crammed into times square. >> it is a chilly night >> it is frigidly cold, but in the nation's capital, no one's breaking out the champagne. at least not in public. >> it looks like i'm gonna be spending new year's here in dc. congress fails to meet its the fiscal cliff. the u.s. will go over the fiscal cliff tonight at midnight. because of a decision by the republican- led house of representatives to adjourn until tomorrow. and yet despite this decision, we are hearing that. though a day late. congress and the white house have reached a deal. kron 4's dan kerman is here with the very latest on this developing story. >> reporter: the bush tax cut expire at midnight, and if nothing is done, taxes go up for middle class americans. that is what everyone is trying to avoid. late monday evening vice president joe biden and senator harry read headed to the capitol to brief democrats on a deal worked out between congressional leaders and the white house to prevent across the board spending cuts and tax hikes. >> i think that this is a

modest goal that we connect ambush. democrats, republicans in congress set to get this done. this is a modest goal that we can accomplish. >> reporter: for a tax hike for couples earning more than 450-thousand dollars a year. that's a compromise. between what the president wanted and what republicans wanted. the deal also calls for the extension of unemployment benefits and sources say the deal also delays by two months the automatic across the board spending cuts. that two month delay will end up being payed for half with tax revenue and half wiwith spending cuts. for some this is a way to get this legislation through. for others it's a matter of kicking the can down the road. and delaying the tough choices for another day. now the senate is expected to vote tonight, if they can get the bill drafted in time. if it passes it goes to the republican-controlled house of representatives. they are due to meet tomorrow at noon eastern

time. at this point it is unclear if house leaders boehner and cantor are on board. so while there is optimism tonight, we could end up going back to the drawing board if the house votes this down tomorrow. the other big story tonight. the big celebrations in the bay area and around the world. for new year's eve! this was the scene in the bay earlier today. where crews set up the fireworks show on a barge. 5-thousand fireworks will set off into the sky over the bay. all choreographed to music. some can go as high as 1- thousand feet into the air. let's go live now to davies symphony hall in san francisco. and kron-4's catherine heenan. who is getting ready to host kron- 4's "new year's live" pretty in pink. >> this is billed as the most glamorous party in the city with music, champagne and a symphony performance. it is a very, very nice party. gary radnich and i will be here and we are going to be celebrating with sydney, australia, and

quite a shock for one bay area man who bought a car off criagslist. as kron-4's scott rates explains. it turns out his shiny new ride. had actually been stolen from someone else. >> i just cannot believe it. >> patrick moore is holding a title of looks real. this chrysler 300. it proves supposed to be his daughter's new car. >> i have the papers. >> reporter: patrick thought that he did everything right. after finding his car on craigslist he agreed to find it this owner at a nearby shopping mall. >> we spoke on the phone >> reporter: he drove it back to his home and paid him in cash. he was able to snap this photograph. just before this man and left with 30,000 of dollars. >> today, when i went to aaa. >> the provided the vin

this evening police in oakland are still looking for the gunman who shot and killed a teenage girl. the murder, that happened on sunday, marked the city's 131st homicide of the year. kron 4's j.r. stone is following the story and spoke with the police chief who is pushing several new crime fighting initiatives. >> this senseless act of violence >> reporter: a deadly shooting brings a violent end to what has been >> watching 12 young people get murdered this year is here, does hearted, discouraging and embarrassing to this city

oakland. john r. stone, kron 4 news. >> this deadly shooting brings a violent and to a violent year in the terms of a violent year in terms of jose. this morning. police were called to the sprawling summer breeze apartments on lewis road where a manwas shot and killed in the parking lot. police did not immediately identify the lone, male victim and wouldnot discuss any possible motive, except to say it is not thought to be gang-related. two people were detained for questioning in the city's 46th homicide this year, compared with 40 last year. that would be the most since 1991 when there were 53. the woman accused of crashing into several pedestrians, killing one, near san francisco's twin peaks lookout point earlier this month pleaded not guilty today to vehicular manslaughter, d-u-i and hit- and-run charges. police say gina eunice fatally struck a 56-year- old woman on december 20th. prosecutors say eunice had arraignment had a blood alcohol content of point-2- 3 at the time of the collision. eunice is being held on one million dollars bail. she will be back in court on january 14th.

for the new year got a little bonus today. the folks at goodwill held a donate-a-thon at their main location on mission street in san francisco. those who came to give away their old belongings were assisted by those dressed as popcorn. the first 400 people also got free passes to the zoo or movie tickets. event organizers say this is to thank people for their donations, which they call the lifeblood of their >> what these donations to his support our missions. we of a digital literacy program you can learn how to use e-mail, microsoft office these are free. our mission is to put people back to work. your donation helps people get employed or perhaps for the first time. goodwill estimates that close to 4-thousand people will donate today at their 34 drop off locations in san francisco, san mateo and marin counties. that's double their usual number. >> jacqueline: some rainfall

now for today's market update. stocks close out the year strong. fueled by progress in budget talks in washington. on wall street. the dow jumped 166-points to end the year above 13- thousand. and snap a five day losing streak. the dow gained seven percent fo the year. the nasdaq gained 59-points to finish out the year above 3-thousand. and the s-and-p-500 rose 23-points. insurance giant a.i.g. is thanking the american people for the nearly 200- billion dollar bailout it received. but, the company also wants taxpayers to know the u-s treasury made a multi- billion dollar profit on the loan. according to a new "thank
