partly sunny inland in the low 60's this afternoon. as we go hour by hour on future cast and you can see the showers pushing out of here and we are looking at a little bit of sun later on today. partly sunny to mostly cloudy. we will talk more about what you can expect, how long this little break will last from the rain and when we will see the next weather system roll in just a few minutes. be careful if you hit the roadways. it's definitely wet out there. live look at the bay bridge toll plaza. metering lights turned on. we are seeing some slower speeds across the upper deck of the bay bring. not brake lights just yet. that will likely change. more and more cars on the roadway this morning. also a couple of new hot spots to report. new crashes south 680 at stone ridge. another crash northbound 680 around pleasant. heads up there if you are taking 680. we have the brake lights building in to the pass. still a busy ride out of tracy as you get onto 580.

there's also some troubles for bart this morning. ann has more on that. >> yeah. we are still trying to figure out what was on fire. our photographer just arriving on scene and seeing a lot of emergency vehicles. we will take you live right now this is the near the el norte station where all bart trains are being stopped this morning. as of about 45 minutes ago. now bart has just said that it is trying to recover from this. as far as we know they still have a bus bridge right now on that richmond line. no service right now because of some sort of fire in a commercial building between el sorito, and richmond. want to take you there live again. you can see some is smoke there so we don't know what exactly is on fire trying to find out more about that but what will affect a lot of you listening right now is the bart delay

that that continues to cause right now. we know it is a commercial building on fire. that is all we have right now near the el sorito, station. we are going to watch everything going on over there. back to you. > with. the post holiday covid surge is hitting the united states hard. the number of news cases has tripled in the last two weeks. right now california's testing positive rate is almost 16%. that's up from nearly 10% last week. one of the biggest spikes happening in the state is right here in the bay area. justin andrew is live in san francisco this morning and restaurants are temporarily closing because of this. >> absolutely. so many of them are reporting cases among workers. they have no choice but to shut their doors because they don't have enough workers with the number of people who may come in. des say that morin effects could becoming next week. we looked at the numbers, specifically for

hospitalizations that were last updated on december 29th. 63 people are in the hospital with covid in san francisco. that's up from 24 at the beginning of last month. for clarity this morning that number is still muchlower than 220 we saw this time last year. there are so many restaurants across the bay area who are seeing the results of this. one of them report that 25% drop in reservations and they are not the only ones. others also are closing due to the surge. restaurants say they are doing this as a precaution to protech its safety and well being of their workers and guests. restaurant workers have been stretched very thin lately. >> i kind of do everything like i'm serving, bartending, working just because of so few of us that are left had a few t positive so we have been short staffed. >> some of those bay area restaurants who are remaining open will require you to show proof of a booster shot in

order to dine in. we are live in san francisco this morning. kpix5. and happening today san mateo county is reopening a vaccine clinic on saratoga side. it is for age groups 12 and up. it includes first and second doses and boosters it. will be open tuesday through saturday. doors open at noon. and this morning stanford is reporting this very 146 new infections. those students are now isolating and campus housing. 740 weeks of surveillance with 514,000 student tests has resulted in 593 positive results. >> we will reverse the mandate itself. take a look. this was the scene over at the state capitol yesterday. hundreds protested the governor's proposed covid mandates for children. the state won't put it in until a vaccine gets full approval. in just about 24 hours we

help people who are homeless and using drugs and said she would request more police overtime to crack down on crime. a majority of the supervisors supported her emergency announcement after a hearing on it. there has been backlash and claims by critic that the mayor is planning a police crack down. today's supervisors will consider whether to hold another hearing and whether to withdraw their support. community activists are planning on holding a news conference against her plan. that plan is expected to be discussed at the supervisors meeting around 2:00 p.m. today. of course we will stay on top of it. for now i will send it back to you. >> all right. thank you. list beck holmes is now a convicted felon. a jury found her guilty of four conspiracy and fraud charges for swindling her investors. one legal expert said that this case is far from over. >> i'm sure she has been preparing herself for a while on this. you know the conviction is not final until the appeal is final. we have some time. you know appeals can take a

year or two. >> holmes faces up to 20 years for each count. out of 11 charges the jury found her guilty of conspiracy to defraud or invertors and guilty of wire fraud. she was acquitted of four other charges. before her company started to unravel holmes promised her blood testing device could detect hundreds of diseases and health issue was just a finger the technology never delivered and it was never accurate. developing in san jose this morning police are looking for suspects in a double shooting. officers were called north first and east rosemary streets last night. investigators say a man and a woman were found with a gun shot wounds. both victims are expected to survive. police are still looking for the gunman. so far no word on what led to the shooting. still ahead, thousands still without power in the

happening now, thousands of people are still without power this morning in nevada county. its been that way for more than a week after a major storm topped trees and knocked town power lines. the county has now created fire wood stations with so many people stuck in the cold the rule is to take only enough for three days of home heating. >> my house is 48 degrees right now inside. i hope i can go warm it up. i hope this catches fire. >> trying to survive. that's the every day thing. >> it's within a whole week. it's not expected to come back any time soon. >> pg&e said that it has finished assessing all nevada county power line damage. sea for the utility has not given customers specific times for when that power will be restored. in southern california a traffic nightmare in the snowy mountains, cars illegally parked on the roads. causing a major traffic jam.

