(lydia)you can see the water has slowed down quite a bit... we're told the water has been shut off but at the top of the hill.the family that lives here was allowed to go inside to get some items.but they are not being allowed to stay in their home for now because engineers are still looking at the hillside.we spoke with the family who lives in this home, they told us at about 3:30 they heard water and initially thought it was a storm....then when they looked outside they saw the water gushing down the hill and called 911.we're at san juan

the highlights. steph and lebron sharing a hug before the game. but the star of the game was kevin durant. the game was close in the first quarter. lebron james here with the big dunk over javale mcgee then steph curry with the tough finish at the rim. he had 28 points in the game. kevin durant then takes over in the second quarter. he had a game high 38 points. durant also added 8 assists and 8 rebounds. the warriors would go on to win this one easily by a final score 113 to 91. after the game durant talked about his big game 1 performance.

crews are trying to figure out how a massive grass fire started in fairfield. highway 12 is back open and evacuation orders have been lifted for a nearby apartment complex. the fire broke out around 5 yesterday evening along highway 12 near pennsylvania avenue. firefighters were able to control the fire about two hours later. people who live in the area say this isn't the first time that field of dry grass has caught fire.

starts heating up you know. the, uh, grass be dry. you know make sure she be all right, but the only, uh, thing that i was worried about was the smoke you know because it was blowing back into the, um, houses and stuff so that's an issue.">( averi ) firefighters say winds and the dry brush fueled the fire. that was the second grass fire in fairfield within just a few hours. ( james ) a menlo park pastor is behind bars this morning, accused of sexually assaulting both children and adults. 47-year-old victor tax-gomex led services at the el senor justicia nuestra

church for at least four years. police say several victims claimed he sexual abused them at the church, across the way from a playground. one member accused him of touching her chest so she left the church. another member says she had seen tax-gomez innappropriatel y hug and kiss children too close to the lips. he faces six charges. police are now looking for any other possible victims to come forward. ( mark ) three santa clara county deputies are found guilty of second degree murder in the death of a mentaly ill inmate. 31-year-old michael tyree was found naked and badly beaten in his jail cell back in 2015. several weeks later the coroner found tyree died from blunt force trauma. the next day rafael rodrigues, jereh lubrin, and matthew farris were arrested. the sheriff's department came under intense scrutiny as a result of the case. santa clara county sheriff laurie smith says she hopes the sheriff's office will be able to regain the public's trust.

( james ) deliberations in the sentencing phase of the antolin garcia-torres murder trial are done for the week. garcia-torres is still waiting to find out if he will get the death penalty or life in prison.. three weeks ago, the 26-year-old was found guilty of first degree murder in the death of morgan hill teenager sierra lamar. deliberations in the penalty phase of the trial will resume on monday. ( james ) family and friends of the victims involved in a deadly crash in alameda on memorial day are demanding answers from the driver. and now we are also learning some new information about one of the people who remains in the hospital in critical condition. this is sergio garcia valdez. his aunt

reached out to kron 4 saying family members have been by his side ever since he was brought to highland hospital following the crash. the aunt says - sergio owned the truck involved in the crash. but he was not behind the wheel at the time of the accident. witness say they saw the truck was speeding down the street when it clipped a minivan and rolled several times. these are the two high school seniors killed in the crash. they are 18-year-old simon soleto and 17-year-old briana ortega. ( mark ) we now know the name of the person killed in a shooting wednesday night in antioch. we first brought you this story on the kron 4 morning news. police say 24-year-old emetrik mckneely was shot and killed on lemontree way. when police arrived on scene.. they say mckneely tried driving away. that's when he crashed into several other cars. police took him to the hospital where he later died. officers eventually located the shooter and took him into custody after a short standoff. the gunman's name has not yet been released. ( mark ) three men have been convicted of murder for a 20-15 shootout in west oakland that left an innocent

bystander dead. the victim was chyemil pierce. she was a 30-year-old mother of three. the gun battle started after two groups got into an argument. pierce was on her way home with two of her children when the fight broke out near by. she was hit in the back of the head by a stray bullet while trying to get her kids to safety. is still 180-percent of snow pack for this time of year. that means there's almost two winters worth of snow at some resorts. officials say there is a good chance some of the snow will survive the summer season... as the melting process is taking longer in some spots than others. there has been one to three inches of snowmelt each day, with a lot of runoff flowing into waterways. but officials say the threat of flooding is small. (mark) and taking a live look at squaw valley this morning. you can see how much snow is still on the mountains. squaw valley says they will stay open through the 4th of july... and even longer if the snow allows it. (james) a warning if you shop at k-mart. some of their stores were targeted by hackers. the company says it caused unauthorized activity on some of its customer's credit cards. they say stores payment systems were infected with a code that is undetectable by anti-virus systems. k-mart says some credit card numbers were stolen, although it did not say how many or when. they say no personal information was compromised. k-mart says they fixed the infected payment systems and customers

