working the story for months now. he is here with word of a major lawsuit. this 67 page complaint that was served today alleges that bank of america acted negligently and failed to protect tens of thousands of edd clients from fraudulent transactions as the civil lawsuit in a class-action lawsuit was filed today. >> this lawsuit is intended to be a wake-up call for bank of america. >> reporter: since last fall hundreds of thousands of edd accounts have been locked by either bank of america or the employment development department to weed out fraudulent, on the planet claims in suspicious activity. forcing legitimate recipients to call the bank. >> as soon as i told her there is fraud on my edd card, she said, i'm sorry, i am unable to

help you. >> there working to solve the they admit is at least a $2 billion fraud problem involving the debit cards. >> i want america to be accountable, i want our voices to be heard, i don't want to feel like i am second-class just because i have an edd card. and that is how they made me feel. >> reporter: the complaint filed in federal court alleges bank of america failed to provide basic security measures like chip technology for its edd debit cards. that they did not respond in a timely manner to fraud of customers and breached the contract with edd. >> i do think this is a very useful step forward in making sure that the bank is aware of just how serious the problem is, making sure that the public is aware of just how serious the problem is. >> reporter: he is back to work in real estate but says it is the principle of not having her case resolved that bothers her and worries others have lost much more. >> when i heard 4700 of these people lost, i'm thinking, what is the recourse for these

people? with families and rent to pay? >> tell me about some of the information you've gathered so far. >> yes, well, your reporting has been essential to our investigation. we believe that the damage in this case is in the tens or hundreds of millions of dollars because there were so many victims. >> we know that you have been in contact with bank of america since we first started reporting on this back in october. have you received any response from them? >> reporter: we have reached out to bank of america asking for interview multiple times since we first started reporting on this months ago. they did send us a statement today in response to the lawsuit that was filed, saying that it is working every day to prevent criminals from stealing money, while helping those legitimate benefit recipients to get their benefits. we are going to post the entire statement on our website, we are going to stay on top of this story, we are going to

still something we have to watch. a high wind watch in effect from 10:00 sunday evening through 6:00 on monday but i think they will have to extend that into tuesday because it does not look at the wind will die down until tuesday evening and our fire danger index, fire weather index, does show an elevated fire threat for the north bay mountains and the east bay hills as we head into sunday night early monday morning already, with the strongest wind and the driest air actually kicking in a little bit later in the day on monday and continuing into tuesday so that is something we will have to monitor very carefully. right now temperatures still in the 60s and a few spots to bring down to the 50s but otherwise low to mid 60s. over an hour after the sun has gone down. temperatures are mild in petaluma for stormy weather. temperatures dropping off steadily, they look like they're ready to go for a walk, does prevent something reflective and enjoy the mild temperatures. temperatures start off in the 40s tomorrow morning but then we warm-up rapidly, low to mid 60s across the board already by noon, with high temperatures tomorrow afternoon along the coast right around 60 degrees
