thank you for joining us i'm steve aveson.(vicki) and i'm vicki liviakis ... pam moore is off this week. today the district attorney said the two men charged acted recklessly and created the high risk of death inside the building.(steve) tonight we have team coverage on the arrest. kron-4's justine waldman joins us live from oakland with emotional reaction to the charges but first grant lodes is here to break down the accusations the men are facing (grant) this is a picture of one of the two man arrested and charged with 36 counts of involunary manslaughter.. derek almena appeared in a lake county courtroom...he was picked up in lake county. almena is the former master tennant at the ghost-ship warehouse...where musicians and other artists gathered...and lived. also now facing charges...max harris...who allegedly lived in the building and helped mannage it. harris was arrested this morning in los angeles county.

(grant) almena and harris could face up to 39 years in state prison if they're convicted. almena's attorney's released a statement today saying they're confident this attempty to make him a scapegiat will fail. the exact cause of the fire is unknown and officials say we may never know what started it because of how badly burned the building was. (vicki) family and friends of loved ones killed in the fire tell us they feel criminal charges being filed are just one step in a long journey to get justice.(steve)

kron 4's justine waldman is live for us in oakland tonight at the site of the ghost ship warehousejustine, you spoke with a mother today who lost her daughter in the fire.. what was her reaction to the da's decision? the mother of one of the woman killed her in december she has been waiting a long time for criminal charges to be filed. and even though every day without her daughter is extremely difficult.. today feels like the beginning of a new chapter. trt 1:26on a memorial outside the ghost ship.. hangs charms with the names of the 36 victims. one is heart with donna kellogg's name on it.a vibrant, loving lady.. is how donna's mother remembers her 32 year old daughter.sot miss her so much she was such a good friend .. little red head dynamite sue slocom spoke to kron 4 news over the phone from her home in salinas. and says her daughter loved to

dance, which is why she came to the ghost ship that deadly december night.. sot i firmly believe she would have not gone there had she known it was so unsafesue also expressed disbelief in the district attorney's claims that one of the staircases was blocked off leaving just one way out of the warehouse..sot it is horrifying to think they didn't even have chanceher mother has waited a long time for an answer from da's office and is pleased the case is moving forward. it's time she says.. for someone to be held accountable for her daughter's death.sot these two men set up a death trap for our children and they need to be held responsible for their actions donna kellogg's was studying to be a nutritional consultant at bauman college in berkeley. her family has set up a scholoarship fund in her honor.

and now they begin the long wait as this case moves its way through the courts.even though vicki and steve they know it will never bring donna or the other victims back. (vicki) the criminal charges kindling emotions for victims' families. one mother is speaking publicly for the first time since the loss of her son alex vega. the 22 year old who you see here on the right died in the fire alongside his long-time girlfriend 20 year old michaela gregory. today his mother mary told kron-4 when she got a call about the arrests.... it opened up a flood of memories. anger sadness...i dont' want to be angry it's not going to bring him back. i think what it mostly is sadness.i want to see justice done.i want someone to say i'm sorryit's not going to happen

but i want someone to say i'm sorry mrs vega that you lost your son.(vicki) mary says after she got that phone call this morning --- she went to the cemetery. saying she just wanted to be with her son. vega's mother says if there is a trial --- she wants to be in the courtroom....to see someone held accountable for the deaths of alex, michaela and so many others. (steve) today's criminal charges come just days after the six month anniversary of the deadly fire. here's a look at what's happened since december. a little over a week after the fire --- the oakland fire chief revealed that the warehouse had not been inspected. -and they could not find any record of citizen complaints. they say it's because there was never an application for an change of use or event permit --- which would have put the warehouse on their radar. on december 23-rd the first lawsuit was filed on behalf of two families. it was the first of several to

follow. including a consolidated suit in may which includes at least 18 families at this point. a few months later in february --- the city of oakland released some six hundred pages of records on the warehouse. they showed over 30 years -- oakland code enforcers received at least 22 complaints---including that there were people living on the property... something officials have claimed they were not aware of. after a jury decides antonlin garcia torres will spend his life in prison. (steve) kron-4's rob fladeboe has been following this story for years. and was in the courtroom when the sentence was handed down. jeff rosen/district attorney fate of a child murderer.... outside the courthouse after antolin garcia torres had just avoided the death penalty, district attorney jeff rosen telling reporters that the less said about garcia torres the betterjeff rosen" the jury made it so he will die in prison and never take another breath as a free man..."garcia torres had no obvious reaction to the verdict. the decision was unanimous. the jury rejected the prosecutions call to show him no mercy because he showed none to sierra lamar. in closing arguments, the defense had urged the jury to spare garcia torres,' life. that justice doesn't have to be an eye for an eye.brian matthews/defense attorney "we're thankful for the jury's verdict, we're still going to fight for him, we're very thankful..."there were some murmurs of disappointment in

name of the suspect in the death of an australian tourist in san francisco... the tourist... identified as 33- year-old matthew bate... was killed during a fight outside a hotel on van ness avenue. police arrested the suspect inside a nearby hotel. he's 34-year-old david murillo of hesperia -- that's in southern california. murillo is in jail and is expected to be charged with murder. (steve) to the east bay where a fire along highway 24 snarled traffic for most of the afternoon.(vicki) the fire burned about 25 acres and took several hours to bring under control. (vicki)kron 4's charles clifford is live for us tonight in orinda with details about what triggered the fire well, it's not even summer yet and most of the hills here in the east bay area already brown and dry and that means

higher fire danger. just before 1pm, a sedan parked along the side of highway 24 westbound caught fire and sparked a grass fire that quickly spread up the hillside. this blaze required a two alarm response that included crews responding from orinda, san ramon valley and cal fire.the chp also shutdown several lanes of highway 24 westbound so fire fighters could move equipment into place.fire crews on foot worked to surround the burnzone and flame retardant was dropped on the hillside to keep the flames from spreading north.by around 3pm, cal fire tweeted out that they had the fire 75 percent contained and by early evening he fire appeared to be under complete control.in all, 25 acres were burned. . mostly grass. . . no structures were lost and no injuries have been reported. no word yet on exactly why the car caught fire along highway 24.in orinda, charles clifford kron 4 news.