can safely use their credit and debit cards in their stores. there are eight k-mart stores throughout the bay area. (james) a warning to toyota drivers... some of their pickup trucks can stall unexpectedly. the company is recalling 36-thousand tacoma pickus. it involves tacomas with v-6 engines from the 20-16 and 20-17 model years. toyota says a problem with the engine can cause the car to misfire or stall. the company won't say if there are any reports of injuries or accidents related to the defect. owners will be notified about the recall starting next month. dealers will replace the the problem for free. ( mark ) the white house is taking it's push for a travel ban to the nation's highest court. last night the trump administration asked the u-s supreme court to allow the travel ban to go into effect. the travel ban blocks foreign nationals from six muslim-majority countries from entering the u-s. a federal judge ruled in march that the order violates the constitution. the fourth circuit court of appeals

affirmed the judge's decision last month. the white house is asking the supreme court to review the ban and consider the legality of the executive order. (mark) travelers coming into the u-s can now be asked for the social media handles and email addresses. the trump administration says this new government request could help t-s-a agents find people who intend harm. the questionnaire will only be given to a small amount of people applying for visas to visit the country. applicants are not being asked for the passwords to their accounts... but the state department asked for the right to collect the information under an emergency request. they say they will only ask for the social media accounts of people who present a threat and require enhanced screening. (james) despite pressure from foreign leaders and corporate c-e-o's wordwide, presdient trump is pulling the united states out of the paris climate agreement. president trump announced the decision saying the accord allows other nations to take advantage of the u-s. the announcement came in the face of protests from business groups, world leaders and even

trump's own daughter, ivanka. while critics have said backing out of the deal will put the u-s at a disadvantage on the world stage, the president insisted the paris agreement was bad for business and bad for the economy. but president trump did leave the door open to striking a new climate deal with the help of democrats in washington. (james) withdrawing from the paris climate agreement was one of the president's key campaign promises. but the the u-s pullout will not be completed until november 20-20, when the president is up for re- election. (mark) three bart janitors made an astounding amount of money in overtime last year. the figures are just being released. bart records show that three service workers each worked at least 25-hundred hours in overtime last year. and each made more than 115-thousand dollars

in overtime pay. that's on top of their 60-thousand dollar salaries. bart says these hours are offered up to all system service workers... bart has projected a possible 25-million dollar budget shortfall for the upcoming year... so it has cut off all overtime for employees. their work shifts. the "associate delivery" program would use walmart's current employees to speed delivery and cut costs.(mark) they say workers can choose to participate and would be paid. it's the company's latest effort to compete with amazon. (james) right now the service is being tested in two stores in new jersey and arkansas... it's not clear when it could expand to the bay area. (mark) a popular dating app is revealing the top fashion mistakes made by men. (james) they looked at what men were wearing in their profile pictures... and found that certain clothing items led to less dates. the top fashion mistake was cargo shorts. (mark) second is flip flops or sandals. next is muscle shirts or tank tops... followed by backward hats and athletic shorts when not working out. ( james ) we now know the name of the man shot and killed by san jose police last week. it happened on east saint john street last sunday. police say 35-year-old francis de la cruz was armed with an axe when police showed up to a home and saw smoke coming front under the front door. they say when they entered... de la cruz dropped the axe but then picked it back up after officers tried to use a taser on him. that's when an officer fired his gun. de la cruz died. this was the 6th police shooting in san jose so far this year. ( james ) a redwood city police officer will not be

charged in a deadly shooting earlier this year. the suspect was wanted for a domestic violence incident ... where he chased his estranged wife around a parking lot with a gun. investigators later determined the man was also drunk at the time. officers say they repeatedly told the man to drop the gun but he refused. ( mark ) police have made an arrest in connection to a string of car break-ins at several bart stations. earlier this week... bart police reported as many as 16 cars had been burglarized. nine of those happening in one day at the millbrae bart station. a daly city police officer arrested two teens yesterday for auto burglary in the parking lot of century theatres - which is near the daly city bart station. one of the teens was then identified as a suspect in the string of bart crimes. ( mark ) there will be a major bart closure this weekend. bart officials say they will be closing the track between the fremont- warm springs and south fremont stations. bart officials will be running test trains on the track on saturday and sunday. they say the tests make it unsafe to run

passenger trains. there will be free bus shuttles between the stations every 15 to 20 minutes. passengers should expect up to 30 minute delays. (james) planned parenthood is slated to close three bay area locations this month. the closures are a result of a state funding issue. the clinics in pittsburg, vacaville and central richmond are closing their doors. officials say they help patients regardless if they have insurance or not. in those cases, clinics get a re- imbursement from the state but planned parenthood says there is no longer enough money to fund the program. officials are pushing for more funding including money from the cigarette tax. planned parenthood plans to direct their patients to other nearby planned parenthood locations. ( mark ) with the recent outbreak of botulism at a walnut grove gas station from nacho cheese sauce, a 22-year old survivor is speaking out about her experience with the

