( terisa ) new this morning... police are warning about a phone scam in the east bay. a u-c berkeley employee was targeted by a person pretending to be a campus police officer. that person claimed the victim had outstanding warrants for their arrest for failing to pay their student loans.

the scammer asked for the victim's credit card number. the victim refused and called police. campus police say they will never be sent to collect debt for student loans. ( james ) the bay area air quality management district cited a richmond scrap metal facility in connection to the large fire that prompted a shelter in place. the fire broke out at simms metal managment last week...sending toxic smoke into the airforcing road closures, and evacuations. the company was cited for a public nuisance violation... and for the fire itself. district back in november and december of 20- 13.... fires broke out at their redwood city location. violations were issued for both of those fires. ( james ) on the peninsula... four people are behind bars... after police say they burglarized a business and then led officers on a chase. it happened monday night... at the bridgepointe shopping center in san mateo. police say the driver eventually crashed... and all four people in the car were arrested. ( james ) in mountain view... a volunteer tutor for an after school program is accused of sexually assaulting two children. he's set to be arraigned today. yizhuang (ee-tuang) liu faces two counts of lewd and lasicivious acts with a child under 14. the 'sunyu learning center' is a private after -school program. it teaches children... ranging from kindergarten to 6-th grade. police say liu was communicating with other young boys... thru a gaming app called "discord." police will be reaching out to

( james ) a new report says california should be using controlled burns to better manage wildfires. in a year long study... the little hoover commission found that california is dealing with wildfires all wrong. they claim the state mismanages fires by trying to put them out... instead of letting them burn naturally. the commission says we should be reducing dead trees by fighting fire with fire... something would save california money. ( james ) the california forestry association released a statement in response to the report, saying it supports the commission's findings. ( terisa ) in the east bay... oakland international airport is now offering non stop flights to rome. the norwegian air flight takes a little over 12 hours. the service will operate two times per week on a boeing 787 dreamliner.

( james ) in the east bay... a shooting leaves a man in critical condition. it happened around ten monday night on west leland road and southwood drive near the pittsburg/bay point bart station. officers responded to a call about a car crashing into a pole. once on scene...they found a man unconscious in the driver's seat -- suffering from a gunshot wound to the chest. he was taken to a local hospital where he's in critical but stable condition.

( james ) a kern county judge ruled in favor of a baker who refuses to bake a cake for a same-sex wedding. the judge says he believes the issue is a matter of free speech...and that a cake is a form of artistic expression. he argued if the owner refused to sell anything at all to a same-sex couple... then that would be considered discrimination. the owner of tastries bakery says she will sell a cake to anyone. < i am very happy to serve anyone who walks through that door anything in my case, make a birthday cake for anyone, i just cannot be a part of something that's not ordained by god.>( james ) the judge also said the state should not force the owner to bake a cake she disagrees with in the name of equal access. ( james ) a new report says california should be using controlled burns to better manage wildfires. in

a year long study... the little hoover commission found that california is dealing with wildfires all wrong. they claim the state mismanages fires by trying to put them out... instead of letting them burn naturally. the commission says we should be reducing dead trees by fighting fire with fire... something would save california money. ( james ) the california forestry association released a statement in response to the report, saying it supports the commission's findings. ( terisa ) in the east bay... oakland international airport is now offering non stop flights to rome. the norwegian air flight takes a little over 12 hours. the service will operate two times per week on a boeing 787 dreamliner. this is the first nonstop bay area service to rome... since 2001.

( terisa ) a five- thousand dollar reward is now being offered to find the person who tossed a puppy from a moving car. this is rex ... he escaped from his home in vacaville on thursday.... hours later... the dog was tossed from a blue toyota prius on interstate- 80 near davis street. a witness tried to stop and save the 18-month old puppy - but he did not survive. ( terisa ) there's a new push to make uber and lyft environmentally friendly. state senator nancy skinner -- from berkeley -- has introduced legislation pushing ride-sharing services toward zero-emission and electric cars. the bill calls for up to 300- million in state funding for rebates for drivers who buy eco-friendly cars. the goal is to reduce emissions from uber and lyft drivers by 20% by the year 20-20. marijuana dispensaries to sell cookies. the apothecarium in san francisco posted this to instagram a few days ago. ( james ) and a southern california girl scout is also cashing in on the legal marijuana laws. a nine-year old was seen selling cookies near a pot dispensary in san diego. the girl's father wants him and his daughter to stay anonymous. but says she sold 312 boxes of cookies... during two trips to the pot shop. the dispensary even advertised that the girl would be there. the girl scouts allow booth sales generally in front of any business...even dispensaries. a girl scout leader says this time it was okay because they were not right at the dispensary's door.