dealing with. i will show you the reason why. taking a live look in el s, rito. you can see there is a fire that is raging right now. this is a commercial building and it looks like it was an abandoned building. that is the good news here. no word on the cause. you can see the flames there as firefighters continue their fight right now. the problem is that this is right near the richmond bart line. that caused basically all trains to stop running through the area for almost an hour. it looks like trains are running again but there are those delays this is on san pablo avenue. the fire breaking out just before 4:30 and a lot of firefighters responding there to the scene. they have been having a rough go at it as it does continue to burn. it looks like maybe a hot spot roared up with in the past ten minutes or so. we are keeping an eye on that again. bart service getting back to

normal. several some trouble there on spablo near the station. back to you. do you have any reaction to your guilty verdict here? >> after a marathon trial a jury found elizabeth holmes guilty of fraud. why legal experts say this is not over yet. >> that's right. experts say the former ceo can still fight this and it's expected that she will. after a four month trial a jury of eight men and four women found holmes guilty of conspiracy to defraud her investors and guilty of wire fraud. the jurors came back dead looked on three and acquitted her of four other charges. holmes promised her blood testing device could detect hundreds of diseases and health issues with just a finger it didn't deliver now it took jurors seven days to reach the verdict and in the end ruling she defrauded investors of millions of dollars but didn't mislead patients and doctors as

to the arc ccuracy. she faces up to 20 years for each count but the legal expert was in the courtroom when the verdict was raid and as she explains this isn't over yet. >> i'm sure she has been preparing herself for a while on this. you know the conviction is not final until the appeal is final. we have some time. you know appeals can take a year or two. >> you heard hagan. it is not every until the appeal is over. we may be looking at a year or two before anything is done in terms of a sentence. now back to you. now to the correspond inspected hospitals in napa are out of icu beds. the counties emergency services coordinator said that infections among health care workers adding to the crisis. she said the current surge is driving more patients to the health care system. it's also impacting staff. when staff is infected covid they can't come into work and care for patients which can cause strain on the health care system.

and taking a live look at san francisco which now has the third highest covid transmission rate in the state. right behind los angeles county. health data shows about 600 new cases a day in the city. justin andrew is live in san francisco this morning and you have been going through all of this data. >> the last time numbers were updated was on december 28th and that showed that about 1,447 new cases in san francisco that day alone. doctors telling us things could get worse come next week. those were last update dated on december 29th. that shows 63 people are in the hospital with covid in san francisco. that is up from 24 at the beginning of last month. though that number is still much lower than the 220 we saw this time last year. restaurants are reporting cases among workers. the rate so alarming they say they have no choice but to shut

down for now. some popular restaurants reported a 25% drop in reservations. restaurants say they are doing this as a precaution to protect the safety and well being of workers and also their guests. restaurant workers have been stretched very thin lately doing the job of really just three people. there are some who are staying open but they are requiring booster shots in order to dine in. >> it'll be situation of managing a case here and there. then when omicron came it came with a vengeance. >> vaccines still protect us against serious disease and this is hopefully going to exit very quickly. >> doctors say after this surge we should be at community immunity and that will provide relief they say. they also warn us that it is until the next variant pops up. we are live in san francisco

this morning. i'm justin andrews. and all over the bay area people are in a rush to sit and wait for post holiday covid test. we spotted this long line at one site in heyward. far south a long line of cars snaked through the drive through test site at the fairgrounds. health officials say they are rushing to add more testing capacity. it's a similar problem across the country. over in texas, more than a third of all tests are positive as people wait in line for hours just to get swabbed. in new york, hospital cases are above 94500, passing the all time high from last march. today the president will meet with the white house covid response team and then address the american people. we have breaking booster news right now. the cdc just announcing that it has cut the time between the two dose and the booster shot for pfizer to five months from six months. that makes that official after

the fda recommendation yesterday. also hearing the cdc could update the recommended isolating period as soon as today that got slack since cutting it from ten days to five without recommending a test before people leave quarantine. we will see if there is any movement on possibly adding a testing part. tomorrow the cdc could put its stamp of approve alon the fda recommendation. yesterday recommending boosters for kids between the ages of 12 and 15. that coming tomorrow. we will watch that back to you. and time now is 6:38. going live to the big board the opening bell ringing just minutes ago. the dow is up in the green about 225 points this tuesday morning. the united states economy is entering the new year with significant momentum. average weekly jobless claims near historic lows and the unemployment rate was just 4.2% in november. the economists say there are at least four risk factors to

monitoring the covid numbers and doctors say they will keep climbing. we looked at the numbers from hospitalizations. reveal that 63 people are in the hospital with covid. that's up 24 at the beginning of last month. though that number is still much lower, than what we saw this time last year. that was sitting at 220. san francisco now has the third highest covid transmission rates in the state right behind los angeles county and that last updated december 28th shows 1,447 new covid cases in san francisco that day alone. restaurants reporting cases among workers at a rate so

alarming that they are forced to shut doer their doors for at least now. there are some bay area restaurants who are open but they will returner are irpeople to show proof of a booster shot. live this morning in san francisco, supervisors may reconsider support for the announcement of emergency in the tenderloin. the mayor promised to open a center for people who are homeless and using drugs. she also said she would request more police overtime to crosswalk down on crime. now about two weeks ago a majority of the supervisors supported her emergency announcement after a hearing on it but there's been backlash and claims that the mayor is planning a crack down. today's supervisors will interest whether to hold another hearing and if to withdraw their support. community acts visits are planning on hopping a news conference against the plan and

that plan is expected to be doesed at the supervisors meeting around 2:00 p.m. today. we will betray staying on top of it. back to you. the live news desk. going live to el sorito because of a fire that broke out here at an old taco bell restaurant this is on san pablo avenue. there was fire coming through the roof and they were afraid it could spread to the tracks. bart stopped its trains at that point. the taco bell had been closed for about five years but firefighters say there is the second fire there. no word on the cause of this one. people have been reported inside looking for shelter though it is fenced off. the building was set to be destroyed any way. there are apartment that will be built there. a big mess to clean up. firefighter also be on scene there. are some road closures in that area near the el sorito bart station. it'll be in effect for. next few hours when it comes to