illness. karina uroza says the first sympton she experienced last february was blurred vision. by the next day her health problems escalated. she was losing her ability to walk and talk. it took a few days for doctors to diagnose her correctly. she ended up staying in the hospital for three weeks and was forced to drop out of u-c- davis for the semester. ( mark ) karina uroza recovered in about half of the usual time. she was able to return to school and is graduating this year with a degree in psychology. ( james ) newly released video of tiger woods at a police station after his arrest shows the golfer disoriented and struggling to stay seated in a chair. police in jupiter, florida arrested woods early on memorial day after finding him asleep at the wheel in his

car. he was unable to pass field sobriety tests and appeared intoxicated. in the video... woods asks the deputies to unlock his bracelets. two breath tests at the police station confirmed that he had no alcohol in his body. woods is recovering from a back surgery he had last month and was likely prescribed powerful painkillers. cavaliers 113-91 in game 1. with durant on board, the opener of cavs-warriors iii was a mismatch as golden state scored the first 13 points of the third quarter to take a 21- point lead and never looked back. lebron james had 28 points and 15 rebounds for the cavs but also finished with seven turnovers. cleveland has lost the opener in the finals to golden state for three straight years but did rally to win the championship in seven games last year.

a baby hippo that was born prematurely at the cincinatti zoo is expected to make her public debut in the next couple weeks. "fiona" the hippo did appear for a preview on wednesday and explored the pool for the first time. swimmers went into the pool with her. they were filling in for

( mark ) breaking news... two people shot and killed in oakland this morning and the shooter is still on the loose. it happened around 2:00 this morning on the 14-hundred block of 85th avenue. when police got to the scene... officers found two men suffering from gunshot wounds. they died at teh scene. police have not said what led up to the shooting. the identities of the victims have not yet been released.

victims involved in a deadly crash in alameda on memorial day are demanding answers from the driver. and now we are also learning some new information about one of the people who remains in the hospital in critical condition. this is sergio garcia valdez. his aunt reached out to kron 4 saying family members have been by his side ever since he was brought to highland hospital following the crash. the aunt says - sergio owned the truck involved in the crash. but he was not behind the wheel at the time of the accident. witness say they saw the truck was speeding down the street when it clipped a minivan and rolled several times. these are the two high school seniors killed in the crash. they are 18-year-old simon soleto and 17-year-old briana ortega. ( james ) three bart janitors made an astounding amount of money in overtime last year. the figures are just being released. bart records show that three service workers each worked at least 25-hundred hours in overtime last year. and

each made more than 115- thousand dollars in overtime pay. that's on top of their 60-thousand dollar salaries. bart says these hours are offered up to all system service workers... bart has projected a possible 25-million dollar budget shortfall for the upcoming year... so it has cut off all overtime for employees. ( mark ) breaking news... a man is dead after a fight in san francisco's russian hill neighborhood. police are investigating this as a homicide...(áátriggeráá) it happened earlier this morning at around 2:15 near the corner of van ness avenue and union street. police say a group of people got into a fight, and one man later died at the hospital. police have not yet released any information about the attackers or the victim. ( mark ) there will be a major bart closure this weekend. bart officials

say they will be closing the track between the fremont- warm springs and south fremont stations. bart officials will be running test trains on the track on saturday and sunday. they say the tests make it unsafe to run passenger trains. there will be free bus shuttles between the stations every 15 to 20 minutes. passengers should expect up to 30 minute delays. ( james ) police have made an arrest in connection to a string of car break-ins at several bart stations. earlier this week... bart police reported as many as 16 cars had been burglarized. nine of those happening in one day at the millbrae bart station. a daly city police officer arrested two teens yesterday for auto burglary in the parking lot of century theatres - which is near the daly city bart station. one of the teens was then identified as a suspect in the string of bart crimes. different bounce houses in opposite directions. but it's the one closer to the camera that is violently thrown in the air and over a fence landing in a parking lot. at least four kids were injured. one was still in the hospital this morning. ( mark ) a warning if you shop at k-mart. some of their stores were targeted by hackers. the company says it caused unauthorized activity on some of its customer's credit cards. they say stores payment systems were infected with a code that is undetectable by anti-virus systems. k-mart says some credit card numbers were stolen, although it did not say how many or when. they say no personal information was compromised. k-mart says they fixed the infected payment systems and customers can safely use their credit and debit cards in their stores. there are eight k-mart stores throughout the bay area.

