from any akin to concord, a little under 15 minutes started. james, back to you. thanks. a lot. ran a 5 o'clock in our big story this morning. 3 people have been arrested in the kidnapping of a 3 month-old baby in san jose. baby brandon was unharmed, thankfully and is back with his mother this morning. but there's still a lot of questions unanswered as to. >> why why? why would somebody do this? let's find out what we know at this point. kron four's will tran has been following this since the start is live in san jose. will. >> james duryea, what we don't know is the motivation, the san jose police department actually held 2 news conferences yesterday morning, one at 9, one at 11 and they both times did not go into the motivation, but they did say that there is some sort of connection to the family between these 3 suspects and the family. you know what? it was actually a snafu between the chp and san jose police department that eventually led to the recovery of kidnapped

baby brandon because they sent out this picture here. this is from the chp. this was the minivan that they said that was on the lookout that people should be looking for. this is from the chp. they tweeted this out and then the san jose police department stepped in and said, wait a minute, take that tweet down. not before a lot of people out in the public. they saw this. the san jose police department didn't want to confirm it or tip their hand, but it was an employee about 5 miles away from where baby branding was taken at a nursing home. she saw that than she actually called the san jose police department. they came out there and then they blocked that minivan in. they went into a nearby home and that's when they recovered baby brandon. he had been missing for close to 20 hours. this happened on monday at around 1 o'clock in the afternoon when his grandmother was at elm street to was that was sarah apartment unit. she was watching baby brandon. she

went inside the apartment, kept unloading groceries and between walking back and forth. that's when a man walked in and grab brandon in casually walks off with the carrier. according to the san jose police department. they said this was not a mistake. this was all orchestrated because he came with the so as far as the 3 people who have been arrested, james and area, we do know, but the man in the surveillance footage, he was one of those suspects. another was a woman who was with the grandmother at the time they kept interviewing her and her story kept changing. she's suspect number 2 and a 3rd suspect. so far they have not released any details about that particular person. all 3 names have not been released to the public. but again, it was a miscommunication between the chp and the san jose police department with the chp tweeting out that picture of the minivan that let somebody in the public to spot that

apparently shows a 6th grade student being tossed around by another student inside a classroom at park middle school in antioch on monday. the fact that there was no teacher there. >> and that's the whole problem with all of this. you know, like that's the most wanted capital thing about a concerned parent who didn't want to share their identity out of fear of retaliation against their child says. >> the teacher of that class room didn't show up for school monday morning and no substitute was provided all the time for coming from her school. but this time there's there was no one there. >> to break up the fight, there was no adult supervision. there is a staff member running across a they had seen it from a distance. i mean, sometimes happens at lunch and they don't have anyone direct the supervising them at >> but you know, it will be seen from a distance of someone somewhere. we'll break it up. but there was nothing. nothing being done at all. >> she says this behavior shouldn't be tolerated at the school you get. it happens

repeatedly and often times it's the same students allegedly starting the flights. the parents says she's now worried about what is and isn't being taught at the middle school. and my concerns are that my child is not getting an education. >> not an academic education may be an education and how to fight until second reporting. kron. 4 news. >> well, another big story that we're following this morning. the san francisco board of supervisors has voted to keep jfk drive closed off to cars for good. it's a lot of people wanted that after experimenting with that during covid kron four's. sara stinson is live in san francisco with more. hi, sarah. >> that's right. jfk drive here in golden gate park is going to be closed to cars permanently 7 days a week and again, as you said, a lot of people in support of that. we saw that at the meeting yesterday, the san francisco board of supervisors voted and approved after 12 hours of

discussion and public comment. there's been so many organizations in the city that have fought to make this happen a lot in some with a coalition. some with the kids safe. they have all worked hard and tirelessly to make sure that this boat goes in their favor and it did. you can see video on your screen up or we're talking about jfk. this 1.5 mile stretch of it just being closed to cars and open for people who are walking and biking and enjoying that outdoor recreation people against this, though, want jfk open on weekdays for cars. so there's more accessibility since people have gone back to work and kids have gone back to school. so not everyone is in favor of this, but a lot of people are jfk first became 100% car free back in april, twenty-twenty by mayor london breed closing it off to cars between jfk drive on the eastern end of golden gate park from keys or drive to the transverse drive. 24 hours a day so can safely exercise

with social distancing during the pandemic. people in the city fell in love with this open space. now around 300,000, people use it per month. so maryland and be breed wrote up this legislation to make it like this for ever. and the board supervisors agreed approving it before was closed to traffic. the organization walk sf says it was the city's it was on the city's list of most dangerous streets due to the number of traffic crashes. mayor london breed push for this saying it's not only about safety, but it's all about cutting those climate emissions. let's take a look at what she tweeted. she's clearly very excited about this. she said, quote, today is an historic day. the board just voted to make jfk drive permanently car free and essential space for residents and families that has no long-term benefit to the city. we still have some work to do, but passing this legislation is one we begin to make real change in by work to be done. she's coined really addressing the issues head on. for those

