top stories we are following on this friday october 4th. destructive winds overnight knocking down power lines and trees across the bay area. here's video out of the east bay this morning. a tree came crashing down near diablo and blocked a roadway. a big cleanup is now underway.

a san jose family of six escapes an overnight house fire that investigators say started in the attic. the fire on foothill court. just off of highway 87. was called in around 2-30 this morning. the fire department believes the fire got a good head start because it went undetected for quite some time in the attic where there are no smoke detectors the mother was up at the time and smelled smoke and woke up the family to get out. none of the surrounding homes were damaged. a bail hearing is being

held today for a man who ran an black market drug website. ross william ulbricht is accused of being the mastermind behind "silk road". a website that allowed users to shop anonymously for illegal drugs like heroin and l - s -d. it is believed the site made more than one billion dollars in revenue. the 29 - year -old was arrested here in san francisco.as he was chatting online in a public library. ulbricht also faces a

charge in maryland of arranging to hire someone to kill a witness. a former high school student faces life in prison for a sexual attack he called a "prank". a jury convicted 21 - year- old david velasquez of trying to kidnap and rape a teacher at a redwood city high school. it happened in january of 20 -12.when velasquez pointed a knife at a teacher outside a school and attacked her. velasquez is being held on one million dollars bail.and faces sentencing in november. ♪ detroit tigers in the *first detroit tigers in the *first game of at kaiser permanente we've reduced serious heart attacks

the initialed chp reports. then that person was struck by at least one of possibly two vehicles and there are several other vehicles pulled over at the scene. originally, only the right lane was available and the right shoulder and now the chp reporting to lanes are available east bound. look what it's doing to the westbound a ride back it up towards estacio and the commute direction. so 580 is the freeway to avoid in either direction east bound for westbound. use the nimitz freeway in said. still rolling pretty well.

>>darya: happening now. a grass fire burning near lake berryessa in napa county. the fire department says 500 a. have burned so far. the blaze is 75- percent contained this morning. and firefighters have stopped the forward progress. strong winds of 50- miles an hour are pushing smoke down to the bay area. the smell of smoke from the fire has been reported as far away as downtown san francisco. the blaze was reported around 8:15 yesterday evening near the

32-year-old hugo cortes guzman taught math at santa clara high school. his victim was a 17-year- old student. the two had a sexual relationship that began in september of last year when the girl was sixteen. guzman faces four counts of sex with a minor. he'll face a judge at 9:00 this morning. the san francisco department of public works is investigating why it had no idea a field maintenance worker had no license. department officials say

they didn't learn that the employee's license was suspended until the employee drivinga dpw vehicle collided with another car at the intersection of cesar chavez and valencia wednesday morning. there were no serious injuries in the accident. public works says it is also looking into whether the employee ever told a supersivor that their license had been suspended which is protocol under that circumstance. we begin coverage of this top story -- the accident involving the car hit by a d-p-w truck.

the san francisco department of public works says it's investigating why it was in the dark in regards to the employees license status. public works says it didn't learn that the employee's license was suspended until after the crash happened. public works says at around 11 o'clock wednesday morning.

the >>george: traffic and the westbound direction still backed up and from time to time we've had the left lane block the westbound by emergency vehicles. they've managed to get four of the lanes open on the eastbound side of this major injury accident on interstate 580. chp told me that originally this report which came in just about an hour ago was of a pedestrian and running in the roadway. they believe that this mail entered the roadway the dead-mail entered the roadway and there were reports this person was reported running and the lanes. it quickly turned into a major injury accident and that's what we're dealing with. use interstate 880 instead of 580 with your east bound or westbound print used

the mother of 34-year-old miriam carey says her daughter had no history of violence. the woman set off a high- speed car chase yesterday, putting the capitol on lockdown. officers arrived at her relative's home in brooklyn, new york, last night.trying to gather information. neighbors of the woman say they are shocked. a toddler in the car with carey was not injured in the incident. the officer hurt in the pursuit is expected to be okay. >>james:in just a few hours, bart management and union leaders will be back at the bargaining table trying to work out a deal.

this as the deadline of the cooling off period quickly approaches. the good news is that the pension side of the deal is wrapped up. but the main sticking points, compensation, health care and safety, are still points of contention. the unions want nearly a 12 percent raise over three years while bart is still proposing a 10 percent increase over four years. meanwhile, a new poll by the bay area council says 77 percent of residents surveyed oppose a strike. the poll also says 63 percent of residents think workers should accept bart's offer while 6 percent say bart should accept the unions' proposal. police in fremont are on the hunt for a woman suspected of robbing a

>>james: wow. the person you saw in that video was34- year-old john van allen, a military veteran allen was on a road trip with his three children, each between the ages of ten and 15. you can see allen gets out of his car wearing military fatigues -- with one hand behind his back. the trooper repeatedly asks allen to get back in his car and then allen opens fire. the trooper returned fire, hitting allen, who then got back in his car and drove off. allen was found dead half- mile down the road with a single gunshot wound to his chest. the children were not harmed. state trooper was shot on the right side of the chest, but he did not suffer serious injuries.

are >>: the scene has been cleared. the major entry accident is gone from the freeway. the heavy traffic remains of 580 westbound which is backed up from before the 13 interchange coming out of san leandro. the backup is likely to dissipate since there are no lanes blocked in the westbound direction. eastbound traffic in new accident replace the old one but it's a much smaller incident at park boulevard. still jammed up in the walnut creek interchange coming out of concord on to 42 the 680 southbound. south bay freeways are much better today than any other day this week.

>>james: part of the government forecasters a tropical storm karen as on weaker as it approaches the central gulf coast. they say the top sustained winds are now around 50 mi. an hour. this is the latest projected path over the next several days. national hurricane center forecaster expects parent to be near the central gulf coast on saturday likely as a weak hurricane or tropical storm. it is expected to bring three to 6 in. of rain over parts of the central and eastern gulf coast between

now and sunday. a hurricane watch is in effect from grand isle louisiana west to destine florida. louisiana has already declared a statewide state of emergency. florida has declared one in 18 counties. the storm posed as a big challenge for fema many workers were furloughed due to the government shut down and are now have to be called back into work that in anticipation of the store. >>darya: part of the government is back to work this morning but don't think congress. it was because of a hurricane watch in effect for parts of the gulf coast. only some people working for the florida national guard who had been furloughed were asked to back to work this week. about 1000 civilian employees were sent home on tuesday. yesterday, about 10 of them return to work. another two dozen or so will come back tomorrow. officials worry that might not be good enough.