( mark ) the palo alto school district has opened 20 separate investigations into student-involved sexual assault or harassment cases. all 20 cases were brought up this school year. board members learned about the extent of the investigations at a special meeting earlier this week. a majority of the incidents were logged last month following public scrutiny into the district's handling of student sexual violence. the superintendent says the district will create a new assistant superintendent position to oversee reports of sexual harassment as well as staff training. ( mark ) three bart janitors made a combined 365- thousand dollars in overtime last year. kron four's philippe djegal reports on the figures are just being released.

(philippe) records show that in 20-16... three bart system service workers, or janitors.... each worked more than two- thousand-500 hours of overtime... gapo (gah-poh) chan... liang zhao zhang (lee-ang jzao jzang)... and, yiu fai ko (you-fi-ko).alicia troast/bart- "they're taking the hours, but i can also tell you they don't have the highest seniority, which means, other people are saying no to the hours and they are taking them." bart spokesperson alicia troast says that abundance of volunteer overtime resulted in each of those employees making more than 115-thousand dollars in overtime... on top of their roughly 60-thousand dollar base salary. all while working in the downtown san francisco stations. and, this isn't the first time zhang (jzang) has made headlines. in 20-15, he earned about 162-thousand dollars in overtime, working an average of 114 hours per week.alicia troast/bart- "and, i can tell you they earned every single penny, and they are doing a thankless job of cleaning up urine, feces, uh,

needles. they are scrubbing our downtown san francisco stations troast adds though that in anticipation of up to a 25-million dollar budget shortfall to start off this year... bart cutoff the overtime available for employees like the three janitors in question. so, in 20-17, they're only making their base salaries.alicia troast/bart- "our police officers are still able to do overtime because that's a safety issue, but when the 20-17 data comes out, its gonna show a significant drop, um, in the overtime of these employees and others." by not offering overtime so far this year... troast says bart has saved seven million dollars. though bart is in a hiring freeze on vacated positions due to retirement... it is filling in new openings for janitors. though, bart concedes it's cheaper to offer current employees overtime... rather than fill the vacated positions because they'd have to pay out benefits. philippe djegal, kron four news. antioch. we first brought you this story on the kron 4 morning news. police say 24-year-old emetrik mckneely was shot and killed on lemontree way. when police arrived on scene.. they say mckneely tried driving away. that's when he crashed into several other cars. police took him to the hospital where he later died. officers eventually located the shooter and took him into custody after a short standoff. the gunman's name has not yet been released. ( mark ) the investigation into russia's interference in the 20-16 election is playing out on multiple fronts. the house of representatives issuing more subpoenas this week. and russian president vladimir putin is speaking out about russian's involvement in our election. reid binion has the details. vladimir putin / russian president: "hackers are free people, just like artists. they wake up in a good mood and paint things. same with hackers."russian president vladimir putin......continuing to insist that moscow did not have a hand in 20-16's election hacking.putin -- instead offering a new line: that "patriotic" hackers may have acted on their own.

(mark) walmart says it's testing a delivery service using its own store employees. they will deliver packages ordered online while they are driving home from their work shifts. the "associate delivery" program would use walmart's current employees to speed delivery and cut costs. they say workers can choose to participate and would be paid. it's the company's latest effort to compete with amazon. right now the service is being tested in two stores in new jersey and arkansas... it's not clear when it could expand to the bay area. ( mark ) there will be a major bart closure this weekend. bart officials say they will be closing the track between the fremont- warm springs and south fremont stations. bart officials will be running test trains on the track on saturday and sunday. they say the tests make it unsafe to run passenger trains. there

( mark ) police have made an arrest in connection to a string of car break-ins at several bart stations. earlier this week... bart police reported as many as 16 cars had been burglarized. nine of those happening in one day at the millbrae bart station. a daly city police officer arrested two teens yesterday for auto burglary in the parking lot of century theatres - which is near the daly city bart station. one of the teens was then identified as a suspect in the string of bart crimes. ( mark ) we now know the name of the man shot and killed by san jose police last week. it happened on east saint john street last sunday. police say 35-year-old francis de la cruz was armed with an axe when police showed up to a home and saw smoke coming front under the front door. they say when they entered... de la cruz dropped the axe but then picked it back up after officers tried to use a taser on him. that's when an officer fired his gun. de la cruz died. this was the 6th police shooting in san jose so far this year.

( mark ) a redwood city police officer will not be charged in a deadly shooting earlier this year. the suspect was wanted for a domestic violence incident ... where he chased his estranged wife around a parking lot with a gun. investigators later determined the man was also drunk at the time. officers say they repeatedly told the man to drop the gun but he refused. ( mark ) some drivers in mountain view are not following two back to back traffic lights in their neighborhood. kron four's stanley roberts takes a look in "people behaving badly."
