but it appears the fight may be over for now. house republicans appear ready to drop their fight to defund the president's health care law, and pass a continuing resolution to keep the government funded. so while the government may be fully up and running on october 1st. an even bigger deadline is approaching on october 17th. the u.s. government will hit it's debt ceiling and need approval from congress to raise it. top republicans say they will use that opportunity to try and stop the affordable care act.

to fix the problem kron4's will tran has been following a story of a deadly stabbing all morning long. >>will: we will have a news conference in 90 minutes from now. we will try to bring it to live as it happens. thin the meantime i'm corresponding with police chief greg serve. he says at this point he doesn't know the motive behind the murder and what led up to the altercation. here's video of the scene. it happened at third and perry at about 1143 if this was the time of around when the giants came to get out. for some reason. up to zero groups of men got into an altercation. be a victim was in fact wearing dodgers gear. he wasn't sure if the attackers or wearing giants but they did tell me that overnight three people were detained. they are saying are rats have been made. they are calling them suspects in this case. we

after 51 year-old david lamont was badly beaten early saturday morning after police say he approached a group of people outside his home who were making noise. lamont's wife then found him lying unconscious- unconscious in the street. people have identified the four people who were there during the assault. at this point they're not calling that person a suspect. authorities said the other three juvenile are considered witnesses to the incident. police are not releasing any more information on these four people but said they are cooperating with the investigation. what police are now calling on any of those four suspects at this point they say there's no evidence to suggest anyone was at the scene-else was at the scene during the attack. david lamont remains in critical condition this morning but police are hoping at some point his condition improved so they can ask him what transpired early saturday morning.

kron4's mike pelton is alive at the pleasanton police headquarters with the latest of the man in the tent. >> police have identified a police-does a person of interest. an 18 year-old to they say does not live in this area. this is this person of interest is among a group of four people have been identified as being at the scene when this attack took place early saturday morning. that was when 51 year-old david lamont was viciously beaten after police say he approached a group of people outside his home when they were making noise. his wife found him lying unconscious in the street. they are naming the 18 year-old as a person of interest in the case but at this point not a suspect. authorities said the other three are juvenile and are considered witnesses to the incident. they also attend the schools in the area. they are cooperating with

>> a south bay teacher will be arraigned today for allegedly having sex with a student. school officials say.hugo cortes guzman.taught math at santa clara high school. on monday, they received a tip that he had a sexual encounter with a 17-year-old student. an investigation was launched and guzman was arrested a day later. at this point police believe there is only one victim. but their investigation continues. guzman will appear in santa clara county superior court around 1:30 this afternoon. >> a new legal claim accuses officials at the mount diablo school district of failing to report suspected child abuse by a teacher who is now charged with molesting numerous students. the claim on behalf of seven alleged victims of joseph martin, alleges a 2006 district report found martin may have abused children. but the claim filed last week says district officials at the time did not report the findings to police. martin has been charged with over 100 felony counts involving 13 fifth-grade boys. he has pleaded not guilty.
