about some of the information you've gathered so far. >> yes, well, your reporting has been essential to our investigation. we believe that the damage in this case is in the tens or hundreds of millions of dollars because there were so many victims. >> we know that you have been in contact with bank of america since we first started reporting on this back in october. have you received any response from them? >> reporter: we have reached out to bank of america asking for interview multiple times since we first started reporting on this months ago. they did send us a statement today in response to the lawsuit that was filed, saying that it is working every day to prevent criminals from stealing money, while helping those legitimate benefit recipients to get their benefits. we are going to post the entire statement on our website, we are going to stay on top of this story, we are going to

hear from a person who was working with edd for years, he's got a compelling story, that will air on monday. now to the latest on coronavirus, only a third of california's vaccines have been administered. gov. newsom is addressing the slow rollout. >> we've got to increase the pace and distribution in the demonstration of these vaccines. the reality is we need to get these vaccines out of the freezer and into people's arms. >> santa clara county is trying to ramp up its vaccinations but as devin fehely reports, officials worry they might run out of their supply. >> reporter: the county was depending on the federal government to get them more shipments of the vaccine. but with the news that the federal stockpile has basically been depleted, county officials say they are increasingly alarmed with their supply and therefore the entire operation could be disrupted.

this weekend, i'll meteorologist joins us now with the other weather story, a big warmup. >> temperatures will continue climbing. today's highs were about 10 to 12 degrees above average in most locations, tomorrow's high temperatures are going to be even further above normal. let me step out here and make sure i kick the computer and it does what it is supposed to do. let's take a look at the high temperatures, anywhere from 7 to 10 degrees above average, 10 to 15 degrees above average as we had farther inland, and this will be the coolest day of the three-day weekend, so some very warm temperatures potentially record-setting in store for us by sunday and monday. back to the high surf advisory committee continues to 7:00 on saturday evening, 15 to 17 foot waves with some of the larger ones up to 20 feet and of course the ripcurrents and sneaker waves that go along with any high surf at event. we talk more about that, coming up in a few minutes. here is look at right

speech in sonoma county, warmer weather could draw more people to the coast. don ford says rescue teams will be on alert. >> this weekend's weather will be beautiful, the beaches will be magnificent. why are rescue people so nervous? warm temperatures are expected for the weekend making for a very nice beach weather, attracting folks to the shore. but the national weather service is sounding the alarm about very high surf. the sonoma county rescue helicopter will be patrolling the coast. >> don't be surprised if you are in a bad spot, probably here , me or another flight officer telling you to get back. absolutely. >> the danger is real. this is where three people lost their lives in the surf just last week. a father and two children. the children are still missing. lifeguards here will be here all weekend. >> standing on dry sand and waves will come up, they can grab you and you will be in 10 to 15 feet of water within

california sending extra security to the u.s. capital. 300 national guard members will be deployed this weekend, this as washington, dc, beats of security ahead of president- elect joe biden's inauguration. and possible protests from now until then. after basis ended for a little over one week, president trump's facebook and instagram pages are back up and running. this is how both pages looked at last check. facebook which owns instagram had initially bowed to suspend the presidents accounts at least until the end of his term. we recheck to facebook for comment but so far, no response. millions of dollars on

a special prosecutor has cleared six fully hope police officers of criminal wrongdoing in the shooting death of rapper willie mccoy. a special prosecutor determined lethal force was justified. police say he was sleeping in his car with a gun on his lap at a taco bell drive-through in 2019.

officers claim once he woke up, he reached for his gun, so they opened fire on his car, hitting him 38 times. the family attorney insists new video shows him reaching for his gun, and his race played a factor in that shooting. police have arrested a man they say opened fire on police officers. 27-year-old of san jose was reportedly firing shots on the street corner early this morning. when officers showed up, based day he shot at them. nobody was hit, but he then ran into a nearby home, a standoff lasted for several hours, the suspect eventually surrendered. oh, they include the boss coley ctr., san francisco wholesale produce market in the bayview, and the one at city college could open by the end of next week. contra costa county says it is not considering any idiom style mass vaccination rights just yet. right now the county only gets

12,000 doses from the state each week but it does not have a logistical capacity to inject much more than that. 36,000 doses have been administered. bay area-based delivery at insta cart says that it's will help pay for its workers to get covid-19 vaccines. meanwhile, trader joe's says it will pay its employees extra to get vaccinated. the grocery chain says that will also shift schedules to make sure that employees have the time to get the shots. the city of alameda is launching feed alameda, the new program to support local restaurants and people impacted by the pandemic. starting january 20, the program will pay local restaurants to provide 90 meals per week to alameda's homeless individuals. women and children at midway shelter residents at the fema trailers, and those who use overnight parking areas.

and rain, roughly equivalent over the next few days but there is better news down the line in the extended forecast so i don't want to leave you hanging with that. let's take a look at the weather headlines, fog tonight but it's will not be as widespread as the past few nights and early mornings. drier weather is going to continue throughout the weekend, dry unseasonably warm weekend with near record high temperatures sunday and monday. we keep track of that for you and then an elevated fire threat develops monday and tuesday because we are going to see very gusty wind picking up sunday night into monday, continuing tuesday, combined that with low committee levels and those very warm temperatures , that is a bad combination. the good news is the fire fuels, the grass is vegetation, not as crispy as they were back in the fall and summer but

still something we have to watch. a high wind watch in effect from 10:00 sunday evening through 6:00 on monday but i think they will have to extend that into tuesday because it does not look at the wind will die down until tuesday evening and our fire danger index, fire weather index, does show an elevated fire threat for the north bay mountains and the east bay hills as we head into sunday night early monday morning already, with the strongest wind and the driest air actually kicking in a little bit later in the day on monday and continuing into tuesday so that is something we will have to monitor very carefully. right now temperatures still in the 60s and a few spots to bring down to the 50s but otherwise low to mid 60s. over an hour after the sun has gone down. temperatures are mild in petaluma for stormy weather. temperatures dropping off steadily, they look like they're ready to go for a walk, does prevent something reflective and enjoy the mild temperatures. temperatures start off in the 40s tomorrow morning but then we warm-up rapidly, low to mid 60s across the board already by noon, with high temperatures tomorrow afternoon along the coast right around 60 degrees
