morning.. police are investigating a shooting in the south bay.( darya ) it happened near the bay 101 casino in san jose. kron 4s sara stinson is live with the details. sara?

im live at bay 101 casino where the california highway patrol continues to investigate a shooting. the casino is right off highway 101 and airport parkway near the san jose international airport. the shooting happened last night there was a heavy police presence here and the casino parking lot was tapped off surrounding a car that had multiple bullet holes. i spoke with a security guard here who says a man was shot near the freeway in his car and he drove into the casino parking lot for help. people here called 911 and the man was sent to the hospital with at least one gunshot wound. we are still waiting to hear back from chp san jose to confirm these details and see if they have the shooter in custody. as well as an update on the victim. stay tuned as we learn more. live in san jose, sara stinson kron four news.

( darya ) this morning we are hearing from lyft after a driver was arrested in a sexual battery investigation. the incident happened last thursday on shellmound street in emeryville. the victim told police she called for a ride to a hotel and during the ride she was sexually battered. police have since arrested 22-year-old bipin thapa for the attack. lyft says the allegations are disturbing and they are cooperating with investigators. the company says the driver passed a background check last month. ( james ) an uber driver in sacramento says he is lucky

control of the car. police say this video posted to facebook shows the man partying and drinking just one hour before requesting the uber ride. ( darya ) new this morning ... the city of berkely is changing the way you eat take-out or dine-in at restaurants ... in an effort to reduce waste.( james ) kron 4's will tran is live in berkeley with more on the new ordinance passed by city lawmakers.will? a local law was passed requring only reusable foodware to be used for dine- in service. the new law also requires that all take- out foodware must be compostable. vendors would have to charge customers 25- cents for every disposable cup. and, take- out customers would have to ask for straws ... napkins and utensils. small grants would be made available to help businesses reach these requirements. the new law will go into effect in 20-20.

room. this is on the 900 block of sonoma avenue. the fire started around 4:30 this morning. there are no reports of any injuries. ( james ) oakland lawmakers are now one step closer to naming at street next the fruitvale bart station after oscar grant. grant was the 22-year old man fatally shot by a bart police officer at the fruitvale station more than 10 years ag. it happened after reports of a fight on a train. grant and others were detained on the platform before shots were fired. last night ... the oakland city council approved the street to be named oscar grant way. now approval must come from the bart board. grant also hope to get a mural near the station on march 23rd. they hope the bart board can officially name the station after grant around the same time. ( darya ) the longest government shutdown in u-s history is now in its 33rd day. more than 800-thousand federal workers are set to miss their 2nd pay check on friday. but there is new hope. the senate has agreed to vote on two competing bills to reopen the government. kron 4's washington correspondent mark meredith is in d-c with the latest. following this morning in the south bay... a san jose teacher is accused of having sexual contact with a student. ricardo chavarria was arrested on felony sex charges with a person under age 18. investigators say the victim was assaulted inside a classroom. chavarria worked as a spanish teacher at pioneer high school in san jose. he has worked in the school district since 20-11. district officials say... he will not return to pioneer nor any other position in the district. ( darya ) oakland police arrested a person of interest for the deaths of three men. the three were shot and killed on center street january 4th ... that's three- blocks from the west oakland tation. two victims were in a parked car... while a third was standing outside. they were identified as 21- year old gino houchins ... 29- year

searching for a man who impersonated a "meals on wheels" employee last week. reports say the man was outside of the safeway on shattuck avenue asking for donations. police say the man ran away after being confronted by an actual meals on wheels employee. the suspect is described as a man in his 60's about six feet tall, last seen wearing a white meals on wheels t-shirt. ( james ) in national news... the fallout continues from last week's incident involving students from a catholic high school in kentucky and a native american elder in washington d-c. now... the student in the center of the controversy is breaking his silence. miguel marquez has the latest. nick sandmann, the high school junior from kentucky's covington catholic high school, speaking out.nick sandmann:"as far as standing there i had every right to do so. my position is that i was not disrespectful to mr. phillips."the video of sandmann facing off with omaha tribe elder nathan phillips ignited anger nationwide.nick sandmann:"i'd like to talk to

( james ) a new report is out that ranks the safest cities across california and here in the bay area. it was conducted by the national council for home safety and security. the study ranks cities based on both violent

and non-violent crime. statewide, the report ranks hillsborough as the safest california city. the findings are based on the fbi's uniform crime reporting tool along with the trade group's "internal population research." in the bay area, the study says the top ten safest cities are hillsborough, los altos, piedmont, foster city, mill valley, los gatos, healdsburg, clayton, moraga and belmont. left out of the study are cities with fewer than 10,000 people fewer than 10,000 people or cities that failed to submit crime reports to the f.b.i. reports to the f.b.i. the bay area's three largest cities were way down the list...with san jose coming in at 194, san francisco at ( darya ) coming up on the kron 4 morning buzz... when the saints go marching home and sue roger goodell.. steph curry talks about his banana peel fall.. and the sharks so close to the stanley cup they can taste it.

the saints get another shot at the superbowl because as they see it, they were robbed! by a a cartoon from the front page of a local paper. when saints they put up around atlanta where play feb 3rd. and some saints marched straight in to a lawyers office to sue roger goodell to have the end of the game re-played. the personal injury lawsuit claims saints fans suffered incredible damages from the blown call, including mental anguish,

to the san francisco s-p-c-a. yesterday, the third annual pop up at the embarcadero center in san francisco allowed visitors to cuddle