people who said that it's not going to allow those who are disabled to access the park. and that's why she said that this plan now gives them the green light to make dozens of fixes to make it more accessible to all. for now, i'm sara stinson reporting live in golden gate park. back to you. thanks a lot, sarah. >> 5, 0, 9 is the time. some east bay commu ers are asking that the mask mandate be brought back for public transportation. they sent a letter to the ac transit board saying that this is a major public health issue camila barco is live with the details. camilla. >> yeah, good morning. so in that letter, the east bay transit riders union says that bringing back mask on public transportation will help reduce the spread of covid. now we're also hearing the same from bart. if you remember bart's board president is also proposing to bring back mask on its trains. now, the east bay transit riders union as a group of riders who use public transportation daily and they

want the ac transit board of directors to bring back mask on buses that run in the east bay. now the union says they owe it to the people who ride these buses that are high-risk and vulnerable because by not wearing them, it could lead to serious health problems. they also argue that taking no action is likely to drive people away from taking the bus is now bart's board. president rebecca saltzman also wants to see a mask requirement on bart trains. she sent a letter to 5 bay area counties where bart operates urging them to make masks a requirement on public transportation. now, saltzman says she's not trying to make mask a permanent lifelong thing. they she says that they're trying to keep it rule, at least until july, but we're just going to have to see what happens because bart board of directors will consider this mask requirement at a meeting tomorrow. but darya james tonight, the east bay transit riders union will present their proposal on bringing back mask on public transportation to the ac

over those limits. so be force resistance. who takes a look? >> we're going into a stage, 2 drought. that means that customers are going to be required, not asked to conserve water effective immediately. east bay municipal utility district customers must start conserving water or else face penalties. >> the board approved the move into stage 2 drought at its tuesday meeting. district spokesperson andrea polk breaks down. what happens next? >> we're asking them to conserve water at a level of temper and that is district-wide not individually. some people can save more. and some people have already taken, you know, significant measures. polk says that the board stopped short of putting in a drought surcharge or rate hike to help pay for extra water supplies due to the drought, tabling that tell a meeting in may. >> but the board will start an excessive water use. panel. the ordinance that puts a limit of slightly more than

1600 gallons per household. and if you go over that daily rate is $2 per unit. it's definitely time to take that route seriously. so it was tempting back in october and december to think that we were out of the are dry january march. certainly polk says all of this is not to punish households, but >> face a reality. 3 year statewide drought. i would say the most important thing for people is that what they do really matters what they do counts collectively, we really can make a difference. and we must make a difference in case next year is dry to recess to kron. 4 news. >> well opened. teachers are preparing now for a major strike on friday. they gathered for a news conference yesterday ahead of that strike at the port of oakland to explain why they feel they need to take this next step. starting in june, the oakland unified school district plans on merging and closing schools in the district says it's

necessary to avoid budget shortfalls and improve quality of education. well, the oakland education association says the district illegally backed out of a 2019 agreement to not close schools before giving teachers at least a chance to offer some input. >> there is they have decision. 8. we welcome to the community there's all of the guidelines. >> oakland school district superintendent kayla johnson trim l called the strike a violation of the current collective bargaining agreement between the district and e a friday strike is scheduled to start at 6.30 in the morning. a judge will hear eas unfair labor complaint on may. 20th. >> dublin, unified teachers, families and community members are demanding more support and better resources for students. the dublin teachers association feels the district is not doing all it can to better retain and recruit

educators for the dublin schools. the association president says right now the schools have a number of special education teacher openings vacancies that have been filled. also math and science vacancies, district life. >> that was last in alameda county with 30 years of service credit that come when people join our district. we only take 5 years when districts around our county take anywhere from 9 to all years of service. and that's a huge contention when you're recruiting educators and then obviously we are also working toward salary enhancements for the retention of our current in place and the recruitment process. >> the teachers association leaders say they're looking forward to their next negotiate meet negotiations with the district. >> time now is 5.35. and lawmakers are moving forward with a plan that could force people who are homeless and severely mentally ill into treatment. the controversial plan known as care court still has several hurdles ahead. kron four's ashley zavala takes a closer look.

>> the state senate judiciary committee tuesday kicked off legislative debate on governor gavin newsom's care court proposal. there are thousands of californians who are languishing. >> this impacts families throughout the state of california. the plan aims to get the most severely mentally ill off the streets are out of jail and into court ordered care. california health and human services secretary doctor mark galli was a witness in support. >> he said it's expected to help between 7,000 to 12,000 people, homelessness as many faces in california. >> one of the most tragic treatable. this not experienced by the sickest of the sick who often need effective treatment and supports to identify the road to recovery and stability. but the measure faces fierce opposition from several disability, mental health and civil liberty groups who have concerns with forced treatment. >> leave that force terror works well for people with mental health disabilities. and we don't feel that there's