...a shocking new report from "human rights watch" claims nursing homes are overmedicating people with dementia. the report estimates nursing homes are giving more than 179-thousand residents antipsychotic medications without the proper diagnoses.most of these people are older and have dementia. researchers say facilities use the drug as a cost- effective chemical restraint to help overwhelmed staff.the f-d-a says the drugs can almost double the risk of death in these patients.the report blames the government for lack of oversight.the centers for medicare & medicaid services launched an initiative to combat the issue back in 2012. more children have been

affected by mothers drinking during pregnancy than previously thought. that's according to a new study from u-c berkeley. researchers say up to one in 20 kids fall somewhere on the spectrum of disorders... caused by maternal drinking. a previous study found that up to -one in 100 american children were affected by drinking during pregnancy. some disorders caused by maternal drinking... include abnormal growth and facial features... intellectual disabilities and behavioral problems. ( terisa ) happening later this morning ... students and workers will rally in support of a u-c berkeley employee who was arrested last week while protesting unfair wages.( james ) kron 4's lydia pantazes is live at u-c berkeley with the details. lydia? (lydia) protesters will gather here at 11:30 to speak out against the arrest of david cole... a uc berkeley employee. let's take a look at the video of coles arrest. david cole is 51-years old and works as a cook at uc berkeley employee. he was detained during a protest where he and about 100 other employees were picketing for the fair treatment of campus employees. a video circled online shows three uc police officers wrestling cole to the ground. he sustained a

cut on his forehead during the arrest and was treated by the berkeley fire department before being transported to highland hospital. cole was then booked at the berkeley jail, cited for vandalism and resisting arrest. witnesses say the arrest stemmed from a car than had began to "push through the crowd and make contact with the picketers, who were occupying the intersection. witnesses say someone did throw something at the car but pointed out that cole was still holding his sign after the incident. the driver circled the block, then got out of the car and cole. again that here at 11:30 this morning. reporting live lydia pantazes kron 4 news. ( terisa ) in santa clara county... voters have four months to consider a controversial effort to recall superior court judge aaron persky. the board of supervisors is sending the recall effort... which collected some 95-thousand signatures... to the june ballot. judge persky is under fire for handing down what ácritics feel was a far too lenient sentence.. to a former stanford swimmer.... who sexually assaulted an intoxicated, unconscious woman after a party in 2015.

southwood drive near the pittsburg/bay point bart station. officers responded to a call about a car crashing into a pole. once on scene...they found a man unconscious in the driver's seat -- suffering from a gunshot wound to the chest. he was taken to a local hospital where he's in critical but stable condition. ( james ) a kern county judge ruled in favor of a baker who refuses to bake a cake for a same-sex wedding. the judge says he believes the issue is a matter of free speech...and that a cake is a form of artistic expression. he argued if the owner refused to sell anything at all to a same-sex couple... then that would be considered discrimination. the owner of tastries bakery says she will sell a cake to anyone. < i am very happy to serve anyone who walks through that door anything in my case, make a birthday cake for anyone, i just cannot be a part of something that's not ordained by god.>( james ) the judge also said the

state should not force the owner to bake a cake she disagrees with in the name of equal access. ( james ) new this morning... the man accused of killing two people -- including a pro football player -- has pleaded ánot guilty to the charges against him. manuel orrego-savala was in court in indianapolis just moments ago. orrego- savala is an undocument immigrant from guatemala. he's accused of killing edwin jackson -- a linebacker for the colts and uber driver -- jeffrey monroe. u-s immigration officials say orrego-savala has been deported twice before -- in 2007 and 2009. he was also convicted of a d-u-i in redwood city. ( james ) the bay area air quality management district cited a richmond scrap metal facility in connection to the large fire that prompted a shelter in place. the fire broke out at simms metal managment last week...sending

toxic smoke into the airforcing road closures, and evacuations. the company was cited for a public nuisance violation... and for the fire itself. ( james ) this is not sims metal managements first run in with the air district back in november and december of 20- 13.... fires broke out at their redwood city location. violations were issued for both of those fires. boys... thru a gaming app called "discord." police will be reaching out to families of those potential victims ... as the investigation moves forward. ( james ) we're learning new information about the mother and son -- accused of running a prostitution ring. police say david romesburg and his mother fay ran the ring in rohnert park for more than 10- years. during that time -- police say they employed about 150 women. police spoke to eight of the women who worked for the mother and son. one of them said she was underage when they recruited her. another says she was sexually assaulted during her interview. the romesburgs were arrested in january... and now face multiple charges. ( terisa ) police in berkeley are investigating an armed robbery. it happened early monday morning near the cal campus. police say the victim -- a student -- was approached by a group of 4 people. one of them pointed a gun and robbed him of his belongings. the suspects then ran off west on channing way before turning south on telegraph avenue. campus police

reported seeing a group jump into a black sedan. the student was not hurt.
